SUBJECT: RZN 2020-000022: Rezone (3670 W. MT. COMFORT RD./LANDMARC HOMES
& HARDIN, 323): Submitted by CLARK LAW FIRM for property located at 3670
W. MT. COMFORT RD. The property is zoned R-A, RESIDENTIAL
AGRICULTURAL and contains approximately 6.05 acres. The request is to rezone
the property to CS, COMMUNITY SERVICES.
RECOMMENDATION:
City Planning staff and the Planning Commission recommend approval of a request to rezone the
subject property as described and shown in the attached Exhibits 'A' and 'B'.
BACKGROUND:
The subject property is located in west Fayetteville at the northeast corner of W. Mt. Comfort Road
and N. Rupple Road. The property is currently zoned R-A, Residential -Agricultural, and the
request contains the southern portions of two separate properties with two separate owners, 3670
W. Mt. Comfort Road and 3568 W. Mt. Comfort Road. Both properties are developed with single-
family dwellings and associated rural land. A similar request was made to the Planning
Commission in August 2020 for a smaller, 2-acre portion of the site located directly at the corner
of W. Mt. Comfort Road and N. Rupple Road; Planning Commission voted to forward the request
to City Council with a vote of 7-1-0 but the request was ultimately withdrawn by the applicant at
City Council.
Request: The request is to rezone the property from R-A, Residential -Agricultural, to CS,
Community Services. The applicant has not submitted an associated development plan.
Public Comment: Staff fielded public comment on the item prior to the December 14, 2020
Planning Commission meeting, mostly in the form of questions about the proposal. However, the
neighboring property owner to the east expressed opposition to the proposal, citing concerns
about the potential for the development of a liquor store; Use Unit 34, Liquor Stores is a conditional
use in the CS, Community Services zoning district. Additional public comment was heard at the
meeting, which is summarized below.

Land Use Compatibility: The property in question is primarily rural and residential in nature, and
is immediately surrounded by rural and low -intensity uses, such as a church and associated
cemetery to the west, and low -density residential to the east. However, the greater surrounding
area is beginning to see redevelopment; the property immediately across the street to the south
and to the southwest was rezoned to CS, Community Services, in 2018 (totaling about 40 acres),
and the property at the corner of N. Salem Road and W. Mt. Comfort Road was rezoned to CS in
2016. W. Mt. Comfort Road is a fully -developed Regional Link -High Activity Street, which expects
a Design Service Volume of 17,600 vehicles per day, and currently sees a daily traffic count of
15,000 cars. N. Rupple Road is also called out in the Master Street Plan as a Regional Link, but
is currently underdeveloped to those standards, so future widening and improvements are
necessary to bring it into compliance with the Master Street Plan. There is not currently an
overwhelming pre-existing development pattern in the area as far as building heights or setbacks,
but the prevailing surrounding zoning districts of CS indicates that this area is going to expect
much more density and higher intensity of uses in the near future.
Land Use Plan Analysis: Staff finds that the proposal is compatible with the goals in City Plan
2040, adopted land use policies, and the future land use designation for this location. This area
is designated as a City Neighborhood Area, which encourages a wide variety of uses, and focuses
commercial uses towards street intersections and major corridors. Staff finds that focusing CS
zoning at the corner of N. Rupple Road and along the W. Mt. Comfort Road frontage is consistent
with the goals outlined in City Plan 2040, and encouraging a form -based district rather than other
districts such as C-1 or C-2 allows for a higher scrutiny of design standards and intention on the
site towards pedestrian friendliness, including for the auto -centered uses which are allowed by -
right in CS.
CITY PLAN 2040 INFILL MATRIX: City Plan 2040's Infill Matrix indicates a score of 6-7 for this
site. The following elements of the matrix contribute to the score:

• Near Park (Bryce Davis Park)
• Near Public School (Holt Middle School)
• Near Sewer Main (8" PVC at southeast corner of site along Mt. Comfort).
• Near Paved Trail (Bike lanes along W. Mt. Comfort)
• Near Water Main (8" PVC along N. Rupple, 6" PVC along Mt. Comfort)
• Appropriate Fire Response (Station #7 at 835 N. Rupple Road)
DISCUSSION:
At the December 14, 2020 Planning Commission meeting, a vote of 7-0-0 forwarded the request
to the City Council with a recommendation of approval. Commissioner Hoffman made the motion
and Commissioner Brown seconded. Commissioners acknowledged the timing of a City Council
discussion regarding the possible shift of Use Unit 18, Gasoline service stations and drive -in/ -
through restaurants from a by -right use to a conditional use in the CS zoning district. Given the
current suite of by -right uses, however, Commissioners voted to forward the item with a
recommendation of approval.

