BACKGROUND: The Fayetteville Fire Department is currently in the process of reviewing policies and updating as necessary to make changes as recommended and to meet best practices while working through the CFAI accreditation process. DISCUSSION: These changes are part of Fayetteville Fire Policy AOP-124 On Call Policy. These changes include wording and formatting to aid in the process for maintaining and modifying policies and procedures and to adjust on -call pay amounts. The per day amount will be equivalent to the hourly rate of pay for the market median point pay range halfway between the Step A Firefighter and Step J Battalion Chief. This amount equals $33.38. The current on -call rate is $18.93 per day. This equals $14.45 more per day for a total amount of $5,274.25 BUDGET/STAFF IMPACT: The Budget Impact with these Policy Changes is as follows: Changing the per day on -call amount will be equal to $14.45 more per day (365 x$14.45) for a total of $5,274.25 out of 3010 Fire Prevention Salaries. A Budget Adjustment of $5,300 is submitted for approval moving funds to allow for this expense increase. Procedure The Fire Chief or his/her designee is responsible for determining periods when Employees are needed for "on call" status. • The shift commander on duty or his/her designee is responsible for assigning "on call" duties to Employees on a rotating basis and documenting on the daily shift report "on call" status. • The Fire Marshal is responsible for his/her Division Employees in the same manner. o An "on call" response is defined as one that occurs on the Employee's personal time, whether athome or otherwise away from his or her place of work. o The Department of Labor defines "on call" as the following: 29 CFR § 785.17 On -call time: An Employee who is not required to remain on the employer's premises but is merely required to leave word at his home or with company officials where he may be reached is not working while on call. • Employees who are designated as "on call" must: o Answer 100% of the calls directed to them o Respond to the call in proper call duty attire as defined by the Division Head FAYETTEVILLE FIRE DEPARTMENT Administrative Operating Procedures On -Call Policy o Be prepared and ready to work and be in a "fit for duty" condition as defined in this policy ■ Any "on call" Employee who fails to answer or respond to any call back will be subject todisciplinary action up to and including termination. • Any "on call" Employees who are called out must check in with the shift commander on duty, incident commander, or station watchman. • An Employee who is absent from work for his/her entire regularly scheduled shift is not eligible to be"on call" and receive call duty pay, unless otherwise approved by the Division Head. • Division Heads or their designee are to complete and maintain a file of current "on call" status Memorandum of Understanding with each Employee subject to "on call" duty. • For an Employee who responds to a call while on "on call" duty ,overtime pay starts when the Employee begins traveling or performing other work in preparation to respond to the call and ends when the job is completed or when they have been released by a supervisor and they return to the point of origin or their home.
