BACKGROUND: There are currently over 80 aircraft based east on the east side of the airfield. The southernmost taxiway providing access to the east side of the airfield is currently Taxiway E, located 3,400 ft from the Runway 16 threshold. Under favorable conditions, most small- to medium sized aircraft arriving on Runway 16 can decelerate in time to safely maneuver onto Taxiway D. However; larger aircraft, and smaller aircraft under unfavorable conditions, are unable to decelerate prior to reaching Taxiway D and must exit the runway to the west. These aircraft must then cross the runway at either Taxiway D or Taxiway C to reach their intended destination. This project will provide a new taxiway connector located 4,800 ft from the Runway 16 threshold. Analysis of aircraft performance data available from the FAA indicates increasing the available distance from 3,400 ft to 4,800 ft from the Runway 16 end will significantly reduce the number of aircraft having to cross the runway to access hangars on the east side of the airfield. Reducing runway crossings will improve airport safety by reducing the potential for runway incursions. Early environmental investigations for the project were initiated late 2022. Potential wetlands and floodplain impacts were identified, prompting coordination with regulatory agencies. Considering these potential impacts and associated mitigation efforts, the FAA determined a separate Environmental Assessment (EA) is required prior to initiating project design. DISCUSSION: This project is included on the Airport's 5-year Capital Improvement Plan (CIP) and is programmed for an environmental -only FAA AIP grant in federal fiscal year (FY) 2023. Design and construction will be funded under separate FAA grants in federal FY 2024 and FY 2026, respectively. Pending Council approval, Garver, in collaboration with the Aviation Division, will prepare an FAA AIP environmental -only grant application for signature of the Mayor. Upon receipt of an FAA environmental -only grant offer in Spring 2023, the Aviation Division will seek approval from Council to execute the grant offer and execute Task Order 07 in the amount of Mailing address: 113 W. All costs associated with Task Order 07 will be included in the FAA environmental -only grant application. The FAA AIP grant will cover 90% of project costs which total $189,450.00. The Aviation Division will submit a grant application to the ADA for reimbursement of the remaining 10% of project costs at the conclusion of the environmental phase. BUDGET/STAFF IMPACT: The Aviation Division may expend up to $121,050 of its fund balance reserve. This amount includes $100,000 for cash -flow to cover the FAA's 90% share of billed invoices until monthly reimbursement is issued, and $21,050 for cash -flow to cover the ADA's share until reimbursement at the end of the project. Objective: The planned extension of Taxiway E will eliminate runway crossing at Taxiway C & Taxiway D by aircraft wishing to access the east side of the airfield following a Runway 16 arrival, which is the primary runway utilized at FYV. The overall project will improve safety at FYV by eliminating unnecessary runway crossings. This phase of the project will be to conduct an Environmental Assessment for the Taxiway E Extension. Early environmental investigations determined potential impacts to existing wetlands, leading to the need for an EA to be completed. The EA will meet AIP policy of protecting the environment. 2. Benefits Anticipated: Finding of no significant impact (FONSI) for the future project location. 3. Approach: (See approved Scope of Work in Final Application) The environmental assessment (EA) will consist of four major sections which address: 1) Purpose and Need for the Project (which includes the Proposed Action), 2) Alternatives, 3) Affected Environment, and 4) Environmental Consequences & Mitigation. To complete the EA, a Cover Sheet, Table of Contents, and appropriate appendices will be included. CITY OF FAYETTEVILLE, ARKANSAS By: Mayor, Lioneld Jordan ATTEST: By: City Clerk Task Order 07 FYV Taxiway E Extension — Environmental Assessment GARVER Title: Senior Project Manager 2 of 2 Garver Project No. 22A13212 EXHIBIT A-07 (SCOPE OF SERVICES) Generally, the Scope of Services includes the following professional services to support the completion of an Environmental Assessment (EA) for the Taxiway E extension project at Drake Field Airport (Airport). The EA will consist primarily of assessing the impacts of the proposed project for the Airport as shown in Exhibit B. Garver (Consultant) will prepare an EA in accordance with Federal Aviation Administration (FAA) Orders 5050.46 & 1050.1 F and the FAA Environmental Desk Reference for Airport Actions (Airports Desk Reference). The EA will consist of the following major sections: • Purpose and Need • Proposed Action and Alternatives • Affected Environment, Environmental Consequences, and Mitigation • Public Involvement A.1 Environmental Assessment A.1.1 Studv Development Garver will review current environmental conditions based on desktop review of governmental databases and other resources. A review of pertinent airport data, forecasts, planning or feasibility studies, and other environmental documents will be completed prior to initiating the EA. Garver will identify the specific issues to be addressed in the EA and attend a virtual project kick-off meeting. Upon concurrence of the issues to be addressed in the EA, Garver will develop a conceptual layout for the Taxiway E extension (Proposed Action) and connected actions. A.1.2 Purpose and Need for the Proiect