WHEREAS, pursuant to §39.10(C)(4) of the City Code, the City Council may in an extraordinary case, upon the
Mayor's recommendation and by two-thirds majority, approve the payment of water or sewer damage claims exceeding
$25,000.00 up to $50,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas, pursuant to § 39.10(C)(4) of the Fayetteville City
Code, authorizes Mayor Jordan to pay the amount of $33,347.65 to Lawrence Scheme] for Flooring, cabinets, sheetrock,

Staff recommends approval of a damage claim payment to Lawrence Schemel in the amount of $33,347.65 for
water damage remediation at 2143 West Loren Circle after a City sewer overflow caused damage to the
property.
BACKGROUND:
On November 21, 2022, the City of Fayetteville experienced a sewer overflow on Loren Circle. Lawrence
Schemel owns the home located at 2143 West Loren Circle. The sewer overflow caused water damage to the
property.
DISCUSSION:
Per City Code Section 39.10 — Water and Wastewater Damage Claims, "The Utilities Department Director may
not authorize any payment greater than $10,000.00 for any claim pursuant to this section. The Mayor may
request the City Council to authorize an amount greater than $10,000.00 by resolution, but in no case shall the
city pay more than $25,000.00 pursuant to this claims procedure for a damage claim related to a water or
wastewater utility infrastructure occurrence unless in an extraordinary case the Mayor recommends and the
City Council by two-thirds (%) majority approves an exemption from the $25,000.00 damage cap and approves
a payment up to $50,000.00."
Mr. Schemel's property received extensive damage due to the overflow, requiring the tenants to move out so
renovations can take place. The water damage occurred in the living room, kitchen, bedrooms and bathrooms
of the home. Floors, cabinets, sheetrock, and trim were damaged and will require repair and then painting.
Three competitive bids were obtained for repairs, with JM Roofing & Construction being the most economical
at $35,847.65. Mr. Schemel's insurance paid his limit of $2,500.00 toward the claim, leaving a total
reimbursement of $33,347.65. Staff requests approval to reimburse Lawrence Schemel in the amount of
$33,347.65 to pay for the necessary repairs.
BUDGET/STAFF IMPACT:
Funds are available in the Insurance Self (Non -Vehicle Damage) account within the Water & Sewer fund.

PARTIAL DENIAL OF COVERAGE AND PAYMENT EXPLANATION
Dear Policyholder:
This letter concerns the above -captioned claim ("Claim") with respect to Commercial Property Policy Number
02PRM084394-02 issued by Berkshire Hathaway Homestate Insurance Company (the "Company") for the period
of March 3, 2022 to March 3, 2023. For the reasons described below, a portion of the damages sought in the
Claim are not within the coverage afforded by the Policy.
We understand the material facts and circumstances regarding the Claim to be as follows: On November 22, 2022,
you reported a sewer backup at the above referenced property. During our phone conversation on that same date,
you stated that the City had been working on the sewer outside the property and caused a backup from all drains
in the house.
Local Independent Adjuster, John Hart with Signature Adjustment Group was assigned to assist with the
investigation and report on this claim. Mr. Hart's inspection found water damage consistent with the claim of a
backup from toilets and drains. Mitigation efforts had been completed prior to his inspection, and Mr. Hart
reported that the City confirmed that they had workers in the area and had an issue which caused backups in some
houses. The City had contacted ServiceMaster directly for mitigation, and ServiceMaster will be billing the City
directly.
We have reviewed the material facts and circumstances regarding the Claim with respect to the coverage afforded
by the Policy. The Building is insured subject to the Building And Personal Property Coverage Form CP0010
0607. This coverage form is subject to certain exclusions, limitations, and endorsements which modify the
coverage provided.

A. Covered Causes Of Loss

When Special is shown in the Declarations, Covered Causes of Loss means Risks Of Direct Physical Loss
unless the loss is:
1. Excluded in Section B., Exclusions; or
2. Limited in Section C., Limitation;
that follow.
B. Exclusions
1. We will not pay for loss or damage caused directly or indirectly by any of the following. Such loss or
damage is excluded regardless of any other cause or event that contributes concurrently or in any
sequence to the loss.
g. Water [... ] — see Water Exclusion Endorsement CP 1032 0808 below
The Policy includes the Water Exclusion Endorsement CP 10 32 08 08 which modifies the policy as it relates
to the Water Exclusion. This form reads in pertinent part:
A. The exclusion in Paragraph B. replaces the Water Exclusion in this Coverage Part or Policy.
B. Water
1. Flood, surface water, waves (including tidal wave and tsunami), tides, tidal water, overflow of any
body of water, or spray from any of these, all whether or not driven by wind (including storm surge);
2. Mudslide or mudflow;
3. Water that backs up or overflows or is otherwise discharged from a sewer, drain, sump, sump pump or
related equipment;
4. Water under the ground surface pressing on, or flowing or seeping through:
a. Foundations, walls, floors or paved surfaces;
b. Basements, whether paved or not; or
c. Doors, windows or other openings; or
5. Waterbome material carried or otherwise moved by any of the water referred to in Paragraph L, 3. or
4., or material carried or otherwise moved by mudslide or mudflow.
This exclusion applies regardless of whether any of the above, in Paragraphs 1. through 5., is caused by an act
of nature or is otherwise caused. An example of a situation to which this exclusion applies is the situation
where a dam, levee, seawall or other boundary or containment system fails in whole or in part, for any reason,
to contain the water.