INFRASTRUCTURE:
Streets: The subject area has frontage to N. Rupple Road & W. Mt. Comfort Road. N.
Rupple Road is a partially improved Regional Link with asphalt paving, curb and
gutter. W. Mt. Comfort Road is a fully improved Regional High -Activity Link street
with asphalt paving, curb, gutter, and sidewalk. Any street improvements required
in these areas would be determined at the time of development proposal, as well
as any improvements or requirements for drainage.
Water: Public water is available to the subject area. Existing 12-inch water main is present
along the south side of W. Mt. Comfort Road and existing 8-inch water main is
present along the west side of N. Rupple Road.
Sewer: Sanitary Sewer is available to the subject area. Existing 8-inch sanitary sewer main
is present at the southeast corner of the subject area along W. Mt. Comfort Road.
Drainage: Any additional improvements or requirements for drainage will be determined at
time of development. Hydric soils do not appear to be present on the site. No
portion of the property is within the Hillside -Hilltop Overlay District. Nor within a
FEMA Floodplain. No protected stream is present in the area.
Fire: Fire apparatus access and fire protection water supplies will be reviewed for
compliance with the Arkansas Fire Prevention Code at the time of development.
Station 7 located at 835 N. Rupple Road protects this site. The property is located
approximately 1.2 miles from the fire station with an anticipated drive time of
approximately 3 minutes using existing streets. The anticipated response time
would be approximately 5.2 minutes. Fire Department response time is calculated
based on the drive time plus 1 minute for dispatch and 1.2 minutes for turn -out
time. Within the City Limits, the Fayetteville Fire Department has a response time
goal of 6 minutes for an engine and 8 minutes for a ladder truck.
Police: The Police Department expressed no concerns with this request.
CITY PLAN 2040 FUTURE LAND USE PLAN: City Plan 2040 Future Land Use Plan designates
the property within the proposed rezone as City Neighborhood Area.
City Neighborhood Areas are more densely developed than residential neighborhood areas and
provide a mix of non-residential and residential uses. This designation supports the widest
spectrum of uses and encourages density in all housing types, from single-family to multi -family.
Non-residential and commercial uses are primarily located at street intersections and along major
corridors. Ideally, commercial uses would have a residential component and vary in size, variety
and intensity. The street network should have a high number of intersections creating a system
of small blocks with a high level of connectivity between neighborhoods. Building setbacks and
landscaping are urban in form with street trees typically being located within the sidewalk zone.

2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The applicant has not submitted an associated development plan. Staff finds
that even without an associated development proposal, a rezone from R-A
to CS is consistent with long-term land use plans, and brings the site into
agreement with City Plan 2040 as a City Neighborhood area, therefore
making this request justified from the city's perspective.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Rezoning the property to CS does have the potential to increase traffic along
W. Mt. Comfort Road and N. Rupple Road, as opposed to keeping the
property zoned R-A. However, staff finds that the uses permitted in CS
zoning, and the proximity to pre-existing residential neighborhoods, would
open up a suite of by -right uses that would provide more walkability for
residents that can reduce vehicle dependence and trips. There are few
commercial services located within a walkable distance to this site, which
negatively contributes to traffic counts. Staff finds that bringing commercial
services to the area within a walkable distance to existing residences offers
the potential for the consideration for the use of alternative transportation
options. Ultimately, overall traffic may be improved with the availability of
services in closer proximity to residences.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: Rezoning the property from R-A to CS would have the potential to increase
the population density, since CS does allow for residential uses up to multi-
family dwellings. Staff finds that given the master street plans for the area,
and the availability pre-existing infrastructure such as nearby schools, and
availability of water and sewer, this request would not put an undue burden
on these existing services.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the
proposed zoning is not desirable.

Homes LLC and Mr. and Mrs. Tony and Sherrol Hardin in their application for rezoning the
property described in the attached property description. The request is being modified and the
total acreage being requested to rezone is now 6.05 acres along Mt. Comfort Road. The property
is currently zoned R-A, Residential Agriculture and the applicants are requesting the property be
rezoned to CS, Community Services.
This requested rezoning is compatible with the surrounding neighborhood and will not
unreasonably adversely affect or conflict with the surrounding land uses. We believe this request
is compatible with the City Plan 2040 and other tracts within this neighborhood have already been

I own the home at 2360 Caney Drive in Fayetteville. My understanding is this application is for rezoning
of approximately 6 acres but the parcel numbers included in my notice amount to far more land than 6
acres. The Parcel No 765-13589-000 is almost 6 acres in itself and would be adjacent to homes in the
neighborhood, specifically directly next to mine. I'm not sure what exactly Community Service would
allow but I assume it is commercial and I think abutting residential is the wrong place for this type of
zoning. I'd like to see some development plans or whatever is available to understand what is being
done next door to my house.

