A RESOLUTION TO APPROVE THE LAND SALE CONTRACT WITH PEACE AT HOME
FAMILY SHELTER, INC. FOR THE CITY TO CONVEY FOUR ACRES TO PEACE AT
HOME FOR $80,000.00 PLUS VALUABLE SERVICES FOR OUR RESIDENTS
WHEREAS, on January 4, 2005, the City of Fayetteville sold 1.5 acres to Peace at Home Family
Shelter, Inc. for $20.000.00 per acre to assist Peace at Home to construct its larger and better
equipped new facility made possible by a generous grant from the Donald W. Reynolds Foundation;
and
WHEREAS, after its new facility was opened in 2008, Peace at Home has been able to help many
more domestic violence survivors and their children with a safe and nurturing environment during their
transition to new private housing; and
WHEREAS, Peace at Home needs to expand its shelter to meet the increased need in our rapidly
growing area; and
WHEREAS, Peace at Home has secured grants to help fund this expansion and also to fund a small
animal shelter for pets owned by its domestic abuse survivors and their families; and
WHEREAS, Peace at Home services for Fayetteville's victims of domestic abuse are very needed
and valuable to Fayetteville and justify the sale of City property at the reduced rate of $20,000.00 per
acre for this salutary purpose; and
WHEREAS, Peace at Home has already submitted its Planned Zoning District rezoning to allow
construction of additional buildings for its Peace at Home Family Shelter expansion and for its animal

shelter and related developments to the City and has obtained a recommendation of approval from the
Planning Commission; and
WHEREAS, the Fayetteville City Council can consider and approve Peace at Home's requested
rezoning along with this Land Sale Contract during the same City Council Meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves the Land Sale
Contract with Peace at Home Family Shelter, Inc. to convey four acres of City property to Peace at
Home for eighty thousand dollars and other valuable consideration.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan
to sign this Land Sale Contract (attached to this Resolution) and all other necessary documents
necessary to accomplish this conveyance.

SUBJECT: Resolution of Intent to sell land to Peace at Home Family Shelter, Inc.
RECOMMENDATION:
Mayor Jordan recommends the City Council approve a resolution to sell to Peace at
Home Family Shelter the land described in the attached exhibit for $20,000 per acre, in
acknowledgement of the vital services performed by the Shelter.
BACKGROUND:
The City of Fayetteville has long appreciated and supported the efforts of the nonprofit
Peace at Home Family Shelter as a service that provides vital accommodations for
victims of family violence and domestic abuse. On January 4, 2005, the City Council
approved the initial sale of 1.5 acres of land for the construction of a new shelter east of
Highway 265 on Ivy Lane for $30,000 (Ordinance 4670). The City also leased
additional land as a buffer zone for increased privacy and security and for a temporary
septic system area. Peace at Home moved into this facility in 2008.
DISCUSSION:
Over the last 12 years, the Peace at Home program has grown to address the needs of
domestic violence survivors and their children, growing from 12 staff members with an
annual budget of less than $800,000 to a 35-member team with an annual budget of
over $2,500,000.
Services have expanded to include a rapid rehousing team to help families obtain and
pay for safe new housing, bilingual therapeutic services, and a children's program to
address their unique needs. The Shelter now works with over 1,000 families seeking
support from domestic violence annually.
The Shelter has now outgrown the existing building and office space and currently
operates a waiting list for emergency safe shelter, with approximately 30% of the
requests for emergency shelter going unmet. The Shelter is proposing to purchase 4
acres of city land for an expansion which will include more capacity for beds and baths,

additional parking, and the Candy Clark Pet Sanctuary to be constructed in memory of
one of its biggest supporters, in order to provide a safe space for families staying at the
shelter to house their pets. The sale price would be the same as the City previously
authorized in 2005 - $20,000 per acre, in acknowledgement of the vital services
performed by the Shelter.
City Council approved a resolution to provide public notice of intent to sell at its May 4,
2021, City Council Meeting and the Planning Commission forwarded the PZD to the City
Council recommending approval for the expansion and animal shelter at its January 10,
2022 meeting.

