D/B/A FRIENDS OF YVONNE RICHARDSON COMMUNITY CENTER TO CLARIFY THE RESPONSIBILITIES OF EACH ENTITY BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to sign a Memorandum of Understanding with the Southeast Fayetteville Community Center, Inc. d/b/a Friends of Yvonne Richardson Community Center, to clarify the responsibilities of each entity with respect to operations, programming, and other matters at the Yvonne Richardson Community Center. BACKGROUND: The Friends of YRCC was established in 1995 to serve as an advisory board to the Yvonne Richardson Community Center. Their mission is "Provide support to underserved families of Fayetteville. This support includes social, educational, and recreational programming in hopes of providing life lessons and skills to develop leaders who, in turn, invest in their communities in the future." Parks, Natural Resources and Cultural Affairs staff works closely with the Friends of YRCC board to achieve this mission and is very thankful for their contributions to support underserved families in Fayetteville. Friends of YRCC have donated over $130,000 to the City for this cause over the past ten years. DISCUSSION: The purpose of this Memorandum of Understanding is to outline the responsibilities of each entity, recognizing the City owns and staffs the YRCC and is responsible for the general provision of services to all residents of Fayetteville while Friends of YRCC is focused on ensuring programming is accessible and available to underserved families. NOW, THEREFORE, THIS MEMORANDUM OF UNDERSTANDING is made by and between the City of Fayetteville, Arkansas ("City") and Southeast Fayetteville Community Center, Inc. d/b/a Friends of YRCC ("Friends") and the parties agree as follows: Purpose. The purpose of this document is to outline the responsibilities of each party recognizing that the City owns and staffs the Yvonne Richardson Community Center ("YRCC") and is responsible for the general provision of services to all residents of the City of Fayetteville while Friends is focused on expanding these services to underserved families and individuals in our community. Underserved families and individuals include those: 1) living in subsidized housing in the City of Fayetteville; 2) identified by school counselors to the board or staff as needing access to YRCC services; or 3) are in the Extremely Low, Very Low, or Low categories of the Annual CDBG / HUD Income Guidelines. 2. Term. The term of this Agreement shall begin January 1, 2023 and shall end December 31, 2023. The Agreement shall renew automatically unless either party provides notice in writing at least 60 days prior to the end of the term that it does not wish to renew. 3. General Recreation a. As the City provides recreational services for City residents at the YRCC: i. Friends will provide to the City funding to support program participants from the underserved community, to include all program expenses, during the annual program donation request process, or as new program opportunities arise. ii. City will identify the number of registrations allocated for underserved participants for each City program and submit an annual program donation request to be reflective of those numbers. b. With respect to programs developed by Friends specifically for underserved individuals and families: i. Friends will: • Notify the City 60-90 days in advance of the proposed program (depending on scope/scale of program) and include any transportation request associated with hosting the program. Friends shall follow the City's standard reservation policies for all programs requiring use of the YRCC facilities. • Pay all the costs of the program including program staffing, materials, and transportation. • Pay the cost of YRCC staff for programming taking place outside of the YRCC's regular hours. • Help with any marketing needed for the program, specifically to underserved populations identified by Friends. • Return the YRCC to the same condition they found the facility. • Report and pay for any damage to the YRCC as a result of the program. • Provide a report of the program to the City at its completion. ii. The City will • Perform background checks as needed for any facilitators, volunteers, or instructors • Open the YRCC for the program at least 30 minutes before or longer as agreed by program staff and the YRCC. • Allow the use of the YRCC with rental fees waived. • Assist with marketing, such as flyer creation and email distribution to YRCC databases. • Immediately report to Friends any issues or damage within the facility post -usage as determined by YRCC staff. 4. Transportation a. Friends will i. Provide the City with funding, through the annual program donation request process, to pay for any transportation services required for programs. ii. Provide a detailed transportation request for Friends -hosted programs taking place at the YRCC. b. The City will i. Hire and coordinate transportation services for programs if such services cannot be adequately provided by existing YRCC staff and YRCC or City fleet vans. i. Perform background check for drivers. ii. Confirm insurance coverage by service provider. ii. Provide the YRCC van to be used for programs when available. iii. Be responsible for maintenance and storage of the YRCC van. The City will pay the gas for the YRCC van c. Additional transportation needs, based on individual programs offered, can be coordinated on a case by case basis. 5. General Operations. a. The Mayor of the City of Fayetteville shall have the right to appoint two members to the Friends of YRCC Board of Directors. b. Friends shall be primarily responsible for raising funds that will be used pursuant to this Agreement to support programming for underserved communities. This responsibility includes, but is not limited to: i. Pursuing grants opportunities. ii. Hosting at least one fundraising event per year. iii. The City will seek additional funding through grant opportunities, donations, and general operational support through the annual budget process. 6. Contract Amendments. Changes, modifications or amendments to the scope of this Agreement shall not be allowed without a prior formal amendment approved by the City and by the authorized agent of Friends of YRCC in advance of the change.
