NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a payment of $48,511.28 to the Arkansas Department of Transportation for the construction of a side path along Wedington Drive at the Interstate 49 intersection, as shown on the plans attached to this Resolution. BACKGROUND: The City has worked with the Arkansas Department of Transportation (ARDOT) over the past 6 years to include a side path with the improvements to the 1-49 and Wedington Intersection as shown on the Active Transportation Plan. In 2017, the City was awarded a Transportation Alternatives Program grant in the amount of $332,000 to fund the costs directly associated with widening the new bridge over 1-49 to accommodate the side path. In May of 2021, the City agreed to pay $199,940 to ARDOT by resolution 137-21 for the cost to widen 5-foot-wide sidewalks to a 10-foot-wide trail extending out from the bridge over 1-49 west to Steamboat Dr. and east to the north bound 1-49 on Ramp. During the April 27th, 2021 Transportation Committee review, a recommendation was made to extend the 10 foot side path farther east to Futrall Drive. DISCUSSION: Contingency in the amount of $40,000 was included in resolution 137-21 to be applied to the the extension of the side path to Futrall Dr. Costs for extending the side path recently provided ARDOT are $48,511.28. This amount exceeds the contingency and requires the additional funds be approved by City Council for payment to ARDOT. BUDGET/STAFF IMPACT: Funding in the amount of $48,511.28 has been allocated through the 2019 trails bond program for the side path along Wedington Drive and includes the previously allocated $40,000 for contingency.
