Staff's preferred option was the development of a contract which retained the following: • Arkansas Economic Development Commission project management of all prospective, expansion, and retention employment projects, • Workforce Development support items. Staff placed a valuation of these items at $100,000, which is roughly the Department's cost to hire an economic development professional internally. In the absence of agreement from the Chamber of Commerce on that valuation, staff proceeded to work with the Chamber to add new services at a total valuation of $180,000 and is recommending approval of the attached contract. Staff believes that the City of Fayetteville's twelve-year history with the contract and the great work done managing AEDC projects and in the area of workforce development merited the item proceeding for consideration. Lastly, staff felt it was important to have a full discussion of this item with the full City Council and provide an avenue for the Chamber to highlight their work. Mailing Address: 113 W. Mountain Street www.fayetteville-ar.gov Fayetteville, AR 72701 BACKGROUND: The City of Fayetteville issued RFP 16-05 on July 6, 2016 and received proposals on July 29. The selection committee (which included Council Member Adella Gray) recommended entering negotiations with the Fayetteville Chamber of Commerce to provide the services requested by the RFP. On October 4, 2016, Resolution 185-16 was passed, authorizing a two-year contract with the Fayetteville Chamber of Commerce. In 2018, the Fayetteville City Council passed Resolution 270-18, authorizing the first two-year renewal of the contract with the Fayetteville Chamber of Commerce. Several revisions to the contract were made ahead of the 2018 adoption, including the removal of retail and restaurant recruitment. This item was removed because of the creation of the City's Department of Economic Vitality's Business Development Manager position, which would give a full-time focus to sales tax generating businesses. The contract allows for three additional two-year terms with approval of both parties. This item is for the second renewal of the economic development consulting contract. DISCUSSION: This economic development consulting contract was originally developed in response to RFP 16-05 which was generated prior to the Department of Economic Vitality existing. RFP-16-05 called for traditional economic development services to be completed such as business retention and expansion, new employment projects, and workforce development. The Fayetteville Chamber of Commerce has excelled at project management with the Arkansas Economic Development Commission and with workforce development efforts. Staff has worked with the Chamber to develop the attached contract which add new services that build on these strengths and include performance metrics for the first time. Revisions: The Development and Implementation of a Proactive Employment Growth Plan This new service calls for the development of a strategy for competing for employment projects that are considering Fayetteville. The strategy will pursue targeted industry sectors (Corporate services, legacy manufacturers, and specialized technologies) that build on Fayetteville's current employment strengths, and those which would diversify the types of jobs available in the City. The plan will call for the contractor and Director of Economic Vitality to travel to meet with these companies on their home turf when the opportunity for capital investment, number of jobs, and wage rates are extremely high. Expanded Workforce Development Services As mentioned above I highly value the contractor's workforce development services and intend to keep that as a focus. The City has added career guides, such as 'A Calling", expanding its target audience beyond high school students. The forthcoming editions will aim to provide residents who face barriers to employment access to career pathways in Fayetteville that lead to a living wage. A New Digital Business Retention and Expansion (BRE) Survey that will go to every business in Fayetteville The contract alters the traditional BRE program, which was one hundred in -person site visits, and replaces it with the development of a new system that enables every business in Fayetteville to be surveyed throughout the year. The questions will be designed by staff and the data will be valuable for the City's economic recovery efforts. Staff anticipates the development to take a few months and expects the program to roll out in the fall of 2021. Performance Metrics in Output and Outcome Format: Staff has changed performance metrics to focus on out puts and outcomes rather than overall economic indicators (overall new businesses, overall new jobs, etc.) a. Outputs: i. Number of requests for Information completed; ii. Number of new employment projects assisted; iii. Number of active expansion projects assisted, iv. Number of employers highlighted in the career atlases. b. Outcomes: i. Number of net new employees from projects served, ii. Number of successful expansions; iii. Total potential net new payroll estimates from expansions; iv. Total net new payroll secured from projects; V. Amount of capital investment from