ADJUSTMENT
WHEREAS, on June 19, 2018, the City Council approved a contract with Nelson Byrd Woltz, LLC,
to provide landscape architecture services for the design of the Cultural Arts Corridor; and
WHEREAS, change orders were previously approved to allow the landscape architect to proceed
with Phase 2: Design Development, Construction Drawings, and Bidding Services; Phase 3:
Construction Documentation, Bidding, and Negotiation; and Phase 4: Construction Administration; and
WHEREAS, Change Order No. 6 will provide professional landscape architecture services for the
completion of Construction Documentation, construction administration for the streetscapes in the
Upper Ramble, as well as water and sewer replacement and additional construction administration for
the Lower Ramble in the Cultural Arts Corridor.
NOW, THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a loan of
$988,070.00 from the General Fund to the Arts Corridor 2022 Bond Fund to be reimbursed when the
bonds are issued.
Section 3: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget
adjustment, a copy of which is attached to this Resolution.

SUBJECT: Resolution authorizing a Change Order to contract with Nelson Byrd
Woltz in the amount of $999,510 to provide professional landscape
architecture services for construction documentation and construction
administration for the Upper Ramble, to approve a loan of $988,070 from
the General Fund to the Arts Corridor 2022 Bond Fund to be reimbursed
when issued, and to approve a budget adjustment.
RECOMMENDATION:
Staff recommends approval of a Change Order to contract with Nelson Byrd Woltz in the
amount of $999,510 to provide professional landscape architecture services for construction
documentation and construction administration for the Upper Ramble, to approve a loan of
$988,070 from the General Fund to the Arts Corridor 2022 Bond Fund to be reimbursed when
issued, and to approve a budget adjustment.
BACKGROUND:
The Ramble/Cultural Arts Corridor is a downtown revitalization project to activate a 50-acre
outdoor public space and create a destination and attractions to draw residents and visitors to
the city's urban core. Linking the city's key cultural institutions —including the Walton Arts
Center, TheatreSquared, Nadine Baum Studios, Fayetteville Public Library, and the University
of Arkansas' Art and Design District —the corridor will showcase and celebrate the local arts
culture, enhance public space downtown, and serve as a catalyst for additional development
and density in the area, increasing bike trails and connections, and improving streets and
walkability.
Schematic design for this portion of the Ramble focused on the West Avenue civic space was
completed in January 2019, following a series of public design charettes. The design chosen by
participants who engaged in the process consists of a gathering and event lawn, public plaza,
garden spaces, and a civic promenade.

Construction on the Lower Ramble in the Fay Jones Woods and along the southern portions of
West Avenue and the Razorback Greenway began in September 2020 and will be completed in
the Summer of 2022. Construction on replacement parking deck in the Upper Ramble began in
January 2022. The replacement parking deck must be complete prior to the start of substantial
construction on the Civic Plaza portion of the Upper Ramble. An early package of design work
on the Upper Ramble that including work along the Razorback Greenway, West Ave and
Dickson Street began in the fall of 2021.
DISCUSSION:
The scope of work and fees proposed in this change order are for the remaining work on the
the Ramble project, including:
1) Construction Documents & Construction Administration for the Upper Ramble - Civic
Plaza in the space that is currently occupied by the West Ave Parking Lot:
2) Construction Administration for the Streetscapes (Early Package) in the Upper Ramble

BUDGET/STAFF IMPACT:
The maximum not -to -exceed amount authorized for this change order is $999,510. Funding for
the work will come from the Arts Corridor 2022 Bond Fund and the Water & Sewer Fund.

Construction Administration
The following scope of work and fees are for design services for Areas A and B as outlined in Basic
Services below. The Schematic Design, including its illustrative package and estimated construction
cost, served as the basis for inclusion in a bond referendum administered by the City of Fayetteville (the
"City") to fund the proposed improvements. This bond referendum was passed by City voters on April 9,
2019.
Basic Services
The following proposal is intended to clearly describe the scope elements provided by NBW and those
that will be provided by sub -consultants. As prime consultant, NBW will coordinate all sub -consultants
and collect and submit design packages and billing directly to the City.
The team of sub -consultants includes the following:

• Coordinate drawings with full sub -consultant team.
• Finalize materials palette for all landscape elements in coordination with Client.
• Coordinate with South and North Developers on establishing finish floor elevations and ground plane
material transitions for 50% CDs.
• Facilitate and review construction specifications to accompany 50% CDs, 90% CDs, and 100% CDs
(by Rico Associates).
• Meet with team and construction manager ("CM") to review 50% and 90% CDs.

