SUBJECT: Approve a Community Access Television, Inc. (d/b/a Your Media) Contract for
Public Access Television Services for 2021.
RECOMMENDATION:
Staff recommends approval of the attached contract via RFP 20-12 Public Access Television
Provider between the City of Fayetteville and Community Access Television, Inc. (d/b/a Your
Media) in the amount of$197,133.00 to provide Public Access Television services from January
1, 2021, through December 31, 2021, contingent on approval of the 2021 annual City budget
and work program.
BACKGROUND:
Community Access Television, Inc. (d/b/a Your Media), has been the City's Public Access
provider for the previous five-year term from January 2016 through December 2020, which was
approved through City Council Resolution 207-15 in November 2015.
DISCUSSION:
The nonprofit Community Access Television, Inc.—d/b/a Your Media—has been the contract
service provider for Fayetteville Public Access Television for the previous two five-year term
periods. Community Access Television, Inc. (d/b/a Your Media) was the only organization to
submit a proposal for the public access service provider RFP for the 2021-2025 term. The
contract was developed by the City of Fayetteville in partnership with Your Media and was
approved by the Your Media Board of Directors. The new contract cost has considerations for
increases to health insurance premiums and staff expenses. During a special PEG Advisory
Board meeting on November 10, 2020, the PEG Advisory Board members unanimously voted
their approval of this contract and to present it to City Council. This is a request for a new
contract for fiscal year 2021 with up to four renewals for the five-year term of January 2021
through December 2025.
BUDGET/STAFF IMPACT:
The total cost of this contract is $197,133.00. This amount is included in the proposed 2021
Budget to be approved by the City Council.

CONTRACT BETWEEN CITY OF FAYETTEVILLE, ARKANSAS
AND
COMMUNITY ACCESS TELEVISION
d/b/a Your Media
A 501-C-3 NONPROFIT ORGANIZATION
AGREEMENT
This Agreement is made this 1st day of January, 2021, by and between the City of Fayetteville, a
municipal corporation("City"), and Community Access Television, Inc., a nonprofit corporation,
dba Your Media("Your Media") who agree as follows:
PURPOSE AND INTENT
I. The purpose of Public Access Television in Fayetteville is to provide an opportunity for
users and others to produce and telecast television programming in a first-come, first-
served, content-neutral, non-discriminatory manner, in accordance with the First
Amendment, and to provide training in the techniques of video production for Public
Access Television.
2. The City of Fayetteville is accorded a Public Access Television channel by television
services providers with which it holds agreements, or pursuant to Arkansas law.
3. The City of Fayetteville desires to provide support for the operation of Public Access
Television in Fayetteville.
4. This contract for Public Access Television services is contingent upon the City retaining a
Public Access Television channel, either through agreements with television services
providers or pursuant to Arkansas law.
5. The City has determined it will provide support for the operation and programming of its
Public Access Television channel and it will provide physical space and equipment at the
City of Fayetteville Television Center, located at 101 W. Rock Street, Fayetteville.
6. The City of Fayetteville provides financial support through General Fund Revenue
allocations for operational contract services, building and facilities, approximately 3,000
square feet of space, utilities, repairs, maintenance, custodial services and capital
expenditures for facilities, studios and equipment.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein, the
parties agree as follows:

SECTION 1. DEFINITIONS
For the purposes of this contract, the following definitions will be established:
Class: An organized, regularly scheduled, interactive teaching session that is focused on a
particular subject and lead by an employee qualified to teach the subject.
Curriculum: A documented plan of teaching in which subject matter and class sessions are
described in a detailed syllabus, including specific topics, teaching methods, schedules and
methods of student evaluation.
Inside Program: A program produced utilizing Television Center equipment.
Outside Program: A program produced not utilizing Television Center equipment.
Producer: An individual who creates, owns, controls or is responsible for the content of a
television program.
Programming:Video and/or audio material that is organized in a particular fashion as determined
by a producer and distributed through one or more means to an audience.
Program Requestor:A user who requests a program to be telecast on the Public Access Television
channel.
Resident User: An individual who resides within the city limits of Fayetteville, a student at the
University of Arkansas or a public school within the city limits of Fayetteville, or an employee of
a public institution(or branch thereof)or non-profit organization that is based in Fayetteville. This
status may be documented by producing a current City of Fayetteville utility bill,a rental contract,
a driver's license, other government-issued photo ID that contains name and address (including a
student identification card), or a check stub or other proof of employment by a public institution
or non-profit organization located in Fayetteville.
Non-Resident User: An individual(henceforth referred to as non-resident)who resides within the
Washington or Benton County limits, is a student of a public school within the county limits, or is
an employee of a public institution (or branch thereof) or non-profit organization that is based
within the county limits and who does not otherwise qualify as a Resident User. County Residency
may be documented by producing a current utility bill,a rental contract, a driver's license,student
identification card, or other government-issued photo ID that contains name and address, or a
check stub or other proof of employment by a public institution or non-profit organization located
in Washington or Benton County.
Trainee: A resident or non-resident of Fayetteville who is currently enrolled in a class offered by
Fayetteville Public Access Television.
Television:Video programming that is distributed through any one or more wide-area distribution
methods, such as Video On Demand, Web site embedding,cable,IPTV,Web streaming,over-the-
air broadcast, etc.
Workshop:An organized,non-regular interactive teaching session which covers a particular topic
of interest to the participants, usually lead by an expert in the subject matter.

