WHEREAS, on August 7, 2018 the City Council passed Resolution 165-18 authorizing an
application for a 50150 matching grant with the Arkansas Department of Parks and Tourism's Outdoor
Recreation Grants Program and the City has received notification that the grant has been awarded; and
WHEREAS, the grant will provide $220,000.00 which, along with the City's match, will fund
improvements to the Gulley Park playground area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan
to execute a Matching Grant Agreement with the Arkansas Department of Parks, Heritage, and
Tourism, a copy of which is attached to this Resolution, to receive $220,000.00 in grant funds from the
Outdoor Recreation Grant Program.

RECOMMENDATION:
Recommend a resolution authorizing the City to enter into a Matching Grant Statement of
Agreement with the Arkansas Department of Parks, Heritage, and Tourism Outdoor Recreation
Grant Program which will provide $220,000 in funding as a 50/50 matching grant for park
improvements at Gulley Park.
BACKGROUND:
The Arkansas Department of Parks and Tourism offers a matching grant opportunity through its
Outdoor Recreation Grants Program. Resolution 165-18 authorized applying for a grant through
this program, which has been successfully completed. The target of the grant application was
improvements to Gulley Park's playground area. This resolution allows the city to enter into the
agreement for the 50/50 matching grant. The grant will provide $220,000 in funding to assist
with the playground area at Gulley Park. The city is required and has funds available to match
the grant with a minimum of $220,000 for its match. The grant also requires putting the project
in a Project Boundary which ensures the use of the area remains in perpetuity for outdoor
recreation. This was done previously with a 2007 Outdoor Recreation Grant for the playground.
An updated Project Boundary Map is included as part of the agreement.
DISCUSSION:
These improvements to Gulley Park Playground area follow the master plan which was updated
in 2018 (attached) and were highly recommended by the public. In a written survey conducted
during two planning meetings hosted April 14, and May 31, 2018 at the park, "Improved
Playground", was the third highest supported amenity out of a list of 22 items specific to the park
(see attached survey results). The grant funds will assist in financing the interactive fountain,
parent's pavilion, playground equipment, and supporting enhancements.
BUDGET/STAFF IMPACT:
The grant will provide $220,000. Matching funds are budgeted in project 13001.1803, Gulley
Park Improvements. This is a reimbursable grant.

STATEMENT OF AGREEMENT Project No. A-10773-19-WA
Granting Agency: Arkansas Department of Parks, Heritage and Tourism
The State of Arkansas, represented by the Director of the Outdoor Recreation Grants Program, Arkansas Department of Parks,
Heritage and Tourism (hereinafter referred to as "Grantor") and the applicant named above (hereinafter referred to as 'Applicant")
mutually agree to perform this agreement in accordance with the terms, promises, conditions, plans, specifications, estimates,
procedures, project proposals, maps, and assurances attached hereto.
Grantor hereby promises, in consideration of promises by Applicant herein, to obligate to Applicant the amount of money referred
to above, and tender to Applicant that portion of the obligation which is required to pay Grantor's share of costs relative to project
stage, based upon percentage of assistance and contingent upon receipt of those funds per Arkansas Act 729 of 1987. Applicant
hereby promises, in consideration of promises made by Grantor herein, to execute the project or project stage($) described above
in accordance with the terms of this agreement.
To ensure full reimbursement, Applicant must not deviate from the scope of the project without concurrence of Grantor. Should
any condition(s) in the agreement change, e.g., change in project scope, deletion or addition of item(s), or extension of project
period, Applicant will submit to Grantor for approval a formal request for project amendment.
Applicant agrees to follow, to the best of Applicant's knowledge and abilities, all rules, laws, and/or regulations applicable to
Applicant's agreed -upon project as those rules, laws, and/or regulations are enforced by local, state, and/or federal authority under
whose jurisdiction Applicant operates. Applicant also agrees to comply with the requirements of the Arkansas Department of Parks,
Heritage, and Tourism, including rules, laws, and/or regulations that may pertain to lawful dispersal of public monies by Grantor.
Applicant understands that willful or egregious disregard for rules, laws, and/or regulations applicable to Applicant's project and
jurisdiction may result in forfeiture of reimbursement, either in part or in full, and/or disqualification from future consideration, either
temporarily or perpetually, of public monies dispersed by Grantor under Grantor's funding mandate.
Upon completion of project. Applicant agrees to erect a permanent sign acknowledging the funding assistance provided by the
Arkansas Natural and Cultural Resources Grant and Trust Fund (ANCRGT), and to bury all new utility lines at ANCRGT-funded
project sites, Including ANCRGT-assisted property acquisitions. Applicant agrees to be responsible for in perpetuity maintaining,
as public outdoor recreation, the project area shown on attached Project Boundary Map.
Applicant hereby agrees to and accepts the responsibilities and obligations set out herein, as does Grantor. Applicant further
understands, agrees, and accepts that this agreement is not effective until said agreement has been duly executed by Grantor
and Applicant notified accordingly, and no development is to be Initiated and/or invoiced by Applicant prior to receipt of said
notification.
In witness thereof, the parties have executed this agreement as of the date entered below.

