THE CITY OF FAYETTEVILLE, AND TO APPROVE A PROJECT CONTINGENCY IN THE AMOUNT OF
$4,783.43
WHEREAS, 11th Street Cottages, LLC has proposed an infill cluster housing development south of llth Street
between S. Washington Avenue and S. Beebalm Avenue; and
WHEREAS, in order to service this development, Ilth Street Cottages will need to install a water line from
Washington Avenue to the corner of the subject property, approximately 174 feet, and then extend it along the frontage
of the property to the middle of the property, an additional approximately 62 feet, for a total of 236 feet; and
WHEREAS, the installation of an 8-inch water main will allow development of this property and will provide for
ample future capacity which the City recognizes will be necessary for the area served by this main; and
WHEREAS, the total cost of the water main extension is estimated to be $95,668.60 and exceeds the rough
proportionality of the development's impact so the City agrees to pay 50% of the cost.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to sign a cost
share agreement with 1 lth Street Cottages, LLC for the installation of an 8-inch water main near the corner of East 1 lth
Street and South Washington Avenue, with a refund in an amount not to exceed $47,834.30 to be paid by the City of
Fayetteville, and further approves a project contingency in the amount of $4,783.43.

Staff recommends a Cost Share Agreement with 11th Street Cottages, LLC in an amount not to exceed
$47,834.30 for a water line extension near the corner of East 11th Street and South Washington Avenue, and
approval of a project contingency in the amount of $4,783.43.
BACKGROUND:
Infill development is proposed by 11th St Cottages, LLC south of 11th Street between S. Washington Avenue
and S. Beebalm Ave. (parcel 765-03341-000). The site is approximately 0.66-ac, currently vacant, and is
zoned RIU. The developer proposes to build 9 cottages in a cluster housing development. In order to service
these houses, they will need to install a water line from Washington Ave to the corner of the subject property,
approximately 174-ft, and then extend it in along the frontage of the property to the middle of the property, an
additional approximately 62-ft, for a total of 236-ft.
DISCUSSION:
This waterline would also benefit any future development east and north of this project site. 11th St Cottages,
LLC requests a 50% cost share on this waterline installation. The project engineering and permitting has been
completed and the developer has secured three contractor quotes. The low quote is from Pavecon for
$87,183.20 and the engineering costs for the project are $8,485.40 for a total project cost of $95,668.60. The
50% cost share would therefore total $47,834.30. Staff also recommends approval of a project contingency in
the amount of $4,783.43.
The cost share agreement was considered by the Water, Sewer and Solid Waste Committee on April 11, 2023,
which recommended approval by a vote of 4-0.
BUDGET/STAFF IMPACT:
Funds are available in the Water/Sewer Impact Fee Cost Sharing account.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF WATER MAIN INSTALLATION COSTS
This Agreement, made and entered into on this 19th day of May, 2023, by and between
the City of Fayetteville, Arkansas ("City") and 1 lth Street Cottages LLC ("llth Street Cottages"),
witnesseth:
WHEREAS, llth Street Cottages has requested that the City share in the cost of
constructing an 8-inch water main near the corner of East llth Street and South Washington
Avenue, a distance of approximately 236 linear feet, so that 1 lth Street Cottages may develop a
property located on East 11 th Street; and
WHEREAS, constructing this segment of 8-inch water main will allow development of
this property, and will provide for ample future capacity which the City recognizes will be
necessary for the area that is served by this water main.
NOW, THEREFORE, the City of Fayetteville, Arkansas and 11 th Street Cottages LLC
agree as follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse llth Street Cottages LLC for 50.0% of the cost to install
approximately 236 linear feet of 8-inch water main in the area identified in
Exhibit "A" up to a maximum -not -to -exceed amount of $47,834.30, as was
estimated by the builder's representatives and shown on Exhibit `B", attached.
B. Payments due to 1 lth Street Cottages LLC, shall be remitted within sixty (60)
days after receipt of valid invoices.
2. 11th Street Cottages LLC agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department, per
their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.
C. Pay for the water main installation (with reimbursement of 50.0% of the cost
by the City of Fayetteville in a not -to -exceed amount of $47,834.30).

Dear Mr Nyander,
I am writing to submit a request for consideration of a Cost Share for a water line on 11th St just east of S
Washington Ave, and on the southern entrance to the Willow Bend subdivision. The site is
approximately 2/3 of an acre, and is zoned RIU. We are looking at building 9 cottages in a cluster
housing development. In order to service these houses, we will need to install a water line from
Washington Ave to our the corner of our property, approximately 174', and then extend it in along the
frontage of our property to the middle of the property, an additional approximately 62', for a total of
236'.
This service will benefit our development, but it will also have the potential to benefit our neighbor to
the west, , who may be able to use this to build more units on his vacant lot. In addition, it may provide
a future benefit to our neighbor across the street, 1090 S Washington, as well as all of the lots to the
north of that lot, which are bordered on both sides by alley right-of-ways, but with no current utility
services. It is possible that the waterline may in the future be able to be connected to the Willow Bend
waterline to make a full service loop for better connectivity, service and flow.
This waterline and development, while not directly in the boundaries of the original 1910 city limits, I
believe meets the general philosophy of infill development, in line with City Plan 2040. This
neighborhood Berl Dodd (aka Burl Dodd) appears to have been platted in 1926, so just shy of 100 years
ago, and is 4 blocks to the south of the southern 1910 border. It is surrounded by development to the
East, West, South, Northeast and Northwest. This location is within the Walker Park Neighborhood
Master Plan area, adopted in 2008, and we believe the development plan is consistent with that plan. In
addition, we believe it is in line with Fayetteville Vision 2025, one of those items from that vision being
"Revitalized South Fayetteville".
Below is our Engineer's Estimate of Probable Costs. We are requesting a 50% cost share. My
understanding is that once submitted, it will go to the Water and Sewer Board with your
recommendations for whether or not to support this. If it is supported by the Board, we will then
provide detailed bids in order to be presented to the City Council. If you need any additional information
or documentation in the meantime, please reach out to me or our engineer, Brian Teague at Community
By Design.
