ELKINS SEWER EASEMENTS:
A RESOLUTION TO APPROVE THE CONVEYANCE OF EASEMENTS TO THE CITY OF ELKINS ACROSS
PORTIONS OF CITY OF FAYETTEVILLE PROPERTY LOCATED NEAR LAKE SEQUOYAH FOR THE
INSTALLATION OF SEWER LINES
WHEREAS, the City of Elkins is in the process of upgrading its sewer lift station and the downstream force main that
transports the wastewater to Fayetteville's system to reduce wet weather sewer overflows and accommodate growth in
its system; and
WHEREAS, temporary construction and permanent easements are needed for the Elkins sewer lines across several
City of Fayetteville parcels.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to execute the
two Easements attached to this Resolution in favor of the City of Elkins conveying permanent sewer line easements and
temporary construction easements across portions of City of Fayetteville owned property located near Lake Sequoyah
for the installation of sewer lines.

That for and in consideration of $1.00 and other valuable considerations to the undersigned,
City of Fayetteville, the receipt of which is hereby acknowledged, the said Grantor does hereby
GRANT, SELL AND CONVEY unto the CITY OF ELKINS, an Arkansas municipal corporation
(herein styled Grantee), its successors and assigns, the perpetual right of way and easement for the
purpose of constructing, maintaining, inspecting, operating, testing, and repairing and replacing
public water transmission line(s) and/or sewer collection or force main line(s) and related facilities
on, over, across and under the following described real estate located in Washington County,
Arkansas,to-wit:

Permanent Water and Sewer Easement and Temporary Construction Easement
See attached "Exhibit A"and "Exhibit B".
TO HAVE AND TO HOLD unto said Grantee, its successors and assigns, forever or until
said easement is fully abandoned.
The Grantor hereby covenants that Grantor is lawfully seized of said land and premises,
and Grantor will forever warrant and defend the title to said lands against all legal claims
whatsoever. The Grantor agrees not to interfere with the operation of any utility infrastructure or
facilities in any way. The Grantor agrees not to erect any building, structures or fences in said
utility easement. No trees shall be planted or permitted by Grantor on said utility easement.
Grantor shall not be entitled to any compensation for fences or growing crops removed or disturbed

within this utility easement by virtue of Grantee's exercise of the rights under this agreement. The
Grantor agrees not to permit any other utilities to be located in the easement without the written
consent of Grantee.
As further consideration for the utility easement rights granted herein, it shall be Grantee's
responsibility to ensure that, upon completion of construction, any driveway, parking area or fence
moved, taken down, damaged or otherwise altered by Grantee or its contractor(s) during and as a
result of construction is returned to the same or better condition as existed immediately prior to
construction. Further, it shall be Grantee's responsibility to ensure that any yard, pasture or field
lying within the easement area which is damaged by Grantee or its contractor(s) during
construction shall be repaired using the same type and variety of grass as predominated the
easement area immediately prior to construction.
The consideration recited herein is in full satisfaction of every right hereby granted. All
covenants and agreements herein contained shall extend to and be binding upon the respective
heirs, legal representatives, successors and assigns of the parties hereto.
It is hereby understood and agreed that the party securing this grant in behalf of the Grantee
is without authority to make any covenant or agreement not herein expressed.
TEMPORARY CONSTRUCTION EASEMENT
Grantor does further hereby grant, bargain and convey unto the said Grantee and unto
Grantee's successors and assigns, agents, employees, and contractors a non-exclusive temporary
construction easement for the construction and installation of utility and other related
improvements upon, along and across Grantor's property described above.
The temporary construction easement shall be used by the Grantee only during periods of
actual construction and installation activity and for any necessary restoration of the easement
property to a clean, slightly and safe condition, with all rubbish, trash and debris removed
therefrom, and all such construction, installation and restoration is to be done and completed by
and under the Grantee's supervision and at the sole expense of the Grantee.
The temporary construction easement shall terminate when this project has been completed
and accepted by the City of Elkins, Arkansas.

RECOMMENDATION:
Staff recommends approval of certain sewer easements across City of Fayetteville property for the City of
Elkins to allow the installation of a sewer force main line.
BACKGROUND:
The City of Fayetteville and City of Elkins have an agreement for both water and sewer services. The City of
Elkins operates their own water and wastewater systems, purchasing water wholesale from Fayetteville and
metering sewer wholesale from a lift station and metering site east of Lake Sequoyah. Elkins is in the process
of upgrading their sewer lift station and the downstream force main that transports the wastewater to
Fayetteville's system. These upgrades are needed to reduce wet weather sewer overflows and accommodate
growth in their system.
DISCUSSION:
Temporary and permanent utility easement is needed for the Elkins sewer lines across several City of
Fayetteville parcels as shown in the attached exhibits. These areas are generally north of Highway-16 in the
vicinity of Lake Sequoyah. Staff recommends approval of the easements as requested.
BUDGET/STAFF IMPACT:
No impact.

COMMENCING at the Southeast corner of said Southwest Quarter (SW 1/4) of the Southwest Quarter

Southwest Quarter (SW1/4) a distance of 527.31 feet; thence leaving said South line N 02°38'54" E a
distance of 204.44 feet to the Centerline of a Twenty-five foot Sewer Easement being the POINT OF
BEGINNING of said Centerline; thence along said Centerline the following: N 75°17'27" W a distance
