FEET TO PROVIDE FOR FIVE-FOOT SIDEWALKS TO MATCH PREVIOUS PHASES OF
THE SUBDIVISION, AND TO REDUCE THE MASTER STREET PLAN RIGHT OF WAY
DEDICATION FOR THESE INTERNAL STREETS
WHEREAS, the applicant has proposed a subdivision with 53 total lots in Phases 3 and 4 of the
Magnolia Park Subdivision; and
WHEREAS, Phases I and 2 of the subdivision were approved under the 2030 Master Street Plan
standards and the applicant is requesting a two -foot right-of-way reduction along all proposed internal,
Residential Link streets to provide five-foot sidewalks to match those in the previous phases; and
WHEREAS, the City Council has determined to accept the dedication of two feet less of right of way
for the internal. Residential Link streets in Phases 3 and 4 of the Magnolia Park Subdivision and to
reduce the Master Street Plan right of way dedication requirements for these streets by two feet.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby accepts the offered
dedication of right of way for the internal Residential Link streets in Phases 3 and 4 of the Magnolia
Park Subdivision, which has been reduced by two feet to provide for five-foot sidewalks to match

those constructed in Phases I and 2 of the subdivision, as shown in the attached Exhibit A and legally
described in Exhibit B to this Resolution, and reduces the Master Street Plan dedication by two feet

The request is for a reduction to the Master Street Plan Right -of -Way.
RECOMMENDATION:
Planning Commission and staff recommend approval of a request to accept a lesser right-of-way
dedication as depicted in Exhibits 'A' and 'B' with the following conditions:
The requested lesser right-of-way dedication is limited to the internal streets associated
with Phases III and IV of the Magnolia Park Subdivision, as shown in Exhibit `A'.
BACKGROUND:
The subject property is located at the north end of Rupple Road in northwest Fayetteville and
contains approximately 24.26 acres. In late 2018, the City Council approved ordinances to annex
the property and rezone it to a mixture of RSF-4, Residential Single-family, 4 Units per Acre; NC,
Neighborhood Conservation; and NS -G, Neighborhood Services, General. A preliminary plat of
the Magnolia Park subdivision was approved for the property in March of 2019. The entitlement
expired prior to the developer receiving the requisite grading permit for Phases III and IV, so a
new preliminary plat for those phases was submitted and approved by the Planning Commission
on November 8, 2021.
Request: The applicant has proposed a subdivision with 53 total lots on the subject property (PPL-
2021-000018). Since the previous phases of the subdivision were approved under the 2030
Master Street Plan standards, the applicant is requesting a two -foot right-of-way reduction along
all proposed internal, Residential Link streets to provide five-foot sidewalks to match those
constructed in the existing portion of the subdivision.
Staff Findings: Staff recommends in favor of the request.

DISCUSSION:
At the November 8, 2021 Planning Commission meeting, the overall preliminary plat of the
property was approved. As part of this action, the Commission forwarded the request for lesser
dedication of right-of-way to the City Council with a recommended for approval by a vote of 9-0-
0. No public comment was made.

property located at 3855 W. WEIR RD. The property is zoned RSF-4,
RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE & NC, NEIGHBORHOOD
CONSERVATION and contains approximately 24.26 acres. The request is for the
preliminary plat of 51 residential lots and 2 non-residential lots.
RECOMMENDATION:
Staff recommends approval of PPL-2021-000018, with conditions.
RECOMMENDED MOTION: "1 move to approve PPL-2021-000018, recommending:
• In partial favor of the requested variance;
• In favor of the recommended street improvements; and
In favor of all other conditions as recommended by staff."

