1. West Transmission Water Line
Discussion of the West Transmission Line from Beaver Water District to the City of Fayetteville.

2. Damage Claim — 2425 East Sharon Street
On September 20, 2021, the City of Fayetteville experienced a large 36-inch diameter water
main break on N. Makeig Ct. Misty Simpson owns the home located at 2425 E. Sharon St. This
large water main break caused substantial amounts of flooding and damage to the
neighborhood and to the Simpson residence. Ms. Simpson's home received damage to the
interior, foundation and landscaping. Ms. Simpson's insurance company denied her claim, so
she immediately filed a damage claim with the City after the incident.
To date, the City has directly paid vendors for carpet and floor cleaning, fencing repair,
landscaping and structural evaluation. Ms. Simpson has been reimbursed for damaged
contents. Ms. Simpson has requested foundation repairs. 3 bids have been obtained with Vesta
being the low bid at $56,350.91 however, this does not include the driveway. Considering this,
the low bid that includes the full scope would be PFS at $61,200.00.

3. Damage Claim — 185 North Hartman Avenue
On September 20, 2021, the City of Fayetteville experienced a large 16-inch diameter water
main break on near W Pratt Drive and W Hotz Drive. Walter Woodward owns the home located
at 185 N Hartman Drive. This large water main break caused substantial amounts of flooding
and damage to the Woodward residence. Mr. Woodward's insurance has denied liability for the
damages. Mr. Woodward filed a damage claim with the City after the incident.

4. 11t" Street Waterline Cost Share
Infill development is proposed by 111" St Cottages, LLC south of 11t" Street between S.
Washington Avenue and S. Beebalm Ave. (parcel 765-03341-000). The site is approximately
0.66-ac, currently vacant, and is zoned RIU. The developer proposes to build 9 cottages in a
cluster housing development. In order to service these houses, they will need to install a water
line from Washington Ave to the corner of the subject property, approximately 174-ft, and then
extend it in along the frontage of the property to the middle of the property, an additional
approximately 62-ft, for a total of 236-ft.
This waterline would also benefit any future development east and north of this project site. 11tn
St Cottages, LLC requests a 50% cost share on this waterline installation. The project
engineering and permitting has been completed and the developer has secured three contractor
quotes. The low quote is from Pave Con for $87,183.20 and the engineering costs for the
project are $8,485.40 for a total project cost of $95,668.60. The 50% cost share would therefore
total $47,834.30.

Specifications
1) Install PolyLEVEL as indicated on job drawing. 2) Install Push Pier(s) to support the foundation as shown on job drawing using a
standard bracket. Final Location of pier(s) is subject to field conditions. Foote r will be prepared by notching the concrete to seat bracket.
External sleeve will be installed to re -enforce the pier system. The friction reducing collar will be utilized to ensure proper depths and
load testing. Once complete the pier will be locked, benchmarked, and documents. Load testing and depth logs to be delivered upon
completion. 3) Excavate the soil at each pier location to the footing. Backfill and tamp soil after the system is installed. 4) Remove and
replace concrete as indicated on job drawing.
Contractor Will
1.) Remove and replace concrete as necessary in the workplace. Concrete will vary in color from what is existing.
2.) LIFT IS ALWAYS ATTEMPTED BUT NOT GUARANTEED. Every house or concrete fixture responds differently.
3.) Attempt to lift the foundation, but is not responsible for cosmetic damage that may result.
4.) Install dates are given but can be changed for circumstances outside of Vesta's control, such as weather, or equipment failure
5.) Install piers to any depth necessary at no additional cost to the customer.
6.) Benchmark the foundation and provide depth logs to customer when complete.
7.) Inject POLY Level foam on the inside of each pier to ensure settlement does not occur inside of the home.
8.) Coordinate to have utilities marked.
9.) Vesta can not guarantee that cracks wil I close either inside or outside. The customer is responsible for tuckpoint on exterior brick, or
drywall interior cracks.
10.) Consult the customer if additional work is needed. This could be true if while doing work the production team comes across
additional areas of concern that were not previously noted. No additional work will be done without the consent of the customer.
11.) The landscape will be disrupted. Vesta is not responsible for replacement.
12.) Remove and replace concrete as necessary in the workplace. Concrete will vary in color from what is existing. Vesta is not a concrete
finisher therefore the texture will be different.
Customer Will
1.) Move items out of the work area space. If items are not moved and the production crew has to move items, the customer will be
charged accordingly. If the job has to be rescheduled because items are not moved, the customer wil I be charged $750.00
2.) Have flooring repaired or replaced once the project is complete.
3.) Remove carpet.
4.) Mark any private lines that may be hidden underground, and assumes all liability if damage should occur to such lines.
5.) Be available at START and FINISH of the project for a walk-through with the Foreman. This is intended to provide any changes needed
for a successful installation.
6.) Customer will have HVAC duct lines in slab scoped and mapped prior to installation by third party provider.
7.) Call prior to 10 days of install date if rescheduling is necessary. If customer calls within those 10 days prior to installation a $750.00
rescheduling fee can be applied.
8.) Be responsible for any replacement of landscape.

Additional Notes
Underground lines that cannot be located may be subject to damage during excavation. Vesta is not liable for damage to underground
hidden lines that may be damaged.
Customer understands to move personal belongings away from work area prior to installation date. If items are not moved then the
project will need to be rescheduled and subject to a fee of $750.
The design of your system may be subject to change based on field conditions but is not limited to movement of product or possible
additional products to help correct the issue.
Customer understands that VFS will attempt to confirm installation date and time 10 business days prior to installation. If we are unable
to confirm the installation date, the project will need to be rescheduled and subject to a fee of $750.