SECTION 2: GENERAL PROVISIONS
All services described in this contract and provided to the public by Your Media will be provided
free of charge to Resident-of-Fayetteville Public Access Users who were qualified users as of
December 31,2020.Non-resident-of-Fayetteville Public Access Users shall pay a$50 per year fee
for services described in this contract. Your Media will not require, solicit, or accept any
compensation of any kind, beyond that agreed upon in this contract and provided by the City, in
return for providing the services described herein, unless otherwise stipulated in this contract.
At no time shall the number of non-resident users exceed 49% of the total user base of FPTV
services and resources.
Your Media shall not provide any services or engage in any activity not described in this contract,
with or without compensation,that utilizes equipment, facilities,or resources owned or controlled
by the City of Fayetteville, without the expressed written consent of the City, or as stipulated in
this contract.
Your Media may charge a fee for the following items or activities utilizing equipment,facilities or
resources owned or controlled by the City of Fayetteville:
1. Non-resident of Fayetteville annual service dues.
2. Training workshops and seminars that are conducted utilizing City of Fayetteville
resources.
3. The sale of blank recording media.
4. Transfer and/or duplication services.
5. Other small items, such as t-shirts or other promotional items, as approved by the City of
Fayetteville Communications Director or Director of Media Services.
6. Video production services. If production services are provided, the following conditions
apply:
a. These services and activities will be referred to as "contract production".
b. Contract production may include studio production activity at the Television Center
and related activity, including pre- and post-production.
c. Your Media shall charge rates adequate to cover the basic costs of production.
Service rates will be reviewed and approved by the Director of Media Services on
an annual basis.
d. Your Media will utilize a standard contract document for each agreement to provide
contract production services. This contract document will be approved by the
Director of Media Services.
e. All fees charged for providing contract production services will be collected at the
point Your Media delivers the final product for which it was contracted.
f. All monies collected for providing production services will be utilized to support
Fayetteville Public Access services or capital improvements as approved by the
City Council and following applicable City of Fayetteville policies and procedures.

7. In addition to charging a fee for services described above, Your Media may generate
revenue utilizing equipment, facilities, or resources owned or controlled by the City of
Fayetteville through:
a. Fundraising activities designed to raise funds to support the operations or capital
improvements of the Public Access channel.
b. Acquisition of grants or awards dedicated to support the operations or capital
improvements of the Public Access channel.
If Your Media generates or collects any revenue through activities as allowed in this contract, or
otherwise approved by the City, utilizing equipment, facilities, or resources owned or controlled
by the City of Fayetteville, Your Media will ensure:
1. All monies collected for such services will be deposited into and all checks shall be made
payable to the"Trust Account of Community Access Television, Inc."which shall contain
only those funds.
2. Your Media's manager shall ensure proper accounting of all such revenues collected and
shall report such accounting monthly to the Director of Media Services.
3. All funds within the "Trust Account of Community Access Television, Inc." may only be
expended through City Council Resolution authorizing the receipt of funds into the
Television Center budget and approving any necessary Budget Adjustments.Normal bank
fees related directly to the use of this trust account may be paid with trust account funds
without prior authorization.
4. Proper accounting and records of services provided,fees charged and monies collected for
services will be kept by Your Media, in a manner approved by the Director of Media
Services.
The City of Fayetteville provides the services described herein as a public service to the users for
non-commercial use. Your Media will not allow any equipment, facilities, or resources owned or
controlled by the City to be used to generate revenue for any private company,group,organization,
or individual with the following exceptions:
1. Your Media may produce, or allow to be produced, televised fund-raising programs or
activities for 501(c)3, non-profit organizations that directly provide services to the users.
These programs are limited to one(1)per organization per contract year.
2. Your Media may produce or conduct one(1)fund-raising program or activity for itself that
is televised, or produces programming that is televised, on the Public Access Channel.
3. Your Media may be contracted to produce, or assist in the production of, productions that
utilize facilities and equipment controlled by the City at the discretion of the Operations
Manager and the Director of Media Services for a market-appropriate fee structure to be
determined by the Operations Manager and the Director of Media Services.
4. Televised fund-raising programs or activities may not exceed twenty-four (24) hours of
continuous programming or activity, or, if not continuous programming, exceed seven(7)
contiguous days of duration.
5. Fund-raising activities may not disrupt the normal operations of the Television Center.
Questions regarding disruption will be determined by the Director of Media Services.

6. Fund-raising messages may not be displayed over other programming without the
expressed written consent of the program owner.
7. The on-air bulletin/message board and the "Open Mic" program may be used by 501(c)3
non-profit organizations to announce or publicize activities of their organizations that
generate revenue for their organizations or programs.
Ownership title to all capital acquisition, supplies, material, or any other property purchased with
funds received under this Contract is vested with the City, and possession of such property shall,
upon termination of the Contract, revert to the City unless otherwise provided for by the City in
writing. Any equipment secured through fund-raising efforts to benefit the Public Access
Television channel shall remain the property of the City's Television Center.Any funds or revenue
secured through fund-raising efforts to benefit the Public Access Television channel shall be
remitted to the City.
All policies, procedures, information, and execution of the services and responsibilities described
in this contract shall be subject to approval by the Director of Media Services. Your Media will
not make changes or revisions to any policy, procedure, or method of work directly related to the
services described herein without the prior approval of the Director of Media Services.
In exchange for the funding provided by the City to Your Media,pursuant to this Agreement,Your
Media shall provide the following services and report progress in each area to the PEG Advisory
Board and the City as defined in this contract:

