BUDGET ADJUSTMENT - 2019 POLICE HEADQUARTERS BOND PROJECT
WHEREAS, in April of 2019, Fayetteville voters approved the public safety bond question to
construct the new Police Headquarters; and
WHEREAS, on December 3, 2019, the City Council passed Resolution 282-19 to approve a
Construction Manager at Risk agreement with Flintco, LLC for pre -construction services; and
WHEREAS, on January 19, 2021, the City Council passed Resolution 37-21 to approve Change
Order No. 1, which included the earthwork package for the Police Headquarters and Fire Station No.
8; and
WHEREAS, Change Order No. 3 includes site utilities, fire sprinkler, mechanical, ventilation,
electrical, plumbing and equipment bid packages.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves Change Order
No. 3 to the Construction Manager at Risk Contract with Flintco, LLC in the amount of
$12,536,023.00 for the Police Headquarters site utilities, fire sprinkler, mechanical, ventilation,
electrical , plumbing and equipment bid packages.

SUBJECT: 2021-0278: Change Order #3 to RFQ# 19-06 Contract with Flintco, LLC for
the Police Headquarters Facilities Project
RECOMMENDATION:
Staff recommends approval of Change Order #3 to the RFQ # 19-05 contract with Flintco, LLC
for the Police Headquarters Facilities Project in the amount of $12,536,023.00 and approve a
Budget Adjustment.
• In April 2019, Fayetteville voters approved the public safety bond question 9 in the
2019 bond initiative, which included a new police headquarters, and identified
$38,801,126 for the new facilities.
• In September 2019, Resolution 202-19 authorized the approval of the Land Sale
Agreement with the University of Arkansas System Division of Agriculture in the
amount of $2,590,000 for 11.50 acres with PD utilizing 10 acres and Fire utilizing 1.5
acres. The Close of the Land is ongoing.
• In September 2019, The City of Fayetteville Purchasing Division managed the RFQ
process of selecting a construction manager at risk for the Police Headquarters
Facilities. The request for statement of qualifications (RFQ) was advertised on 9-3-19
with a deadline of 9-26-19. Ten responses were received. Three construction
management firms were short listed for interview. The selection committee chose
Flintco to negotiate a CMAR contract for the Police Headquarters.
• In December 2019, Resolution 282-19 authorized the approval of a Construction
Manager at Risk contract with Flintco Construction and included pre -construction
services.
• In January of this year, resolution 37-21 was approved for the Earthwork package for
the police headquarters and Fire Station 8.
• In January of 2021, Resolution 37-21 authorized Change Order #1 for earthwork and
grading.
• In April 6ch of 2021, Resolution 116-21 authorized Change Order #2 including
Foundations, Masonry, Structural Steel, and the Elevator

DISCUSSION:
The scope of this work includes Site Utilities, Fire Sprinkler, Mechanical, Ventilation, Electrical,
Plumbing, and Equipment. These packages were publicly advertised and received by our
Purchasing Division.
BUDGET/STAFF IMPACT:
Funding in the amount of $11,143,489 has been allocated through the 2019 Police Bond
Program and $1,392,534 will be allocated from Police Impact Fees. A breakout of funding
source is contained below. A budget adjustment will be included for approval.