Limited Warranty
Standard Exclusions Permitted By State Law
This Foundation Limited Warranty ("Warranty') is made in lieu of and excludes all other warranties, express or implied, and all other obligations on the part of Vesta Foundation
Solutions ("Contractor') to the customer ("Customer"). There are no other verbal or written warranties and no warranties that extend beyond the description on the face hereof,
including NO WARRANTIES OF EXPRESS OR IMPLIED MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE,
General Terms
For the applicable time periods indicated below, this Warranty is transferable at no charge to future owners of the structure on which the work specified in this Contract is
completed. This Warranty is in effect if the job specified in this Contract is completed and paid in full and, alternatively, is null and void if full payment is not received. Contractor
does not warrant products not mentioned below, but some of such products may be covered by a manufacturer's warranty, All material used is warranted to be as specified in
this Contract. All work will be completed in a workmanlike manner according to the standard practices of the industry. Due to unknown seismic events and characteristics of
concrete this material and warranty are subject to observation of seismic occurrences and their effect to the home and repair.
Foundation Piers
Contractor warrants that the foundation piers will stabilize the affected area(s) against further settlement for 75 years from the date of installation, or else Contractor will
provide the labor and materials, at no cost to Customer, to correct the problem with the foundation piers. Contractor does not warrant to lift, to close cracks, to render doors and
windows operational, or to move walls back to their original position, but will do its best to achieve positive results in this regard. Customer should be aware that damage can
occur to the structure during a lift operation and that Contractor is not responsible for such damages. Foundation piers provide vertical support only and cannot be expected to
provide lateral support. If lateral movement occurs, additional work may be needed at an additional cost. Examples of lateral movement would be steep slopes and street creep
causing the stem wall to rotate.
PoIyLEVEL®
Contractor does not represent that PoIyLEVEL nO will lift the Customer's slab to meet any criteria of levelness, but instead that it will lift the slab as much as practical. For
concrete slabs raised with PolyLEVELO. Contractor warrants that the area where the slab of concrete was lifted will not settle more than'/< inch for a period of 5 years from the
date of installation. If it does, Contractor will provide the labor and materials to re -level the area at no additional charge to Customer. This Warranty includes any applications
that are caulked or patched. Warranty does not protect against damage or abuse to concrete or caulking. This Warranty is void if Customer does not maintain grade around
slabs and seal joints between slabs. When SealantPro is installed the contractor will warranty the surface area against water penetration and flaking for 5 years. Warranty is
limited to surface and not cracks which should be treated using nexus pro joint caulking. Warranty does not cover existing flaking of surface and algae growth on surface.
Regular maintenance is suggested following normal guidelines(I.E Powerwashing, cleaning).
Exclusions
THIS WARRANTY DOES NOT COVER, CONTRACTOR SPECIFICALLY DISCLAIMS LIABILITY FOR, AND CUSTOMER HOLDS CONTRACTOR HARMLESS FROM: 1) exterior
waterproofing; 2) plumbing damage; 3) Customer -caused damage; 4) dust from installation; 5) damage to real or personal property such as walls, countertop, or floor coverings,
framing, sheetrock, exterior materials, cabinets, appliances, and so on, including any damage alleged to have been done by the Contractor's use of heavy equipment necessary to
complete the job; 6) any injury or damage caused by mold to property or person; 7) failure or delay in performance or damage caused by acts of God (flood, fire, storm, methane
gas, etc.), acts of civil or military authority, or any cause outside Contractor's control; 8) damage from a lifting operation; 9) basement water seepage; and 10) damage from heave,
lateral movements/forces of hillside creep, land sliding, or slumping of fill soils. While Contractor assumes responsibility for utility damage that occurs as a result of Contractor's
installation, such protection is limited to replacing/repair the area Contractor damaged and does not include any upgrades to utilities for code compliance or other reasons.
Items For Which Customer Is Responsible
Customer shall: 1) make full payment to the crew leader upon completion of work; 2) prepare the work area for installation; 3) be responsible for any finish carpentry, painting,
paneling, landscaping, etc. that may be necessary after Contractor's work is finished; 4) mark private lines (satellite, propane, sprinkler, etc.) 5) maintain positive drainage away
from the repaired wal I(s); 6) keep gutters clean and in good working order; 7) direct downspouts a sufficient distance away from the repaired wall(s); 8) maintain proper
expansion joints in concrete slabs that are adjacent to the repaired wall(s); and 9) any items mentioned in this Contract under "Customer Will" or "Additional Notes."
Water Management
Water Management --The Contractor warrants that if water from the walls or floor wall joint passes through the perimeter water managementsystem and into the basement
floor that we will provide the additional labor and materials to fix the leak at no additional charge to the Customer. Contractor is not responsible for any damages caused as a
result of failure of the water management system. Contractor is not responsible for any damage to contents of the property. This warranty applies to WaterGuard systems
along
the specific areas where the system is installed. Said warranty will be in ettect for the lifetime of the structure. I his warranty may be transferred to future homeowners
provided
VFS, LLC. is notified within 30 days of the real estate transfer. The water management system shal I not rust, rot or corrode for the life of the structure. If the entire
perimeter of the basement was not treated, then additional work at an additional charge may be necessary to extend the system or treat other areas or other problems not
addressed by this work. In addition, a pump or power failure is possible, therefore this warranty is not a guarantee of a dry basement, as the scope of this work cannot guarantee
that in al I circumstances. This warranty shall not apply to: condensation, or any system that has been altered in any way, water vapor transmission, concrete discoloration from
capillary action, water squirting out of the walls over the system, window well flooding, plumbing leaks, surface water flooding, leaks from chimneys or garages, wall dampness,
or efflorescence (white powder) on concrete, masonry or bricks, hurricanes or other acts of God. Contractor is not responsible for peeling paint, water once it is pumped from
the
house, dust created from installation, damage to hidden or buried fuel/utility service lines, orfrozen discharge lines without an IceGuard. Floor cracks are warranted against
leakage only with full perimeter WaterGuard systems. Primary AC operated sump pumps and DC back-up pumps are covered under a separate manufacture's warranty which is
60 months from date of installation. Failure of any pump for any reason is outside the scope of this warranty. Back-up pumps that run off a battery, if not maintained, or that are
called on to run beyond the current life of the battery, can fail. These systems are recommended but cannot be relied upon to work in every situation. Annual maintenance is
recommended to find potential problems, but not required for this warranty to be in effect. Unless otherwise noted, electrical work is not included in this contract and problems
for electrical connections or lack thereof are the responsibility of the customer. Systems that drain to daylight cannot be warranted by the contractor if such drain: does not
drain enough water, does not drain water from under the floor, clogs or freezes. While drainage systems clogging or malfunctioning from iron ochre, iron get or iron bacteria
from the soil are rare, the contractor cannot be responsible for these situations, or for a system which requires cleaning, flushing or other service as necessary to keep it
functioning. Wall cracks repaired with FlexiSpan are warranted against leakage for 1 year.