Once received, I will also sign the agreement and mail you a bound document that includes the Notice to
Proceed, fully executed Contract Agreement, Project Boundary Map, and Project Management Guide that
will be mailed to you to be included with the permanent records for the City. Please do not begin
construction until after you've received this document.

Gulley Park Survey Results
GP2. When doing a master plan for a park such as Gulley, often a theme
or concept helps shape the park and the direction that is pursued. Below
are some possible themes and ideas that could influence Gulley Park's
master plan. Please read about the ideas and then rate them. If you have
an idea for a theme, please add it.
A. Develop Gulley Park respecting the sites history from its prior use as a
working farm. For example, the playground could have a farmyard
theme, the open space could emphases the pastures. A history trail with
information about older farms and farm life could be pursued.
B. The Gulley Park events in the park are very popular and a strong
cultural event. In following this the park could be developed with an
emphasis on culture and art. For example, the playground could have a
theme that pushes performances as part of play, a fire pit could be used
to offer storytelling events.
GP1. The University of Arkansas is expanding its C. Niokaska Creek is one of the most loved features of Gulley Park. Along
arts program. Would you support the integration with the other natural areas of the park, Gulley provides a wonderful

This letter serves as your Official Notification to Proceed. Attached are copies of the Contract Agreement,
Project Boundary Map, and Project Management Guide. Please retain this copy in the permanent files of the
City of Fayetteville
Part of our responsibility in administering the Outdoor Recreation Matching Grants program is to inform and
remind you of the rules and regulations that you have agreed to abide by in this contract. Please review the
attached documents carefully and contact me at (501) 682-1301 if you have any questions. Below are some
of the major responsibilities:
The Project site must be retained and maintained for public outdoor recreation in perpetuity. This
means that the land and facilities within the Project Boundary cannot be converted to uses other than
public outdoor recreation. No private facilities may be constructed within the Project Boundary. With
few exceptions, no public building or facility that is not in direct support of outdoor recreation may
be constructed within Project Boundary. Please contact our office if you plan to add any additional
facilities within the Project Boundary so that we may determine if they are allowable, and if so, what
rules and regulations apply.
2. If the site is converted to some other use, it will have to be replaced entirely at your own cost with
land and facilities of approximately equal financial value and recreational usefulness. Should the need
for conversion ever arise, suitable replacement property will have to be approved through this office
prior to any action taking place.
3. All funded facilities must comply with all applicable state and federal laws regarding barrier free
access.
4. All future utility lines within the Project Boundary must be placed underground.

5. A permanent Natural and Cultural Resources Grant Trust Fund (NCRGTF) acknowledgment sign is
required on all project sites. Your Project Officer will provide you an acknowledgement sign upon
completion of the grant project to be mounted in a prominent location within the site. Please contact
our office if ever a replacement sign is needed.
6. Your recreational facility must be open and available to the general public at all reasonable times,
generally during daylight hours. No person shall be subject to discrimination on the basis of race,
color, or national origin. If your project site is closed at any time, you must post hours stating when
the facility is open to the public.
Please note that grantees shall, at minimum, adhere to all purchasing/procurement laws specific to their
jurisdiction including bidding requirements and local ordinances.

the City of Fayetteville. The 50/50 grant provides $220,000 in funding for park improvements at
Gulley Park.

The City entered into a grant agreement with the Arkansas Department of Parks, Heritage and
Tourism in 2022 with Resolution 60-22. The grant will provide $220,000 in matching funds.
Funds are budgeted in project 13001.1303, Gulley Park Improvements. The target of the grant
application was improvements to Gulley Park's playground area. This resolution will extend the
contract's expiration date to December 31, 2023.