Garver will clearly identify the need for the project, the purpose or the proposed action, and the proposed time frames for the proposed actions. The proposed action includes the following: • Extension of Taxiway E • Associated NAVAIDS • Grading and drainage improvements Garver will verify that the proposed action(s) is consistent with the Airport Layout Plan (ALP) and coordinate with the Airport Sponsor the collection or documentation of relevant information supporting the need for the project, including specific justification and/or forecasts. A.1.3 Alternatives Garver will define the No Action, one build alternative, and Proposed Action alternatives. No other reasonable alternatives are anticipated to be described in the EA. The ALP defines the Taxiway E extension and will be screened as the build alternative. Documentation of why other alternatives were not considered will be supplied in the EA as it relates to statutory or regulatory requirements applicable to the alternative. Each action's expected environmental impacts will be discussed along with proposed mitigation measures as appropriate. A.1.4 Affected Environment Garver will conduct a site visit to review the presence of readily visible and environmentally sensitive features such as wetlands, endangered and threatened species habitats, streams, farmlands, historic Exhibit A — Scope of Services Taxiway E Extension Environmental Assessment Garver Project No. 22A13212 GARVER properties, residences, businesses, and parks. Photos of the site will be taken being sure to include environmentally sensitive features. A minimum of four photos will be included in the EA. Garver will document existing and planned land uses, including noise -sensitive receptors such as residences, schools, churches and hospitals; public parks; wildlife and waterfowl refuges; floodplains; recreation areas; historic properties; and archaeological sites. Special interest groups such as low income or minorities, will be identified, if present. The affected environment is anticipated to encompass an area around the airport within the noise review area. A.1.5 Environmental Consequences and Mitigation Garver will analyze and document the potential impacts and mitigation of the No Action and Proposed Action (no other reasonable alternatives are anticipated to be included in detailed review in the EA), including consultation with the appropriate agencies. Garver's reviews will include but not be limited to the following resources: Air Quality — Determine if threshold levels specified in the Airports Desk Reference will be reached. Measures to be utilized to minimize adverse air quality effects will be documented. The FAA Air Quality Handbook will be used as a guide. A detailed air quality analysis is not anticipated. 2. Biological Resources — Assess the potential effects of the proposed project on biological communities (including Federally -Listed Endangered and Threatened Species and State - listed species of concern). Complete Section 7 informal consultation with the U.S. Fish and Wildlife Service (USFWS). Consult the state Department of Natural Resources (DNR) or appropriate wildlife resources agency. If directed, a biological survey for the project area will be completed as extra work and submitted to the USFWS and state wildlife resources agencies for review. In compliance with Section 7 of the Endangered Species Act, coordinate the completion of a habitat assessment for potential preferred habitat. 3. Climate — The Proposed Action, build alternative, and No Action alternatives are not anticipated to cause a net change in greenhouse gas emissions. Consideration should be given to whether there are areas within the scope of the project where emissions could be reduced. However, reduction is not mandated and will not be possible in all situations. 4. Coastal Barriers — Review not required. 5. Coastal Zone Management — Review not required. 6. Department of Transportation Act, Section 4(f) — Contact the appropriate federal (Department of the Interior), state Department of Natural Resources (DNR), and local agencies to determine if any 49 Section 303(c), 4(f) lands (public parks, recreation areas, wildlife or waterfowl refuges, or public/private historic sites) will be affected by the proposed project. 7. Farmlands — Consult with the U.S. Department of Agriculture, Soil Conservation Service (county district office) to determine what impacts the proposed project will have on prime or unique farmland and submit Form AD-1006. 8. Hazardous Materials, Solid Waste, and Pollution Prevention — Discuss if the project has the potential to involve or affect hazardous materials. If so, include a discussion of the means of compliance with applicable regulations. Determine if any "Superfund" sites are in the project area and discuss the impacts of the project on the site, if applicable. Potential impacts will be evaluated and discussed in the EA. If the proposed project will cause or change a solid waste stream, discuss how the solid waste will be handled and disposed of properly to minimize environmental effects. Determine whether local disposal facilities have the capacity to hold solid waste streams the proposed airport facilities would produce during their construction or operation. Pollution prevention measures both employed by the Airport and those that could be implemented during construction will be described. 