projects served; vi. Number of Robotics Training Certificates awarded. In 2019, the Fayetteville Chamber of Commerce developed a career guide titled "A Calling" that highlighted career pathways with existing employers in Fayetteville. With 30 participating employers and over 10,000 copies distributed, the publication was such a success that staff has requested it become a semi-annual deliverable. N BUDGET/STAFF IMPACT: The contract in consideration is for a two-year period, this is the second renewal of the contract and has a cost of $180,000 annually. A more detailed view of the Chamber's successes and work completed on a month -by - month basis can be found by reviewing the Fayetteville Chamber of Commerce's monthly reports on the same progress page. ' Selected highlights include: • Securing one of the largest Economic Development Administration grants in Arkansas history, a $2,100,000 grant representing a 300% return -on -investment of the City's first use of Economic Development Bond funds. • The publication of "A Calling" in 2019, a career exploration guide distributed to school districts. Over 10,000 copies of the publication were distributed to students and parents. • The opening of the Robotics Training Center on the Fayetteville Square. This training center was the first of its kind in Arkansas. In 2019 the center issued 78 training certificates, and 51 in 2020 before having to close for four months due to the pandemic. The center is currently operating with reduced capacity to ensure adherence to social distancing guidelines. • The Chamber of Commerce's service on Mayor Jordan's Small Business Recovery Task Force. • Establishing weekly business leader update calls to provide COVID-19 resource updates, as well as guidance from healthcare professionals. The other area of the contract staff would like to highlight is workforce development. The Chamber of Commerce has a robust focus on early childhood education, which can be seen in the organizations investments in the NWA Fab Lab (which averages 1,200 visits a year), the Northwest Arkansas Regional Robotics Training Center which has already issued 130 training certificates, and the career exploration guide 'A Calling' (discussed more in the following section). SECOND RENEWAL OF CONTRACT FOR ECONOMIC DEVELOPMENT CONSULTING SERVICES BETWEEN THE CITY OF FAYETTEVILLE, ARKANSAS AND THE FAYETTEVILLE CHAMBER OF COMMERCE WHEREAS, the City of Fayetteville, Arkansas wishes to contract for Economic Development Consulting Services, and; WHEREAS, the Fayetteville, Arkansas Chamber of Commerce wishes to provide certain Economic Development Consulting Services to the City of Fayetteville, Arkansas, and; WHEREAS, the Fayetteville, Arkansas Chamber of Commerce has been selected to perform Economic Development Consulting Services for the City of Fayetteville utilizing the competitive Request for Proposal selection process (via RFP 16-05, Economic Development Consulting Services — Business Retention and Expansion), and; WHEREAS, the City Council of Fayetteville, Arkansas and the Fayetteville, Arkansas Chamber of Commerce wish to extend the contract for Economic Development Consulting Services an additional two years as provided in RFP 16-05 and the original contract approved by Resolution No. 185-16. NOW THEREFORE: In consideration of the mutual promises contained in this Agreement and other good and valuable consideration, i 1. The terms and conditions set forth in this Agreement supersede and replace the terms and conditions of any prior contract or amendment for economic development consulting services between the parties 2. Term: This Agreement, governing the second of three potential two-year extensions, shall be effective as of January 1, 2021, and shall end December 31, 2022. This contract may be canceled by either party with thirty days written notice. 3. Renewals: This agreement may only be renewed by approval of the City Council and with mutual agreement of the Chamber of Commerce. The City may exercise an option to renew the contract for one (1) additional two (2) year term with approval of both parties. Economic Development Consulting Services Contract Page 1 of 9 4. Attachments: The Contract documents which comprise the contract between the City of Fayetteville and the Fayetteville Chamber of Commerce consist of this Contract and the following documents attached hereto, and made a part hereof: a.) Exhibit A - Revised Schedule of Deliverables and Performance Measures * The City of Fayetteville shall coordinate with the Fayetteville Chamber of Commerce for modifications to this schedule. Any modifications to Exhibit A shall not reduce the quality or quantity of the services to be provided pursuant to this contract, as determined by the Mayor or his/her Chief of Staff or his/her Director of Economic Vitality. Any modifications shall be agreed upon by both the City and Fayetteville Chamber of Commerce; however, any changes affecting price shall have prior approval by the Fayetteville City Council. In the event Exhibit A is revised and price is not modified, such revised document shall be provided to the City Council at the next regularly scheduled update. 