PACKAGE #3A UTILITIES & MEPF
FAYETTEVILLE POLICE HEADQUARTERS
CLARIFICATIONS, ASSUMPTIONS, INCLUSIONS AND EXCLUSIONS
Scope of Work
Work Package #3A / Change Order #3 is a partial scope of work which includes labor, material, equipment,
tools, and supervision required to perform the scopes of work specifically listed below.
• Bid Package 31B - Site Utilities
• Bid Package 26A - Electrical and Low Voltage
• Bid Package 23B - Combined Plumbing, HVAC & Mechanical Controls
• Bid Package 21A-Fire Suppression
• Range equipment by InVeris
• Range ventilation by Carey's
• Structural Steel Supply & Erection (Revisions Released in WP#3)
• Building Concrete (Revisions Released in WP#3)
• Earthwork (Revisions Released in WP#3)
There are additional scopes of work applicable to work package #3 which are not included in this change
order. This work is still under review and will be issued in a future change order.
All work to be performed in accordance with the Work Package #3 plans issued by BSW Architects dated
March 8, 2021, Specification Manual dated March 8, 2021, Addendum #1 dated March 23, 2021,
Addendum #2 dated March 31, 2021, and the Construction Managers Bid Manual dated March 12, 2021.
Design Criteria
Where possible, items and systems specified by these C&A's are defined and specific to material, finish and
intended use. Where materials, finishes and/or quantities are not clearly defined, this proposal assumes the
most practical and economical solution consistent with the design concepts and scope. Where scope is
unclear, suggested allowances have been provided.
Any work referred to as "By Owner", "By Others", "OFCI" (owner furnished contractor installed), or "N.I.C." (not
in contract) is not part of the scope of this proposal unless installation is specified.
Code Requirements
We exclude any liability regarding errors and omissions from the bid documents. In addition, we have
assumed that the Architect/Engineer has incorporated into the bid documents all code requirements, ADA
requirements and has taken all seismic design into consideration.
General Conditions & Project Requirements
General conditions have been included for a 5-month duration of service and the remainder of the general
conditions will be included with Work Package #4. General conditions have been included as a lump sum
which will be billed in equal monthly installments. Fixed General Condition Items shall mean the provision
of facilities or performance of supervisory work by the Construction Manager with respect to items that are
not included in one of the separate trade contracts and are not customarily so included. This includes all
the Construction Manager's indirect costs and expenses, supervisory or general overhead costs, and
personnel and benefit costs related to the administration and supervision of the work.
Project Requirements will be billed as a cost of work and shall include but are not limited to cost and
expenses incurred by the Construction Manager in operating and maintaining jobsite security, safety, and
supporting the work from the subcontractors in the field. Example of project requirements are permits,
layout, documentation photos, temporary toilets, utilities use, cleanup, waste disposal, etc.

Bonds & Insurance
General Insurance (0.6%), General Contractor Bond (1%), and Subcontractor Default Insurance (1.25%) have
been included. Builders Risk insurance is included to cover a maximum project value of $34,000,000.
Quality Control Services
Costs for testing and special inspection services shall be provided by Owner and are excluded. We will provide
coordination and scheduling of said services. These services include, but are not limited to engineering
testing services, engineering observation, and LEED consultation and testing.
Schedule
This proposal is based on a continuing construction schedule with anticipated activity from February 5, 2021
through January 2022. The date of substantial completion will be determined with Work Package #4 after all
documents have been issued.
Delays
If the Contractor is delayed at any time in the progress of the work by labor disputes, unavoidable
casualties, material shortages or delay, changes in the work, or any other causes beyond Contractor's
control, the time of completion shall be extended. Claims for extension of time and/or adjustments to the
Contract Sum shall be made within a reasonable time after the occurrence of the delay.
This proposal excludes any time delays and cost increases arising from or related to the COVID-19 virus
and any government or other third -party action in response thereto.
Permits and Fees
The Architect/Engineer is responsible for permit submission and acceptance by the City of Fayetteville and
other Authorities Having Jurisdiction (AHJ).
The Owner is responsible for the cost of the building permits, tap fees, impact fees, and meters.
Allowances. Contingency, Fees
The following are included:
1. 2% CM Contingency $235,219.00
General Inclusions/Exclusions
1. Typical hours of construction operations are 7 am through 7 pm.
2. Certain construction procedures such as concrete placement and material deliveries require work
outside of normal hours. Work will be scheduled with onsite personnel.
3. Excludes all work associated with the Asset Building #1 and Asset Building #2.
4. All work shown within the Fire Station 8 boundary is excluded.
5. Dean & Porter road improvements along with parking, sidewalks, greenway trail and utility
improvements and repairs are excluded. Only temporary gravel road patch is included for new water
and sanitary sewer utility construction crossings.
6. Fuel station canopy and fueling equipment is excluded.
7. LEED flush and air quality test must occur after punch list is completed and Certificate of Occupancy
issuance.
8. Additional engineering design requirement as noted by specification section 23502-1.5 B 1 is
excluded.
Division 5 - Structural Steel Supply & Erection
Includes Structural Steel revisions which have been issued in Work Package #3.
Division 11 - Range Ballistic Equipment
Includes InVeris Range ballistic equipment as proposed offer # MTS20USL5541 Revision 3 dated February
24, 2021 in response to RFP 20-08 PD indoor shooting range.