write to you today to encourage strong consideration regarding the development of
the Mt. Comfort Rd. corridor in west Fayetteville and particularly the intersection at
Rupple. I have lived in the west Fayetteville area. approximately .5 miles northwest
of this intersection, for almost 7 years. There have been recent great strides made
to deal with the rapid expansion of west Fayetteville such as the rerouting of Rupple
and the restriping of Mt. Comfort to create the dedicated left turn lane. This has
been a huge win for the nearby residents and greatly improved traffic. I caution
against undoing the improvements to quality of life and ease of movement for
residents in this area of town by approving any category of rezoning that creates
increased traffic through this area.
As you are no doubt aware, a recent application to create a Kum and Go gas station
at the northeast corner of Mt. Comfort and Rupple was met with very mixed. and
majority negative. feedback from the neighboring community. This is not the sort of
development we want to see for this area. Nor is the application to the planning
commission I recently saw that proposed a 300+ unit housing complex for the
southeast corner adding a huge burden to the traffic on Mt. Comfort daily.
Development to this area is coming, I have no doubt, despite the objections of a
vocal portion of the surrounding neighborhoods including myself. We prefer and
enjoy the pastoral landscape of this area. My daily commute includes driving past
the Mt. Comfort Cemetery, the church and old school house and yes. the cow
pasture to the southeast. I realize this area is identified in the 2040 plan as a growth
node. though few if any of my current neighbors seem to be aware of that or in line
with that decision. What I ask is that these decisions about what sort of development
to allow take into consideration the infrastructure available and the wishes of the
neighboring communities. not simply infill for infill's sake. Other recent developments
such as the addition of the veterinary clinic and the construction of another daycare
center just east of the parcel in question are welcome additions and won't greatly
impact the operation of the Mt. Comfort corridor or greatly affect the natural
landscape. This is the sort of zoning requests that should be considered in this
entire area.
The parcel in question now seems to again be the northeast corner. I don't pretend
to be any sort of expert in zoning laws and only have a passing familiarity with what
is allowed with a CS -Community Services rezoning, but I ask you to please consider
the specific use intended by the applicant and carefully consider its impact to the
surrounding landscape. the safety of students commuting to and from Holt Middle
School, and the impact on the traffic load to Mt. Comfort. Design aesthetics will play
a huge part in preserving what remains of the natural beauty in this corridor as it is
developed. Please do not allow this area to become massive housing complexes
that block out the wide open sky, lower surrounding property values and create a
nightmare for Mt. Comfort travelers daily.

Comments I am writing to OPPOSE the rezoning of the parcel of land at Mount Comfort and
Rupple Rd from RA to CS. We have addressed this issue once before and it
remains a bad idea. The parcel of land is less than 200 feet from Holt Middle
School. This is a neighborhood school with many of its students walking to and from
school everyday. It is also a school that does outdoor activities regularly. including a
"bike train" led by a teacher so that kids in adjacent neighborhoods can ride their
bikes to and from school.
Traffic is already heavy on Mt Comfort and Rupple Road . With the new extension of
Rupple Road; this traffic could get heavier. Adding a gas station could only make it
more dangerous for the children in the area. After all. this is a residential area.
There are several neighborhoods in the area. Clabber Creek is a large
neighborhood with homes located just 0.3 miles from the parcel of land where the
gas station is proposed. The surrounding areas are zoned RSF-4. Residential, not
commercial. The parcel in question is currently zoned RA. Again, residential.
Changing this to CS is for commercial areas. not residential. There are no other gas
stations in Fayetteville that are zoned CS. or community services. They are all C1 or
C2 commercial.

Comments I do not support the rezoning of this property for the reasons stated in my first email
copied below.
I live in the Clabber Creek (phase 1) subdivision. My backyard backs up to Holt
Middle School . We purchased our house in September of 2005.
Since that time. Mt. Comfort was transformed from a 2 lane road to 4 lane and
Wedington (west of the interstate) was built out to epic proportions.. without proper
consideration for traffic. The congestion on Wedington has become so severe that
Mt. Comfort is now completely backed up with overflow traffic during peak hours. 1
can't fathom what traffic would look like if Mt. Comfort were transformed into
something remotely resembling Wedington.
BEG you. please don't allow what happened to Wedington befall Mt. Comfort. I
believe the overwhelming number of home owners in this area appreciate the
residential feel and the school -friendly characteristic of the neighborhood. We don't
want commercialization and gas stations and Dollar Generals littering Mt. Comfort.
They are already easily accessible a short drive away on Wedington and there seem
to be countless opportunities on College Ave. where businesses can benefit and the
city can accrue taxes.
I also have a concern about a survey of the traffic pattern/flow in this area, will it be
done during regular (non-covid) school hours to see how traffic usually flows and
builds up out there? The way the traffic is now is in no way indicative of how it
usually is due to only half the school population will be attending each day .
A 24 hr gas station is not what we need along Mt Comfort... from my backyard we
would be able to see the gas station and its lights. 1 see the vet clinic and school that
is going in as a good fit for this area, not a gas station, especially with one (Caseys)
already being built about a mile away.
Please help to preserve our peaceful residential neighborhood