5. Services to be Provided: During the terms of this Agreement, the Fayetteville Chamber of Commerce shall: • Serve as the first point of contact as the City's contractor for Business Retention and Expansion services for economic development as defined in the Fayetteville First Economic Development Strategic Plan and maintain good relations with the Arkansas Economic Development Commission and other economic development partners locally, nationally and internationally Maintain clear and open communication with the City on all economic development services and activities provided underthe scope of this contract; and the Chamber shall clearly articulate when communicating on behalf of the Chamber of Commerce versus City -contracted initiatives to create clear accountability and separation of City -contracted initiatives and Chamber of Commerce initiatives; and • Provide all deliverables and performance measures outlined in the attached Exhibit A 6. Fees and Expenses: The City of Fayetteville agrees the consulting fee shall be paid upon invoice as follows: Consultation Services shall be invoiced for each quarter in the amount of $45,000 per quarter. Total fees for consultation services shall not exceed $360,000 from the date of contract. The Fayetteville Chamber of Commerce shall provide monthly itemized invoices. Payment of the above -described fees shall be contingent upon annual budget approval by the Fayetteville City Council. If funds are not appropriated for any year this Agreement shall be terminated at the end of the then current term. If funds appropriated are less than the full amount contemplated by this Agreement, then the parties shall agree upon an amended Revised Schedule of Deliverables and Performance Measures (Exhibit A). In Economic Development Consulting Services Contract Page 2 of 9 the event the parties are unable to reach an agreement on an amended schedule, then the Agreement shall be terminated at the end of the current month. 7. Notices: Any notice required to be given under this Agreement to either party to the other shall be sufficient if addressed and mailed, certified mail, postage paid, delivery, fax (receipt confirmed), or overnight courier. 8. Applicable Law: This Agreement shall be governed by and construed in accord with the laws of the State of Arkansas. 9. Entire Agreement: This Agreement sets forth the entire agreement and understanding between the parties on the subject matter of this Agreement. Neither party shall be bound by any conditions, definitions, representations or warranties with respect to the subject matter of this Agreement other than those as expressly provided herein. 10. Amendments and Waivers: Changes, modifications, or amendments in cost or fees to this contract shall not be allowed without a prior formal contract amendment approved by the Mayor and the City Council in advance of the change in cost or fees. No modification of this Agreement shall be binding unless made in writing and executed by both parties. No waiver by either party or any breach or obligation of the other party under this Agreement shall constitute a waiver of any other prior or subsequent breach or obligation. 11. Performance Measures: The Fayetteville Chamber of Commerce shall provide the deliverables as outlined in the attached Exhibit A, which serves to implement the adopted Fayetteville First Economic Development Strategic Plan. Performance measures are included for the services and will be used to evaluate the work performed throughout the entire term of the contract. 12. Contract Administration: The Mayor or his/her Chief of Staff or his/her Director of Economic Vitality shall be the Contract Administrator for this contract. The Fayetteville Chamber of Commerce President and CEO or his/her Designated Representative shall be the primary contact for all matters pertaining to this contract. While it is understood that many facts pertaining to projects must be held in the strictest confidence, the Fayetteville Chamber of Commerce President and CEO will ensure that the Mayor and the Director of Economic Vitality are kept abreast of details and progress made pertaining to Economic Development prospects considering development in Fayetteville to the greatest extent possible. 13. Freedom of Information Act: City contracts and documents prepared while performing work pursuant to this contract may be subject to the Arkansas Freedom of Information Act. If a Freedom of Information Act request is presented to the City of Fayetteville or to the Chamber of Commerce the parties shall do everything possible, in a prompt and timely manner, to determine whether the requested records must be disclosed as required by the Arkansas Freedom of Information Act (A.C.A. §25-19-101 et. seq.), or whether the records are exempt pursuant to A.C.A. § 25-19-105(b), A.C.A. § 14-176-105(b)(1) or other applicable state or federal law. 