Proposal: The applicant is proposing a subdivision with 53 total lots; 51 of which would be
buildable. The non -buildable lots would be used for tree preservation and a detention pond. One
Planning Commission variance was requested with the proposed development. The requested
variance to the Unified Development Code is outlined below alongside staff's recommendation:
166.08(D)(5) — All street requirements shall be met as set forth in the City of
Fayetteville Master Street Plan and adopted minimum street standards. The
applicant proposes to reduce the typical Residential Link Street Section from 52 feet to 50
feet to allow for the construction of five -foot -wide sidewalks. The applicant's stated intent
is to match the existing sidewalks in the Magnolia Park subdivision. Rather than making a
recommendation on this request, the Subdivision Committee recommended that the
Alternative Residential Link Street Section be used throughout the development. The
applicant also proposed additional right-of-way and a separated drive at the north entrance
to the subdivision, which the Subdivision Committee was supportive of.
o Staff Recommendation: Staff recommends partial approval of this variance. Staff
finds that a lesser dedication of right-of-way in order to match the previous phases
of the subdivision is a reasonable request, and one that will minimally impact
pedestrian traffic and safety. Staff cannot support the Alternative Residential Link
Street Section as currently shown on the plat for Phases 3 and 4. The section was
included in the Master Street Plan for use in the Hillside/Hilltop Overlay District, as
well as in other special circumstances. The subdivision does not meet any of the
five criteria that would prompt staff to recommend the alternative street section.
The entire subdivision includes 166 lots which equates to 1,567 vehicle trips per
day — far exceeding the 250 vehicle trip maximum consideration for alternative
residential links. There are slopes on the site that average 20% in some places,
however, they are the result of grading and utility installation and will only be
temporary. Also, the development is not alley -loaded or a small in fill project, and it
has two block lengths less than 400 feet, not including stub -outs. In addition to
those considerations, if the Alternative Residential Link Street Section is approved,
it is likely that the City will receive requests after homes are built in the subdivision
to install sidewalks along those sides of the street which are proposed to have
none. If a lesser right-of-way dedication is approved instead, the applicant will be
required to seek approval from the City Council.
Street Improvements:
Internal Streets: Staff recommends that the internal streets for this phase of the subdivision be
improved according to the 2040 Master Street Plan Standards for a Residential Link Street, with
a reduced right-of-way dedication to accommodate 5 -foot sidewalks. Other recommended
improvements associated with this street section include 6 -foot greenspace, streetlights, and
street trees.
Weir Road: Staff recommends that the property's Weir Road frontage be improved in accordance
with the Master Street Plan standards for a Residential Link Street. Requested improvements
include 26 feet of right-of-way dedication from centerline, 6 -foot sidewalk, 6 -foot greenspace,
streetlights, and street trees.
Block Length/Connectivity: The phase of the subdivision will be accessed at four locations by the
existing adjacent street network. Future connectivity to adjacent properties is proposed at two
street stub -outs along Lierly Lane and Street K. The internal street network will have one block
along Street A which will exceed the permitted 660 linear feet of block length required for
Residential Link Streets. A variance was granted for that block length as part of the subdivision's
initial preliminary plat (PPL 19-6526). A 10 -foot soft trail is proposed to provide access to Lot 153.
Water and Sewer System: Public water lines and sanitary sewer lines will need to be extended
through the development. As proposed, this phase of the subdivision will connect to public water
through an existing 8 -inch main along Whistle Post Drive, 4 -inch main along Weir Road, and a
planned main along Rupple Road. Sanitary sewer will connect with existing lines at two locations
within the Magnolia Park subdivision.
Tree Preservation:
Canopy minimum requirement: 26.0%
Existing canopy: 23.9%
Preserved canopy: 11.3%
Mitigation required: 1,050 2" caliper trees
Parks: A PRAB meeting was held for this proposal on January 7, 2019. PRAB recommended fee -
in -lieu for this development, with the current amount estimated to be $55,539 based on 51 single-
family lots. The final amount of fee -in -lieu needed to satisfy parkland dedication will be determined
after the Planning Division's approval of the final plat. Fee -in -lieu must be paid prior to the
issuance of any building permits.
Public Comment: Staff has not received any public comment on this item to date.
RECOMMENDATION: Staff recommends approving PPL-2021-000018 with conditions.
Should the Planning Commission choose to approve the project, staff recommends the
following conditions of approval:
Conditions of Approval:
1. Planning Commission determination of street improvements:
a. Staff recommends that the internal streets be improved to the Master Street Plan
standards for a Residential Link Street with a two -foot right-of-way reduction to
allow for five-foot sidewalks. Staff also requests that the property's Weir Road
frontage be improved in accordance with the Master Street Plan standards for a
Residential Link street with 26 feet of right-of-way dedication from centerline.
External and internal streets should be improved with 6 -foot greenspace,
streetlights, and street trees. If approved, the reduced right-of-way will proceed to
City Council for consideration.
Subdivision Committee recommended in favor of street improvements for Weir Road,
and in favor of the Alternative Residential Link Street Section for internal streets
2. Planning Commission determination of requested variances:
a. §166.08(D)(5) - All street requirements shall be met as set forth in the City of

partially recommends in favor of this request. Staff is supportive of the variance to