SECTION 3: SCOPE OF SERVICES
PROVIDE EQUITABLE CHANNEL AVAILABILITY AND PROGRAMMING SERVICES TO
USERS ON A FIRST-COME, FIRST-SERVED, CONTENT-NEUTRAL, AND NON-
DISCRIMINATORY BASIS.
The City of Fayetteville provides airtime on the Public Access Television channel as a public
service to users. Your Media will not require, solicit, or accept any compensation of any kind,
beyond that agreed upon in this contract and provided by the City, in return for telecasting any
programming on the Public Access Television channel. Each program that is produced utilizing
City of Fayetteville Television Center equipment or facilities will be telecast on the Public Access
channel at least one time. A program may be excused from the telecast requirement with approval
from the Director of Media Services prior to the production of the program, or at any time at the
discretion of the Director of Media Services.
Your Media will:
1. Maintain a process whereby users may request programming to be telecast on the Public
Access Television channel. This process is subject to approval by the Director of Media
Services.
2. Ensure individuals requesting programs to be telecast by Your Media on the Public Access
Television channel are users, as defined in Section 1.
3. Require requestors to sign an affidavit warranting that the program they are requesting to
be telecast does not contain:
a. any violation of any Federal, State or local statute or ordinance relating to
obscenity; or
b. any material that is an unlawful invasion of privacy; or
c. any use of material which violates copyright law;
Such a statement does not relieve Your Media of its duty to prevent further telecast of
programming that does not meet the stipulations contained herein,as such programming comes
to its knowledge.
4. Ensure programming on the public access channel (FPTV) is not commercial in nature.
Commercial programming is defined as: "Programming that contains direct appeals to
purchase commercial goods or services; promotes the activities of for-profit groups,
organizations, or individuals; contains any call to action or solicitation to purchase a
product or patronize a business; any use of superlatives in describing a product, service,or
business; any direct comparison to other products, or direct comparisons to unnamed
products; any price or value information; or any inducements to buy."
5. Require program requestors to provide Your Media with expressed, written consent of the
program's owner for the program to be telecast on Fayetteville's Public Access Television
channel. Your Media will maintain a copy of all such permissions on file.
6. Maintain a decision-making process and criteria for the scheduling of programming that
will ensure the protection of 1st Amendment rights of program requestors while ensuring
programming does not violate Federal, State, or local laws or ordinances. The process and
criteria are subject to approval by the Director of Media Services. At a minimum, the
process and criteria will:

a. Utilize program type definitions as included in Section 1 and define other program
types as necessary (i.e. one-time, series, date-sensitive, etc.).
b. Define scheduling priority of program types.
c. Define a priority conflict-resolution process.
d. Establish criteria for defining"mature-audience"-type programming.
e. Ensure program requestors are informed of"mature-audience"-type programming
criteria and sign an affidavit categorizing a requested program as "mature-
audience"-type programming if appropriate.
f. Define day-parts of the programming schedule that are appropriate for "mature-
audience"-type programming.
g. Define the program scheduling process.
7. Program the automated telecast system to ensure the telecast of programming on the Public
Access Television channel 24 hours per day/7 days per week.
- 8. Manage the program scheduling process in such a manner that ensures no more than seven
(7) days elapse between the submission of a new program and its first scheduled telecast.
9. Manage the programming schedule in such a manner that the on-air bulletin/message board
constitutes no more than 15%of the total weekly air time.
10. Publish and distribute to the public a current program schedule weekly. The schedule will,
at a minimum, be published in the following media:
a. The Public Access Television channel's on-air bulletin/message board.
b. The Public Access Television channel's web site.
c. A publicly accessible bulletin board at the Television Center.
d. Your Media's email address list that is maintained as an opt-in list in the central
records database.
The schedule will also be made available for publication by other media outlets that wish
to do so.
Your Media will not:
1. Exercise any control of the content of programming,with the following exceptions:
a. Programs that are produced solely by Your Media staff for the purposes of
communicating information about the Public Access Television channel or itself.
b. Portions of "open-studio" program content created by Your Media (i.e. opens,
closes, bumpers, etc.).
c. The on-air bulletin/message board.
d. Programming that is produced as a result of classroom/training/studio laboratory
production activity that is conducted by Your Media.
2. Schedule for further telecast any programming that has been found to violate any Federal,
State, or local statute or ordinance. Your Media staff will bring any possible violations
immediately to the attention of the Executive Director and the Director of Media Services
as they become known to them, either through complaint or observation. The Director of
Media Services will make an initial determination regarding the status of the programming.
An email message is sufficient for notification. Questions regarding the legality of any
programming should initially be directed to the Director of Media Services.

3. Schedule for further telecast any programming that has been found in violation of any
policy of Your Media or the City, including, but not limited to, a violation of the affidavit
of copyright; the affidavit of ownership; the affidavit of redistribution rights; or the
affidavit of"mature audience" content; each of which is included in the telecast request
process. Your Media staff will bring any possible violations immediately to the attention
of the Executive Director and the Director of Media Services as these violations become
known to them, either through complaint or observation. The Director of Media Services
will make an initial determination regarding the status of the programming. An email
message is sufficient for notification.
The City reserves the right to approve the content of any program telecast on the Public Access
Television channel that in any way indicates or implies it has originated directly from the Public
Access Television channel or its management. The Director of Media Services will determine if
programming meets such criteria.
PROGRAM SPONSORSHIP
Program producers and owners may accept sponsors for programming they produce for telecast
on the Public Access Television channel. Program sponsorship must adhere to the following:
1. The following may be identified as a program sponsor:
a. Corporations or Divisions or Subsidiaries of Corporations
b. Endowments and Foundations
c. Individuals
2. General Rules for Acceptability
a. The sponsor may not exercise editorial control over the content of any portion of
programming telecast on the Public Access Television channel.
b. The public must not perceive that the sponsor has editorial control over the content
of any portion of programming telecast on the Public Access Television channel.
c. The public must not conclude that any programming on the Public Access
Television channel promotes sponsors' products, services or other business
interests.
d. Product placement in programming in exchange for sponsor support is prohibited.
3. Rules for Display of Sponsor Credits
a. All sponsor credits must identify the sponsor by name and/or logo.
b. Sponsor credits may not include:
i. Any call to action or solicitation to purchase a product, i.e. any use of"you"
or"your"; or slogans such as"Get Met. It Pays."
ii. Superlatives, i.e. "...the most intelligent car ever built."
iii. Direct comparisons, i.e. "...when a Cadillac just isn't good enough."
iv. Price or value information
v. Inducements to buy, i.e. "six months free service when you buy"
c. Toll-free numbers or Web site addresses are acceptable if their purpose is only for
the viewer to receive more information, and not to solicit sales.
d. Sponsor credits may not exploit or take unfair advantage of the child audience for
children's programming.

