BACKGROUND: In 2019, the City Council approved Resolution 109-19, authorizing a sublease agreement for reserved parking between the City and Tower Square, LLC. At that time the parking lot was owned by the Off - Street Parking Development District and the 112 W. Center Building (formerly known as the EJ Ball building) was owned by Tower Square Fayetteville, LLC. One tenant of the building, the Federal Public Defender's Office, requested four (4) reserved parking spaces in the Center Street parking lot, located behind the 112 W. Center Building, citing the sensitive nature of the files and clientele that frequently enter and exit their office. At their March 28, 2019, meeting, the Off -Street Parking (OSP) Commission heard and granted the request from the Federal Public Defender's Office to reserve four (4) parking spaces at a rate of no less than $50 per space per month. The OSP commission then took affirmative action authorizing the City to execute a two-year sublease agreement to convert these spaces to "reserved" spaces. DISCUSSION: Since the original sublease agreement, the parking lots owned by the Off -Street Parking Development District have been transferred to the City and LFKDF, LLC, now owns the 112 W. Center property. The sublease agreement is set to expire and this proposed lease agreement between the City and LFKDF, LLC, renews and extends the terms of original sublease agreement to allow the Federal Public Defender's Office to continue to reserve four (4) parking spaces in the Center Street parking lot for a period of four (4) years. BUDGET/STAFF IMPACT: Continued annual revenue of $2,400 for the reserved spaces. Attachments: Lease Agreement with LFKDF, LLC Exhibit A Mailing Address: 113 W. Mountain Street www.fayetteville-ar.gov Fayetteville, AR 72701 LEASE AGREEMENT BE IT KNOWN TO ALL: T at the City of Fayetteville, Arkansas (the "City") and LFKDF, LLC on this day of J , 2021, hereby agree that: Four (4) metered spaces adjacent to the 112 W. Center building (formerly known as the Ball Plaza building), as shown in the attached Exhibit "A", will be allocated for reserved parking to be used by the Federal Public Defenders Office. The City of Fayetteville is responsible for collecting payment from LFKDF, LLC which has agreed to lease the spaces and pay $50.00 per space per month for the reserved spaces. Meters will be reinstalled by the City and reserved parking will end for these spaces four (4) years from the effective date of lease unless LFKDF, LLC and the City of Fayetteville, by mutual agreement, choose to extend or terminate the lease before that time, or if payment is not received by the City of Fayetteville in accordance with the lease. Each monthly payment is due in advance and payable on or before the first of each month.
