This parking lot was fenced to secure police vehicles and equipment. On December 7, 2019, Fayetteville Police Officer Stephen Carr was shot and killed while sitting in his marked police car which was parked on the north side of the Fayetteville Police Department building. On June 6, 2020, a marked police unit was vandalized while parked on Block Avenue adjacent to the building. On September 6, 2020, three juveniles were intercepted as they were taking selfies while kneeling down next to marked police units parked outside the building. On January 9, 2021, a marked police unit was vandalized while parked outside the building. On October 21, 2021, a suspect fired a "bolt" arrow from a crossbow into a marked police unit which was parked on Block Street adjacent to the building. DISCUSSION: These increased incidents of vandalism and attack directed at police officers and marked police units have led us to move all of our marked police units away from the building and into the more secure fenced parking lot at the southeast corner of Block Avenue and Rock Mailing Address: 113 W. This will mitigate the danger of a suspect approaching officers while their attention is focused on loading, unloading, and inspecting their marked police units. This parking lot cannot accommodate the storage of all marked police department vehicles. This request is for funding to fence the perimeter of the unfenced, city -owned parking lot immediately south of the current fenced lot, thereby combining the two parking lots into one secure lot for the parking of police vehicles, as well as the addition of lighting, cameras, and other security measures. On November 1, 2021, the Fayetteville Planning Commission granted a fence -height variance for the additional fencing for this lot. The fencing will match the design and height of the existing fence. BUDGET/STAFF IMPACT: The attached Budget Adjustment will allocate up to $100,000 for these security upgrades. There is no Staff impact. BLOCK AVEJ PD PARKING LOT FENCING, 523): Submitted by CITY STAFF for property located at 216 S. BLOCK AVE. The property is zoned DG, DOWNTOWN GENERAL and contains approximately 0.57 acres. The request is for a variance of the Downtown Design Overlay District fence standard. RECOMMENDATION: Staff recommends approval of VAR-2021-000049, with conditions. RECOMMENDED MOTION: "I move to approve VAR-2021-000049, determining: • In favor of the requested parking lot design variance; and • In favor of the other condition recommended by staff. BACKGROUND: The subject property is located in Downtown Fayetteville at the southeast corner of W. Rock Street and S. Block Avenue. While historical aerial imagery suggests the property was developed with single-family homes through the 1980s, it has since been used for surface parking that is divided by terrain into two pads. The upper pad accesses Rock directly and is used by the Fayetteville Police Department. A variance was approved by the Planning Commission in June of 2015 to allow fencing in excess of the Downtown Design Overlay District's maximum height along the lot's perimeter. The lower lot is used as overflow parking for City staff, City vehicles, and members of the public accessing the Media Services Department at 101 W. Rock Street. Surrounding land uses and zoning is depicted in Table 1. DISCUSSION: Request: Uniformed officers of the Fayetteville Police Department have experienced heightened levels of violence and threats of violence in recent years. In acknowledgement of this, the Planning Commission November 8, 2021 Agenda Item 2 ADM 21-000049 (PD Lot Fence) Page 1 of 14 Department proposes to repurpose the southern parking area of the subject property for marked police car parking. In evaluating the proposal, the Department identified a need for fencing that conflicts with the Downtown Design Overlay District (DDOD). Specifically, §168.21(E)(6) delineates fencing standards, including a height maximum of 42-inches in a front yard area. Accordingly, the Fayetteville Police Department requests a variance to allow installation of an 8- foot, metal security fence similar to that around the northern portion of the property on the currently un-fenced southern parking lot. Staff Recommendation: Staff acknowledges that it is in the public interest for uniformed officers of the Fayetteville Police Department to discharge their duties effectively. This includes entering and exiting their vehicles and preparing for shifts without delays associated with additional security precautions. Accordingly, from a hardship perspective, staff finds that the variance is justified. Further, in considering the existing fencing installed on the northern portion of the site, staff finds that extending this southward meets the intent and purpose of the DDOD to use quality materials in Downtown Fayetteville. RECOMMENDATION: Staff recommends approval of VAR-2020-000049 subject to the following conditions: Conditions of Approval: 1. Planning Commission determination of a variance of Chapter 166.21(E)(6), to permit fencing in excess of 42-inches and continuing the design utilized on the property to the north. Staff finds in favor of the request, finding that a variance is necessary for the Police Department to properly secure their vehicles and equipment. 