HomeMy WebLinkAboutOrdinance 6633113 West Mountain Street Fayetteville, AR 72701 (479) 575-8323 Ordinance: 6633 File Number: 2022-266 AMEND §51.136 MONTHLY WATER RATES & §51.137 MONTHLY SEWER RATES: AN ORDINANCE TO AMEND § 51.136(A)(2), § 51.136(B)(2), § 51.136(C)(2), § 51.137(A)(2), § 51.137(B)(2), AND § 51.137(E)(3) OF THE FAYETTEVILLE CITY CODE TO DEFER WATER AND SEWER RATE INCREASES FOR 2023 UNTIL AFTER THE ADOPTION OF A NEW RATE STUDY, AND TO DECLARE AN EMERGENCY WHEREAS, various provisions within § 51.136 Monthly Water Rates and § 51.137 Monthly Sewer Rates provide for an automatic 3% cost increase in water and sewer rates and service charges at the beginning of each year; and WHEREAS, the new Water and Sewer Rate Study which is being conducted by Black and Veatch consultants is expected to be brought before the City Council in the Spring of 2023; and WHEREAS, to avoid the potential of snaking two financial adjustments on utility system water and sewer customers within a few months staff recommends that the City Council defer the annual 3% cost adjustment that would take effect in January 2023 until the Black and Veatch rate study. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends §51.136(A)(2), § 51.136(B)(2), § 51.136(C)(2), § 51.137(A)(2), § 51.137(B)(2), and § 51.137(E)(3) by adding the following sentence to the end of each subsection as follows: "No rate or service charge adjustment shall occur in 2023 until after the completion of a new rate study." Section 2: That the City Council of the City of Fayetteville, Arkansas hereby determines that this ordinance should become effective without delay because of the potential burden rate increases could place on the City's water and sewer customers and to avoid water cutoffs that could occur as a result of rate increases, which is necessary for the public peace as well as the health and safety of Fayetteville residents. Therefore, the City Council hereby declares an emergency exists such that this ordinance shall become effective immediately upon its passage and approval. The City Administration, through the Water and Sewer Committee, is currently working on a new Water and Sewer Rate Study which is being conducted by Black and Veatch consultants. DISCUSSION: Although the rate study has not yet been finalized, it is anticipated that recommendations will be brought to the City Council in the spring of 2023 for consideration. The automatic annual increase and rate study recommendations would result in two separate rate changes in a short time period on City utility system water and sewer customers. Therefore, to avoid confusion and multiple financial adjustments, it is recommended that the annual 3% cost adjustment for January 2023 be waived. Water and Sewer rates would then be changed later in 2023 in accordance with the new study as adopted by the City Council. BUDGET/STAFF IMPACT: This request would maintain water and sewer revenue at current levels in 2023 until new water and sewer rates are adopted and become effective.