• Participate in site visits and construction meetings with contractors and the Client representatives per

• Provide punchlists at substantial completion and final acceptance/project closeout
• Attend construction meetings in person that coincide with site visits
• Attend all other construction meetings via web-conference/phone call as appropriate

Meetings
• Attend virtual pre -construction meeting
• Attend bi-weekly virtual OAC meetings
Assumptions
• NBW assumes that all base materials including a current survey of the project site shall be provided by
the client prior to start of work.
Additional Services
If any of the following Services are required due to circumstances beyond the Landscape Architect's
control, the Landscape Architect shall notify the Client. No Additional Services will be performed until
receipt of written authorization from the Client. If the Client deems that such Services are not required,
the Client shall give prompt written notice to the Landscape Architect and the Landscape Architect shall
have no obligation to provide such Services. Authorized Additional Services shall be paid for in
accordance with the attached schedule of hourly rates.
• Providing Services required because of changes to the Project Scope.
• Providing Services in connection with a public hearing, administrative hearing, arbitration proceeding
or legal proceeding to which the Landscape Architect is not a party.
• Providing "project management" services to assist the Client in performing its obligations to other
people or entities in connection with the Project.
• Civic Space geotechnical services are not included in this proposal. Per client direction, the design
team will reference the 2012 Geotech investigation for parking deck feasibility - 5 borings total.
Additional Geotech borings will be considered as additional services.
• Substantial changes to South and North Development layouts or elevations after 50% CD submission
will be considered as additional services.
• Additional CD submissions related to early bid packages which are not described the NBW CD scope
of work will be considered as additional services.

Flintlock, LTD - Local Landscape Architect
I. Area B Civic Space
Construction Documents
Scope
• Provide ongoing design review and critique of overall design
• Support the team with logistical support, meeting space, and attend internal design meetings during
NBW visits.
• Participate in twelve (12) coordination and design digital design meetings with North and South
Building Developers, fire marshal, and City
• Design scope duration of 5.5 months, beginning in May 2022
• Attend and participate in twelve (12) bi-weekly team digital meetings , led by NBW
• Attend and participate in necessary meetings that may arise during the construction document
development (i.e. w/ material suppliers, city officials, project construction manager), not to exceed six

• Provide full drawing review (in .dwg format) at key milestones (50%, 90%, 100%). Olsson and NBW to
lead document production.
Bidding and Negotiation
Scope
• Provide support to NBW in navigating the Bidding and Negotiation process with City.
• Attend and participate in three (3) weekly team digital meetings, led by NBW
• Attend and participate in two (2) bi-weekly OAC digital meetings, led by Nabholtz
Construction Administration
Scope
• Provide on site Construction Administration support to NBW for a 9 month construction period
• Attend a NBW led Pre -Construction meeting for Upper Ramble with contractor and all key
subcontractor personnel in attendance. Assist with organizing in -person meeting site location and
meeting provisions.
• Serve as on -going liaison with property owners as requested by the City
• Attend a maximum of thirty-two (32) on -site OAC meeting (organized and led by Construction
Manager) and site visits to monitor progress and observe the quality of the work. NBW to attend and
lead meeting. Written reports of site visits and meeting minutes to be provided by Construction
Manager.
• Attend a maximum of thirty-two (32) site walks with contractor as requested to review and comment on
installation of streetscapes work or assist in resolution of issues in the field.