Vesta Encapsulation System
VESTA Encapsulation System -- A crawl space encapsulation system will isolate the home from the earth. The humidity level in the air wil I be lowered, reducing moisture,
however the encapsulation system does not claim to be a mold mitigation system and a April Aire dehumidification/air purification system is highly recommended to further
reduce mold growth. Wet crawl spaces require a drainage system, and a Sump system to remedy the problem with water below the VESTA Liner liner. VESTA Liner has a
transferable 25
year warranty— there will be no charge for service calls on any tears or holes in the VESTA liner (not caused by abuse or misuse), in the unlikely event this occurs. Sump pumps
are covered under a separate manufacturer's warranty. Installation of the system does not include extending discharge lines more than five feet form the foundation or electrical
work unless specified. Contractor is not responsible for frozen discharge lines without an IceGuard, water once it is pumped from house, or condensation. THIS WARRANTY
DOES NOT COVER, AND THE CONTRACTOR SPECIFICALLY DISCLAIMS LIABI LITY FOR: WATER DAMAGE TO FLOOR COVERINGS, FURNITURE, STORED ITEMS,
FINISHED WALLS AND OTHER OBJECTS INSIDE THE FOUNDATION. Contractor will not be responsible for any damages caused by mold, to include but not be limited
to property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, adverse heath effects, or any other effects. Customer agrees to keep area
dry and to promptly report any problems to the Contractor. There are no other warranties, oral or written.
Helical Tie Backs
Contractor hereby warrants that the wall anchors will stop further inward movement of the walls) repaired for 25 years from the date of installation, or else Contractor will
provide the labor and materials, at no cost to Customer, to correct the problem with the wall anchors. Walls that do not have wall anchors installed entirely from corner to
corner, by Contractor, are not warranted. Wall anchors are warranted only to stabilize the affected waII(s) and not straighten them. If Customer desires further outward
movement in the waII(s) repaired, Customer may tighten the installed wall anchors as recommended by the manufacturer, but assumes all liability for damages due to over -
tightening of the wall anchors.

RE: 23-02201 Cursory Foundation Assessment and Proposal
Dear Misty,
Thank you contacting our licensed foundation specialist company to provide a foundation
assessment on the residence referenced above. This report shall serve as our opinions as to the
current foundation conditions and recommendations for repairs to be done. All references and
recommendations are based the Non -Destructive Test (NDT) Methods and local building code by
visual observations only. The visual assessment was conducted by Dr. Matthew Johnston, PhD,
VP Operations and our International Code Council Certified Master Special Inspector (#8053368).
The foundation was constructed utilizing a concrete continuous footing with ASTM C90 hollow
stem concrete masonry unit (CMU) block for s foundation stem wall a minimum of three (3)
courses tall with a concrete slab on grade for the top out. The concrete slab on grade should be a
minimum of four (4") inches in thickness with at least 6"x6" wire mesh for horizontal
reinforcement. The concrete should have been placed with a in minimum compressive strength of
3, 000 psi and all exterior concrete should have been placed with 3,500 psi concrete should have
been core -filled by building code, with a four (4") inch concrete slab on grade. The footing
should have been installed with a minimum of 18" in width and 18" in depth with 3,000 psi
concrete and horizontal reinforcement consisting of three (3) #4 bars at equal spacing and cross
bracing at T-0" O.C. Below shall serve as our opinion(s):
Background
It is our understanding that a 36" water main ruptured about 345 linear feet to the South of the
rear of the residence on September 22, 2021; discharging close to multi -millions of gallons of
water based upon local sources, neighbors and background research. This is not to be considered
100% factual as this is all second hand information as nothing could be found to actually
determine the exact gallon quantity/flow of the discharge.
Opinion(s)
We are of the opinion the entire perimeter foundation should be underpinned due to
flooding of the property as described above. The existing soils are classified as a Gravelly
Clay with high plasticity indices. The Unified Soils Classification System (USCS)
classifies the clays with plastic/liquid limits above 20/40; meaning the soils will shrink
and swell with limited moisture introduced.. This is known in geotechnical engineering
as "linear shrinkage" and can be tested by performing an Atterberg Limits test according
to ASTM D4318
2. We are of the opinion the interior concrete slab on grade should have a lightweight/high
density polyurethane foam injected through the slab to consolidate the unconfined sub-
surface soils and to stabilize the concrete slab on grade.
3. We are of the opinion the existing concrete slab on grade consisting of the rear patio and
the driveway is displaying differential soil settlement. The rear patio will require
replacement (at a minimum) to install the rear foundation piers (underpinning)
Recommendation(s)
1. We are under the recommendation the perimeter foundation should be underpinned to
provide stabilization by the installation of up to (6) hydraulic pressed steel piers consisting
of 2 7/8" @ 0.25" wall internally sleeved with a 2 3/8" @ 0.25" wall pipe while supporting the
footing and the foundation stem wall with an engineered bracket to bedrock/soil bearing
strata (whichever occurs first, providing bearing pressures greater than 3,500 pounds per
square foot (psf) which may result recovery and crack closure (which cannot be guaranteed)
The cost of the foundation stabilization is estimated at $32,000.00;
2. We are under the recommendation the interior crack in the slab on grade should have 4
lbs/ft3 polyurethane foam injected beneath the slab to for soils stabilization and potential
lifting of the concrete. The cost of the interior stabilization is estimated at $16,000.00;
3. We are under the recommendation the driveway and rear patio will have to be replaced. The
cost associated with this replacement is $13,200.00
The total cost of the foundation stabilization and replacement of concrete as required for the
installation of piers and differential settlement is $61,200.00.
CONCLUSION
We are of the professional opinion the existing issues will continue to worsen over time due to
the existing sub -surface soils providing bearing to the perimeter footing.
PFS Inc. reserves the right to adjust the pricing based upon current market value. Pricing is valid
for 30 days from the date of this survey.
Below are some specifications for minimum construction standards that are referenced for our
cursory surveys.
International Residential Code I( RC)
Section R301.1 Design (Comment: The code requires that buildings and structures have adequate
strength to support the loads -and forces without exceeding the allowable stresses on any
element)
Section R301.5 Minimum Uniform Live Loads (Comment: The code requires that the minimum
live loads be not less than the minimums established by the code)
Section R301.7 Deflections (Comment: The code establishes standards for the deflection of
members)
Section R401.2 Foundation Construction (Comment: The code requires that the foundation
construction be capable of accommodating of all loads. Structural fill can also be utilized with
appropriate engineering design.)
Section R401.3 Drainage (Comment: The code requires that surface drainage shall be diverted to
a storm sewer conveyance or other approved point of collection so as to not create a hazard. Lots
shall be graded to drain surface water away from foundation walls. The grade shall fall a
minimum of 6 inches (152 mm) within the first 10 feet (3048 mm))
Section R403.1.4 Minimum Depth (Comment: The code requires that the bottom of foundations
extend below the frost penetration level, but not less than twelve inches)
Section R403.1.8 Expansive Soils (Comment: The code requires that foundations in expansive
soils be designed for that condition)
ASTM C1754 Standard Test Method for Density and Void Content of Hardened Pervious
Concrete (Comment: The code requires for the concrete to be free of porosity and consolidation
by vibratory screed methods, not hand vibration)
All opinions and references are in accordance with the International Code Council, the
International Residential Code and the Arkansas Fire Prevention Code as it pertained to the
minimum specifications as required by local building codes.
This professional opinion was based upon a cursory examination of the crawlspace construction materials visible at the
time of examination on this specific day within thegiven range of environmental factors on tyre date of this report above.
Other opinions could perhaps be developed as tire result of a technically exhaustive engineering design by a licensed
engineering firm. Such a study could involve several hours of information gathering at tire site, laboratory testing,
research, and engineering analysis; involving a substantially higher fee (beginning at ($1,500.00). This cursory survey