e. Sponsor credits may not create the perception that there is a connection between
the program content and the sponsor's products or services.
f. Sponsor credits may only be displayed at the beginning and/or end of a program.
g. Program content may not be interrupted to provide sponsor credit.
h. No one sponsor credit may exceed fifteen 15 seconds in length.No single program
may have a sequence of sponsor credits that exceeds sixty (60) seconds in length.
i. Credits for in-kind goods and/or services are acceptable but they must appear in
context with normal production credits and may incorporate brands or logos.
PROVIDE TELEVISION STUDIO PRODUCTION SERVICES FOR USERS ON A FIRST-
COME, FIRST-SERVED,NON-DISCRIMINATORY BASIS
Your Media will:
1. Produce a weekly program("Open Mic")of no less than 30 minutes and no more than one
hour in length that provides an open-studio opportunity for users to express their views,
present information, or perform; not to exceed five minutes per person.
a. The"Open Mic"program is owned and controlled by the City of Fayetteville.
b. Your Media will conduct two (2) separate studio sessions of one (1) hour each
during which users may record their"Open Mic" segments. The schedule of studio
sessions is subject to approval of the Director of Media Services.
c. All participants,residents and non-residents of Fayetteville appearing on the"Open
Mic"program will be provided a document that informs them that what is presented
on the"Open Mic"program must conform to all guidelines for other programming
telecast on the Public Access Television channel.
d. Non-residents of Fayetteville wishing to participate in the "Open Mic" service
alone shall not be required to pay the $50 annual non-resident fee.
2. Produce programming for the users utilizing studio production laboratory sessions.
a. Content of programming produced in studio laboratory sessions will be the
responsibility of the producer requesting the production services.
b. All technical aspects of production will be under the control and responsibility of
Your Media.
c. Producers requesting production services utilizing the studio laboratory sessions
will be notified that they will be working in a classroom/training environment. The
experience of the participants in the class will be priority.
d. Your Media will not charge any production fees for programming produced in
studio laboratory sessions.
e. Studio laboratory sessions may not be used to produce series programming.
f. Production slots in the studio laboratory sessions will be scheduled on a first-come,
first-served basis. A producer may not schedule more than one session at a time.
3. Produce and telecast an electronic community bulletin/message board for residents to
announce events or other information.

4. Produce and telecast a disclaimer at random times during the program schedule, no fewer
than six (6)times per day, which contains the following message in both video and audio
format: "Fayetteville Public Access Television is a public service provided by the City of
Fayetteville to help residents exercise their First Amendment Rights. The views and
opinions expressed on this channel are not necessarily those of the staff or management of
Fayetteville Public Access Television or the City of Fayetteville."
EDUCATE FAYETTEVILLE RESIDENTS AND NON-RESIDENTS IN THE PRODUCTION
AND DISTRIBUTION OF NON-COMMERCIAL TELEVISION PROGRAMMING
Your Media will provide training and technical support for users so they may learn the techniques
and details of video production and television programming distribution.
Your Media will:
1. Create and implement a training curriculum that emphasizes technical proficiency and
production quality. The curriculum will contain at least 3 core classes in the subjects of:
a. Basic Field Production
b. Basic Video Editing
c. Basic Studio Production/Crew Positions
And at least 3 advanced classes in the subjects of:
a. Advanced Field Production
b. Advanced Video Editing
c. Advanced Studio Production
The syllabus for each class will be available on the Fayetteville Public Access Television
web site.
2. Offer a minimum of six (6) free classes a week taught by Your Media staff in various
disciplines of video production and programming distribution.
a. At least three(3) classes each week must be in the core subjects.
b. At least two (2)classes each week must be in the advanced subjects.
c. The studio production laboratory does not count toward the total of required classes.
3. Conduct a studio production laboratory session at least once per week that provides a
"hands-on"training environment for students in Studio Production classes.
4. Create student evaluation criteria and methods that allow students to demonstrate
proficiency in training both in writing and through practical application.
5. Require a minimum level of proficiency, as approved by the Director of Media Services,
to achieve a passing grade in classes.
6. Maintain records of student performance and evaluations.
7. Provide training and development resources, and technical support, in addition to regular
classes,to users while they are engaged in training or production activities.
8. Provide technical and production consultation to users who are producing outside
programs.
9. Offer training in the use of all available methods of television programming distribution.
10. Ensure that instructors maintain a minimum level of competence in the operation of
equipment, as approved by the Director of Media Services. This can be demonstrated
through industry certification or actual demonstration of skills to the Director of Media
Services or their designee. If an instructor fails to meet a minimum level of competence,

they will be prohibited from teaching any classes or workshops until such time as they have
demonstrated to the Director of Media Services, or his/her designee, they have achieved
that level.
11. Create and publish a monthly schedule of classes and workshops, a minimum of 30
calendar days prior to conducting the classes. The schedule will, at a minimum, be
published in the following media:
a. The Public Access Television channel's on-air bulletin board.
b. The Public Access Television channel's web site.
c. A publicly accessible bulletin board at the Television Center.
d. Your Media's email address list that is maintained as an opt-in list in the central
records database.
e. Made available for publication in other media that wish to do so.
12. Ensure Your Media staff stays current with emerging technologies through professional
development that includes technical training.
13. Provide reports on training and education activity as required by the City.
PROVIDE EQUAL ACCESS TO TELEVISION PRODUCTION EQUIPMENT AND
FACILITIES TO ALL USERS ON A FIRST-COME, FIRST-SERVED, CONTENT-NEUTRAL,
NON-DISCRIMINATORY BASIS.
The City of Fayetteville provides video production equipment and facilities as a public service to
the users so they may learn and apply the skills and techniques of television production. Your
Media will not require, solicit or accept any compensation of any kind, beyond that agreed upon
in this contract and provided by the City,in return for the opportunity for residents to use any video
production equipment or facilities provided by the City of Fayetteville.
The City of Fayetteville Director of Media Services is responsible for the use designation of
equipment and facilities within the Television Center. Your Media is responsible for the
management of equipment and facilities designated for use by the public and designated for use
by Your Media staff in the execution of the services described herein.
Your Media will:
1. Maintain accurate and detailed inventory records of all equipment designated for use by
the public and use by Your Media staff.
2. Assist City staff in maintaining accurate and detailed inventory records of all equipment in
the Television Center.
3. Maintain accurate and detailed records of the identification and use of all equipment that
is designated for use by the public.
4. Maintain accurate and detailed records and identification of users to check-out or utilize
equipment designated for use by the public. Each record will contain, at a minimum, the
user's name, address, telephone number, the area(s) in which they are qualified, and the
expiration date of their qualification(s). A photocopy of the documentation of residency
must be included.