Design team to verify the ceiling structure within the range is capable of supporting the new range
equipment and containing any errant type secondary bullet impacts.
Bridging, structural supports or any other material that is required as support for InVeris' baffle, safety
ceiling, or target systems are not included and must be designed and provided for pricing in Work Package
#4. Load points to be verified by Design team to support InVeris equipment.
Coordination for baffle, safety ceiling and bullet trap (and associated hanging provisions) is the
responsibility of the design team. InVeris will provide accurate submittal drawings for this purpose.
Specialty anchors or seismic type hanging devices are excluded.
Division 21 — Fire Suppression
Includes Fire Suppression systems as designed for Range and Police buildings including clean -agent fire
extinguishing system and standard wet system.
Division 22 - Plumbing
Includes plumbing systems, equipment and fixtures for police and range buildings as provided in the fixture
VE (Value Engineering) email titled "FPDHQ Plumbing Fixture VE Options" dated 4-27-2021. Pricing will be
subject to change upon final approval of listed VE options. We have excluded under -slab hangars as
referenced in detail 1/P501
Division 23 - HVAC
Includes Heating Ventilation and Air Conditioning systems with controls as designed for police and range
buildings.
Includes labor and materials to make connection to the range HVAC equipment provided by Carey's but
excludes any equipment which may be required to make the BMS system interface with this equipment.
Fire smoke dampers are included only at locations shown in the drawings and not per prose statement #5
on plan sheet M002.
VE Option to eliminate preventative maintenance per spec section 23 8123 2.2.3 has been accepted and
excluded from this pricing.
Test and Balance has been included by the mechanical contractor.
Division 23 — Range Ventilation Eauipment
Includes Range ventilation equipment by Carey's revised proposal letter dated December 14,2020 as
directed by Owner selection in reference to RFP 20-08, PD Range Ventilation System.
Division 26, 27, 28 — Electrical. Communications, Electronic Safety. and Security Systems
Includes all Electrical, Communications, Audio Visual, Security, Access Control, and Fire Alarm systems in
accordance with the contract documents. Excludes all 911 Call Center communications equipment,
antenna, etc. (Owner intends to use existing equipment) this is Owner Furnished, Owner Installed.
This change order also incorporates the following Value Engineering options as directed by the owner.
VE Saving have been included in this change order but are subject to final approval by the design team.
1. Remove generator walk-in enclosure - Removing the spec'd walk-in enclosure on the generator and replace with
a standard 3R style. The 3R style still offers the same protection for the unit itself.
2. Remove generator docking station - Generator docking stations are used for connecting portable generator to
service buildings/equipment etc. By removing the docking station FPD will no longer have the option to do so.
3. Change 800A bypass -isolation ATS to Standard 800A ATS - (A) A bypass isolation has an automatic and manual
mechanism allowing for servicing of the ATS while maintaining power to the facility. (B) Standard ATS has a
single mechanism that transfers power from utility power to emergency power. Bypass isolation is typical in
critical applications such as hospital, data centers, municipal facilities.
4. PVC coated rigid deletion. All power elbows and conduit extensions thru floor would change to galvanized rigid
in exposed areas that are subject to damage. Galvanized rigid elbows with PVC thru floor in non -exposed areas
such as within walls, exposed in electrical rooms as they are not subject to damage. Our intent is to change
over to EMT at slab elevation. Elbows for low voltage systems (Data, security, etc.) would change to PVC
(common practice for our area)
5. Changing the 30KVA transformers from 115*C rise to 150*C rise. The 115*c rise only allows for the
transformers to have a max operating temp of 115*C. the 150*C allows for a max operating temperature of
150*C. The heat is not increased based on the rating on the transformer it is determined by the load on the
transformer.

