PROJECT, AND TO APPROVE A BUDGET ADJUSTMENT
WHEREAS, on June 19, 2018. the City Council approved a contract with Nelson Byrd Woltz, LLC,
to provide landscape architecture services for the design of the Cultural Arts Corridor; and
WHEREAS. change orders were previously approved to allow the landscape architect to proceed
with Phase 2: Design Development, Construction Drawings. and Bidding Services, Phase 3:
Construction Documentation, Bidding, and Negotiation; and Phase 4: Construction Administration; and
WHEREAS, Change Order No. 5 will provide professional landscape architecture services for the
completion of construction documentation, bidding and negotiation for the early package of the Upper
Ramble as well as additional construction administration services for the Lower Ramble in the Cultural
Arts Corridor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section I : That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan
to sign Change Order No. 5 to the contract with Nelson Byrd Woltz, LLC in an amount not to exceed

WHEREAS, on June 19, 2018, the City Council approved a contract with Nelson Byrd Woltz, LLC, to

WHEREAS, change orders were previously approved to allow the landscape architect to proceed with Phase

Bidding, and Negotiation; and Phase 4: Construction Administration; and
WHEREAS, Change Order No. 5 will provide professional landscape architecture services for the completion
of construction documentation, bidding and negotiation for the early package of the Upper Ramble as well as
additional construction administration services for the Lower Ramble in the Cultural Arts Corridor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

RECOMMENDATION:
Staff recommends approval of Change Order #5 to the contract with Nelson Byrd Woltz (NBW)
Landscape Architects in the amount of $395,009 to provide professional landscape architecture
services for the completion of Construction Documentation and Bidding and Negotiation for the
early package of the Upper Ramble and additional Construction Administration for the Lower
Ramble and Approval of a Budget Adjustment.
BACKGROUND:
The Ramble is a new 50-acre outdoor public corridor that will help to revitalize Fayetteville's
downtown area and create a destination for residents and visitors. Linking the City's key
cultural institutions —including the Walton Arts Center, TheatreSquared, Nadine Baum Studios,
Fayetteville Public Library, and the University of Arkansas' Art and Design District —the corridor
will showcase and celebrate local arts culture. It will also enhance civic space and serve as a
catalyst for additional development and density in the downtown area, increasing bike trails and
connections, and improving streets and walkability. This project is part of the Cultural Arts
Corridor Bond package approved by Fayetteville voters in April 2019.
Construction on the Lower Ramble in the Fay Jones Woods and along the southern portions of
West Avenue and the Razorback Greenway began in September 2020 and will be completed in
the Spring of 2022. Construction on replacement parking deck in the Upper Ramble is
scheduled to begin in November 2021. The replacement parking deck must be complete prior
to the start of substantial construction on the Civic Plaza portion of the Upper Ramble. An early
package of the Upper Ramble that includes work along the Razorback Greenway, West Ave
and Dickson Street has been developed to advance a portion of this work.

DISCUSSION:
The scope of work and fees proposed in this change order with Nelson Byrd Woltz are for the
Early Package design work of the Upper Ramble that includes the northern portion of
West Ave (between Meadow St. and Dickson Street), Dickson Street (between the Railroad
Tracks and School Ave) and the Razorback Greenway (between Center Street and Spring St).
It does not include any portion of the future Civic Plaza space that is currently occupied by the
West Ave Parking Lot.
The following preliminary schedule has been developed by NBW for Scope Area B in the Upper
Ramble:
• Construction Documentation — 10 weeks — November 2021 — January 2022. This will
include the development of technical documentation for construction, coordination of
drawings with the full sub -consultant team, finalization of the materials palette for all
landscape elements in coordination with the City, facilitation and review of construction
specifications at 50% and 100% of construction drawings, meet and coordinate with the
project Construction Manager as they provide cost estimates, on -going documentation of
all necessary project materials for SITES certification.
• Bidding and Negotiation — 8 weeks — February 2022 - March 2022. This will include
coordination and information requests from contractors and sub -contractors and
preparing necessary addendums as directed and requested by the City.
• Audio Visual Design Development — November 2022. This work will define audio visual
infrastructure needs and pricing for the Civic Space.
• Dickson Street Schematic Design — 10 weeks — November 2021 — January 2022. This
work will provide schematic level design for Dickson Street between West Ave and
School Ave.
Additionally, the scope of work includes additional construction administration from November
2021 — April 2022 for the completion of the Lower Ramble in Scope Area A.
BUDGET/STAFF IMPACT:
The maximum not -to -exceed amount authorized for this change order is: $395,009. Partial
funding for this work will come from the remainder of the Walton Family Foundation Design
Excellence Grant. The remainder of the funding will come from a combination of the Cultural
Arts Corridor Bond, Transportation Bond and Water/Sewer Capital Improvement.

