NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the requirements of formal competitive bidding and authorizes the purchase of six anoxic mixers for the Noland Water Resource Recovery Facility for the amount of $266,250.00 (plus any applicable taxes and freight charges) from Jack Tyler Engineering, Inc., and further approves a project contingency in the amount of $26,625.00. BACKGROUND: Bid #21-63 was conducted for the replacement of the anoxic mixers for the East Basin at Noland WRRF. The project was intended to replace all the mixers in both the West and East Basins. Jack Tyler was the lowest responsive bidder and was selected to provide the equipment because the only other bidder did not meet specifications. The bid specifications required engineering to match the mixers with the process design for wastewater treatment. The East and West Basins are symmetrical and require the same mixer configuration to operate in the same manner. DISCUSSION: It was not possible to bid 12 mixers and replace them at the same time. During the fall/winter/early spring, the permit is relaxed allowing the plant to treat with only one basin. However, one basin must remain in service. We were only able to purchase six mixers because we could only install one basin in that time period. The remaining mixers will be installed in the next permit period that allows one basin. Because Jack Tyler Engineering is the sole provider of the brand of anoxic mixers to match existing equipment, staff is seeking a bid waiver to complete the rehabilitation of the remaining basin in 2022. Jack Tyler Engineering has submitted a quote for six anoxic mixers. The total estimated cost including freight and taxes is $266,250.00.