I stumbled upon an online petition seeking to deny rezoning for the Kum & Go on Mt Comfort & Rupple roads. As I saw
no major issue off -hand, I looked through all of the comments as to why others were opposed. Reading through them, I
was disappointed. People spoke of a gas station as if it were a place that is so unsavory that "one should avert the
children's eyes whilst passing." Last I checked, this is not the case. And I quote, "My children ride their bikes near
there." Well, ma'am, perhaps you can send you kiddos to the store on their bikes for more milk, as most of us did when
we were children (and loved it).
Additionally, there were comments about all of the additional traffic a gas station would bring. Now, I have not seen the
traffic studies for this location, but when not located near an interstate, a gas station is not a place to generate
additional, independent traffic flow. Quite to the contrary, by the sheer nature of being a "convenience store," it will
actually relieve some outbound traffic by providing a closer location for people living in the area than currently exists.
As for the unsavory nature of the business, I did not know that the "selling of items regularly found at a grocery store"
was deemed unsavory. Perhaps I should don a scarlet letter moving forward. Or, just perhaps, I can all look forward to
the convenience of milk and eggs within walking distance the next time it snows and I wish to make cookies.

I am a resident in ward 4. 1 wanted to discuss the upcoming zoning for the corner of
Rupple and Mount Comfort.
I would like you to oppose zoning that would allow for any gas stations in the area.
We are thrilled to see construction of a Casey's closer towards the interstate. but
that's where those services belong.
Allowing a gas station further into the residential area would be out of place and I
also fear reduce property values.
With the new Casey's residents already have multiple options for gas @ Shell on
Weddington, Casey's on Mt Comfort and Sam's Club on 112.
With the push for electric vehicles and the high likelihood of less and less gasoline
vehicles being produced and used. a gas station in this location will feel very odd 5-
10 years from now and very rarely does land that's been used for a gas station get
repurposed easily.

construction of a gas station in a Community Service area! The discussion on
January 5th to do such a thing would be a travesty to the community it serves.
And the meeting on January 7th to discuss a zoning change at the corner of Rupple
and Mt. Comfort - just vote "NO". It would have such a negative impact on our area
as to not even consider such a decision. Just look at the effect it would have on the
nearby school. let alone the traffic and congestion dangers, especially when that

Comments Hello.
I am writing to share my concern about what is happening at the Rupple Road/Mt
Comfort Road intersection between that and all the all the development that is going
on - or that developers are hoping will be built - it seems that
this area of west Fayetteville is going to get very crowded.
1. Not enough sidewalks (including along Mt Comfort west of Rupple Rd
2-The Kum and Go will create more of a loggerhead at an already busy intersection.
3. The planned construction on Mt Comfort & north of Mt Comfort.. North Rupple.
and near Wedington (additional apartments in the Links) means that we will have
even more cars waiting to turn left or right from Rupple to Mt Comfort which will
cause even more Traffic jams. One of the potential complexes on Mr Comfort has
about 384 apartments - I picture lots of college kids and multiple cars per apartment
— adding even more traffic every day.
4. It is already difficult to turn left out of Wildflower Meadows during the day - the
additional traffic will make it even worse.
5. There is not a public transportation option in this area either.
6. The closest "planned park is more than a mile away from Wildflower Meadows
and at this point it is a crazy route - sidewalks are not
available everywhere.
7. Between 7:30am and 9am and between 4 30pm and 6.30pm the traffic on Mt
Comfort is crazy.
8. Holt Middle School is so close the potential Kum and Go and I am concerned for
the walkers and bike riders - as well as adding to the traffic
around the school area.
I do realize that change is inevitable, but it seems that Fayetteville has gone into a
building frenzy. Fayetteville west of 149 is getting the majority
of the development. We will potentially have 2 new gas stations within 2 miles of our
home - in addition to the 4 that are already within 4-5 miles. I have a suggestion -
build some gas stations off of Maple and over in the "historic" area..... or south
Fayetteville - they are few and far between over there.
I oppose adding another gas station to this area. We need sidewalks, public
transportation options. and parks that are within a reasonable distance and easily
accessible. Plus, what would be really nice would be a library branch on this side
town.