Project Understanding
There are two Primary Scope Areas and four Design Phases of the Cultural Arts Corridor (CAC).
Primary Scope Areas:

Phase 4 - Construction Administration
The following scope of work and fees are for design services for Areas A and B as outlined in Basic
Services below. The Schematic Design, including its illustrative package and estimated construction cost
served as the basis for inclusion in a bond referendum administered by the City of Fayetteville (CoF) to
fund the proposed improvements. This bond referendum was passed by Fayetteville voters on April 9,
2019.
Because of limited bond fund availability at this time, Construction Administration (CA) for Streetscapes
and Construction Documents (CD), Bidding and Negotiation (BN) and Construction Administration (CA)
for Civic Space scope are omitted from this scope discussion. We assume that these services would be
provided as an amendment to the contract or as Additional Services.
Basic Services
The following proposal is intended to clearly describe the scope elements provided by NBW and those
that will be provided by sub -consultants. As prime consultant, NBW will coordinate all sub -consultants
and collect and submit design packages and billing directly to the City of Fayetteville.
The team of sub -consultants includes the following:

submittals to regulatory agencies. Their scopes specific to this proposal are outlined below.

Nelson Byrd Woltz Landscape Architects (NBW)
I. Area B Streetscapes (Early Package): Phase 3: Construction Documents
10 weeks (November - January 2022)
Scope
• Design strategies based upon feedback from the CoF and Design Development pricing exercise;
including refining budget/phasing/implementation strategies.
• Coordinate drawings with full sub -consultant team.
• Engage with stakeholders and steering committee through web conferences as required.
• Provide information and coordinate with the project Construction Manager as they produce Cost
Estimate

• Lead the design team in preparation of the project for Sustainable Sites Initiative (SITES) certification.
This will include an ongoing evaluation of the project design to ensure that it meets point targets and
design aspirations.
• Facilitate and review construction specifications to accompany 50% CDs and 100% CDs (by Rico
Associates).
• Meet with team and construction manager (CM) to review 50% CDs
• The timing of this cost estimate will be scheduled in coordination w/ the design team and CoF.
• Coordinate team submission of required permits and document review by City officials

I. Phase 3 Early Package Streetscapes: Bidding and Negotiation

• Respond to requests for information from contractor and subcontractors.

• Prepare and coordinate necessary addendums as directed and requested by the City.
II. Area B Civic Space: Phase 2: Audio Visual Design Development
10 weeks (September — November 2021)
Scope
• NBW will work with the Client and AV sub -consultant to assist in defining the AV infrastructure needs
and pricing for the Civic Space

Scope
• Coordinate with CoF and subconsultants on street, parking and sidewalk improvements on Dickson
Street between West and School Avenue