Mr. Handyman Service Technicians are covered by General Liability, Workers' Compensation, and are fully bonded
Mr. Handyman bills a setjob price. Customer agrees to pay the agreed upon rate immediately following the completion of the service. Unless
other payment arrangements are made. We have a $65 diagnostic fee if you decide not to proceed with the work.
Charges include all productive labor normally associated with the agreed -upon job assignment. This labor is inclusive of, but not limited to, the
following:
Loading and unloading tools and equipment at the beginning and end of each day
Planning, discussing, and/or problem -solving the work to be completed
Purchasing and picking -up materials
Normal handling, measuring, cutting, and fitting
Keeping a record of time spent on a job
Regular clean-up of debris and equipment due to faulty or incorrect materials
There will be a $4.50 fee for credit card payments under $1000 Anything over $1,000 will be a 3% charge.
If payment is not made upon completion of the job and payment is not tendered within 30 days, interest will accrue at the rate of 10% per
month from the date work was completed. In the event that legal action is required, the customer agrees to pay all costs and expense of
collection, including reasonable attorney fees.
Customer acknowledges that all Service Technicians are employees of Mr. Handyman, and will not solicit or attempt to solicit any employee of
Mr. Handyman.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF WATER MAIN INSTALLATION COSTS
This Agreement, made and entered into on this day of May, 2023, by and between
the City of Fayetteville, Arkansas ("City") and 1 lth Street Cottages LLC ("llth Street Cottages"),
witnesseth:
WHEREAS, IIth Street Cottages has requested that the City share in the cost of
constructing an 8-inch water main near the corner of East llth Street and South Washington
Avenue, a distance of approximately 236 linear feet, so that 1 lth Street Cottages may develop a
property located on East 11 th Street; and
WHEREAS, constructing this segment of 8-inch water main will allow development of
this property, and will provide for ample future capacity which the City recognizes will be
necessary for the area that is served by this water main.
NOW, THEREFORE, the City of Fayetteville, Arkansas and 11 th Street Cottages LLC
agree as follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse llth Street Cottages LLC for 50.0% of the cost to install
approximately 236 linear feet of 8-inch water main in the area identified in
Exhibit "A" up to a maximum -not -to -exceed amount of $47,834.30, as was
estimated by the builder's representatives and shown on Exhibit `B", attached.
B. Payments due to 1 lth Street Cottages LLC, shall be remitted within sixty (60)
days after receipt of valid invoices.
2. 1 lth Street Cottages LLC agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department, per
their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.
C. Pay for the water main installation (with reimbursement of 50.0% of the cost
by the City of Fayetteville in a not -to -exceed amount of $47,834.30).