Comments The agenda item in question has not been posted yet but I oppose the construction
of a gas station at the intersection of Mount Comfort and Rupple Road, This issue
was raised previously and was tabled. The issue has been raised again by
requesting a different zoning designation (Community Services) in support of a gas
station. I strongly oppose a gas station so near Holt Middle School. In addition. a
Casey's gas station is under construction at the intersection of Shiloh and Mount
Comfort (about a mile away from the Mount Comfort/Rupple road intersection) and
there is also a Shell gas station at the intersection of Rupple and Wedington
Decisions made by the Planning Commission and the City Council have contributed
to increasing density in the Mount Comfort/Rupple Road area. More apartments
have been built at The Links on Rupple. There is a large development going in on
North Rupple. Consideration is being given to construction of 364 apartments on
Mount Comfort. These actions will add thousands of automobiles to the area and
place greater demands for infrastructure and utilities. Prior to the pandemic traffic
was backed up from the Subaru dealership to Salem Road during morning and
evening rush hours. This situation will only get worse. Low profile businesses such
as the Mount Comfort Veterinary Clinic and Goddard School (under construction
next to the vet clinic) are good fits for the area but more gas stations and more
apartments are not. I urge you to oppose development that is detrimental to the
environment, the character of the residential areas. and the green space in the
Mount Comfort/Rupple Road area.

I am writing to oppose the plan to build a Kum & Go at the corner of Mt Comfort and
Rupple Rd. The surrounding area is residential. and there is a school very close to
where the convenience store is to be located. Those of us that live in this area do
not want the lights and traffic that a convenience store/gas station would bring. Not
to mention the traffic it would create. This traffic would be a disruption to the flow of
traffic along both Mt Comfort and Rupple Road. It also seems like a safety hazard
for the kids that walk to and from Holt Middile School. The only business in this non
commercial area is a new vet clinic, which has very limited impact on traffic flow and
is not open 24 hours a day.

Comments I'm in favor of the rezoning at Mt Comfort and Rupple. I would like to see services
closer to my home and believe it would help relieve traffic in some areas of the city.
Currently. 1 have to drive to Wedington (closest) for gas, and having that available at
Mt Comfort would keep me out of an area of high traffic. This seems more like
balancing traffic across the city; and with all the subdivisions in that area. makes
good sense to me.

I am a resident in ward 4. 1 wanted to discuss the upcoming zoning for the corner of
Rupple and Mount Comfort.
I would like you to oppose zoning that would allow for any gas stations in the area.
We are thrilled to see construction of a Casey's closer towards the interstate. but
that's where those services belong.
Allowing a gas station further into the residential area would be out of place and
also reduce property values.
With the new Casey's residents already have multiple options for gas at Shell on
Wedington. Casey's on Mt Comfort and Sam's Club on 112.
I've lived within a minute of this intersection for 5 years and have not once felt the
need for a gas station at this junction, especially not now that we will have a Casey's
down the street.
Please keep our area thoroughly residential and preserve our quiet.. family -friendly
area by preventing a gas station to divide our lovely neighborhoods.

Comments I want to express my opposition of a construction of a gas station at the corner of
Rupple and Mt. Comfort. I frequently use this intersection as a primary way of exiting
and entering my subdivision. This intersection is extremely busy. especially during
rush hours. School buses to and from the nearby Holt Middle School also travel
through this intersection. To add a gas station will increase congestion and will
greatly increase the probability of accidents as vehicles pull in and out of the gas
station.
This gas station is not needed. There is a Shell gas station nearby on the corner of
Wedington and Rupple. Also. a Casey is being constructed just down the road near
the Interstate. An additional gas station will ruin the atmosphere of this area which
has an historic church and school and graveyard.
With Holt Middle School very nearby students will walk to its convenience store for
snacks before and after school. This greatly increases the danger of accidents and
congestion at this intersection.
In addition.. please change Community Service zoning to remove gas stations. Gas
stations should be considered separately in zoning our community.
The community is against this gas station at Rupple and Mt. Comfort. Please vote
NO on this matter.

I would like to make sure and offer my plea to please not rezone the area / allow any
other gas stations along mount comfort. We have more than enough fuel and
shopping options especially with the new Casey s under construction closer to 1-49 -
where a gas station logically should live!
Please do not vote to further compact the traffic situation around my neighborhood.
My hope is to allow my son to walk to school next year and I fear the added and
unnecessary traffic will make this impossible.