But if any of the above, in Paragraphs 1. through 5., results in fire, explosion or sprinkler leakage, we will pay
for the loss or damage caused by that fire, explosion or sprinkler leakage (if sprinkler leakage is a Covered
Cause of Loss).
The Property Extensions, Form CPM 002 08 12 is part of your Policy.
Section II — The following modifications are made to the Causes of Loss — Special Form:
A. The following is added to SECTION F.
ADDITIONAL COVERAGE EXTENSIONS:
4. Sewer Back Up. We will pay for the loss or damage caused by or resulting from water that backs up
from a sewer or drain. We will not pay for the cost to repair any defect of a sewer or drain system from
which water backs up. The most we will pay is $2,500 during the policy period, subject to a $2,500 limit
in any one occurrence. This amount is subject to the deductible applicable in this endorsement.
SECTION III —The following provisions are applicable to all coverage modifications made by this endorsement
unless a modification expressly states otherwise.
A. Excess Insurance
The extended coverage provided by this endorsement is excess over any other valid and collectible insurance.
B. Deductible
One deductible of $500 applies to all coverage extensions on this endorsement unless specifically indicated
otherwise on this endorsement.
We will not pay for loss or damage in any one occurrence until the amount of loss exceeds $500. We will then
pay the amount of loss in excess of the deductible up to the limit stated in that particular coverage extension.
This $500 deductible is in addition to the deductible shown in the Declarations. This deductible will not be
used to satisfy the requirements of the deductible shown in the Declarations.
If one occurrence causes losses covered by more than one of the coverage extensions under this endorsement,
only one deductible will apply to the coverage extensions under this endorsement. The deductible that will
apply is the highest deductible under any one of the coverage extensions, with a maximum deductible of
$1,000.
Based on the information developed in the investigation, a portion of the Claim, as presently articulated, does not
implicate the coverage afforded by the Policy. Specifically, the Policy states we will not pay for loss or damage
caused directly or indirectly by surface water, water that backs up or overflows or is otherwise discharged from a
sewer, drain, sump, sump pump or related equipment, and or water under the ground surface pressing on, or
flowing or seeping through foundations, walls, floors, or paved surfaces; basements, whether paved or not; or
doors, windows or other openings. Such loss or damage is excluded regardless of any other cause or event that
contributes concurrently or in any sequence to the loss. You made a claim for a water damage resulting from a
sewer backup at the above referenced property. The Independent Adjuster confirmed damage consistent with a
sewer backup as well as confirmed with the City that they had workers in the area and had an issue which caused
backups in some houses. As the water damage is a result of water backing up from a sewer / drain, the Policy
does not apply.
However, the Policy also includes Property Extensions which states we will pay for the loss or damage caused by
or resulting from water that is discharged from a sewer or drain. We will not pay for the cost to repair any defect
of a sewer or drain system from which water backs up. The most we will pay is $2,500 during the policy period,
subject to a $2,500 limit in any one occurrence. This amount is subject to the additional deductible applicable in

this endorsement which provides this additional extended coverage. You submitted a claim for damages resulting
from a sewer backup through the drains in your house. The Independent Adjuster's inspection confirmed the
damage was the result of water backing up from drains at the property. Therefore, via the Property Extensions
portion of the Policy, which is subject to an additional $500 deductible above your normal Policy deductible, we
will provide limited coverage for the resulting damage from a sewer or drain back up per the Policy language.
The Policy does not apply to any costs over this $2,500 limited coverage.
Enclosed is our payment in the amount of $2,500.00, representing payment for the policy limit for a loss due to a
sewer or drain backup. A copy of the Independent Adjusters estimate is included for your reference.
Please note that all parties listed on the check must endorse the back of the check before the funds will be released.
This letter is intended to provide an explanation of The Company's determination with respect to the coverage
for the Claim under the Policy. Other Policy terms, conditions, exclusions, or limitations may apply to the Claim
but are not set forth herein.
The Company reserves its rights with respect to such terms, conditions, exclusions, or limitations and their
absence from this letter is not a waiver or modifications thereof. Furthermore, The Company specifically reserves
the rights to seek and obtain a declaration regarding the absence of coverage and to amend this communication.
This letter is based upon the facts and information regarding the Claim, as we presently understand them. In the
event you have additional facts or information you contend support a contrary conclusion, or in the event new
facts or information regarding the Claim becomes available, please provide such facts or information to us
immediately and we will consider them as quickly as possible.
This letter is subject in all respects to the Policy and no term or provision thereof is or is intended to be waived
or otherwise modified in any respect.
We welcome the opportunity to speak with you regarding our determination as described in this letter. Please do
