A RESOLUTION TO APPROVE CHANGE ORDER NO.2 WITH GARVER, LLC IN THE

ASSOCIATED WITH THE GREEN PARKING LOT AT KESSLER MOUNTAIN REGIONAL
PARK, TO APPROVE A PROJECT CONTINGENCY IN THE AMOUNT OF $3,000.00, AND
TO APPROVE A BUDGET ADJUSTMENT
WHEREAS, on July 3, 2018, the City Council passed Resolution 139-18 approving a cost share
agreement with Beaver Watershed Alliance to use grant funding in the amount of $160,000.00 to
design and construct a green parking lot at Kessler Mountain Regional Park; and
WHEREAS, on October 15, 2019, the City Council passed Resolution No. 238-19 approving a
Professional Engineering Services Agreement with Garver, LLC to provide surveying, design,
engineering, architectural, and construction administration services associated with Phase Two of
Kessler Mountain Regional Park, which included the addition of a four field baseball complex and
parking lot; and
WHEREAS, Parks & Recreation Department staff recommend executing a change order to expand
Garver's scope of services to include construction administration for the green parking lot construction
project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan
to sign Change Order No. 2 to the contract with Garver, LLC in the amount of $11,470.00 for

Mountain Regional Park, and further approves a project contingency in the amount of $3,000.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget

SUBJECT: A resolution to approve Change Order No. 2 to the contract with Garver

$3,000 and to approve a budget adjustment.
RECOMMENDATION:
A resolution to approve Change Order No. 2 to the contract with Garver Engineering of
Fayetteville, AR (RFQ #19-01, Selection #19) in the amount of $11,470 for construction
administration services at Kessler Mountain Regional Park for the LID Parking Lot located by
the soccer complex and a project contingency in the amount of $3,000 and to approve a budget
adjustment.
BACKGROUND:
On July 3, 2018, Resolution 139-18 approved a Cost Share Agreement with the Beaver
Watershed Alliance (BWA) for grant funding the amount of $160,000 and assistance in design
and construction of a LID parking lot at Kessler Mountain Regional Park. Amendment #1 to the
BWA Cost Share Agreement was approved on October 13, 2020 to increase the parking lot
from 52 to approximately 80 parking stalls, decrease the number of green parking stalls from 20
to 8 and to extend the project completion date.
DISCUSSION:
Construction of the new four -field baseball complex has started at Kessler Mountain Regional
Baseball Complex. Garver Engineering was hired as the consultant to design and supervise this
project. Because Garver is performing work at Kessler Park, it would be efficient and timely for
them to also do construction administration work on this parking lot. The grant requires this
project to be completed by September 1, 2021. This change order is contingent on the approval
of the change order adding the construction of the LID parking lot to the Crossland Heavy
Equipment, Inc. Contract.
BUDGET/STAFF IMPACT:
Change Order No. 2 is funded by the Parks Development Fund.

GARVER
AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES

CONTRACT AMENDMENT NO. 2
This Contract Amendment No. 2, effective on the date last written below, shall amend the original
contract between the City of Fayetteville (Owner) and GARVER, LLC (GARVER), dated October 15,
2019 referred to in the following paragraphs as the original contract.
This Contract Amendment No. 2 adds professional services for the:
Phase 2 of the Kessler Mountain Regional Park Project
The original contract is hereby modified as follows:
APPENDIX A — SCOPE OF SERVICES
The following items will be added to Section 12. Construction Phase Services of the original contract
SCOPE OF SERVICES:
1. An 82-space parking lot that was designed by others to be located to the east of the existing soccer
fields shall be added by change order to the Kessler Mountain Regional Park, Phase 2 construction
contract. The following shall be added to the construction phase services being provide by Garver in
relation to these additional improvements:
A. Prepare a change order to the project construction contract and provide coordination with the
contractor for performance of the field work.
B. Provide limited onsite observation services for the 18-week construction contract performance
time. The proposed fee is based on an average of 4 hours per week during the 18-week
construction contract performance time. If the construction time extends beyond the time
established in this agreement or if the Owner wishes to increase the time or frequency of the
observation, the Owner will pay Garver an additional fee agreed to by the Owner and Garver.
C. Using a set of working drawings maintained by the Contractor, prepare and furnish record
drawings. CAD drawings to be provided to Garver and the Contractor.
D. Participate in final project inspection, prepare punch list, review final project closing documents,
and review final pay request.
E. The review of material submittals and shop drawings (if applicable) to be provided by others
and are not included in this amendment.
APPENDIX B — GARVER FEE SPREADSHEETS
The Maximum Not to Exceed Amount will be increased $11,470 from $452,325 to $463,795 as shown
on the attached revised Appendix B Fee Summary Sheet.