Peace at Home Family Shelter 2025 Vision
Peace at Home Family Shelter has met with its clients, staff, and Board of Directors to develop this vision
which addresses both immediate and long term programmatic needs for our agency to continue
providing high quality services to victims of domestic violence and their children.
Need•
Peace at Home Family Shelter moved into its current facility in 2008. Over the last 12 years, our
program has grown to better address the needs of domestic violence survivors and their children. We
have gone from 12 staff members with an annual budget of less than $800,000 to a 35 member team
with an annual budget of over $2,500,000.
We added a full legal team including attorneys who provide free legal representation to over 400
families a year. We added a rapid rehousing team to help families obtain and pay for safe new housing.
We now have bilingual therapeutic services and a children's program to address their unique needs. We
have grown beyond simply providing emergency respite shelter to an organization that is helping
address the barriers keeping citizens in dangerous relationships. Our organization now works with over
1,000 families seeking support from domestic violence annually.
This growth means that we have outgrown the existing building. Staff are now doubled or tripled up in
offices. This is especially problematic when staff are trying to meet with individuals in crisis and there is
an office mate. We no longer have space large enough for the entire staff to meet and now have to
meet off site for trainings or all staff meetings. We have insufficient privacy for our therapists to meet
with clients. We no longer have a private spaces for law enforcement or other important community
partners to meet with victims to discuss confidential matters. We have converted spaces designed
originally as storage into offices. We utilize telework when possible to maximize space but unlike many
other agencies, we are required to have staff on site every minute of every day for the safety of our
residential program.
Worse, we are unable to meet the daily demands for emergency safe shelter. In 2017, Peace at Home
expanded its facility and added four large family rooms and bathrooms. This project increased our daily
sheltered capacity by 40%. We filled those beds within 24 hours and those beds have remained full ever
since. We operate a waiting list for emergency safe shelter and are daily unable to serve those seeking
shelter services. Over the last year, approximately 30% of the requests for emergency shelter went
unmet. It is time to invest in more bed space.
In addition, we have begun to accept animals into the shelter. Nearly 30% of domestic violence survivors
will delay leaving a dangerous situation if they are unable to take their animals with them. And with
good reason. Domestic batterers will often harm beloved pets as punishment especially if they are left
behind. We are now partnered with several local vets to provide medical care and donors provide pet
supplies. What we lack is the sufficient space to meet the growing demand for animals. We want to
ensure their health and welfare and maintain a safe space for all residents.
PEACE
Response•
In response to these critical challenges, Peace at Home is working with donors to expand its facility and
programs. We have identified the following priorities:
1. Add 4 emergency shelter bedrooms with private bathrooms to the existing building site
2. Build out new, more efficient storage space on the existing building site
3. Build a new ground up building (approximately 6,500 SF) with matching exterior to the existing
building and a canopy attaching the two structures. The new program building will be designed for
expansion overtime.
4. Rework the front security gate and fencing to connect both buildings and enhance existing security
5. Build the Candy Clark Pet Sanctuary which will be constructed in loving memory of community
advocate, animal lover, and Peace at Home supporter, Candy Clark. This building will provide a safe
space for families staying at the shelter to house their beloved pets. With the Candy Clark Pet Sanctuary,
families will be near their pets and able to see them and care for them every day. It would also allow the
pets to be close to their families, but safely separated from the other families in shelter who may have
pet allergies or be uncomfortable around animals.
6. Address needed parking, retainage and lift station needs through the above expansions
Land Needed•
In order to achieve this vision, Peace at Home Family Shelter is requesting to utilize four acres currently
owned by the City of Fayetteville for this project. This land is adjacent to Peace at Home's current
building.

Candy Clark Pet Sanctuary Vision
Safe Haven for Pets in Shelter
It is not safe for animals in domestic violence households. Animal abuse both correlates highly with
domestic violence and is a known tactic of domestic violence. Nearly 30% of domestic violence
survivors will delay leaving a dangerous situation if they are unable to take their animals with them.
And with good reason. Domestic batterers will often harm beloved pets as punishment especially if
they are left behind. Survivors of domestic violence need a safe place for themselves and their pets
when escaping violence.
Currently the Peace at Home Family Shelter is not equipped to regularly have pets in shelter. A
space is needed so that the health and welfare of family pets can be assured while still keeping a safe
space for all residents of the emergency shelter.
Candy Clark Pet Sanctuary
The Candy Clark Pet Sanctuary will be constructed in loving memory of community advocate,
animal lover, and Peace at Home supporter, Candy Clark. This building will provide a safe space for
families staying at the shelter to house their beloved pets. With the Candy Clark Pet Sanctuary,
families will be near their pets and able to see them and care for them every day. It would also allow
the pets to be close to their families, but safely separated from the other families in shelter who may
have pet allergies or be uncomfortable around animals.
The Candy Clark Pet Sanctuary will make leaving domestic violence safer for our community
members and their pets, but it cannot be built on our current site without additional land. It is
important that the land the Candy Clark Pet Sanctuary is built on is near the emergency shelter so
that families can easily walk to care for and play with their pets every single day.
Construction
According to estimates obtained from a construction company, building a pet sanctuary that would
safely house up to 6 dogs and up to 4 cats would cost approximately $550,000 and require additional
land adjacent to the emergency shelter. In addition to construction costs, the kennel would require
start-up equipment and supplies such as food, cleaning supplies, care and grooming materials, and a
basic veterinary setup. Total initial costs excluding the value of land are estimated to be about
$600,000. We have already secured a lead gift for this project and many smaller gifts.
Ongoing Needs
Once established, the Candy Clark Pet Sanctuary would require some ongoing operational support
to care for pets on an ongoing basis. A part-time kennel manager would be needed to oversee the