5. Implement a plan to determine, either by elapsed time or demonstrated proficiency, the
need for a qualified user to re-take any classes to maintain their qualification to use
equipment or facilities of the Television Center.
6. Maintain a reservation system and procedure for qualified users to be able to reserve the
use of equipment and facilities designated for public use.
7. Maintain check-in and check-out procedures for equipment and facilities designated for
public use.
8. Design and utilize procedures and checklists that will ensure equipment is checked for full
functionality upon return by a user. Records will be kept of the condition of equipment on
check-out and return.
9. Perform minor repairs, maintenance and upkeep of equipment and facilities as directed by
City staff.
10. Actively monitor the use of editing and studio facilities.
11. Ensure that a staff member who is fully qualified in the operation of all equipment or
facilities available for public use is present and available at all times to any resident who
is using, or wishes to use, any equipment or facilities designated for public use.
Your Media will not:
1. Allow, or continue to allow,the use of any equipment or facilities owned or controlled by
the City of Fayetteville and provided for the use of the public or Your Media under this
contract to be utilized in any way that may violate any Federal, State, or local law.
MAINTAIN A PROGRAM LIBRARY AND MANAGE ARCHIVE/PROGRAM RIGHTS
The City is committed to the preservation of Fayetteville's culture, history and legacy. This is
demonstrated, in part, by support of the preservation of the programs and material telecast on the
Public Access Television channel.
Producers will retain all rights to any program material or programming they create. All producers
requesting their program to be telecast on the Public Access Television channel must sign a
statement granting the City of Fayetteville non-exclusive rights for distribution and re-distribution
of the program,either in whole or in part,as the City determines necessary.In the case of a resident
who requests the telecast of a program, either in whole or in part, to which they do not hold the
copyright,the resident will provide expressed,written consent from the program's owner granting
the City of Fayetteville non-exclusive rights for distribution and re-distribution of the program,
either in whole or in part, as the City determines necessary.
Your Media will create and maintain the necessary documentation, affidavits and statements,
subject to the approval of the Director of Media Services, to be included in any forms used to
document the request for the telecast of programming.
1. Your Media will maintain a program library containing copies of all inside and outside
programs telecast on the Public Access Television channel.
2. Your Media will maintain a program library database of all programs telecast on the Public
Access Television channel.

3. Your Media will ensure the library and program library database are maintained in an easily
accessible manner.
4. Physical recording media containing programming for telecast on the Public Access
Television channel shall become property of the City.
5. Your Media will ensure programs are archived as digital video files in the TV Center
archive server system, unless otherwise determined by the Director of Media Services.
6. Under no circumstances will Your Media remove, or allow to be removed, any program
materials or media from the Public Access Television channel program library or program
library database, without the prior approval of the Director of Media Services.
CONDUCT OUTREACH AND COMMUNICATION ACTIVITIES WITH THE PUBLIC
1. Your Media will manage a procedure whereby residents can communicate their views or
complaints regarding the programming or operations of the Public Access Television
channel to Your Media and the City. All complaints or comments, from whatever source
or however communicated, must be immediately communicated to the Director of Media
Services.After a resident makes a complaint,either verbally or in writing,the public access
outsourced provider manager, or designee, will follow this procedure:
a. Document the complaint, recording:
i. Date.
ii. Time.
iii. Nature of the complaint.
iv. As many details as possible to facilitate the investigation of the complaint.
v. Contact information of the complainant, if available.
b. Immediately communicate the complaint to the Director of Media Services.
c. Immediately communicate to the complainant their complaint is being investigated,
and they will receive a determination, in writing, regarding their complaint within
3 business days.
d. Provide a written response to the complainant detailing the investigation of their
complaint, any findings thereof, and any action taken by the management of Your
Media in response to the complaint. The response will also contain a statement that
the complainant may appeal, in writing, any determination or action to the City of
Fayetteville PEG Advisory Board, c/o City of Fayetteville Television Center, 101
W. Rock Street, Fayetteville.
e. Provide a copy of all correspondence and other pertinent materials to the Director
of Media Services.
2. The management, staff, or members of the Board of Directors of Your Media will not
identify the Public Access Television channel in any way, either expressed or implied, as
belonging to, owned by, or controlled by Your Media.
3. The management, staff, or members of the Board of Directors of Your Media will not
identify the City of Fayetteville Television Center, or the equipment contained therein, or
any portion thereof, in any way,either expressed or implied, as belonging to,owned by,or
controlled by Your Media.
4. The management, staff or members of the Board of Directors of Your Media will not
identify themselves or their organization in any way, either expressed or implied, as "The
City of Fayetteville"or as representing the City of Fayetteville.