• Implement Dickson Street paving and lighting standards

IV. Phase 4 Construction Administration: Additional Services
Scope
• Provide continued CA services for extended phase duration (64 weeks to 78 weeks) due to permitting
delays and other factors
Assumptions
• NBW assumes that all base materials including a current survey of the project site shall be provided by
the client prior to start of work.
Additional Services
If any of the following Services are required due to circumstances beyond the Landscape Architect's
control, the Landscape Architect shall notify the Client. No Additional Services will be performed until
receipt of written authorization from the Client. If the Client deems that such Services are not required,
the Client shall give prompt written notice to the Landscape Architect and the Landscape Architect shall
have no obligation to provide such Services. Authorized Additional Services shall be paid for in
accordance with the attached schedule of hourly rates.
• Providing Services required because of changes to the Project Scope.
• Providing Services in connection with a public hearing, administrative hearing, arbitration proceeding
or legal proceeding to which the Landscape Architect is not a party.
• Providing "project management" services to assist the Client in performing its obligations to other
people or entities in connection with the Project.
Flintlock - Local Landscape Architect
I. Area B Streetscapes (Early Package): Phase 3: Construction Documents
Scope
• Provide ongoing design review and critique of overall design
• Support the team with logistical support, meeting space, and attend internal design meetings during
NBW visits.
• Attend and participate in bi-weekly team digital meetings (10), led by NBW
• Attend and participate in bi-weekly OAC digital meetings (12), led by Nabholtz

• Attend and participate in meetings w/ the steering committee (2) and other local stakeholders as
needed.
• Attend and participate in necessary meetings that may arise during the construction document
development (i.e. w/ material suppliers, city officials, project construction manager), not to exceed (6)
• Work with NBW and Olsson to develop streetscape improvement plans per the below scope plan
exhibit
• Olsson to lead document production, with full drawing review (in .dwg format) by Flintlock Ltd at key
milestones (50% and 100%) to ensure conformance with design intent, current landscape best
practices, and constructability.
• Spring St is excluded west of West Ave (outside the city ROW) from the scope
I. Area B Streetscapes (Early Package): Phase 3: Bidding and Negotiation
Scope
• Provide support to NBW in navigating the Bidding and Negotiation process with CoF.
• Attend and participate in weekly team digital meetings (4), led by NBW
• Attend and participate in bi-weekly OAC digital meetings (2), led by Nabholtz
III. Dickson Street: Phase 1: Schematic Design
Scope
• Develop schematic level design of Dickson St between West Ave and Spring St, coordinated with COF
Engineering and utilizing standard Dickson St construction details. Documented to 100% Schematic
Design level.
Olsson Associates - Civil, Soils, Surveying, Geo Technical, Structural
I. Area B Streetscapes (Early Package): Phase 3: Construction Documents
• Preliminary layout drawings to be provided by NBW. Olsson will finalize layout and grading with NBW
coordination. Plans will be in Civil 3D AutoCAD format, latest edition.
• Significant redesign of drawings provided by NBW or NBW's subconsultants shall be additional
services and shall be billed at Olsson's standard hourly rate.
• Olsson to approximately provide (1) preliminary Existing Conditions Plan, (1) Demolition Plans, (1)
Grading Plan, (2) Street Plans, (2) Drainage plans, and standard civil detail sheets.
• Standard civil detail sheets include standard City of Fayetteville details. Custom project details to be
provided by Client or may be provided by Olsson as an additional service.
• Grading plans shall include only plan view designs. Olsson excludes 3D proposed grade modeling,
street profiling and street cross sections.
• Franchise Utility Coordination: Olsson will coordinate potential relocations with the electric service
provider, gas provider, and communications provider in the area. This assumes roughly 1.5 weeks of
time for services, updates, coordination, etc.