Comments Hello.
I am a resident in Ward 4 and I would like to voice my support for an OPPOSITION
to the rezoning efforts that would allow for additional gas stations to be built in this
area.
Given that there is currently a gas station being built simply one minute's drive away
from the proposed construction site, I do not see any reason to add yet another gas
station. especially as this one will be within such close proximity to a church, a
veterinary hospital, an elementary school, and residential walkways.
The intersection near W Mt ComfortSalem. and Rupple is already a high traffic
area, and adding a gas station will only exacerbate this problem. Placing a gas
station at both the Salem AND Rupple intersections will likely choke all traffic in that
area.. creating gridlock during morning commutes. In addition. I fear it will lower
property values and put the safety of our neighborhoods in jeopardy if a structure
meant to attract even more traffic is allowed to be constructed. It should also be
noted that a significant number of deer live in this area: and there is likely to be an
increase in collisions with an increase in the number of vehicles traveling to this area
after dark or in the early morning.
Furthermore. and perhaps more importantly. allowing for another gas station is in
direct opposition to the green, environmentally -friendly efforts Fayetteville has
already put into place and seeks to improve in the future. This gas station sends
mixed -- if not outright negative -- signals as to the values goals, and efforts made
by our city government.
Please consider the extreme inconvenience, danger, and jeopardy an additional gas
station will cause for the current and future residents of Ward 4.

There is already too much traffic from schools right here. We have many children
who walk to school through this intersection, and we do NOT need more traffic to
become a threat to this habit. Further, allowing a gas station here would be out of
place and reduce property values.
With the new Casey's on Mount Comfort, down by the freeway, residents already
have multiple options for gas @ Shell on Wedington, Casey's on Mt Comfort and
Sam's Club on 112.
Additionally.. I support item 7 under old business: an ordinance to amend the CS
zone to move gas stations and some housing uses from by -right developments to
conditional uses so that Planning Commission will have more power to evaluate the
specific placement of those uses within a broader zone. I support former council
member Kyle Smith's proposed change that would allow the planning commission to
take into account whether it was at a corner, or mid -block. or to craft their own
conditions for the specific location over and above the basic design standards that
would ensure it was appropriate. It would also allow the council to deny an
application entirely if they thought it couldn't be made compatible.
We need this extra layer of protection on our communities. so that they continue to
be desirable places to live. Right now, this is an area where families are comfortable
allowing their children a certain level of freedom to play outside. walk to a friend's
house. ride their bikes on the trail. Adding a gas station right here in the middle of
these neighborhoods and neighborhood schools will certainly harm this freedom.

Comments Please reconsider the plan to rezone 3670 W Mt Comfort Rd. I oppose re -zoning the
plot of land to accommodate a gas station and respectfully urge you to do the same.
There is already a gas station going in near the highway and 1 feel that it will
adequately serve the needs of our side of town. I would hate to see more
businesses encroaching upon the residential section of town., adding to our traffic
and possibly decreasing the surrounding property values. My son attends Holt
Middle School.. which is near the proposed area of rezoning, and I hate the thought
of more traffic being drawn to that area.

I just wanted to submit an email in support of the Kum and Go at Rupple and Mt Comfort. I live close to the Bridgeport
neighborhood. I think this is a good option from a traffic standpoint. There is apparently a lot of support for only the gas
station behind the Subaru dealership. While I support that one as well, the traffic that will now be generated at the
traffic light leading to Deane Solomon is going to be substantial and having another gas station further down Mt Comfort
could provide some relief. Obviously commercial development on Mt Comfort should be controlled but I think this is an
appropriate next step. Thanks for your consideration.

closer to my home and believe It would help relieve traffic In some areas of the city.
Currently, I have to drive to Wedington (closest) for gas and having that available at
Mt Comfort would keep me out of an area of high traffic. This seems more like

applicant has not provided a development proposal at this time with this request, the requested zoning district of CS
does currently allow for gas stations by -right, so the question of appropriateness of this use at this location will certainly
be discussed.
This item is currently on the next City Council agenda, so I have copied the City Clerk to make sure they have received

Afternoon,
I stumbled upon an online petition seeking to deny rezoning for the Kum & Go on Mt Comfort & Rupple roads. As I saw
no major issue off -hand, I looked through all of the comments as to why others were opposed. Reading through them, I
was disappointed. People spoke of a gas station as if it were a place that is so unsavory that "one should avert the
children's eyes whilst passing." Last I checked, this is not the case. And I quote, "My children ride their bikes near
there." Well, ma'am, perhaps you can send you kiddos to the store on their bikes for more milk, as most of us did when
we were children (and loved it).
Additionally, there were comments about all of the additional traffic a gas station would bring. Now, I have not seen the
traffic studies for this location, but when not located near an Interstate, a gas station is not a place to generate
additional, independent traffic now. Quite to the contrary, by the sheer nature of being a "convenience store," it will
actually relieve some outbound traffic by providing a closer location for people living In the area than currently exists.
As for the unsavory nature of the business, I did not know that the "selling of items regularly found at a grocery store"
was deemed unsavory. Perhaps I should don a scarlet letter moving forward. Or, Just perhaps, I can all look forward to
the convenience of milk and eggs within walking distance the next time it snows and I wish to make cookies.