5. In all communication from Your Media, the Public Access Television channel will be
referred to and identified as"Fayetteville Public Access Television".
6. In all communication from Your Media,the entire production facility will be referred to as
"The City of Fayetteville Television Center"or"The Television Center", as appropriate.
7. Your Media will maintain a process for effective communication with, and coordination
among, all affected City programs, City staff, and the PEG Board.
8. Your Media will conduct a consistent community outreach effort designed to recruit new
producers and trainees.
9. Your Media will provide information to the entire community about the nature and role of
public access television; educate the community about the opportunities available for
training,production and programming;and encourage groups and individuals to participate
in training classes and production experiences.
10. Your Media will maintain a Fayetteville Public Access Television-branded web site for the
promotion of Public Access Television services and the education of the public that
includes, at a minimum, current information regarding program, production and class
schedules; policies and procedures; class syllabi; and an internet forum for exchange of
information between the City, Your Media, producers and trainees. Your Media may
include a link to their organization's web site.
11. The City will provide one(1)bulletin board in a publicly accessible area of the Television
Center for the use of Your Media. Information posted on the bulletin board must meet at
least one of the following criteria:
a. It is information from the City or public access operator regarding policies,
procedures or regulations
b. It is a request by a producer to recruit help for video productions
c. It is a request to recruit producers for specific video production projects
d. It is information directly related to the programming of the public access channel
e. It is information directly related to opportunities for training and development in
television production
f. It is information that promotes:
i. The City of Fayetteville
ii. A non-profit, 501(c)3 organization that serves the citizens of Fayetteville
iii. A government organization that serves the citizens of Fayetteville
g. It is information that informs the public of an event or program sponsored by:
i. The City of Fayetteville
ii. A non-profit, 501(c)3 organization that serves the citizens of Fayetteville
iii. A government organization that serves the citizens of Fayetteville
Information shall not be posted on bulletin boards unless it meets all the following
criteria:
a. It shall not contain any type of direct appeal to purchase commercial goods or
services, or promote the for-profit activities of individuals, groups or
organizations
b. It shall not contain any depiction of libelous, obscene, indecent or violent material
c. It shall not be information campaigning for or in support of any political
candidate or ballot issue
d. It shall be no larger than standard"letter" sized paper, 8 'A"x 11"

e. It shall be legible
f. It shall not be a personal message or communication
All other bulletin boards in the Television Center are reserved for use by employees of
the City or Your Media.
GENERAL ADMINISTRATION AND COMMUNICATION
Your Media will administer the activities and responsibilities described herein in compliance with
all applicable Federal, State, or local laws, ordinances, rules, and regulations and within any and
all agreements,rules,or regulations of any television programming distribution service or provider
utilized to perform the activities or responsibilities described herein.
All communication between the City and Your Media with regard to contractual matters or
operations of the Television Center will be directed through the Director of Media Services,or any
other such representative as may be appointed by the City, and Your Media's duly appointed
representative.
1. Your Media will develop, maintain, and enforce operational policies that assure for staff
and users decorum and a professional working environment at the City of Fayetteville
Television Center consistent with other City offices.
2. Your Media will abide by and enforce all policies,rules, and regulations regarding the use
of the Television Center. The Director of Media Services is responsible for developing and
publishing policies, procedures, rules, and regulations regarding the use of the Television
Center facility and equipment. The Director of Media Services will make available to all
users of the facility a reference manual that will contain all policies,procedures,rules, and
regulations regarding the operation of the Public Access Television channel and the City
of Fayetteville Television Center. The City reserves the right to exclude users or staff of
Your Media from the Television Center for violations of policies, procedures, rules, and
regulations.
3. The City shall make three telephone lines available for Your Media's business use.
4. Your Media shall be responsible for reimbursing the City for its own long distance
telephone calls.
5. The City is not required to provide hardware and/or software for the establishment or
maintenance of systems for the purpose of public internet access.
6. Your Media shall be responsible for the maintenance and repair of the hardware or software
of computers installed for the office use of Your Media.
7. The City shall provide access to the Internet for Your Media at the same level provided to
the Television Center. Your Media will be responsible for any access requirements above
the level provided to the Television Center.
8. The City shall be responsible for the payment of the Television Center utilities, routine
building and grounds maintenance and maintenance of the structure.
9. Your Media may use the City's current copier/printer at the Television Center for a charge
of$.039 per page. If the City upgrades the copier/printer located in the Television Center,
Your Media shall pay an adjusted charge per page, up to, but not to exceed the standard
rate charged to City Departments and Divisions as determined annually.

10. Copier/printer maintenance costs will be paid by the City.
11. All business conducted and information maintained by Your Media or the Your Media
Board of Directors in the execution of this contract is subject to the terms of the Arkansas
Freedom of Information Act(FOIA).
12. Your Media will create an operations, training, and production schedule that maintains
convenient business hours as well as a class schedule that allows producers to become
certified through a combination of day,evening,and weekend classes.At a minimum Your
Media will:
a. Provide service to the users, a minimum of forty-five (45) hours per week through
a minimum of five (5)days of operation.
b. Create a schedule that provides service for a minimum of four (4) hours per
scheduled operation day.
c. Provide a staff member in the lobby to greet the public whenever the Television
Center is open to the public.
d. Observe all City Holiday closings and follow City of Fayetteville policies regarding
closing for inclement weather.
Your Media and the Director of Media Services will agree upon the operations schedule
and Your Media will not vary from the agreed upon schedule without prior approval of the
Director of Media Services.
13. Your Media shall submit monthly,quarterly,and annual reports,as defined by the Director
of Media Services, on the execution of the activities and responsibilities described herein.
Monthly reports shall be due by the 10th of the following month, or, if the 10th is not a
regular business day, the next business day following the 10th. No contract payments will
be made to Your Media while any required report is incomplete or overdue.
14. Your Media agrees to provide the City with a monthly financial report, due by the 10th of
the following month, detailing:
a. Expenditures of funds provided Your Media from the City
b. Sources and amounts of other revenue generated from Public Access service
activity
c. Any other expenditures related to Public Access service activity
The report shall be prepared by an independent certified public accountant, based on a
modified accrual or cash basis method, summarizing activity during the preceding month
and year to date. Said report shall include income and balance sheet statements.
15. Quarterly reports shall contain, but not be limited to:
i) Financial reports, detailing:
(a) Expenditures of funds provided Your Media from the City
(b) Sources and amounts of other revenue generated from Public Access service
activity
(c) Any other expenditures related to Public Access service activity
ii) Training reports, detailing:
(a) Training activity provided users
(b) Training activity for staff
(c) Class and workshop activity
iii) Certification activity
(a) Certification of residents