• Drainage Design & Coordination: The fee provided includes preparation of a drainage report meeting
requirements of the SITES and City of Fayetteville for this Scope Area.
• SWPPP Permitting: The fee provided includes preparation and submission a Stormwater Pollution
Prevention Plan (SWPPP) including design of erosion and sediment control plan which shall meet the
requirements of the State NPDES Permit and local agency requirements and which shall include
BMP's such as silt fence, construction entrances, sediment basins, etc.
I. Area B Streetscapes (Early Package): Phase 3: Bidding and Negotiation
Scope
• Per the Clients request, Olsson shall provide all Bidding and Construction Phase Services hourly in
accordance with the hourly rate table. These services are assumed to include but are not limited to,
review of shop drawings, construction meetings, review and responding to BFI's, construction site
visits, punch lists, and record drawings.
I. Area B Streetscapes (Early Package): Phase 3: Construction Documents:
Water and Sewer Replacement
Scope
• Meet with the CoF to understand the project needs.
• Consult with regulatory and governmental authorities having jurisdiction over the project.
• Prepare construction drawings including engineering design and drafting (City of Fayetteville Standard
Specifications for Design and Construction of Water lines and Sewer Lines, 2017 Edition, shall be
used as basis of design and as construction specification).
• Submit, on behalf of CoF, construction specifications, drawings and design criteria for approval to the
Arkansas Department of Health (ADH) and other agencies, if required. The ADH review fee of $500 is
included as a reimbursable expense.
I. Area B Streetscapes (Early Package): Phase 3: Bidding and Negotiation:
Water and Sewer Replacement
Scope
• Provide clarifications, including answering questions from potential bidders, during the bid phase
through the CoF
• Assist CoF with preparation of addenda
II. Dickson Street: Schematic Design
Scope
• Provide SD services for the civil elements of the project located along Dickson Street from West to
School

4. Phase 1 CA -Additional Services
Scope
• Provide continued field observation services in the following manner:
- Water & Sewer Field Observations — Olsson will observe remaining construction of the water and
sewer lines for the Cultural Arts project, which includes U1.04, U1.05, U1.06, and U2.01 thru U2.06.
Olsson has included office documentation from field observations, and project closeout
documentation. Olsson has based this proposal on the estimated remaining observations from
November 1, 2021, to completion.
- Structural Observations — Olsson will observe remaining structural construction items for the Cultural
Arts project, which includes woods, street, and walls. Fees for structural observation are based on
estimated number of hours agreed upon by NBW and City. If additional observation is requested
beyond these hours, an additional amendment may be requested.
• Provide continued construction observation and testing services in the following manner:
- Fill Placement — Olsson will perform field density tests on structural fill placed within the footprint of
proposed pavement areas, and in backfill placed within segments of utility trenches, retaining walls,
and/or along segments of foundation walls.
- Exterior Concrete — Field tests, including slump, air entrainment and temperature, will be performed
on samples of concrete obtained from these structures. Cylinders will be cast from the concrete used
in the construction of the structure for compressive strength testing.
Exclusions
• The following services are not included in this phase of work:
- RPR concrete placement observation and quality control. This is separate from concrete materials
testing that is being provided in testing scope above.
- Preparation of periodic written observation reports other than water and sewer reports included
above.
- Civil observation of street improvements including curb, sidewalks, base placement, asphalt
placement, driveways and storm drainage.
Rico Associates - Specifications

Water -Use & Infrastructure Planning Scope

• Attend as many design/coordination meetings (online conference calls/video conferences) with Owner
&/or design team as needed throughout the scope of design.
• Meet online with the Owner and design team to discuss the water source strategy for the project,
outline water delivery to the site and discuss initial concepts for irrigation water distribution throughout
the building, pumping and irrigation.
• Obtain site landscape and infrastructure information for key areas of the development.
• Obtain & review project design documents for development, landscape planting approaches and
irrigation equipment preferences.
• Site irrigation Water -use Plan will be developed to estimate annual water usage from potable water.
• Water -use Plan drawing showing proposed potable water tap and meter locations, areas to be
irrigated, preliminary mainline pipe routing, isolation valve locations, pipe and wiring sleeves under
hardscapes, and controller locations with electrical power drop requirements.
• Determine the anticipated irrigation approach for general areas of development, primary equipment
recommendations, estimated peak demand and annual water usage for the site.
Water Use & Infrastructure Planning Deliverables
Information requests, notes, communications provided in the required format. Coordination of tap,
meter, backflow and sleeve locations. Summary and charts of water -use demands annually, monthly,
weekly, peak month daily & GPM.
Irrigation Plan Design, Details and Specifications Scope
• Prior to design, determine point -of -connection (POC) location, available pressure and size in
coordination with the Civil or Mechanical Engineer, Landscape Architect, and Architect.
• Water & cost saving strategies will be presented to achieve reduced water use by implementing
weather -based irrigation controls with system performance & management features, efficient irrigation
strategies and superior system design.
• Based on coordination with the Owner & Design Team, Hines will review specification of the irrigation
control system for the appropriate level of system monitoring & water conservation features