Candy Clark Pet Sanctuary and ensure all animals are appropriately cared for. Food and supplies
would be required as well as some veterinary care expenses. We anticipate ongoing expenses for the
Candy Clark Pet Sanctuary to total $25,000 per year, though this figure will likely increase annually
with inflation. A generous donor has already committed to covering these ongoing operational
expenses in perpetuity.
Ongoing Partnerships
For families with pets to receive the best care while staying at Peace at Home Family Shelter and the
Candy Clark Pet Sanctuary, strong partnerships with a veterinarian and other animal organizations
will be critical. Peace at Home Family Shelter has developed relationships with several area animal
hospitals, but would welcome recommendations on organizations and businesses as potential animal
care partners.
Operations
Peace at Home Family Shelter's policies and procedures would be updated to reflect the addition of
the Candy Clark Pet Sanctuary. Peace at Home will utilize the Sheltering Animals and Families
Together (SAF-T) manual as a guide for adjusting operations as needed. This guide was specifically
designed to help domestic violence programs incorporate safe pet shelter into their emergency
shelter programs.
Vision
The vision of the Candy Clark Pet Sanctuary is to make it possible for families to safely flee
domestic violence with all of their family members, including their animals. This program will give
families peace of mind. It will keep survivors of domestic violence and the animals they love safe.
Land Request
Peace at Home is requesting to lease four acres from the City of Fayetteville to build the Candy
Clark Pet Sanctuary. The City of Springdale has agreed to support the water and sewer needs for
the project.

LAND SALE CONTRACT
This Land Sale Contract is made and entered into by and between the City of
Fayetteville, Arkansas, and Peace at Home Family Shelter, Inc. (hereinafter "Peace at
Home").
HISTORICAL CONTEXT
WHEREAS, on January 4, 2005, the City of Fayetteville sold 1.5 acres to Peace at Home
Family Shelter, Inc. for $20.000.00 per acre to assist Peace at Home to construct its larger
and better equipped new facility made possible by a generous grant from the Donald W.
Reynolds Foundation; and

TERMS AND CONDITIONS
In consideration of the Historical Context explained above, the City of Fayetteville
and the Peace at Home Family Shelter, Incorporated covenant and agree to all of the terms
and conditions below:
1. Purchase price and additional consideration for the sale of four acres to Peace at Home
Family Shelter, Inc.
The City of Fayetteville agrees to accept and Peace at Home Family Shelter, Inc.
agrees to pay $80,000.00 (Eighty Thousand Dollars) and furnish to Fayetteville as further
consideration Peace at Home's valuable services to Fayetteville residents who are victims
and family members of domestic violence. Peace at Home may continue to offer region -
wide services to victims of domestic violence at its shelter and may provide an animal
shelter for pets of their residents.
2. Land Description.
Attached to this Contract as Exhibit A is the Legal Description for the approximate
Four (4) acres to be conveyed by the City of Fayetteville to Peace at Home Family Shelter,
Inc. to be used for its planned expansion.
3. General Warranty Deed.
The City of Fayetteville shall convey this parcel by a General Warranty Deed,
subject to any recorded easements, which shall include any mineral rights owned by the
City of Fayetteville, to Peace at Home Family Shelter, Inc.
4. Title Insurance.
The City of Fayetteville shall furnish a policy of title insurance at its cost in the
amount of the purchase price from a title insurance company as selected by the City of
Fayetteville and acceptable to Peace at Home.

5. Survey.
The City of Fayetteville agrees to allow Peace at Home Family Shelter, Inc., (if
Peace at Home Family Shelter, Inc. so desires and at Peace at Home Family Shelter, Inc.'s
expense) to survey the property. The City of Fayetteville agrees to cure any title problems
which may result from any differences between the recorded legal descriptions of the
property and the survey description. Said title problems, if any, shall be solved prior to
closing to the satisfaction of the City of Fayetteville and Peace at Home.
6. Proration of Taxes, etc.
Taxes and special assessments (if any) due on or before closing shall be paid by the
City of Fayetteville. General taxes, ad valorem taxes, and any special assessments shall be
prorated as of closing.
7. Closing Date.
The closing date shall be within sixty (60) days after the approved signature date of
this contract. If such date of closing falls on a weekend or holiday, it will be held the
following working day.
8. Possession.
Possession of the property shall be delivered to Peace at Home Family Shelter, Inc.
on the date of closing.
9. Inspection.
The City of Fayetteville hereby grants permission for Peace at Home Family
Shelter, Inc. or its designees to enter the described property for the purpose of inspection
and/or surveying.
10. Environmental Assessment.
The City of Fayetteville shall disclose to Peace at Home Family Shelter, Inc. any
and all environmental hazards of which the City of Fayetteville has actual knowledge.
Peace at Home Family Shelter, Inc. and the City of Fayetteville shall share equally the
costs of any testing that Peace at Home might deem necessary for the possible existence of
environmental hazards. Should the existence of environmental hazards be discovered, the

City of Fayetteville shall cure such at its expense; or, in the alternative, Peace at Home
Family Shelter, Inc.or the City may withdraw without penalty from this contract.
II. This agreement shall be governed by the laws of the State of Arkansas.