Dear Mr Nyander,
I am writing to submit a request for consideration of a Cost Share for a water line on 11th St just east of S
Washington Ave, and on the southern entrance to the Willow Bend subdivision. The site is
approximately 2/3 of an acre, and is zoned RIU. We are looking at building 9 cottages in a cluster
housing development. In order to service these houses, we will need to install a water line from
Washington Ave to our the corner of our property, approximately 174', and then extend it in along the
frontage of our property to the middle of the property, an additional approximately 62', for a total of
236'.
This service will benefit our development, but it will also have the potential to benefit our neighbor to
the west, , who may be able to use this to build more units on his vacant lot. In addition, it may provide
a future benefit to our neighbor across the street, 1090 S Washington, as well as all of the lots to the
north of that lot, which are bordered on both sides by alley right-of-ways, but with no current utility
services. It is possible that the waterline may in the future be able to be connected to the Willow Bend
waterline to make a full service loop for better connectivity, service and flow.
This waterline and development, while not directly in the boundaries of the original 1910 city limits, I
believe meets the general philosophy of infill development, in line with City Plan 2040. This
neighborhood Berl Dodd (aka Burl Dodd) appears to have been platted in 1926, so just shy of 100 years
ago, and is 4 blocks to the south of the southern 1910 border. It is surrounded by development to the
East, West, South, Northeast and Northwest. This location is within the Walker Park Neighborhood
Master Plan area, adopted in 2008, and we believe the development plan is consistent with that plan. In
addition, we believe it is in line with Fayetteville Vision 2025, one of those items from that vision being
"Revitalized South Fayetteville".
Below is our Engineer's Estimate of Probable Costs. We are requesting a 50% cost share. My
understanding is that once submitted, it will go to the Water and Sewer Board with your
recommendations for whether or not to support this. If it is supported by the Board, we will then
provide detailed bids in order to be presented to the City Council. If you need any additional information
or documentation in the meantime, please reach out to me or our engineer, Brian Teague at Community
By Design.

1. THE REVIEW BY THE ENGINEERING DIVISION WAS FOR GENERAL COMPLIANCE AND DOES NOT WARRANT YOUR DESIGN AND DOES NOT RELIEVE THE OWNER FROM ANY ITEMS
DISCOVERED DURING CONSTRUCTION OR FURTHER REVIEW, WHICH ARE DEEMED NECESSARY TO COMPLY WITH CITY ORDINANCES AND CRITERIA. THE APPROVAL OF THE ENGINEERING
ITEMS ON THE PLANS FOR WATER, SEWER, DRAINAGE, AND GRADING IS NOT A GUARANTEE OF APPROVAL OF THIS PROJECT BY OTHER CITY DIVISIONS.
2. ANY DAMAGE TO THE EXISTING PUBLIC STREET OR OTHER PUBLIC INFRASTRUCTURE DUE TO CONSTRUCTION SHALL BE REPAIRED/REPLACED AT THE OWNER/DEVELOPERS EXPENSE.
3. ALL MATERIAL DELIVERIES, CONSTRUCTION STAGING, AND WORKER PARKING MUST OCCUR ON YOUR SITE AND OUTSIDE THE PUBLIC STREETS DURING ALL PHASES OF THE PROJECT.
4. ALL PUBLIC SIDEWALKS AND RAMPS MUST MEET ADA GUIDELINES. ANY EXISTING SIDEWALKS THAT DO NOT CONFORM TO ADA GUIDELINES MUST BE REMOVED AND REPLACED TO
CORRECT THE ISSUE. COORDINATE WITH THE ENGINEERING DEPARTMENT FOR INSPECTION OF EXISTING SIDEWALKS TO DETERMINE ADA COMPLIANCE.
5. PRIOR TO ANY CLEARING TO INSTALL EROSION CONTROL STRUCTURES, TREE PRESERVATION FENCING MUST BE INSTALLED BY THE CONTRACTOR AND INSPECTED BY THE URBAN
FORESTER (444-3469)
6. WATER AND SEWER IMPACT FEES WILL APPLY FOR THE ADDITIONAL IMPACT TO THE SYSTEM. THE FEES WILL BE BASED ON THE PROPOSED METER SIZE AND WILL BE CHARGED AT THE
TIME OF METER SET.
7. THE ENGINEER OF RECORD SHALL PROVIDE "FULL TIME" INSPECTION FOR UTILITIES AND "PART TIME" INSPECTION FOR THE STORM DRAINAGE AND ROADWAY CONSTRUCTION FOR THIS
PROJECT. THE ENGINEER OF RECORD SHALL ALSO REVIEW AND APPROVE MATERIAL SUBMITTALS (APPROVED SUBMITTALS SHALL BE SUBMITTED TO THE CITY FOR CONCURRENCE
BEFORE PRECONSTRUCTION MEETING AND BEFORE MATERIAL IS ORDERED) - DAILY INSPECTION REPORTS SHOULD BE SUBMITTED WEEKLY TO THE CITY OF FAYETTEVILLE'S PUBLIC
WORKS INSPECTOR (PWI).
8. ALL MATERIALS AND CONSTRUCTION SHALL COMPLY WITH THE CITY OF FAYETTEVILLE'S REQUIREMENTS. IN THE CASE OF CONFLICTS, THE CITY'S CRITERIA SHALL GOVERN.
9. THE PUBLIC WORKS INSPECTOR SHALL BE NOTIFIED NO LESS THAN 48 HOURS PRIOR TO THE INSTALLATION OF PUBLIC UTILITIES, INFRASTRUCTURE, ROADWAY, ETC. TESTING SHALL BE
COORDINATED WITH THE PWI BY THE ENGINEER OF RECORD.
10. CONTACT DAVE ROWDEN (ADA ADMINISTRATOR 587-7145) AND REQUEST AN INSPECTION PRIOR TO:
A. POURING ANY SIDEWALK, TRAIL, OR DRIVEWAY IN THE RIGHT-OF-WAY OR PUBLIC EASEMENTS.
B. PLACING ANY PAVEMENT FOR ADA ACCESSIBLE PARKING/LOADING AREAS.
C. POURING ANY SIDEWALK THAT IS A CONNECTION FROM ADA ACCESSIBLE PARKING AREAS TO THE STRUCTURE.
11. CONTRACTOR SHALL BE CONFINED TO THE LIMITS OF CONSTRUCTION SHOWN ON THIS GRADING PERMIT APPLICATION. ADJACENT PROPERTY SHALL NOT BE USED WITHOUT MODIFYING
THE GRADING AND EROSION CONTROL PLAN THROUGH THE ENGINEER OF RECORD AND OBTAINING WRITTEN APPROVAL FROM THE CITY ENGINEERING DIVISION.
12. CONTRACTOR SHALL BE RESPONSIBLE TO NOTIFY EACH HOME OWNER IN ADVANCE (MINIMUM OF 24 HOURS, AFTER INITIAL CONTACT OF 48 HOURS) OF PERFORMING WORK THAT
AFFECTS ACCESS (ROADWAY AND DRIVEWAY) AND THAT AFFECTS UTILITY SERVICES (SPECIFICALLY WATER AND SEWER) BUT NOT LIMITED TO PUBLIC UTILITIES.
13. PRIOR TO ENGINEERING APPROVAL OF THE BUILDING PERMIT, EITHER THE REQUIRED PUBLIC IMPROVEMENTS MUST BE INSTALLED AND ACCEPTED, OR PERFORMANCE BONDS IN THE
AMOUNT OF 150% OF THE CONSTRUCTION COST FOR ALL PUBLIC IMPROVEMENTS MUST BE SUBMITTED, ACCOMPANIED BY A UNIT PRICE ESTIMATE APPROVED BY THE ENGINEERING
DIVISION AND ALL EASEMENTS MUST BE DEDICATED AND OR VACATED.
14. A GRADING AND DRAINAGE PERMIT WILL NOT BE ISSUED UNTIL:
A. A COPY OF THE SWPPP IS PROVIDED TO THE CITY. THE SWPPP WILL BECOME PART OF THE GRADING AND DRAINAGE PERMIT. (IN PDF FORMAT)
B. THE PERIMETER EROSION CONTROLS, CONSTRUCTION EXIT, AND SWPPP/GRADING PERMIT BOX HAVE BEEN INSPECTED AND APPROVED BY THE ENGINEERING DIVISION. (APPLICANT IS
RESPONSIBLE FOR CONTACTING AND SCHEDULING THE EROSION CONTROL INSPECTION BY CALLING THE ASSIGNED PWI)
C. THE ENGINEER OF RECORD SHALL REVIEW AND APPROVE MATERIAL SUBMITTALS (APPROVED SUBMITTALS SHALL BE SUBMITTED TO THE CITY FOR CONCURRENCE BEFORE
PRECONSTRUCTION CONFERENCE AND MATERIAL IS ORDERED)
D. A PRECONSTRUCTION CONFERENCE HAS TAKEN PLACE.
a. CONTACT THE CITY OF FAYETTEVILLE METER OPERATIONS DIVISION (575-8392) PRIOR TO THE PRECONSTRUCTION MEETING TO DISCUSS THE DOMESTIC AND/OR IRRIGATION WATER