'fi;GTON /111111►11 Economic Development Consulting Services Contract Page 4 of 9 Exhibit "A" Contract for Economic Development Services - Economic Development Consulting Services 2021-2022 REVISED Schedule of Deliverables and Performance Measures As outlined herein, the Chamber of Commerce shall provide the following services, more generally referred to as Economic Development Consulting Services: One. Foster new business growth by representing the City of Fayetteville as the economic development point of contact for all governmental and non -governmental economic development organizations; Two. Develop, implement, and manage the City's new digital business survey; Three. Develop, implement, and manage a robust and proactive employment growth plan focused on Fayetteville's targeted industry sectors other than retail; Four. Performance Measures; Five. Conduct Workforce Development efforts that promote pathways to prosperity for all while helping to satisfy employers need for skilled talent; Six. Collaborate with the City for communication with the public; Seven. Report Outcomes. One: Foster new business growth by representing the City of Fayetteville as the economic development point of contact for state governmental and non -governmental economic development ornanizations. The Chamber will use its connections, expertise, and influence to promote and assist the City of Fayetteville realize its economic development goals. 1. Represent the City of Fayetteville as the primary point of contact for the Arkansas Economic Development Commission (AEDC) coordinating with state officials to promote Fayetteville as an outstanding City for businesses to locate. Manage AEDC projects including new employment opportunities and expansion projects with existing employers. Provide project management services for existing and prospective companies in the areas,of incentive negotiation on behalf of companies with AEDC. 2. Conduct site location work and request for information response for prospective employers, working with the Department of Economic Vitality, Northwest Arkansas Council, and AEDC to encourage and recruit prospective companies to locate in, Fayetteville. 3. Maintain the Arkansas Site Selection Center's database for the City of Fayetteville. 4. Provide project management services for existing and prospective companies. a. Organize projects into manageable action items. Economic Development Consulting Services Contract Page 5 of 9 b. Plan, document, and track, each project phase. c. Schedule tasks and action items. d. Identify and quantify positive outcomes for the City. e. Identify the impact of project delays. f. Plan for and rapidly recover from setbacks. 5. Maintain a bright line of communication with the Mayor and Director of Economic Vitality concerning projects which stem from the Arkansas Economic Development Commission, while it is understood that many facts pertaining to projects must be held in the strictest confidence, the Fayetteville Chamber of Commerce President and CEO will insure that the Mayor and the Director of Economic Vitality are kept abreast of details and progress made pertaining to Economic Development prospects considering development in Fayetteville to the greatest extent possible. 6. Identify industry gaps to further diversify Fayetteville's employment base for above minimum wage jobs. a. Identify industries currently not operating in Fayetteville. b. Assist Department of Economic Vitality in the on -going COVID-19 Pandemic response and recovery. An estimated 18-to-24-month collaborative project. a. Identify businesses that have closed or reduced employees by more than 25%. b. Identify and publicize State, Federal and non -governmental assistance programs. Two: Develop, implement, and manage the City's new Digital Business Survey 1. Working with the Department of Economic Vitality, lead the development of a new digital business survey system which will survey each business in the City on an annual basis. Lead the implementation and adoption of the survey with Fayetteville businesses, providing monthly reports to the Department of Economic Vitality. Manage the ongoing operation and management of the program. Three: Develop, implement, and manage a robust and proactive employment growth plan focused on Fayetteville's targeted industry sectors other than retail. 1. Collaborate with the Office of Economic Vitality to develop and implement a strategic plan to increase non -retail employment that pay a living wage (MIT Living Wage Calculator). a. Develop a proactive strategy to recruit and secure new employment projects within Fayetteville's targeted industry sectors. The strategy should include a list of growth opportunities to pursue, specific strategies to increase Fayetteville's success rate with securing prospective companies, and challenges to such an endeavor. Within the strategy, identify sectoral opportunities to diversify Fayetteville's employment base with the understanding that the overarching goal is new jobs that pay a living wage as defined by MIT. c. Generate a business friendly and in informative welcome packet designed for Site Selectors. Proactively advertise Fayetteville as a place to expand in and solicit new business interest and inquiry. 