WHEREAS, pursuant to the §39.10(C)(4) of the City Code (as just amended), the City Council must
approve the payment of water or sewer damage claims exceeding $10,000.00 and also caps payments
at $50,000.00, with any payments above $25,000.00 requiring a 2/3 vote of the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas, pursuant to § 39.10(C)(4) of the
Fayetteville City Code, authorizes Mayor Jordan to pay a total amount of $23,749.14 to Christopher
Alderson for sewer overflow damage at 727 North Rockcliff Road.

SUBJECT: Sewer Damage Claim — 727 N. Rockcliff Rd. (Christopher Alderson)
RECOMMENDATION:
Staff recommends approval of a payment to Christopher Alderson in the amount of $23,749.14
for a sewer damage claim for the residence located at 727 North Rockcliff Road.
BACKGROUND:
On May 5, 2022, there was a sewer overflow at 727 N. Rockcliff resulting in Mr. Alderson's
finished basement being flooded. Originally, he called Restoration 1 of NWA to begin
remediation but they were unable to complete the job.
DISCUSSION:
Mr. Alderson paid Restoration 1 of NWA in the amount of $1,200.00 for their work that was
completed. Mr. Alderson and his family spent three days in a hotel while their home was being
cleaned, which totaled up to $534.70.
Mr. Alderson's insurance will pay $5,000.00 toward damages, which has been subtracted from
the total claim. A repair estimate has been obtained from NW Restoration in the amount of
$27,014.44, this was the only company who responded with an estimate. This work will include
drywall and trim repair, floor and carpet replacement, cabinet replacement, and painting.
Staff recommends paying the Christopher Alderson in the amount of $23,749.14 to reimburse
him for the initial restoration work, hotel expenses, and the renovation of his residence.
BUDGET/STAFF IMPACT:
Funds are available in the Self Insurance (Non -Vehicle Damage) account within the Water &
Sewer fund.