a. THE WORK SHOWN ON THE CIVIL SITE PACKAGE MUST BE COMPLETE AND THE ITEMS ON THE FINAL PUNCH LIST COMPLETED.
b. VEGETATION MUST BE ESTABLISHED IN ACCORDANCE WITH SECTION 169.06 OF THE UDC AND PERIMETER CONTROLS REMOVED.
c. ONE (1) SET OF AS -BUILT DRAWINGS OF THE COMPLETE PROJECT (EXCLUDING DETAILS) AS A HARD COPY, DIGITAL FILE .DWG, AND PDF FORMAT;
1. PROFESSIONAL SURVEYOR SHALL PROVIDE STAMP DRAWINGS SPECIFICALLY IDENTIFYING THE LIMITS OF AS -BUILT SURVEY PERFORMED.

5. ADEQUATE VERIFICATION SURVEY TO CONFIRM ACCURACY OF DRAINAGE REPORT.

1. Executive Summary
1.1 Fayetteville Team
The Fayetteville team consists of 48 members of which only 97.5% is dedicated to the Fayetteville Projects
and 2.5% are assigned to assist with other Projects. During the month, there were three open positions. The
Regional Support team was utilized to assist with the work order backlog, capital improvement projects, and
various special projects. The Employee Vacancy and Project Status Report is presented in Attachment C.
1.2 Special Projects
1.2.1 Dryer Installation Project
The Dryer Installation Project includes repurposing auxiliary equipment from the old Fenix Fenton
Drum Dryer and modifications of Solar House F for the installation of the new Griffin Residuals Belt
Dryer. We entered into the Dryer Installation Project Phase I Agreement on October 13, 2022. The
Phase I Dryer Installation Agreement detailed the joint work effort with the City to complete two (2)
work components within the current OM Contract and at no additional compensation.
The Dryer Installation Project Phase II Agreement was authorized on December 13, 2022. and Phase II
details the remaining twenty (20) work components. The Agreements identified labor resources would
be provided from onsite and regional support staff to assist the City and the City vendors with
modifications to Solar House F and the auxiliary components to install of the Griffin Dryer.
The site team conducts internal bi-weekly meetings to document and provide project status updates.
To assist with project coordination, the site team participate in weekly meetings with the City and the
City's Vendor.
The team documented the project status during the month of February and provided 413 labor hours
to the dryer installation project. Additional details for the dryer installation project are provided in
Section 4.4 of this report.
1.2.2 Noland Master Plan
The City engaged Garver Engineering to develop the Noland 2023 Master Plan. On September 21,
Garver hosted the kickoff meeting with attendees from the City and Jacobs. On September 30, we
received a Site Records and Maintenance Data Request along with a sampling location list. The staff
developed a Sampling Plan, and this was submitted to the city on November 28, 2022.
On December 1, the site hosted the Noland Facility Assessment tour. The attendees included
approximately 12 Garver Engineers, 8 Jacobs Employees, and 2 City Representatives. The staff
completed the additional sampling request during December and the report was finalized and
submitted to Garver on February 17, 2023.
On February 17, Garver hosted the Historical Data TM Workshop. Following the meeting additional site
information was requested along with a request to drain the decommissioned digesters.
During February, the team provided information and correspondence to Garver, approximately 17
Labor hours were documented this month.