current irrigation approach. We will include that as an upload to gain the pertinent SITES points.
• Review and differentiate project water needs by irrigation method using the final landscape planting
plan and verify landscape square footages with client to ensure consistency between LA and Irrigation
SITES submissions.
• Complete and submit worksheet for `Water Efficient Landscape' on the SITES Online web portal.
Plan Evaluation for SITES Certification Deliverables

I. Area B Streetscapes (Early Package): Phase 3: Construction Documents
Scope
• Participate in design meetings via Go to Meeting, or similar, with the Owner, Landscape Architect and
other Consultants.
• Prepare final design and layouts of proposed lighting fixtures on background drawings as provided by
the Landscape Architect or Electrical Engineer. We have allowed for a maximum of 2 submission sets
during CDs, at 50% and 100% complete. LTLDA will provide lighting layouts as AutoCAD layers to the
Landscape Architect/Electrical Engineer for their use in producing contract documents.
• Please Note: Once 100% complete Bid Documents have been issued, any subsequent revisions to
the layouts will be reviewed and redlined with revisions to be completed by the Landscape Architect;
or by LTLDA as an Additional Service.
• Prepare a final fixture schedules listing fixture types included in the lighting design, including
manufacturer's names and designations. Fixture schedules will be submitted as documents to be
included in the project manual.
• Provide final lighting fixture cuts or other descriptive material describing equipment that is part of the
lighting design. Fixture cut sheets will be submitted as documents to be included in the project
manual.
• Provide light fixture specifications, in CSI Format, for inclusion in the contract documents to be
prepared by the Electrical Engineer/Landscape Architect ("Contract Documents").
• Assistance with coordination of lighting design with landscape, structural, electrical and design.
• We will provide a control zone diagram and schedule as required to explain control intent to the
Electrical Engineer. Control system to be designed and specified by Others. (All electrical circuiting
and power distribution to be designed and specified by electrical engineer; all control equipment to be
verified, specified, and coordinated by electrical engineer.)
III. Dickson Street: Phase 1: Schematic Design
Scope
• Review the city standard for Dickson Street lighting and site conditions along Dickson Street to ensure
the lighting design is in accordance with the municipal ordinance.
• Participate in design meetings via Go to Meeting, with the Landscape Architect and other Consultants.

• Prepare a preliminary lighting plan overlaid on the site plan as furnished by the Landscape Architect.
• Provide diagrams along with fixture cuts to describe the lighting concept.
• Prepare preliminary lighting plan keyed to schematic fixture schedule and preliminary fixture cut
selections suitable for budget pricing.
Threshold - Audio Visual Systems
II. Area B Civic Space: Audio Visual: Phase 2: Design Development
Scope
• Attend an initial remote meeting with NBW, Peter Nierengarten and event organizers in November
2021 to discuss the desired AV systems performance and functional/operational considerations that
will inform the rough order -of -magnitude estimate. The initial meeting will be followed by targeted
conversations with the programming, technical, and steering committees as needed, up to a
maximum of 4 virtual meetings with these Client organizations.
• Participate in up to 3 design team coordination meetings with NBW, MEP and Lighting team.
• Based on the committee conversations, produce diagrams that locate connection panels for
components of user -supplied portable equipment. Requirements for Audio and Video cable as well as
isolated -ground power for AV systems will be defined in these documents. Locations for company
switches and temporary AV rack locations will also be defined.
• Prepare an AV Systems Functional Description at the end of this phase (coterminous with the end of
the project's Design Development phase) summarizing project requirements and the systems required
to meet them. This document will include an order -of -magnitude cost estimate for the AV systems.
Electrical power required for AV systems will be indicated on the Design Development documents
prepared by the Electrical Engineer. Our report will be issued with the 100% Design Documentation
set.
