City Council This is in reference to October 4, 2022 agenda item C.2 2022-0878 as it relates to type two short term rentals. I am the owner of one-half of a duplex located at 1606 Linda Jo. Linda Jo is approximately 2 blocks in length with a cul-de-sac on each end. Houston Street bisects Linda Jo and provides access to Porter Road. The area is composed of small duplexes zoned RMF-24. Both Linda Jo and Houston are narrow and there are no sidewalks. A number of the duplexes are owned by Life Styles, a not for profit which profits assistance to disabled adults. Other duplexes are owned by the parents of Life Styles clients. My adult son with Down syndrome has lived at 1606 Linda Jo for over five years. There are currently two applications for conditional use permits for short term rentals in the area. One is one half of a duplex located on Linda Jo and the other is one half of a duplex located on Houston near Linda Jo. One of the applications was heard at the Planning Commission meeting on September 26, 2022. The Director of Life Styles, John Newman, another parent of a Life Styles client and I spoke in opposition to the conditional use permit. The other is scheduled to be heard on October 10, 2022. The first application was denied by a unanimous vote of the Planning Commission as being a non-compatible use. It is requested the City Council give strong consideration to permitting residential areas to make application for exclusion from use for type 2 rentals. As the Planning Commission found, the nature of the Linda Jo residential area is unsuited for short term rentals. This is based on the lack of on street parking and limited off street parking and the narrow streets and lack of sidewalks which make difficult to walk if there is a lot of traffic. The nature of the residents should be taken into consideration. Many of the residents cannot report inappropriate behavior and cannot easily avoid traffic. If the City Council gives a specific length of time and procedure in which residents can seek to have their residential areas excluded from type -2 short term rentals it can prevent irreversible damage to property values and the lives of the residents. I have resided in gated communities with HOA’s which have the ability to prohibit short term rentals. However, most residents have relied on the zoning codes which were created prior to the advent of the short term rental market. As with the two rentals in the Linda Jo area, these are properties rented, not as a place to live and become a part of a neighborhood, but rather as a place for visitors who have no interest in the surrounding area. There is no one on site to supervise the renters activities as in a hotel or motel. Unlike the owners of property in communities governed by HOA’s, the residents of Fayetteville have only the City Zoning Codes to look to for protection. I am sure you will take this responsibility seriously and create a code requirement which ensure the quiet enjoyment of all residential property for the citizens of Fayetteville.