3. Parks fees are required in the amount of $55,539.00 in -lieu of parkland dedication for 51
single-family lots. The final amount needed to satisfy this requirement will be determined
after the Planning Commission's approval of the final plat. Fee -in -lieu must be paid at the
time of final plat approval.
4. Streetlights shall be installed in accordance with code at all street intersections and
spaced no greater than 300 feet apart;
5. Conditions of approval from Engineering, Urban Forestry, and Parks Department are
included in the official conditions of approval;
6. The following revision(s) shall be made:
a. Update the building setback dimension for lots 125-135. The setback should be
aligned with the zoning district boundary.
- Fences around lots 123 and 153 shall be limited to 42 feet in height.
Standard conditions of approval:
7. All existing overhead utility lines 12kV and under shall be relocated underground. All
proposed utilities shall be located underground;
8. Sidewalk along all commonly owned lots (detention ponds, etc.) shall be constructed prior
to final plat. All other sidewalks shall be constructed or guaranteed prior to final plat;
9. All street names shall be approved by the 911 Coordinator and indicated on the final
plat. All streets require naming for final addresses. Contact the addressing office at (479)

10. All lots shall be labeled with addresses as approved by the 911 Coordinator on the final
plat;
11. A floodplain development permit is required prior to construction for any grading or
structures in the flood zone;
12. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his/her representative, and all comments from utility representative:
Black Hills Energy, AT&T, Ozarks, SWEPCO, Cox Communication);
13. Staff approval of final detailed plans, specifications and calculations (where applicable) for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
parking lot(s) and tree preservation. The information submitted for the plat review process
was reviewed for general concept only. All public improvements are subject to additional
review and approval. All improvements shall comply with City's current requirements; and
14. Preliminary Plat approval shall be valid for one calendar year.

Special Comments:
1. Engineering cannot support the street section shown for Phases 3 and 4. This section
was included in the Master Street Plan for use in the Hilltop/Hillside Overlay District as
well as in special circumstances where the following are taken into account when using
this section outside of the HHOD per the MSP cross-section:
a. Block lengths less than or equal to 400 feet
b. Environmental reasons where no other section is applicable
c. Historic streets for small infill projects
d. Streets with less than 250 vehicles per day
e. Alley -loaded development
Street A and W Lierly Lane serve as 2 of the 3 access points into the overall subdivision
from Rupple Rd and Weir Road. The overall subdivision includes 166 lots which equates
to 1567 vehicle trips per day (9.44 trips per dwelling unit). Street A and W Lierly Lane will
most likely see traffic significantly over the recommended 250 vpd.
There are slopes on site that range in grade up to an average 20% however, the land
disturbance associated with the grading and utility installation will be temporary. The
developer will revegetate and install street trees along the street frontage throughout the
subdivision.
The development is not alley -loaded, is not a small infill project, and has 2 block lengths
less than 400 ft (out of 9), not including stub -outs.
In addition to the previous points, if this street section is approved, it is highly likely the
City will receive requests after homes are built in the subdivision to install sidewalk on
the side that does not have sidewalk.
Engineering will support a lesser dedication of right-of-way in order to match the
previous phases of the subdivision.

at the owner/developers expense
3. All public sidewalks, curb ramps, curb & gutter, and driveway aprons along this project
frontage must meet ADA guidelines and be free of damage. Any existing infrastructure
that does not conform to ADA guidelines or is otherwise damaged must be removed and
replaced to correct the issue. Coordinate with the engineering department for inspection
of existing facilities to determine compliance.
4. Water and sewer impact fees will apply for the additional impact to the system. The fees
will be based on the proposed meter size and will be charged at the time of meter set.
5. Note, the following portions of all projects will typically not be reviewed by the
Engineering Division until time of construction -level review (unless specifically requested
at plat review):
