WHEREAS, RC Park Meadows, LLC is developing a new residential subdivision located along the
west side of Morningside Drive and between 15th Street and Huntsville Road; and
WHEREAS, the developer discovered that the west side of Morningside Drive has an irregular cross
section making it difficult for the developer and the contractor to meet city street standards and the
condition of Morningside Drive is deteriorating; and
WHEREAS, recognizing an opportunity to work with the developer to have the entire width of this
street repaved all at once, city Staff is recommending this cost share to reimburse tl-_e developer for
cost associated with paving the western half of the street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: Tha. t-ie City Council of the City of Fayetteville, Arkansas hereby determines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement
with RC Park Meadows, LLC, for the overlay of the west side of Morningside Drive with a refund in
an amount not to exceed $75,155.88 to be paid by the City of Fayetteville.

SUBJECT: Cost Share with RC Park Meadows LLC to overlay the west side of
Morningside Drive in conjunction with Park Meadows Development
RECOMMENDATION:
Staff recommends approval of this cost share with RC Park Meadows LLS to pay $75,155.88 to
overlay west side of Morningside Drive for approximately'/2 mile between 151h Street and
Huntsville Road.
BACKGROUND:
In 2017, the Development Services Office received a request from RC Park Meadows LLC for a
new residential subdivision to be located along the west side of Morningside Drive, and between
15th Street, and Hunstville Road. The development would encompass over 60 acres and
include nearly 300 new homes. During review of the project multiple improvements were
required, including turn lanes, sidewalks, trails, and widening of Morningside Drive along the
property frontage (approximately 2,600 feet or'/ mile).
DISCUSSION:
During construction and in preparation for paving the eastern half of Morningside Drive, the
developer and their engineer Crafton Tull discovered that the west side of Morningside Drive
had quite an irregular cross section and requested a meeting to discuss with city staff. The
existing cross section for Morningside would make it difficult for the developer and their
contractor to meet city street standards on the eastern half of the road where they were building
the widening. In addition to this, the condition of Morningside drive is deteriorating, and the
surface is in need of maintenance. Recognizing an opportunity to work with the developer to
have the entire width of this street repaved all at once, city Staff is recommending this cost
share to reimburse the developer for cost associated with paving the western half of the street.
This item was presented to the Transportation Committee on April 27th, and received a
unanimous recommendation of approval.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF STREET IMPROVEMENT COSTS
This Agreement, made and entered into on this day of 2021, by and
between the City of Fayetteville, Arkansas ("City") and RC Park Meadows LLC ("RC"),
witnesseth:
WHEREAS, RC is currently constructing a new residential subdivision called Park
Meadows along the east side of Morningside Drive
WHEREAS, the RC development is required to improve the eastern half of Morningside
Drive in accordance with the Master Street Plan along its property frontage: and
WHEREAS, RC has committed to completing these required street improvements; and
WHEREAS, it is also necessary to overlay the western side of Morningside Drive to
facilitate the improvements to the eastern side of the street: and
WHEREAS, the City of Fayetteville Engineering Division recommends a cost share to
pay for the overlay of the western half of Morningside Drive, because requiring that of RC would
exceed the rough proportionality of impact from the development.
NOW, THEREFORE, the City of Fayetteville, Arkansas and RC agree as follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse RC for $75,155.88 which represents the cost to overlay the western
half of Morningside Drive for approximately 2,600 linear feet from 15ih Street
on the south to Huntsville Road on the north as shown in Exhibit "A", attached.
B. Payments due to RC, shall be remitted within sixty (60) days after receipt of
valid invoices, and pending successful inspection and acceptance of the
completed work by the City of Fayetteville Engineering Division.
2. RC agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary to complete the work shown on Exhibit "A", in accordance with
the City of Fayetteville Minimum Street Standards, and City Standard Details,

Specs -Details. It has been discussed and is understood that certain portions of
this street may not be able to meet cross slope requirements of the minimum
street standards due to irregularity of the existing curb.
B. Provide a copy of the invoices from the Contractor upon completion and City
approval of the street improvements described in Exhibit "A".

C. Pay for the street improvements (with reimbursement of $75,155.88 of the cost
by the City of Fayetteville).
3. It is further understood that the contract for construction is be=wecn RC and their
Contractor and that the City has no contractual obligation wish eit-ler the Contractor
or any agent for RC. The City's only obligation shall be to participate in a
contractual agreement with a not -to -exceed amount of $75,155.89 for the street
improvements.