6. Change switchboard bussing to copper or aluminum instead of silver-plated copper. Silver Plating bus is a
plating used on copper bus to resist some elements from tarnishing the bus. Silver plating is only a contact
plating that does not penetrate the copper characteristics of the bus.
7. Remove SPD's from the following Panelboards - S1ALR, S1FH, S1BLR, S1AHR, S2ALR, S2BLM, S2BLR, 1BLM,
E1AHL, 1AHM, 1BLM, 1ALR, 2ALR, 1BLR, 2BLR, 2BLM, AND 2AHM - A staged approach for SPD's is still
included with the removal of the SPD's listed in the VE option. Protection to the panels that the SPD's are
removed from is still being achieved from outside voltage spikes and swells. The panels that feed the VE
optioned panel have SPD's in them and as a result will protect downstream panels from outside voltage
fluctuations.
8. Change elevator disconnects from spec'd Bussman elevator control disconnects to standard fused, shunted
disconnects. The standard fused, shunted disconnects are what most projects in this area use unless they
come integral with the elevator equipment.
9. Change VAV disconnecting means from fused disconnects to standard switches - Standard switches are most
common means of disconnect for VAV system unless a disconnecting means comes integral to the equipment.
10. Change feeder wire from copper to aluminum - Change wire from copper to aluminum on all feeders while
utilizing machine crimped mac adapts to terminate aluminum wires to breakers/lugs.
11. Remove UPS (A) standard factory witness testing, (B) 8 hr. burn -in time, (C) cellwatch battery monitoring system,
(D) two-year parts and labor warranty, (E) one year extended battery coverage - (A) No one ever visits the
factory for the witness testing. (B) The 8 hour burn test will be removed and not preformed at the factory. (C)
Removing cellwatch battery monitoring system (1/2 the price of the deduct). (D) Owner will still receive a 1-year
warranty from date of energization or 18 months from shipment depending on which one occurs first. (E) Owner

12. Remove Seismic from the project. This is not typically within a seismic zone - This would remove seismic
bracing from electrical gear equipment. Change data cable from CAT6A to CAT6 - (A) Cat6A cable is made and
terminated to tighter tolerances than Cat6. This means the copper conductors are twisted tighter. This requires
higher specification patch panels, wall jacks, and RJ45 connectors. (B) Cat6A speed is at least 500 MHz This
allows 10 Gbp/s (Gigabits per second) up to 328 feet (100 meters). Cat6 speed is 250 MHz Therefore, it only
supports 10 Gbp/s to 165 feet (55 meters) under ideal conditions —less in heavy cross talk environments. (C)
Cat6A cable often uses thicker copper conductors and jackets.

Domestic Water, Sewer and gas infrastructure systems.
VE pricing to change the storm drainage route at the southeast corner of the site and substitute the (2) Contech
structures has been included in the price but is subject to change upon pricing of revisions to the Civil drawings.
1. Substitute the Storm Water Treatment Devices from Contech Structures for Aquaswirl Structures (purchased
from Ferguson that have been used and approved by the City of Fayetteville in the past).
2. Take the Storm drain from structure 2002-HDS found on page C3.2 and run it directly North on the West side of
the road for approximately 150', then install a junction box and another substituted Aquaswirl structure and lay
the remaining approximate 50' to daylight into the detention pond. Also add another 450 sq ft. of concrete
swale. While doing this, deleting the 390' of 18" RCP running to the West, and deleting both structures labeled
2001-JB, and 3001-AI.
