February 14, 2022 flinflock ARCHITECTURE LANDSCAPE PETITION TO RELOCATE EASEMENT TO: Mark Rogers at Fayetteville Water and Sewer Division & The Fayetteville City Council Per our initial conversations with Fayetteville Water and Sewer, Flintlock Ltd Co on behalf of Graham House, LLC requests a vacation of the current empty water and sewer easements and relocation of that easement centered on the existing utilities runs on the following lot (parcel 765-15344-000): • 2100 S School Ave, parcel 765-15344-000 REASON FOR EASEMENT AMENDMENT / STATEMENT OF NEED: Although an extensive water sewer easement wraps the north and east boundaries of the property, the sewer line installed across the property in 2008 was installed almost entirely outside of this easement, representing a fairly large taking of property. Per our initial conversations about correcting the situation, we request a vacation of the current empty easement and propose dedication of a new easement centered on the existing sewer line. The existing easement runs 15' wide for approximately 365' along the northern edge and 150' along the eastern edge of the property. The existing sewer line runs approximately 275' through the property and only within the existing easement for 15' as it crosses the easement exiting the property. The existing line reduces the lot's buildable area and associated development potential, but to minimize cost to the City, we do not request that the line be moved within the existing easement. However, we do request the City refund our $200 application fee to vacate the easement as it represents and undue burden on our client, for which they have no responsibility. We propose a new easement be established 7.5' to either side of the existing sewer line on the property for a total easement width of 15' to replace the vacated empty easement and match its current width. SUMMARY It is our opinion that the proposed vacation and relocation of this easement is a fair, timely, and economical course of action to correct the problematic utilities condition on this parcel. It minimizes expense for the City and the disruption to the site and potential development timeline for our client. We hope you will agree.
