AN ORDINANCE TO APPROVE VAC 22-0003 FOR PROPERTY LOCATED AT 100 NORTH
SKYLINE DRIVE TO VACATE A PORTION OF A WATER/SEWER EASEMENT
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds
or portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of a water/sewer
easement is not required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portion of a
water/sewer easement as described in Exhibit B attached to the Planning Department's agenda memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as
Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County
Circuit Clerk.
Section 3: This vacation approval is subject to the condition that any relocation of or damage to
existing utilities or existing facilities shall be at the owner/developer's expense.

SUBJECT: VAC-2022-000003: Vacation (100 N. SKYLINE DR./GREMILLION-HICKS, 486):
Submitted by BRITT GREMILLION for property located at 100 N. SKYLINE DR. The property is
zoned RSF-4, RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE and contains approximately
0.29 acres. The request is to vacate approximately 0.02 acres of a water and sewer easement.
RECOMMENDATION:
Staff recommends approval of VAC-2022-000003 as shown in the attached Exhibits `A' and 'B',
and with the following condition of approval:
1. Any damage or relocation of existing facilities will be at the applicant's expense.
BACKGROUND:
The subject property is located north of the Mount Sequoyah Center on Skyline Drive. The site
contains one parcel with approximately 0.29 acres. The property is currently developed with one
single-family dwelling which Washington County records indicate was built in 1939.
Request: The applicant proposes to vacate a portion of an existing water and sewer easement
totaling approximately 860 square feet (0.02 acres), as indicated in the attached exhibits. No
public sewer or water mains are currently located inside of the easement. The applicant intends
to add an addition to the existing house in the area where the easement is located.
DISCUSSION:
The applicant submitted the required approvals from the public utility provider with no objections.
With submittal of the required vacation forms and utility consent, staff recommends approval.

We are submitting a "Petition To Vacate" a sewer and water easement on the property at 100 N. Skyline
Drive, on Mt Sequoia, in the City of Fayetteville.
The easement is an empty 10 ft wide strip, contained entirely within the property. The easement runs
approximately north -south, and contains large front yard trees and a driveway adjacent to the small
single family residence [1000 sgft footprint] on the site. The lot is a small quarter acre lot, and this area
is the essential buildable area needed for an addition that we have architecturally designed to fit with
the character of the existing home and Mt Sequoia area.
A site survey with the easement is attached along with the legal description. The easement is currently
surveyed and staked on the property for viewing as needed. We would be available to meet at the site.

abandonment of the portion of the above described easement. The petitioners pray that the City of
Fayetteville, Arkansas, abandon and vacate the above described real estate, subject, however, to the
existing utility easements and sewer easements as required, and that the above described real estate be
used for their respective benefit and purpose as now approved by law. The petitioners further pray that
the above described real estate be vested in the abutting property owners as provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City of
Fayetteville, Arkansas, abandon and vacate the above described real estate, subject to said utility and
sewer easements, and that title to said real estate sought to be abandoned be vested in the abutting

AN ORDINANCE TO APPROVE VAC
22.0003 FOR PROPERTY LOCATED
AT 100 NORTH SKYLINE DRIVE TO
VACATE A PORTION OF A
WATER/SEWER EASEMENT
WHEREAS, the City Council has the
authority under A.C.A. § 14-54-104 to
vacate public grounds or portions thereof
which are not required for corporate
purposes; and
WHEREAS, the City Council has
determined that the following described
portion of a water/sewer easement is not
required for corporate purposes.
NOW, THEREFORE, BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section L That the City Council of the
City of Fayetteville, Arkansas hereby
vacates the portion of a water/sewer
easement as described in Exhibit B
attached to the Planning Department's
agenda memo.
Section 2: A copy of this Ordinance duly
certified by the City Clerk along with the
map attached as Exhibit A to the
Planning Department's memo shall be
filed in the office of the Washington
County Circuit Clerk.
Section 3: This vacation approval is
subject to the condition that any
relocation of or damage to existing
utilities or existing facilities shall be at
the owner/developer's expense.