To my representatives,
I urge you... no I BEG you not to change any zoning that would
allow the construction of a gas station in a Community Service
area! To do such a thing would be a travesty to the community it
serves.
And at the meeting on January 19th to discuss a zoning change at
the corner of Rupple and Mt. Comfort - just vote "NO' . It would
have such a negative impact on our area as to not
even consider such a decision. Just look at the effect it would have
on the nearby school, let alone the traffic and congestion dangers,
especially when that type of business is to be found within a mere
minute of driving from that exact location.
Please remember to keep us, your constituents, in mind when
voting as you express our needs and concerns.

I am writing to oppose the plan to build a Kum & Go at the corner of Mt Comfort and Rupple Rd. The
surrounding area is residential, and there is a school very close to where the convenience store is to be
located. Those of us that live in this area do not want the lights and traffic that a convenience store/gas
station would bring. Not to mention the traffic it would create This traffic would be a disruption to the flow
of traffic along both Mt Comfort and Rupple Road. It also seems like a safety hazard for the kids that walk to
and from Holt Middile School. The only business in this non commercial area is a new vet clinic, which has
very limited impact on traffic flow and is not open 24 hours a day.
Please reconsider this proposal.

Comments This letter is a companion to a letter I submitted regarding agenda item B.1 that will
be considered by the City Council on January 19, 2021. During the same meeting
agenda item B.4 will also be discussed.
B.4 is a rezoning request from Landmarc Homes and Hardin to rezone certain
property at the intersection of Mt. Comfort and Rupple Road from Residential -
Agriculture to Community Services. An attempt was made in 2020 to rezone the
same property for the purpose of placing a Kum & Go gas station on the property.
That attempt was met with opposition by people living in proximity to the location.
The request was withdrawn and the Council tabled the agenda item.
Now. this new request addresses the same location. However, there is no
development plan associated with the request and my neighbors and I suspect this
is another attempt to get approval for a gas station without stating the intended use
for the property. We could well be incorrect but unless agenda item B.1 (also to be
addressed on Jan 19. 2021) is approved, then this rezoning will permit a gas station
"by right" on the property. I strongly encourage the Council to table the request until
the developers disclose their intent for the property. There is a Casey's gas station
near completion at the intersection of Mt. Comfort and Shiloh. There is a Sam's Club
gas station nearby. There is a Shell gas station at the intersection of Rupple and
Wedington. We do not need yet another gas station in our area. Please table the BA
request pending the receipt of more information from the developers.

At this point there is no information about why the development company wants to
rezone this area.... please table this until B-1 CS development proposed change has
been resolved.
Porter Rd/Mt Comfort Rd already has so much more traffic - and the development
that is already underway will bring even more traffic (possibly 24-hour traffic). If you
have ever driven on this road when the commuters are going and coming from work
you will understand this concern.

Dear Mayor Jordan and Council Aldermen:
This correspondence and its attachments are a follow up to the comments I have offered
related to my clients' request to rezone approximately six (6) acres of land on the corner of Mt.
Comfort Road and Rupple Road. As a result of the prior zoning request, made by Kum & Go for
two (2) acres at that corner, there has been strong effort to demonstrate citizen opposition to the
request. Former Alderman Smith, because of the opposition to a gas station on my clients' land,
asked the Council to amend CS zoning to make gas stations and drive -through restaurants a
conditional use, despite the fact that no gas stations exist in the City of Fayetteville under the
heightened design standards imposed in a CS zone.
Those opposed to something are generally more energized to speak up than those in favor.
We therefore wanted to demonstrate that there is as much support for the concept of a gas station
or drive -through restaurant at the corner of Mt. Comfort and Rupple as there is against it. Attached
are the attestations from neighbors in surrounding subdivisions, obtained this week, along with
some of the comments submitted when the prior request was advanced. Our two newest aldermen
have not had the benefit of that prior history. My clients would certainly hope, when the Council
is considering amending the ordinance or deciding to grant or deny my clients' zoning request,
that it would give as much weight to those in favor of these services as it is currently giving to
those opposed to it. Notably, all of these individuals are identified by name and address and are
not simply a "click" on a social media petition.

I just wanted to submit an email in support of the Kum and Go at Rupple and Mt Comfort. I live close to the Bridgeport
neighborhood. I think this is a good option from a traffic standpoint. There is apparently a lot of support for only the gas
station behind the Subaru dealership. While I support that one as well, the traffic that will now be generated at the
traffic light leading to Deane Solomon is going to be substantial and having another gas station further down Mt Comfort
could provide some relief. Obviously commercial development on Mt Comfort should be controlled but I think this is an
appropriate next step. Thanks for your consideration.