1.3 Compliance
1.3.1 Noland
The Noland facility met all discharge permit parameter limits throughout February and there was one
unauthorized discharge reported and no sanitary sewer overflow reported at the lift stations.
1.3.1.1 Unauthorized Discharge
On February 8, the Noland facility reported an unpermitted discharge which pertained to belt -
filter press process water. Following a period of extended rainfall, and subsequent elevated
process flow, remnant process solids were discovered on the facility grounds, immediately around
two process -connected yard drains Thursday morning February 9th.
The overflow from the yard drains was very brief (18 minute). The yard drains are known to back-
up and cause process water to puddle if the influent pump station's wet -well becomes sufficiently
high.
In this incident, the SCADA wet -well level trends never indicated the wet -well reached the critical
a "High -High" level that would; 1.) callfor operation of all influent pumps 2.) trigger SCADA alarms
and/or 3.) Cause the yard -drain overflows.
The SCADA staff have ensured that transducer levels are set correctly, and transducers are
operating correctly. The operations have also adjusted influent pump control set points to ensure
the influent wet -well elevation maintains sufficiently low elevations to prevent yard -drain
overflows.
Most of the released process water flowed back into yard drains, as influent pumps sufficiently
Lowered wet well levels, and no more than 100 gallons of process water is estimated as lost to
ground infiltration. Additionally, remnant solids have been clean-up and lime applied to affected
area(s).
The release of process water is limited to facility grounds only and has not reached any receiving
waters. There were no adverse environmental impacts observed and none are expected.
1.3.2 West Side
The West Side facility met all discharge permit parameter limits throughout January and there were no
sanitary sewer overflows reported at the facility or at the lift stations.
1.4 Financials
The month ended with a positive financial variance. The labor and non -labor expenses were slightly under
budget. The labor budget underage reflects the staff vacancies.
The Budget Performance Table 1-1 (below), February (year-to-date) projected budget for the year is
favorable by $24,040.

2. Plant Operations
The Noland and West Side effluent quality and influent loadings data is summarized in a report table and
provided in Appendix A and B.
During the month, the facilities received a total of 2.81 inches of rain.
2.1 Process Control
2.1.1 Noland
During the month of February, Noland Wastewater Treatment Facility (WWTF) treated a total of 226.3
million gallons and the highest daily flow received during the month was recorded on February 10 at
26.2 million gallons a day (MGD). The average daily influent flow for the month was 8.08 MGD.
The Noland Facility is continuing to see an increase in both flow and biochemical oxygen demand
(BOD) loading.
Biosolids hauling and disposal was halted due to inclement weather at the start of the month. This,
combined with the increased loading, led to an increase in Mean Cell Residence Time (MCRT) and
necessitated an increase in the wasting rate over the last few weeks to maintain a healthy sludge.
As requested by Garver, the out of service digesters on the south side of the Noland facility were drained
for the Garver inspection, pertaining to the Noland Master Plan development.
2.1.2 West Side
During the month of February, the West Side WWTF treated a total of 328.8 million gallons and the
highest flow received during the month was recorded on February 9 at 23.4 million gallons for the day.
The average daily influent flow for the month was 11.7 million gallons a day which exceeds the plant
designed hydraulic loading of 10.0 MGD by 1 17.4%.
All plant processes were monitored and controlled during the month.

3. Laboratory
The Fayetteville Laboratory provides sampling and analysis for process control and regulatory compliance
for both the Noland and West Side WWTF's, and the Biosolids Management Site (BMS), along with the
Industrial Pretreatment Program (IPP).
3.1 Noland and West Side Analysis
The laboratory submitted the semi-annual Performance Evaluation (PE) blind samples from NSI Lab
Solutions, a USEPA approved provider of standardized samples used for evaluating analytical performance.
As a precaution, Jacobs requires all projects that perform DMR reportable tests onsite to participate in at
Least two PE studies per year. Analyses were completed and submitted to NSI and ADEQ for the West Side
and Noland facilities. The graded results will be made available in March.
Whole Effluent Toxicity (WET) samples were collected for the Goose Creek outfall at the West Side facility.
Samples were sent to Cove Environmental in Stillwater, OK for the quarterly analysis. The Goose Creek
sampling passed WET testing for both species; Ceriodaphnia Dubia, water flea, for survival and reproduction
and the Pimepholes promelos, fathead minnow, for growth assessment, showing neither lethal nor sublethal
effects, in the full dilution series outlined in the permit of 100%, 74%, 56%, 42%, 32% and 0%.

4. Biosolids Management Site
4.1 Biosolids Operations
During the month of February, the WWTF's produced 1,985 wet tons of belt -filter -pressed biosolids. Due to
the limited solar house capacity approximately 226 tons were sent directly to the landfill. Solar House F
was removed from service and is now the home for the new dryer.
Approximately 1,759 wet tons were spread into the solar houses and partially dried before disposal at the
Landfill. A total of 1,687 tons of partially dried biosolids were sent to the landfill. This computes to 72 tons
of water removed from the material before disposal. By partially drying biosolids before hauling to the
Landfill, it is estimated that $3,470 was saved in tipping fees.
4.2 Water Treatment Residuals
During February, the water treatment residual (WTR) application was limited due to field saturation
conditions. The site accepted and applied approximately 626 tons of water -treatment residuals for a total
revenue of $20,301 for the City.
4.3 Maintenance
The Spreader Truck, Unit #768, remains out of service as labor resources are occupied with the new dryer
installation. In its absence, asset #5070 (trailer spreader) is being utilized for spreading WTR. The staff is
coordinating with a local machine shop to provide the repairs. The staff has noted the spinner is out of
balance due to wear on the spinner shaft. The machine shop is task with rebuilding the shaft to 1.5" diameter
or to specifications.
4.4 Dryer Installation Project

The fourth and last Griffin dryer equipment truck was delivered on February 3rd and the process of staging
equipment into the dryer room began on February 5th.
The following equipment were staged into position: five drying chambers, exit table and side discharge
auger, blower and burner, control panel, and the cooling tower. The staff began to install conduit and
provide wiring connections between the equipment.

