A RESOLUTION TO APPROVE AN EXTENSION OF THE CITY'S SEWERAGE SYSTEM
BEYOND THE CITY LIMITS TO PROPERTY LOCATED AT OR NEAR 903 SOUTH
BALDWIN AVENUE
WHEREAS, §51.113 Sewer Service and Extension Policy states that "the city's sewerage system
shall not be extended outside the city's corporate limits except on the express approval of the City
Council"; and
WHEREAS, Jerry Payton has requested to connect to the City's sewer main that currently runs near
his property located at 903 South Baldwin Avenue.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves the request by
Jerry Payton for an extension of the City's sewerage system beyond the city limits to his property
located at 903 South Baldwin Avenue upon payment of the necessary tapping fee and any other fees
and costs for the sewer connection.

Kit,
I just got a call from Jerry Payton at 903 S. Baldwin Ave about connecting to the city sewer system. I believe
the sewer line runs through his front yard, and everyone across the street has access to sewer along with
houses to the north and south of him. I believe this item is similar in nature to the one council member Harvey
walked on last week, and it sounds like his existing septic system is about to fail and could constitute a health
risk. I've spoken with Tim Nyander, and he not only supports this proposed connection, but also the possibility
of a walk on item.
I've included Sonia and D'Andre in this email because I believe this is in Ward 1. Please advise what I need to
do to walk this item onto our agenda next week.
