I'm the Brookbury Communications Chair. Robert Rhoads has been speaking for our neighborhood to the City Council and he also was the neighbor who reached out recently to communicate to Mr Bearden on our behalf and others concerned about this area. The Brookbury POA would like to ask the City Council to please deny Mr Bearden's RZN request due to the maximum number of homes in that area that can be built under the RSF-4 zoning using a cluster housing development and due to Mr Rhodes recent conversation with Mr Bearden. I have also pasted at the bottom of this email thread our correspondence to Mr Bearden in July and June. Also, I had communicated the wrong address to my neighbors so you may have gotten comments that referenced the address incorrectly. Meggan Bell From: Robert K. Rhoads <rrhoads@hallestill.com> Date: Mon, Aug 1, 2022 at 6:42 PM Subject: RE: Rezoning of 3160 Skillern Road This evening I talked with the developer from Fort Smith, Mr. Bearden, pleading with him to offer a Bill of Assurance to limit the density of his RSF-4 by any little bit on behalf of his future neighbors measuring over 100 homes ( Brookbury by itself has 97) in order to assuage their concerns over traffic safety, flooding, lack of connectivity (12 lots in a cul de sac), general incompatibility, etc. He kept on saying that he publically said all he was going to say. Finally, I asked to give me a yes or no to our request and he wouldn’t… just that publically he said all he was going to say. I can only presume that his careful use of the words I “intend’ to just have two homes there is to give him room to change his intentions or sell it to someone who maxes out the density. Please deny his RZN request. Per discussion with Mr. Jonathan Curth, Senior Services Director for the City of Fayetteville, the neighbors would feel much better with a Bill of Assurance which would state that your plan for the entire property will not exceed 4 homes. The Brookbury Neighborhood would appreciate your consideration to work with Mr. Curth to add a Bill of Assurance to your rezoning request. 2 If you would like to discuss this further, please call me at 479-422-6548. It was further confirmed with Mr. Umberger that a change in zoning would not require additional approval from the Planning Committee. As that the rezoning to RSF-4 has been approved, an amendment to RSF-2 would only need to be communicated to the Committee before the Agenda Item is brought before City Council on July 5th. > If you believe RSF-2 zoning would suffice for your plans for the Skillern Property, the Brookbury Neighborhood would appreciate your consideration to amend your rezoning request. We have experienced significant flooding and increased traffic flow in recent years.