9. Historic & Archaeological Resources — Assess the potential effects of the proposed project on historic resources. Consult with FAA on the Direct and Indirect (visual) Area of Potential Effect (APE) and the State Historic Preservation Office (SHPO). If directed, a Cultural Resources Survey will be conducted for ground disturbance areas and above -ground historic resources. Potential impacts to NRHP eligible and NRHP listed sites will be evaluated. The Cultural and Historic Resources Surveys and recommendations will be submitted to FAA and SHPO for impact determination. 10. Land Use — Address compatibility of existing and planned land uses in the vicinity of the proposed project. Reference and include a copy of the Sponsor's "Land Use Compatibility Assurance Letter" in the EA Appendix. The Consultant does not anticipate the requirement to rezone the property or attend meetings requiring rezoning. 11. Natural Resources and Energy Supply — Discuss any project effects on utilities, consumable materials, or aircraft fuel consumption. 12. Noise and Noise -Compatible Land Use — A noise analysis not anticipated according to FAA Order 1050.1. 13. Socioeconomics, Environmental Justice, and Children's Health and Safety Risks — Discuss secondary or induced impacts from construction of the Proposed Action. Document anticipated no effect on low income or minority communities. Assess the potential of the proposed project to cause health and safety risks to children, relocation or homes and businesses, dividing or disrupting communities, changing surface transportation patterns, disrupting orderly planned development, or creating notable change in employment. This EA will reference recently completed demographic and socioeconomic studies, if available, pertaining to the Airport. 14. Visual Effects, Light Emissions, Visual Resources/Visual Character — Assess the potential effects of light emissions and visual effects and character per Order 1050.1 F Desk Reference resulting from the proposed action and no -action alternatives. This effort includes documenting visual effects on biological resources Section 4(f) sites, and cultural resources sites. Mitigation measures and BMPs will be proposed in the EA. 15. Water Resources, Wetlands, Floodplains, Surface Waters, Groundwater, and Wild and Scenic Rivers Wetlands — Assess the potential effect of construction and operation of the proposed project on jurisdictional waters and wetlands. Consult with the U.S. Army Corps of Engineers (USACE), the U.S. Fish and Wildlife Service, state DNR, and state Department of Agriculture Exhibit A — Scope of Services Taxiway E Extension Environmental Assessment Garver Project No. 22A13212 GARVER and propose mitigation measures as required for EA purposes. A Jurisdictional Determination will be obtained from the USACE if jurisdictional waters are located within the study area. A wetland delineation for the project area will be completed and submitted to the USACE for review. Section 404 permitting shall be completed as extra work. Floodplains — Review the Federal Emergency Management Agency (FEMA) 100-year floodplain map and consult with local floodplain authorities as necessary to determine whether the proposed project will significantly impact a base floodplain and if permits will be necessary. Water Quality — Assess the potential for any water quality impacts, including potential contamination of groundwater aquifers or surface waters and document measures to be incorporated to minimize adverse water quality effects. Contact the state water quality control agency and other applicable agencies, as necessary. Disturbance of land equal to or greater than one acre will require a National Pollutant Discharge Elimination System (NPDES) permit at the time of construction. Wild and Scenic Rivers — Determine whether the proposed project will have any impact on wild and scenic rivers. This includes the National Wild & Scenic Rivers System (WSRS) of designated and study rivers as well as the Nationwide Rivers Inventory. Coordinate with Federal agencies, as necessary. A.1.6 Coordination with Governmental Agencies and Tribes Garver will provide the following coordination and consultation: 1. Coordinate with the Airport and FAA concerning the Direct and Indirect APEs before coordinating with government agencies. Refer to Exhibit - Area of Potential Effect. 2. Prepare agency and Tribal consultation letters. Coordination letters and attachments will be in electronic format, with hard copies provided as needed, to FAA who will complete the coordination with federally recognized Tribes. 3. Submit an application through the Arkansas State Clearinghouse showing the APE that was developed with FAA concurrence and describing the proposed improvements. 4. Address concerns of Government Agencies and Tribes by responding promptly to requests for additional information or documentation. Consultant will not initiate conversations or correspondence with Tribes, but rather will work through FAA to provide information to Tribes. Consultant may answer questions if contacted by Tribes, but should keep FAA informed of the content of any such communications. 