5. Maintenance
5.1 West Side
As lights fail throughout the facility, they are replaced with light emitting diode fixtures (LEDs). During a few
of the cold days in February, technicians worked indoors and installed LED lights in the biosolids building.
The LEDs installed are not only brighter and provide a better work environment for personnel, but they also
support our sustainability goals because these lights use less energy and last longer.
Cleaning occurs daily and monthly at each facility. In addition to cleaning, staff also paint as needed when
time allows. Selected bollards, water hydrants, gas lines, and water lines were painted this month. The
painting will continue throughout the year, focusing first on the West Side Facility but will soon transition to
the Noland Facility.
Two anerobic mixers were rebuilt and installed at West Side this month. These mixers are important to the
treatment of wastewater as they mix the waste stream with the microorganisms that treat the wastewater.
The mixing also keeps the material suspended and reduces settling over time. These units are deployed in
a severe environment and are sent out for rebuild as needed.
A small portion of the aluminum sweep arm for Clarifier 4 was repaired due to age and wear. This arm sweeps
scum and floating debris off the top of the water on the clarifiers. The failure was minimum and caused by
age and normal use. The issue was identified early, and a minor repair was made before additional damage
could occur.
5.2 Noland
The Maintenance staff has been focusing on a more detailed evaluation of the failing headworks equipment.
The SBU Tank grit isolation valve would not seal and was replaced during February. The old valve would not
seal and allowed water flow which made it difficult to isolate and complete any grit pump maintenance. The
replacement valve allows the much -needed grit pump rebuild project to proceed.

The non -potable water strainer #102 on the reuse water (W3) line located in the headworks was replaced
this month. This strainer filters the W3 water used to flush the band screens, SBU tank, and grit auger system.
Given the importance of cybersecurity and criticality of keeping the network protected, CyberX was installed
at Noland to monitor the SCADA networks at both facilities. CyberX continuously monitors assets in the
network for vulnerabilities, attackvectors, malware, risk assessment, and more. As CyberX scans the network,
personnel examine reports and notifications then address concerns appropriately. The initial examination
showed a healthy network compared to initial scans at other locations and industries.
5.3 Lift Stations
The new upgraded pump was installed at Lift station 12, Double Springs Road in Farmington. The new
FLYGT N-style impeller pump was installed in position #3 and included a new VFD (Variable Frequency
Drive). The new style of pump provides protection from rag and other debris clogging. The same pump style
was previously installed into position #1 and, since that installation, the call out rate went from 4-5 events
per week down to zero.

5.5 Capital Improvement Projects (CIP)
Maintenance continued to work on replacing anoxic mixers on the west side of the Noland aeration basin.
Six mixers were purchased in 2022 as part of an approved capital improvement item. The commissioning
process is expected to begin in mid -March.
The Noland Headworks Equipment Evaluation continued during this month and staff are working on
obtaining quotes and seeking vendor evaluations.

6. Industrial Pretreatment
As outlined in the NPDES permit for the Noland WWTF, the quarterly Industrial Surcharge sample collection
and analysis was completed during February. The quarterly industrial surcharge samples were collected
from Hiland Dairy, ConAgra Brands, and Tyson. The samples were analyzed for pH, total suspended solids,
total phosphorus, and biochemical oxygen demand. The annual samples were collected at Tyson and Hiland
Dairy for Oil and Grease analysis. These were sent to American Interplex Corporation (now Eurofins
Scientific) for analysis. Surcharge fee reports were generated using self -generated industrial data, as well as
data results from the Noland laboratory.
Hiland Dairy has completed installation and calibration of a new effluentflow meter. The installation records
was the last step of completing the compliance schedule.
The monthly surcharge and waste hauler reports were completed and sent to the city for billing. For revenue
generated from the IPP, see Table 6-1 and Figure 6-1.

7. Woolsey Wet Prairie
On Friday, February 17t", Ozark Ecological Restoration, Inc. (OERI) and Eco, Inc. took advantage of favorable
weather conditions to successfully perform Woolsey's 16th prescribed burn. As illustrated below, fire
containment and abatement efforts leading up to the event minimized fire hazards to interior and
neighboring structures. Every year following the controlled burn, university biology students survey the burn
area to assess reptile and amphibian mortality. This year the students only discovered two reptile
(amphibian) mortality occurrences, which is a low rate. The mid -winter burn date, and cold overnight
temperatures are largely credited for the minimal reptile -amphibian mortality. The survey efforts are a great
example of how university student involvement, research, and collaboration at Woolsey Wet Prairie has
helped improve awareness and effectiveness of management activities for responsible stewardship of
Woolsey's ecological health. The clean -slate landscape will assist with the site's late March vegetation
management efforts and activities will focus on tracking certain high priority invasive species, namely Callery
Pear, non-native blackberries, and highly invasive Reed canary and carpet grasses.

8. Sustainability, Stewardship & Community Involvement
The staff provided two Group tours for the Beaver Water District staff. The tours were conducted at the
Noland WWTF and the BMS.
The environmental staff hosted a workshop event at the West Side facility in collaboration with the NWA
Master Naturalists group and multiple U of A students. The workshop focus was on the habitat stewardship
for Arkansas native bird species. Following the presentation and lunch, participants assisted staff in clearing
invasive vegetation along Goose Creek riparian bank near the West Side outfall and also mounted a Wood
Duck nesting box to help encourage this beautiful native duck to make a home there.

9. Health & Safety
The Safety Committee was timely in the completion of 100% of their weekly inspections with only one
concern documented. The team will contact the maintenance team to address the ozone building
emergency lights that were not working at the time of the inspection.
The team uses many valuable safety tools to gauge safety performance. One tool that that we use is the
Beyond Zero Observation (BZO) which documents the task someone is performing from a safety
observation. The management team is required to conduct at least one BZO per week. The purpose of the
BZO's is to seek opportunities to praise appropriate activities or address the at -risk behaviors that might
occur while performing a job assignment. BZO documentation allows management to anonymously record
and evaluate trends that can lead to future incidents while also providing valuable direct feedback to the
associate.