• Notify NBW and the City of any work that does not conform with the construction documents.
Review construction materials testing, on site mockups, materials samples, submittals, and
construction records (RFIs, ASIs, Cos, etc.) related to the streetscapes. Review these materials in

• Provide described CA services for a maximum of nine (9) months of construction Upper Ramble
II. Area B Streetscapes (Early Package)
Construction Administration
Scope
• Attend a NBW led Pre -Construction meeting for Phase 2 with contractor and all key subcontractor
personnel in attendance. Assist with organizing in -person meeting site location and meeting
provisions.
• Attend a NBW led Pre -Construction meeting for Fay Jones Woods with contractor and all key
subcontractor personnel in attendance. Assist with organizing in -person meeting site location and
meeting provisions.
• Organize and lead individual block pre -construction meetings with property owners, contractor, and
City to review schedule, temporary property access, working hours, construction easements, tree
protection, and project contacts
• Serve as on -going liaison with property owners as requested by the City
• Attend a maximum of thirty (30) bi-weekly on -site OAC meeting (organized and led by Construction
Manager) and site visit to monitor progress and observe the quality of the work. NBW to attend and
lead meeting once per month. Written reports of site visits and meeting minutes to be provided by
Construction Manager.
• Attend a maximum of thirty (30) site walks with contractor as requested to review and comment on
installation of streetscapes work or assist in resolution of issues in the field.
• Notify NBW and the City of any work that does not conform with the construction documents.

Olsson Associates - Civil, Soils, Surveying, Structural
I. Area B Civic Space
Construction Documents
Scope
• Civil Design Services - Finalize layout and grading with NBW coordination. Plans will be in Civil 3D
AutoCAD format, latest edition. Preliminary layout drawings to be provided by NBW. Significant
redesign of drawings provided by NBW or NBW's subconsultants after 50% CD submittal shall be
additional services and shall be billed at Olsson's standard hourly rate.
• Civil Design Services - Provide (1) Preliminary Existing Conditions Plan, (1) Demolition Plans, (2)
Grading Plans, (2) Utility Plans, (2) Drainage plans, (1) Erosion Control Plan, and standard civil detail
sheets. Standard civil detail sheets include standard City details.
• Soils Design Services
- Identify preliminary soil sources that may have suitable soil quality, quantity, and capability for
providing appropriate planting and structural soils for the project.
- After potential soil sources have been identified, conduct a soil source assessment inspection. This
task will involve site visits and inspections of potential soil vendors to assess the quality, quantity,
and capability of providers for supporting the project. This would involve a 2-day soil source
inspection period in the Fayetteville region. Up to 4 soil samples would be collected from potential
sources for laboratory analyses.
- Collect data and information from source visits to develop a list of approved soil vendors for the
project
- Prepare 90 percent and final soil specifications. The soil specification will detail the information
necessary for soil procurement, preparation, and installation.
Structural Construction Documents — Provide the final design and detailing of the steel space frame
shade structure that was previously developed to the Schematic Design level. Deliverables will
include Structural General Notes and Sheet Specifications, Foundation Plan and Details, and Steel
Framing Plan and Details. Also included is the review and determination of required reinforcing for
miscellaneous site walls, signs, and water fountains. Not included in this scope of services are the
following:
- Site visits
- Determination of quantities, material pricing, or construction cost estimates.
- Determination of soil properties or allowable bearing pressures
- Additional design services requested by the Owner beyond that which is included in this Scope.
- Redesign of structure due to pricing overruns, excluding VE.
• Franchise Utility Coordination - Coordinate potential relocations with the electric service provider, gas
provider, and communications provider in the area. This assumes roughly 1.5 weeks of time for
services, updates, coordination, etc.
• Drainage Design & Coordination - Prepare drainage report meeting requirements of the SITES and
City for this Scope Area.

• SWPPP Permitting - Prepare and submit a Stormwater Pollution Prevention Plan (SWPPP) including
design of erosion and sediment control plan which shall meet the requirements of the State NPDES
Permit and local agency requirements and which shall include BMP's such as silt fence, construction
entrances, sediment basins, etc.
Bidding and Negotiation
Scope
• Provide services including but not limited to: review of shop drawings, participation in construction
meetings, review and respond to BFI's, make construction site visits, provide punch lists, and record
drawings.
Construction Administration
Civil Design Construction Administration Scope
Attend Preconstruction meeting. Fee is limited to two (2) Olsson engineers to attend preconstruction
meeting.
• Attend monthly progress meetings. Fee is limited to one (1) Olsson engineer to attend monthly
meetings.

technical support for the landscape contractor. It is anticipated that one of the site inspections will
include the initial Pre -Construction Meeting followed by a site inspection during the construction
process. Field reports summarizing observed site conditions and construction will be prepared
following each site inspection.