2. The fence shall be constructed in similar configuration to that installed surrounding the surface parking lot to the north. The intent of this ordinance is to encourage good architectural form through the use of quality design and materials. The goal of the code is to promote functional architecture that creates attractive and usable space. Downtown Fayetteville has a rich architectural history spanning many decades and styles; therefore, architecture should be respectful of the existing built environment and should strive to enhance the public realm. A strong emphasis shall be placed upon designing and implementing sustainable and green architecture practices. (B) Applicability. The Downtown Design Overlay District applies to parcels of land located within the boundaries of the Downtown Design Overlay District. The Downtown Design Overlay District Architecture Standards are applicable in the following instances: (1) If a conflict occurs between different standards, these standards shall supersede the City's Nonresidential Design Standards; Office, and Mixed Use Design and Development Standards in the Downtown Design Overlay District and College Avenue Overlay District. (2) All new construction, additions or renovations shall comply with these standards regardless of whether the improvements require a permit; ordinary repairs and maintenance are not subject to these standards. Specifically, only the new construction or portions of the building that are being renovated shall comply with these standards. (3) Building designs that strictly comply with these standards are to be considered approved for matters of aesthetics and shall not require further discretionary review for architectural character or appearance. (4) Building designs that do not comply with these standards may be permitted by a variance after review and approval by the Planning Commission. (5) Building designs that are denied or approved by the Planning Commission may be appealed to the City Council. (E) Exterior Architectural Elements. The lists of permitted materials and configurations have been selected for their durability, sustainability and responsiveness to climate. The primary goal of the Architectural Elements is authenticity; the elements encourage construction that is straightforward and functional and draws its ornament and variety from the assembly of genuine materials. Items not listed in the Architectural Elements may be approved upon review by the Planning Commission. (6) Garden Walls, Fences and Hedges. (a) General Requirements. Fences, garden walls, or hedges are permitted along side yards, rear yards, and all property lines which abut public streets or alleys. (ii) Fences in the front yard shall be not be 100% opaque and shall provide visible separation between the fence slats. Fences in a rear or side yard, at least 10 feet behind the principal facade of the primary structure, may be at a maximum 100% opaque. (b) Height. (i) Front yard (in front of the primary structure) maximum height of 42 inches. (ii) Fences located in the rear and side yards (behind the principal facade of the primary structure) shall have a minimum height of 36 inches and a maximum height of 8 feet. (c) Permitted Configurations. (i) Wood Fences. Vertical picket fences or horizontal slat fences with corner posts, and split rail fences; privacy fences are permitted in the rear and side yard only, behind the principal facade of the primary structure. (ii) Metal Fence. Fence shall be comprised of primarily vertical pickets with a minimum %-inch diameter, and 4-inch maximum clear space between the pickets. (iii) Brick and Stone. No. 6017, §1, 12-5-17) Planning Commission November 8, 2021 Agenda Item 2 ADM 21-000049 (PD Lot Fence) Page 5 of 14 - IV CITY OF FAYETTEVILLE ARKANSAS VAR-2021-000049 Request Letter MEMORANDUM TO: Matthew Johnson, Planning Conunission Chairman, City of Fayetteville FROM: Jamie Fields, Deputy Chief of Poh& DATE: October 28, 2021 SUBJECT: Fence Height Variance Request The Police Department is requesting a variance from the fencing height restrictions in the Downtown Design Overlay District (Chapter 166.21, E.6.b.i). The City of Fayetteville owns two contiguous parking lots adjacent to the police department at the intersection of Rock Street and Block Avenue. One parking lot opens to Rock Street, and in 2015, it was fenced with 8' black metal security fencing. It is used for police department vehicles, trailers and equipment. One parking lot opens to Block Avenue, and it is partially fenced on three sides with fencing of various materials and heights. Neither lot is available for public parking. Police officers have experienced an increase in physical aggression and violence over the past twenty-two months. Marked police vehicles have been the focus of negative attention and aggression. Due to the threat to officer safety at the police department, we have moved all marked patrol vehicles from parking areas behind and beside the police department to the fenced parking lot. The security this parking lot provides helps mitigate the danger for officers when they are loading, unloading, and inspecting their vehicles. This parking lot does not provide adequate space for all of our marked vehicles. We are currently in the process of obtaining pricing to install the same or similar 8' metal security fencing around the parking lot that opens to Block Avenue. In order to maintain consistency in both aesthetics and security, we are requesting a variance from the 42" maximum fence height restrictions on the Block Street side, allowing the police department to use 8' security fencing for the entire lot. The addition of 8' black metal fencing around the parking lot is a good addition, because the fencing will be the same or similar to the existing security fencing that surrounds the bordering parking lot. The fencing was selected to both deter aggression towards police officers and equipment while also being aesthetically appealing and complimentary of the intent of the Downtown Design Overlay District's standards. If it is possible to do so, the fencing that separates the two lots will be reused, opening the divider between the two lots, creating one fenced area and saving expense. The security fencing is necessary to protect officers as they load, unload and inspect their vehicles, times when their attention is diverted, and they are vulnerable.
