AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND ACCEPT A QUOTE IN THE
AMOUNT OF $150,671.03 PLUS APPLICABLE TAXES AND FREIGHT CHARGES FROM
J.A. RIGGS TRACTOR COMPANY D/B/A RIGGS RENTAL SERVICES FOR THE
EMERGENCY RENTAL OF A 2,000 KILOWATT GENERATOR FOR THE NOLAND WATER
RESOURCE RECOVERY FACILITY, AND TO APPROVE A PROJECT CONTINGENCY IN
THE AMOUNT OF $30,134.21
WHEREAS, on July 8, 2022, the 2,000kw generator at the Noland Water Resource Recovery
Facility failed; and
WHEREAS, the facility cannot operate without a generator due to load shedding requirements and a
rental generator was procured on July 9, 2022 from J.A. Riggs Tractor Company d/b/a Riggs Rental
Services to temporarily replace the failed generator; and
WHEREAS, Riggs Rental Services, which is the region's sole certified Caterpillar distributor and
maintenance provider for our area, provided a quote in the amount of $150,671.03 which will secure
the rental generator for up to four months while the failed generator is rebuilt.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and accepts the quote of $150,671.03
(plus any applicable taxes and freight charges) from J.A. Riggs Tractor Company d/b/a Riggs Rental

Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional
situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the
requirements of formal competitive bidding and accepts the quote of $150,671.03 (plus any applicable taxes
and freight charges) from J.A. Riggs Tractor Company d/b/a Riggs Rental Services for the rental of a 2,000kw
generator for the Noland Water Resource Recovery Facility, and further approves a project contingency in the
amount of $30,134.21.

SUBJECT: Riggs Rental Services — Rental of 2,000kW Generator for Noland WRRF
RECOMMENDATION:
Staff recommends approval of a generator rental from J.A. Riggs Tractor Company d/b/a Riggs
Rental Services in the amount of $150,671.03 plus applicable taxes to rent a 2,000kW
generator for the Noland Water Resource Recovery Facility, and to approve a contingency in
the amount of $30,134.21.
BACKGROUND:
On July 8, 2022, the 2,000kW generator at the Noland Water Resource Recovery Facility failed.
The engine's wet sleeve cylinder inserts failed, which introduced engine coolant into the
crankcase. The engine and generator will need to be rebuilt. The facility can not operate without
a generator due to load shedding requirements, so a rental generator is required for this
emergency.
DISCUSSION:
A rental generator was procured on July 9, 2022, and was set up that day to temporarily replace
the failed generator. Riggs Rental Services provided a quote in the amount of $150,671.03
which will secure the rental generator for up to four months while the failed generator is rebuilt.
Riggs is the only authorized and certified Caterpillar distributor and maintenance provider for our
area. If the generator rebuild does not take four months, Riggs will only invoice for the number
of weeks the City actually uses the rental generator.
The City was required to have a generator within one day and Riggs is the only company with a
generator of that size that could deploy in one day because it was available locally. Additionally,
Riggs was already on site diagnosing the failed generator and confirmed that the rental
generator was available for immediate/emergency deployment and they are the only certified
and authorized local vendor of Caterpillar which is the brand of the failed generator.
If the City didn't get the rental generator online in time, we would not be available to load shed
when required by Ozark Electric. The fine is $250,000.00 dollar per occurrence. At a peak time
on a peak day per month, we are required to take our load off the grid to prevent overloading
Ozark Electric's system that could potentially cause black outs.

Another reason for such urgency with a Noland backup generator is with our holding pond. We
can only store 3 days in our influent pond. After that, we would overflow into the White River
causing a permit violation from the state.
BUDGET/STAFF IMPACT:
Funds are available in the WWTP Building Improvements account within the Water & Sewer
fund.

RECOMMENDATION:
Approval to use contingency funds in the amount of $40,000.00 to pay for additional rental
expenses from J.A. Riggs Tractor Company for the 2,000 kilowatt generator for the Noland
Water Resource Recovery Facility.
BACKGROUND:
On July 8, 2022, the 2,000kw generator at the Noland Water Resource Recovery Facility failed.
The facility cannot operate without a generator due to load shedding requirements and a rental
generator was procured on July 9, 2022 from J.A. Riggs Tractor Company d/b/a Riggs Rental
Services to temporarily replace the failed generator.
Riggs Rental Services, which is the region's sole certified Caterpillar distributor and
maintenance provider for our area, provided a quote in the amount of $150,671.03 which
secured the rental generator for up to four months while the failed generator is rebuilt.
Ordinance 6641 waived competitive bidding and approved the generator rental, and included a
contingency in the amount of $40,000.00. The failed generator is currently being rebuilt by
Riggs, and the rental generator is still in operation.
DISCUSSION:
Riggs has built and tested the generator, and during the load bank test the oil pressure was not
within normal range. Riggs has disassembled portions of the generator to figure out the cause
and they are in the process of reassembling it. Staff requests approval of the use of contingency
funds in the amount of $40,000.00 to pay rental invoices that will come up due soon.
BUDGET/STAFF IMPACT:
Funds are available in the WWTP Building Improvements account within the Water & Sewer
Fund.

WHEREAS, on August 2, 2022, the City Council passed Ordinance 6591 approving a quote from J.A. Riggs Tractor
Company d/b/a Riggs Rental Services for the Emergency Rental of a 2,000 Kilowatt Generator; and
WHEREAS, it is estimated that the City will need continue to rent the generator through the end of February while the
main generator is being rebuilt by Riggs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends Ordinance 6591 and approves an
extension of the rental of a 2,000 kilowatt generator from J.A. Riggs Tractor Company d/b/a Riggs Rental Services in
the amount of $147,472.12 for use at the Noland Water Resource Recovery Facility through the end of February 2023,
and further approves a project contingency in the amount of $40,000.00.