5. Include letters and other pertinent information from Government Agencies and Tribes in the EA including any responses. A.1.7 Conceptual Engineering Services Garver will review preliminary data and develop a conceptual layout for the Proposed Action elements. The ALP defines the Taxiway E extension and connected actions, and will be utilized in the alternatives screening process as the build alternative. A topographic survey will be performed to aid in development the Proposed Action conceptual layout, but shall not be used for construction. Furthermore, the conceptual layout shall not be considered final layout that will be incorporated into the construction plan set in a subsequent project. Exhibit A — Scope of Services Taxiway E Extension Environmental Assessment Garver Project No. 22A13212 GARVER A.1.8 NEPA Document Preparation and Coordination Garver will prepare and submit the Draft EA to the Airport for review and address comments. The Draft EA will then be submitted to the FAA for review and their comments addressed. All Draft EA submittals to the Airport and FAA will be electronic unless otherwise requested. Interim FAA reviews shall be completed for the major EA sections. After FAA approves the Draft EA for advertisement, the EA will be submitted to requesting agencies and advertised in the local newspaper and online on the Airports website and/or an external website developed specifically for advertising the project. Garver will coordinate with and help the Airport to advertise a "Notice of Public Hearing" for the Environmental Assessment based on the proposed development at the airport. The notice shall be published for a minimum of two weeks and include locations and times where the draft EA may be reviewed before the schedule date of the public hearing. The Consultant will provide the Airport Sponsor with two copies of the draft EA for display and review by the public. An opportunity to provide comments will be provided up to two weeks after the public hearing. The Airport is to pay for advertisement costs outside this contract. Garver will assist the Airport in preparing for, participate in, and hold an in -person public hearing. Garver will prepare a slide presentation for the hearing and retain a court reporter for documentation of public comments or record the hearing and transcribe the recording. All public involvement documents will be included in the EA. These documents may include, but not limited to: contact letters, Notice of Public Hearing (with publication affidavit), signed hearing transcript, list of attendees, comments, and responses to comments. Three (3) copies of the final EA will be prepared that incorporates a summary of the public meeting or hearing, comments received as a result of agency coordination, and responses to public comments for the Airport and the FAA. Provide the Airport Sponsor and FAA an electronic copy of the final EA document and supporting materials (PDF format). Note, the FAA shall keep two (2) hard copies of the final EA. Upon receipt of a Finding of No Significant Impact (FONSI), Garver will advertise the FONSI in the same locations and websites advertising the Draft EA. A.1.9 Quality Control Garver will develop a project specific quality control plan. The quality control plan will include the project background and scope, stakeholder contact information, project team and roles, design criteria, project schedule, and quality control procedures. Garver will complete a quality control review prior to any design submission to Owner and/or FAA. QC reviews will be completed by senior environmental staff and project manager. Monthly internal progress meetings will be held during EA completion to ensure adequate quality control throughout the environmental process. A.2 DBE Program Administration Garver will coordinate with the FAA's Office of Civil Rights in preparing an updated Disadvantaged Business Enterprise (DBE) Program and developing a three-year DBE goal for the Owner's federal projects in fiscal years 2023-2026. As part of the three-year goal development, Garver will issue public notices and facilitate the DBE Goal Consultation as required by the FAA. Garver will also prepare the Owners annual DBE report for FY2022 and FY2023. Garver will submit these documents, on the Owner's behalf, to the FAA via the FAA Civil Rights Connect website. Unless otherwise noted below, all deliverables shall be electronic. 1. Draft Environmental Assessment to the Owner and FAA. a. Two hard copies to the Owner and FAA. 2. Final Environmental Assessment a. Three hard copies to FAA 3. Public Meeting or Hearing presentation a. One hard copy to the Owner and FAA 4. Finding of No Significant Impact will be provided to the Airport when furnished by FAA. 5. Other electronic files as requested. A.4 Additional Services Additional Services will be as directed by the Owner in writing for an additional fee as agreed upon by the Owner and Garver. These services are not included as part of the basic Scope of Services to be provided by the Consultant. Compensation for additional services will be in addition to compensation for above - described services and may include but are not limited to: 1. Redesign for the Owner's convenience or due to changed conditions after previous alternate direction and/or approval. 2. Deliverables beyond those listed herein. 3. Engineering, architectural, or other professional services beyond those listed herein. 4. Preparation of a Storm Water Pollution Prevention Plan (SWPPP), including updates to the Airport's Industrial SWPPP. 5. Environmental Handling and Documentation beyond what is listed herein. 6. Coordination with FEMA and preparation/submittal of a CLOMR and/or LOMR. 7. Services after construction, such as warranty follow-up, operations support, and Part 139 inspection support. 8. Coordination to obtain right -of -entry for environmental investigations. 9. Conduct an air quality analysis if anticipated activity exceeds thresholds specified in FAA Order 5050.413. 10. Completion of a biological survey/assessment or presence/absence threatened or endangered species surveys. 11. Completion of a Wildlife Hazard Site Visit, Wildlife Hazard Assessment, and/or wildlife management plan. 12. Completion of light emissions studies/evaluations. 13.