Public Notice: Sale of municipally owned property
Dear property owner,
Please be aware that the Fayetteville City Council will consider a resolution to sell four acres of
municipally owned land located at 5304 N. Crossover Road. The acreage includes a portion of
parcel 765-13206-010 directly south of the Peace at Home family shelter at 3045 E. Ivey Lane.
Sale of the four acres to Peace at Home is being considered for $80,000.
In 2005, the Fayetteville City Council approved sale of 1.5 acres to Peace at Home for
construction of housing for victims of family violence and domestic abuse. The shelter was built
and has been in operation for over 12 years, supporting more than 1,000 families with housing,
children's programs, and therapeutic services.
More recently, Peace at Home approached the City in 2021 about purchasing land adjacent to
their current shelter at 3045 E. Ivey Lane. Peace at Home has outgrown its existing building,
with many families awaiting placement there to escape family violence and domestic abuse.
Additionally, Peace at Home identified a need to house family pets during their stay at an onsite
sanctuary.
The possible sale will be considered by the City Council during its 5:30 PM meeting on February
1, 2022 in Room 219 of City Hall, located at 113 W. Mountain Street. In the week prior to the
meeting, please consider the public calendar at www.fayetteville-ar..gov/ for virtual attendance
options.

Peace at Home is a nonprofit shelter located at 3045 East Ivey Lane. On January 4, 2005,
Fayetteville's City Council approved the initial sale of 1.5 acres of land for the construction of a
new shelter east of Highway 265 on Ivy Lane for $30,000 (Ordinance 4670). The City also
leased additional land as a buffer zone for increased privacy and security and for a temporary
septic system area. Peace at Home moved into this facility in 2008.
After 12 years of operation, Peace at Home's program has grown to support over 1,000 families,
with shelter and housing needs that now exceed the existing facilities. In recognition of this,
Fayetteville's City Council passed Resolution 135-21, providing public notice of consideration to
sell approximately four acres which adjoin the current shelter and rezone it to serve Peace at
Home for a new facility and animal sanctuary. More recently, on February 1, 2022, City Council
passed .Resolution 40-22 (attached), approving the land sale. The associated deed was drafted,
signed, and recorded with the Washington County Circuit Clerk on March 17, 2022.
Parallel to this, Engineering survey staff prepared a property line adjustment to reflect the
property sold to Peace at Home, which city planners reviewed and released for signatures.
Please sign the signature blocks for the Mayor and City Clerk -Treasurer respectively and route
it back to me. The six copies of the property line adjustment have been provided to the City
Clerk's Office for holding. A recorded copy will be returned to the Clerk -Treasurer.

WHEREAS, on January 4, 2005, the City of Fayetteville sold 1.5 acres to Peace at Home Family

equipped new facility made possible by a generous grant from the Donald W. Reynolds Foundation;
and
WHEREAS, after its new facility was opened in 2008, Peace at Home has been able to help many
more domestic violence survivors and their children with a safe and nurturing environment during their
transition to new private housing; and
WHEREAS, Peace at Home needs to expand its shelter to meet the increased need in our rapidly
growing area; and
WHEREAS, Peace at Home has secured grants to help fund this expansion and also to fund a small
animal shelter for pets owned by its domestic abuse survivors and their families; and
WHEREAS, Peace at Home services for Fayetteville's victims of domestic abuse are very needed
and valuable to Fayetteville and justify the sale of City property at the reduced rate of $20,000.00 per
acre for this salutary purpose; and
WHEREAS, Peace at Home has already submitted its Planned Zoning District rezoning to allow
construction of additional buildings for its Peace at Home Family Shelter expansion and for its animal

shelter and related developments to the City and has obtained a recommendation of approval from the
Planning Commission; and
WHEREAS, the Fayetteville City Council can consider and approve Peace at Home's requested
rezoning along with this Land Sale Contract during the same City Council Meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves the Land Sale
Contract with Peace at Home Family Shelter, Inc. to convey four acres of City property to Peace at
Home for eighty thousand dollars and other valuable consideration.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan
to sign this Land Sale Contract (attached to this Resolution) and all other necessary documents
necessary to accomplish this conveyance.
