RECOMMENDATION: Staff recommends approval of a cost share with Aptitude Arkansas, LLC to pay $98,129.00 for installation of a pedestrian hybrid beacon at Razorback Road for the Tsa La Gi Trail, approval of a 10% contingency in the amount of$9,813.00 and approval of a budget adjustment. BACKGROUND: In June of 2019, planning staff approved SIP 19-6659 the Marshall Apartments by Aptitude Arkansas, LLC at 821 S. Razorback Road. This project is located on a missing section of the Tsa La Gi trail extending through this property and crossing Razorback Road. One of the conditions of approval for the Marshall Apartments is for the construction of this section of the Tsa La Gi Trail. To create a safe trail crossing of Razorback Road, a Pedestrian Hybrid Beacon signal has been designed and permitted by ARDOT to be installed by Aptitude Arkansas, LLC. DISCUSSION: Staff has compared the cost of public infrastructure required on two similar other development projects completed over the past few years to determine the rough proportional share for the Marshall Apartments. Based on these calculations, Aptitude Arkansas, LLC is required to contribute $58,750 above the other public infrastructure improvements associated with the project, including the construction of the Tsa La Gi Trail. These funds will be applied to the developer portion of the cost share for the Pedestrian Hybrid Beacon signal at Razorback Road. BUDGET/STAFF IMPACT: The total cost of the engineering ($18,610), inspection ($9,000) and construction ($129,269) of the Pedestrian Hybrid Beacon is $156,879. After the developer fees of$58,750 are applied, the remaining cost to the City will be $98,129. The cost share is funded by the 2019 Bond funds for trail improvements. Dear Misters Carney and Trasher, City Staff has completed the review of and approved the Large Site Improvement Plan for The Marshall Apartments at 821 South Razorback Road (LSIP 19-6659) subject to the following conditions: 1. Further project approvals are contingent upon Planning Commission consideration and approval of a variance of parking space minimum requirements and a conditional use permit for off-site parking (CUP 19-6715). Conditions of this variance or conditional use permit will apply to future grading or building reviews; 2. Street Improvements: a. Construction of the Tsa-La-Gi Trail connection from its existing end point to the west, through the Arkansas & Missouri Railroad right-of-way and subject property to Razorback Road to the east; b. Extension of Arbuckle Lane southward through the subject property, to include street, curb and gutter, greenspace, and sidewalk along both sides; and c. Repair or replacement of any non-damaged ADA sidewalk or trail along the subject property's Razorback Road frontage. 3. Right-of-way dedication in the amount of 50 feet along the required extension of Arbuckle Lane; 4. Any proposed easements or rights-of-way shall be dedicated by easement plat prior to building permit approval; 5. Prior to building permit approval, parks fees in-lieu of land dedication totaling $618,800 shall be required. The actual amount of acreage and/or fees will be determined by the actual number of dwelling units and the park land formula at building permit submittal; 6. Any and all proposed equipment or utilities must be screened pursuant to §166.23(C)(5); 7. All new structures will require addressing action and existing addresses may not be used for future development. All freestanding and wall signs shall comply with ordinance specifications for location, size, type, number, etc. Any proposed signs shall be permitted by a separate sign permit application prior to installation; and 14. Prior to the issuance of a building permit the following is required: a. Grading and drainage permits; b. An on-site inspection by the Urban Forester of all tree protection measures prior to any land disturbance; c. Project Disk with all final revisions; and d. One copy of final construction drawings showing landscape plans including tree preservation measures submitted to the Landscape Administrator. The next step is submittal of construction documents to the appropriate City Divisions for review including a grading/drainage submittal to the Engineering Division and a building permit to the Building Safety Division. This may be done sequentially, or concurrently. Any required right-of- way or easement dedication must be completed prior to building permit approval through easement plat submittal, review, and recordation. This was just pulled from another project, so of course all the names and description of the work and costs would be updated to reflect what we are doing with The Marshal, but hopefully that would give you an idea. In regards to cost, and roughly proportional share, we compared the amount of public infrastructure completed by two other development projects completed over the past few years to those proposed with The Marshall development and found the following: University House (AKA The Domain)—Completed Summer/Fall 2013 • 654 Beds • Street Improvements,Transit Stop, 1168LF of Multiuse Trail, etc. • Total Street and Trail Improvements= $110,192 Beechwood Village (AKA Idyll Village)—Completed Winter 2016 • 682 Beds • Street Improvements (On street parking), thermo trail crossing, 1028 LF of Multiuse Trail, etc.. • Total Street and Trail Improvements= $127,293 That comes out to$168-$186/per bed. Say we average that to$175/bed and apply that same logic to the 650 beds proposed for The Marshal, we'd come out to approximately$113,750 of street and trail improvements that would be expected to be roughly proportional to the impact of the development (compared to past projects of similar size on this same trail corridor). The Marshal project is already showing to construct 568 LF of multiuse trail, an extension of Arbuckle Lane, and some modifications to Razorback Road. We've estimated the total cost of those improvements to be approximately$60,000. This would leave approximately$58,750 in remaining cost that could be considered roughly proportional compared to other recent projects. Attached are our notes on that, and we'd certainly invite your review. Using this logic, we'd propose a cost share where the developer for The Marshal would pay the$58,750, and the city would pay the remainder of the cost for the HAWK based on bid prices. Of course, the total amount of the signal should include engineering fee's, construction observation, etc...