16. In addition to the monthly, quarterly and annual reports, the following special reports and
information shall be provided to the Director of Media Services:
a. Reports of stolen, missing or damaged equipment within one (1) working day of
learning of each occurrence; and
b. Requests for changes in any policies or procedures that affect any services
described herein; and
c. All corporate documents, including but not limited to Your Media's by-laws,
policies, articles of incorporation, certification of compliance with affirmative
action plan and EEO standards, and a list of Board members; and
d. At any reasonable time and as often as the PEG Advisory Board or the City may
deem necessary, Your Media shall make available to them, or any of their
authorized representatives, within three (3) business days, all of Your Media's
records related to all matters covered by this Agreement and shall permit the PEG
Advisory Board or the City to audit, examine, make excerpts and copies of such
records, and to make audits of all contracts, invoices, materials, payrolls, records
of personnel, conditions of employment and other data relating to or deemed
pertinent to matters covered by this Contract; and
e. During the term of this Contract, Your Media shall make available to the PEG
Advisory Board and the City all notices of meetings of its Board of Directors,
setting forth the time and place thereof. Such notice shall be delivered in a timely
manner to give adequate notice and shall also include an agenda; and
f. Minutes of all meetings, if taken, and materials distributed in meetings of Your
Media's Board of Directors, or committees thereof, shall be submitted to the PEG
Advisory Board and the City; and

Your Media will, upon request of the City, make available all supporting documentation and data
relating to any reports required by this Contract or requested by the City.
PERFORMANCE EVALUATION
1. A performance evaluation will be conducted quarterly by the Director of Media Services
to assess Your Media's effectiveness in providing the services described herein.
2. The City and Your Media may agree upon periodic performance measures.These measures
will be documented as Addendum A of this contract.
3. Your Media will provide a method for receiving feedback, comments, input and
suggestions from the public. This communication will be made available to the Director of
Media Services as part of the quarterly evaluation process.
4. The Director of Media Services will immediately communicate to Your Media any
violations of this contract as may come to his/her attention so that Your Media may have
an opportunity to correct such violations in a timely manner.
5. Quarterly evaluations will be communicated to the PEG Advisory Board, consistent with
the process for oversight as specified in the PEG Advisory Board Ordinance.
CONTRACT PERIOD
The contract period will be from January 1, 2021, until December 31, 2021. Either party may
cancel this contract at anytime with a thirty(30)daywritten notice. This contract maybe renewed
by the parties per year for up to four additional one-year terms.
FUNDING
The City hereby agrees to pay Your Media the monthly sum of$16,427.75 for services performed
under the terms of this contract. Each monthly payment will be remitted on or before the 15th day
of each month,beginning January 15,2021,unless Your Media fails to comply with the expressed
terms of this contract. The City reserves the right to withhold contract payments to Your Media
unless Your Media is deemed in full compliance with the contract or until all contract violations
are corrected. For any future renewal period up to four additional one-year terms, payments to
Your Media shall be increased by the amount required to fund salary increases of three percent
(3%).
FUTURE ADDITIONAL SERVICE OPTIONS
Upon any renewal, the City of Fayetteville reserves the right to add services, along with any
additional costs, to this agreement, including, but not limited to, Education Channel operation,

management or services and/or expansion of Public Access operations or services.
LEGAL AUTHORITY
Your Media assures and guarantees that it possesses the legal authority to enter into this
Agreement. Further,that the person or persons signing and executing this Agreement on behalf of
Your Media have been fully authorized by Your Media to execute this Agreement. That such
authority is evidenced pursuant to a proper, appropriate and official motion and resolution, which
was passed and approved specifically to enter into this Agreement and shall legally bind Your
Media to all the terms,performances,and provisions here set forth.A copy of such resolution shall
be provided upon execution of this Agreement.The City may exercise its right to either temporarily
suspend or permanently terminate this Agreement if there is a dispute as to the legal authority of

Your Media or the person signing the Agreement. The City shall not be obligated to pay Your
Media for any performance of the provisions of this Agreement after the City has suspended or
terminated this Agreement as provided in this Section.
PERSONNEL
Your Media shall adequately staff the Public Access operation to meet the services and duties
outlined in this agreement. Both City staff and Your Media staff will be expected to work together
in a cooperative manner within the Television Center. Personnel policies shall be established by
Your Media and shall be available for examination by the City.
Upon termination of any employee from either the City or Your Media, it is understood that any
violation of policy or procedure serious enough to require termination is also grounds for exclusion
from the Television Center.
EQUAL OPPORTUNITY
Your Media shall comply with all applicable equal opportunity,affirmative action,and ADA laws
or regulations, including those of the City of Fayetteville.
INSURANCE
Your Media shall obtain and keep in force during the term of this agreement a policy of public
liability and property damage insurance. Your Media shall provide continued proof of coverage in
its quarterly reports. The coverage, at a minimum, shall be in the following amounts:
General Liability
1. General Aggregate $1,000,000
2. Products/Completed Oper. Aggr. $1,000,000
3. Each Occurrence $100,000
4. Fire Damage (any one fire) $50,000
5. Medical Expense (any one person) $5,000
Worker's Compensation for all employees as required by Arkansas Statute.
Bonding: Your Media shall obtain a fidelity bond covering all persons handling funds
received or disbursed and/or signing or co-signing checks to disburse funds under this
agreement, within 10 days of the contract execution. The fidelity bond shall be in an
amount equal to 10%of the city grant award or$5,000,whichever is less. Your Media shall
furnish the city proof of an adequate fidelity bond prior to the first payment of funds under
this agreement.
POLITICAL/SECTARIAN ACTIVITY
Your Media shall not initiate or sponsor political or religious programming. Your Media shall not
engage in any political activity. Your Media shall not directly produce any programs nor
participate in any activities that establish or promote any religion or prohibit the free exercise
thereof.