2. As part of the implementation of the plan, set standards and thresholds for prospective employers which would warrant outward travel on the part of the Fayetteville Chamber of Commerce and City of Fayetteville to aid in the recruitment and securing of significant employment projects. Four: Performance Measures 1. The performance measures outlined below serve to measure specific work which is completed as a result of the services outlined in the contract being completed. While the tracking of economic indicators such as total employment, unemployment rate, and new businesses will continue, the success and performance of the contract shall be measured using the outputs and outcomes below and reported on monthly. a. Outputs: i. Number of requests for Information completed; ii. Number of new employment projects assisted; iii. Number of active expansion projects assisted; iv. Number of employers highlighted in the career atlas's. b. Outcomes: i. Number of net new employees from projects served; H. Number of successful expansions; iii. The Chamber will use its connections expertise and influence to develop, attract, and retain the City of Fayetteville's workforce. 1. Develop and distribute semi-annual 'Career Atlas's'. Working incoordination with the Department of Economic Vitality, Washington County School Districts, Non -profits, and Fayetteville Employers- develop digital issues of the Career Atlas on at least a bi-annual basis. a. Definition: Career Atlas. The Career Atlas is a digital publication, similar to the Chamber of Commerce's 2019 publication "A Calling". b. Career Atlas's shall be developed in such a manner that they provide career insights and opportunities for high school students, and residents who face barriers to sustainable employment at a living wage. Up to two pages shall be available for the City to use to promote career pathways in the municipal government and workforce development. 2. Engage and connect regional educational and local industry leadership. Coordinate with the Northwest Arkansas Council and the Department of Economic Vitality to participate in discussions with local and regional institutions of higher education, Fayetteville public school career and technical education program leaders, as well as local industry and targeted industry sectors, and determine whether the workforce and training needs of the identified target markets can be met: a. Support relationships with educational institutions and employers to expand skilled trade programs and training and determine possible new program development in the future to meet the needs of the targeted business sectors and existing business and industry. b. Work with the Department of Economic Vitality to connect industry and education through innovative strategies such as student internships, on-the-job training opportunities, apprenticeship programs, teacher externships, industry tours for educators, and other strategies outlined in the Fayetteville Workforce Development Plan. c. Advocate and support the expansion of skilled trade programs and apprenticeship programs through local industry and educational partnerships. 3. Provide innovative workforce training opportunities. Continue to provide training and job skill development opportunities in Fayetteville through the support and utilization of the Fayetteville Chamber of Commerce NWA Fab Lab and the Fayetteville Chamber of Commerce Robotics Training Center located in the Fayetteville Innovation District. Six: Collaborate with the City for Communication with the Public 1. Communications pertaining to the implementation of the Fayetteville First Plan and the implementation, outputs, or outcomes of this contract will be communicated on the City's Economic Development website using the City's branding and marketing. Communication and engagement with the business community as it relates to measures outlined in the contract will be done through the City's website, which is managed by the Department of Economic Vitality. Promotion of the measures outlined in the contract will be conducted through the City's social media channels. All performance measures and reports will be updated on a monthly basis via the City's web site by the Department of Economic Vitality. 2. Communications from the Fayetteville Chamber of Commerce related to economic development initiatives within the scope of this contract, major decisions, announcements, and/or development matters, and public -facing activities should be coordinated with the Mayor's office and the Department of Economic Vitality. Reporting results and milestones will be done as deliverables are met in the implementation of the Fayetteville First Economic Development Strategic Plan and will be formatted to fit within the City's Economic Development branding on the city web site. The City's internal Economic Development team will meet regularly with the Chamber of Commerce (at a minimum on a monthly basis) to discuss the status of deliverables. The Mayor and/or City Council may request. periodic updates and public engagement for citizens to be kept informed of the cty's economic development goals. The Fayetteville Chamber of Commerce will be expected to attend quarterly "collaboration meetings" with the City of Fayetteville and Entrepreneurship and Innovation contractor. A representative from the Fayetteville Chamber of Commerce will attend weekly conference calls with the Director of Economic Vitality. 2. The Chamber of Commerce shall provide written reports and prepare a brief presentation to the Mayor and City Council on at least a bi-annual basis.