• Prior to design, determine point -of -connection ("POC") location(s), available pressure and size in
coordination with the Civil or Mechanical Engineer, Landscape Architect, and Architect.
• Present water & cost saving strategies to achieve reduced water use by implementing weather -based
irrigation controls with system performance & management features, efficient irrigation strategies and
superior system design.
• Based on coordination with the Owner & Design Team, review specifications of the irrigation control
system for the appropriate level of system monitoring & water conservation features commensurate
with the project budget and long-term maintenance targets.
• Coordinate mainline and wire routing, controller location and power requirements with the LA, ME, and
Architect as necessary.

project, we have not included any client meetings.
Prepare final design and layouts of proposed lighting fixtures on background drawings as provided by
the Landscape Architect. We have allowed for a maximum of 3 submission sets during CDs, at 50%,
90% and 100% complete. LTLDA will provide lighting layouts as AutoCAD layers to the Landscape
Architect/Electrical Engineer for their use in producing contract documents. The Landscape Architect
will produce final lighting layout sheets and the Electrical engineer will produce electrical circuiting and
control drawing sheets for construction. Please Note: Once 100% complete Bid Documents have
been issued, any subsequent revisions to the layouts will be reviewed and redlined with revisions to
be completed by the Landscape Architect; or by LTLDA as an Additional Service.
• Prepare a CD level assembly and fixture schedules listing fixture types included in the lighting design,
including manufacturer's names and designations. Schedules will be submitted as documents to be
included in the project manual.
• Provide final lighting fixture cuts or other descriptive material describing equipment that is part of the
lighting design. Fixture cut sheets will be submitted as documents to be included in the project
manual.
• Provide assembly diagrams for pole mounted fixtures and accommodation sketches for architectural

• SITE VISIT: We have allowed for (1) site visit at the end of construction for a final review of the
completed lighting installation and for supervision of focusing the aimable fixtures and balancing of
light levels with the control system. We will aim and focus all adjustable lighting equipment at this time
and provide a final punchlist. The aiming and focus of fixtures takes place at night and the electrical

RECOMMENDATION:
Staff recommends approval of an Add Service Amendment to the Existing Design Contract with
Nelson Byrd Woltz for the Ramble Project
BACKGROUND:
The Fayetteville City Council passed Resolution 276-21 on November 2, 2021 to approve
change order number 5 to the contract with Nelson Byrd Woltz in the amount of $395,009.00 to
provide professional landscape architecture service for the early package of the Upper Ramble.
Later, due to value engineering decisions, the original scope of work was reduced for the early
package therefore existing budget remains within the design fees for this work.
DISCUSSION:
Extended construction administration (CA) on the Lower Ramble and extended time for bidding
and negotiations (B&N) on the Upper Ramble Plaza have exhausted previously authorized
consultant fees for this work. Specifically, this additional work includes:
CA (substantial completion December 2022)
• Extended construction and redesign period of Hillcrest block
• Extended duration of Phase 1 CA
B&N (increase of phase duration from 2 to 6.6 months)
• Participate in VE and Bid markups, meetings and reviews
• Prepared diagrams of VE strategies including:
o Review of alternative materials
o Advise on deletion and phasing of key design elements
o Strategies for shrub and tree planting reductions
o Reduction of electrical bollards
o Coordination of lighting and electrical reviews of bids
• Meetings and reviews of play structure
• Coordination, meetings and review of O&M Manual
• Meetings and reviews of Archetype signage
• Presentation to the WAC
• Fundraising and donor strategies meeting

In order to cover this additional work, staff proposes to use the remaining fee of $66,721,00
from the early package of the Upper Ramble to perform this scope of work. There is no
additional cost for this change.

described below, in accordance with the terms and conditions of the Agreement dated June 19, 2018
between the Client and NBW for the Project, for the following scope.
Phase II Civic Space: Bidding & Negotiation
Scope
• Provide extended duration of Bidding and Negotiation phase from 2 months (January- February
2023) to 6.5 months (January - mid August 2023)
• Review and assist in evaluation of Bid Proposals
• Attend up to six (6) VE and B&N associated meetings with GC and Client
• Review and propose VIE alternates, including:

- Deferrals or deletions of design elements

work.
