III & IV): A RESOLUTION PURSUANT TO § 166.04(B)(2) OF THE FAYETTEVILLE UNIFIED DEVELOPMENT CODE TO APPROVE THE DEDICATION OF A REDUCED AMOUNT OF RIGHT OF WAY FOR INTERNAL RESIDENTIAL LINK STREETS ASSOCIATED WITH PHASES 3 AND 4 OF THE MAGNOLIA PARK SUBDIVISION BY APPROXIMATELY TWO FEET TO PROVIDE FOR FIVE-FOOT SIDEWALKS TO MATCH PREVIOUS PHASES OF THE SUBDIVISION, AND TO REDUCE THE MASTER STREET PLAN RIGHT OF WAY DEDICATION FOR THESE INTERNAL STREETS WHEREAS, the applicant has proposed a subdivision with 53 total lots in Phases 3 and 4 of the Magnolia Park Subdivision; and WHEREAS, Phases I and 2 of the subdivision were approved under the 2030 Master Street Plan standards and the applicant is requesting a two -foot right-of-way reduction along all proposed internal, Residential Link streets to provide five-foot sidewalks to match those in the previous phases; and WHEREAS, the City Council has determined to accept the dedication of two feet less of right of way for the internal. Residential Link streets in Phases 3 and 4 of the Magnolia Park Subdivision and to reduce the Master Street Plan right of way dedication requirements for these streets by two feet. The non -buildable lots would be used for tree preservation and a detention pond. One Planning Commission variance was requested with the proposed development. The requested variance to the Unified Development Code is outlined below alongside staff's recommendation: 166.08(D)(5) — All street requirements shall be met as set forth in the City of Fayetteville Master Street Plan and adopted minimum street standards. The applicant proposes to reduce the typical Residential Link Street Section from 52 feet to 50 feet to allow for the construction of five -foot -wide sidewalks. The applicant's stated intent is to match the existing sidewalks in the Magnolia Park subdivision. Rather than making a recommendation on this request, the Subdivision Committee recommended that the Alternative Residential Link Street Section be used throughout the development. The applicant also proposed additional right-of-way and a separated drive at the north entrance to the subdivision, which the Subdivision Committee was supportive of. o Staff Recommendation: Staff recommends partial approval of this variance. Staff finds that a lesser dedication of right-of-way in order to match the previous phases of the subdivision is a reasonable request, and one that will minimally impact pedestrian traffic and safety. Staff cannot support the Alternative Residential Link Street Section as currently shown on the plat for Phases 3 and 4. The section was included in the Master Street Plan for use in the Hillside/Hilltop Overlay District, as well as in other special circumstances. The subdivision does not meet any of the five criteria that would prompt staff to recommend the alternative street section. The entire subdivision includes 166 lots which equates to 1,567 vehicle trips per day — far exceeding the 250 vehicle trip maximum consideration for alternative residential links. There are slopes on the site that average 20% in some places, however, they are the result of grading and utility installation and will only be temporary. Also, the development is not alley -loaded or a small in fill project, and it has two block lengths less than 400 feet, not including stub -outs. In addition to those considerations, if the Alternative Residential Link Street Section is approved, it is likely that the City will receive requests after homes are built in the subdivision to install sidewalks along those sides of the street which are proposed to have none. If a lesser right-of-way dedication is approved instead, the applicant will be required to seek approval from the City Council. Street Improvements: Internal Streets: Staff recommends that the internal streets for this phase of the subdivision be improved according to the 2040 Master Street Plan Standards for a Residential Link Street, with a reduced right-of-way dedication to accommodate 5 -foot sidewalks. Other recommended improvements associated with this street section include 6 -foot greenspace, streetlights, and street trees. Weir Road: Staff recommends that the property's Weir Road frontage be improved in accordance with the Master Street Plan standards for a Residential Link Street. Requested improvements include 26 feet of right-of-way dedication from centerline, 6 -foot sidewalk, 6 -foot greenspace, streetlights, and street trees. Block Length/Connectivity: The phase of the subdivision will be accessed at four locations by the existing adjacent street network. Future connectivity to adjacent properties is proposed at two street stub -outs along Lierly Lane and Street K. The internal street network will have one block along Street A which will exceed the permitted 660 linear feet of block length required for Residential Link Streets. A variance was granted for that block length as part of the subdivision's initial preliminary plat (PPL 19-6526). A 10 -foot soft trail is proposed to provide access to Lot 153. Water and Sewer System: Public water lines and sanitary sewer lines will need to be extended through the development. As proposed, this phase of the subdivision will connect to public water through an existing 8 -inch main along Whistle Post Drive, 4 -inch main along Weir Road, and a planned main along Rupple Road. Sanitary sewer will connect with existing lines at two locations within the Magnolia Park subdivision. Tree Preservation: Canopy minimum requirement: 26.0% Existing canopy: 23.9% Preserved canopy: 11.3% Mitigation required: 1,050 2" caliper trees Parks: A PRAB meeting was held for this proposal on January 7, 2019. PRAB recommended fee - in -lieu for this development, with the current amount estimated to be $55,539 based on 51 single- family lots. The final amount of fee -in -lieu needed to satisfy parkland dedication will be determined after the Planning Division's approval of the final plat. Fee -in -lieu must be paid prior to the issuance of any building permits. Public Comment: Staff has not received any public comment on this item to date. RECOMMENDATION: Staff recommends approving PPL-2021-000018 with conditions.
