Dear Mayor & Council (via City Clerk):
Thank you to Council Members Hertzberg and Bunch for their proposal to promote the adoption of animals we already
have and to prevent our community from becoming an additional dumping ground for profiteering puppy-mills. In
addition to the plight of the animals, the stories of heartache and financial ruin when for-profit pet stores use predatory

lending to sell sick animals is worth keeping out of a college down. In reading the proposal, I noticed to technical issues
that I would like to raise. I hope in discussion tonight, you would be amenable to considering/proposing an amendment
to the proposed language to address these concerns:
1. Section 1 specifically addresses the Fayetteville Animal Shelter which might accidentally preclude the Washington
County Animal Shelter or neighboring municipalities from offering their animals for adoption in Fayetteville pet
stores. There is an existing inclusive definition of "animal shelters" in 92.01 that should work nicely.
2. There is no definition for an "animal rescue organization" in the current code. This might allow a pet store to list
some less-than-reputable organization in meeting the requirements of the last line of Section 1. I have prepared a
definition for "Animal rescue organization" that could be added to 92.01 to ensure they're using only animal welfare
organizations.
I have prepared a draft of how I would address those issues and attached it here for your use. I'm sure the City
Attorney's office could provide any fine polish that's needed.
This is important work and I support your efforts wholeheartedly!