I stumbled upon an online petition seeking to deny rezoning for the Kum & Go on Mt Comfort & Rupple roads. As I saw
no major issue off -hand, I looked through all of the comments as to why others were opposed. Reading through them, I
was disappointed. People spoke of a gas station as if it were a place that is so unsavory that "one should avert the
children's eyes whilst passing." Last I checked, this is not the rase. And I quote, "My children ride their bikes near
there." Well, ma'am, perhaps you can send you kiddos to the store on their bikes for more milk, as most of us did when
we were children (and loved it).
Additionally, there were comments about all of the additional traffic a gas station would bring. Now, I have not seen the
traffic studies for this location, but when not located near an Interstate, a gas station is not a place to generate
additional, independent traffic flow. Quite to the contrary, by the sheer nature of being a "convenience store," it will
actually relieve some outbound traffic by providing a closer location for people living In the area than currently exists.
As for the unsavory nature of the business, I did not know that the "selling of items regularly found at a grocery store"
was deemed unsavory. Perhaps I should don a scarlet letter moving forward. Or, Just perhaps, I can all look forward to
the convenience of milk and eggs withln walking distance the next time it snows and I wish to make cookies.

Comments The issues concerning the rezoning request of the subject property are not new. It is
something that has been discussed in Ward 4 meetings for the past 4 years.
The community overwhelming voiced their concerns about the potential for rezoning
to allow a gas station and drive-thru restaurant as by -right.
The owner, to my knowledge, has not declared any plans for the property other than
to request rezoning. As the initial plans were for a gas station the residents of the
area still fear the same potential development could occur after they have their
request approved and the property is sold.
Concern was brought up that in doing this it would change the rules. Rezoning in
itself is requesting the rules be changed. In the last council meeting the
representative of the seller indicated the Hardins themselves had no intent to put a
gas station on the property. This, however, would not stop a buyer from attempting
to do so once approved. Again. the Hardins seeking to sell their property is their
right. I do not believe anyone is opposing this. It is the councils responsibility to
balance what happens when they do sell with the concerns of the citizens in the
surrounding area.
I would implore the council to delay this decision until the issues with CS are
resolved through the resolution currently before the council.
As the city continues to grow we understand there will be change. I am not opposed
to this. I believe it provides opportunity to continue to enhance a town that I was
fortunate enough to move back to.
What I am vehemently opposed to is the wrong kind of change. My family survived
five years in Little Rock between the Heights and West Little Rock. We moved to
this area despite looking throughout the city because it allowed us the proximity to
recreation areas we frequent while affording a more rural environment where it felt
safe to walk and ride on the streets and trails. We ask that you consider these
factors, the intent of CS and Fayetteville being a walkable area, and the balances
moving forward. Until the issues with CS are address I would ask that the motion be
tabled.
Enclosed are the comments and signatures of mostly residents that opposed the
rezoning in August. Despite the limitations in personally engaging them I have not
had anyone indicate their position on the matter has changed.

Letter: Greetings,
As a community, we do not want the opportunity for our identity to overran
as a result of unintended consequences of overly broad definitions allowed
by certain zoning in current city regulations. Our intent is to protect and
preserve the future of our community as safe, walk -able, neighborhoods.
We continue to emphatically oppose the zoning requests at the intersection
of N. Rupple Rd and Mount Comfort as we did this past August.
We humbly request you oppose the rezoning request before the council,
item C.8 - 2020-1134 - RZN 2020-022 pertaining to the rezoning of the
Northeast Corner of N. Rupple Rd. and Mount Comfort to CS for the reasons
stated above.
We also request you to support the resolution before the council,
item B.7 - 2020-1067 - Amending Community Service zoning removing
gas stations and drive-in/drive-through as by -right. The current zoning
allowances by CS standard are too broad. As a result, these two uses defeat
the stated purpose of the current city plan.

Letter: Greetings,
As a community, we do not want the opportunity for our identity to overran
as a result of unintended consequences of overly broad definitions allowed
by certain zoning in current city regulations. Our intent is to protect and
preserve the future of our community as safe, walk -able, neighborhoods.
We continue to emphatically oppose the zoning requests at the intersection
of N. Rupple Rd and Mount Comfort as we did this past August.
We humbly request you oppose the rezoning request before the council,
item C.8 - 2020-1134 - RZN 2020-022 pertaining to the rezoning of the
Northeast Corner of N. Rupple Rd. and Mount Comfort to CS for the reasons
stated above.
We also request you to support the resolution before the council,
item B.7 - 2020-1067 - Amending Community Service zoning removing
gas stations and drive-in/drive-through as by -right. The current zoning
allowances by CS standard are too broad. As a result, these two uses defeat
the stated purpose of the current city plan.

The flow causes significant back ups on at that corner & all the
way to 540 causing 10-15 minute delays. Please consider another