HOLD HARMLESS
It is expressed,understood and agreed by both parties that the City is contracting with Your Media
as an independent contractor and that as such,Your Media shall save and hold the City,its officers,
agents, and employees harmless from all liability of any nature of any kind, including costs and
expenses for, or on account of, any claims, audit exceptions, demands, suits or damages of any
character whatsoever resulting from injuries or damages sustained by persons or property,resulting
in whole or in part from the performance or omission of any employee, agent or representative of
Your Media. This Agreement shall not be construed in any manner or form as a waiver of that Tort
Immunity as set out under Arkansas Law.
CONFLICT OF INTEREST
Your Media covenants that neither it nor any member of its Board of Directors currently has any
interest or shall acquire any interest, direct or indirect, which would conflict in any manner or
degree with the performance of services required to be performed under this Agreement. Your
Media further covenants that in the performance of this Agreement no person having such interest
shall be employed or appointed as a member of its Board of Directors.
Your Media further covenants that no member of its Board of Directors or its staff or employees
shall possess any interest in or use their position for a purpose that is or gives the appearance of
being motivated by desire for private gain for themselves or others, particularly those with which
they have family, business, or other ties.
No officer,member, or employee of the City and no member of its governing body who exercises
any functions or responsibilities in the review or approval of the undertaking or carrying out of
this Agreement shall participate in any decision relating to the Agreement which affects his or her
personal interest or the interest of any corporation, partnership, or association in which he has a
personal financial direct or indirect interest; or have any personal financial interest, direct or
indirect, in this Agreement or the proceeds thereof.
CONTRACT ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties hereto, and any prior
agreement, whether written or oral, shall have no force or effect. Any subsequent agreements will
have no effect unless properly executed in writing and recorded as an addendum to this Agreement.
SEVERABILITY
If any section, subsection, sentence,clause,phrase,or word of this agreement is held to be invalid
or unconstitutional by any court of competent jurisdiction, such section, subsection, sentence,
clause,phrase, or word will be deemed as a separate,distinct and independent provision,and such
holding will not affect the validity of the remaining provisions of this agreement.

No late proposals shall be accepted. RFP's shall be submitted in sealed envelopes labeled with the project
cumber and name as well as the name and address of the firm.
All proposals shall be submitted in accordance with the attached City of Fayetteville specifications and bid
documents attached hereto. Each Proposer is required to fill in every blank and shall supply all information
requested;failure to do so may be used as basis of rejection. Any bid, proposal,or statements of qualification
will be rejected that violates or conflicts with state, local,or federal laws,ordinances,or policies.

Executive Summary
Community Access Television, (dba) Your Media, has been serving the city and
residents of Fayetteville as the service provider for Fayetteville Public Access Television
(FPTV) for over thirty years. In the past five years, Your Media has continued to dynamically
develop the operation and services resulting in quantifiable overall operational growth. Building
on the foundation that was established in 2015, Your Media has shaped Public Access in
accordance to the specifications of the Director of Media Services (DOMS), while creatively
finding new ways to grow and engage with the community to achieve the goals set out in the
2015 RFP. These efforts have led to clear continued growth and accomplishment for Public
Access.
Since the contract was awarded in 2015, Your Media has developed and enriched every
aspect of the operation. 2019 was the pinnacle of these efforts, with record-breaking
participation and award-winning productions.
The last 5 years have been filled with examples of the successes that can be
achieved with a supported Public Access Television operation. These successes include:
• We celebrated 5 years of sustainable growth in every aspect of the operation. We
achieved unprecedented participation numbers.
• We partnered with the U of A Computer Sciences department and developed a new
customized user portal at no cost.
• We have evolved to a near-paperless operation.
• We have produced a regionally-syndicated, multi-award winning show, and in 2019
FPTV was awarded its first Telly award (a national broadcast award) for our
promotional piece "Future Editing".
• Most importantly, FPTV has developed successful working relationships serving the
community in many ways, including nonprofit organizations, city departments,
community groups, and students of all ages.
It has been a pleasure to serve our community for another five years. It has also been
very exciting to see the growth that has come directly from an effective working relationship with
the city and the service provider. It is with a spirit of dedication to the continued growth and
success of this operation that we respectfully submit this proposal. Throughout this proposal,
you will see these core commitments that will ensure the continued success of the Public
Access operation:
• An aggressive campaign of community outreach and public relations so that more
Fayetteville residents are aware of the resources
• A steadfast and increased commitment to serving Fayetteville residents and the region
by providing accessible training with the goal of the production of locally-focused original
programming.
• A focus on sustainable growth in the Public Access operation.

• The development of the Education Channel.
The development of the Education Channel is an exciting prospect for us. Your Media
is uniquely poised to offer the most efficient and successful launch of this new initiative. With
the infrastructure already in place to provide staff services, Your Media can use the same
strategies that led to the growth of FPTV to grow the Fayetteville Education Channel. These
recent times have shown the value of alternative methods of instruction, and we are
confident that we would be able to work with our community to develop an invaluable
resource for the region. This would create the most vibrant and active PEG operation in the
state.
In conclusion, Your Media is uniquely and solidly positioned to continue to fulfill the
requirements necessary to be Fayetteville's provider for Public Access Television and the
Fayetteville Education Channel services for the next five years. Twenty five years of
seasoned experience combined with the last five years of award-winning success has
resulted in quantifiable growth and an exciting new chapter for FPTV. Your Media has a
proven record of innovative new strategies for outreach and has performed work as the
service provider that has been acclaimed by the community, the participants, and the Mayor.
We are dedicated to continuing to serve our growing community with these resources.
Digital media literacy is an essential skill in the 21st century. Having these resources
available to the community not only enriches our community and documents our history, but
also serves as another example of how Fayetteville leads the region in providing modern
public resources.

Scope of Work
A.) Educate Fayetteville residents in the production and distribution of non-commercial
television programming:
Your Media has created and maintains a comprehensive educational program to
match the resources at the operation that serves residents of all interest levels from
beginner to advanced.
1. Provide information to the entire community about the nature and role of public
access television; educate the community about the opportunities available for training,
production and programming; and encourage groups and individuals to participate in
training classes and production experiences.
Your Media has developed a diverse outreach strategy that has grown awareness and
utilization of the operation. In the next five years our outreach efforts will include:
• Effective Digital Marketing. Your Media has worked to optimize the digital marketing
of FPTV. This included developing a social media strategy that engages the
community for organic traction, combined with strategic boosting of posts. Your
Media has developed the website to serve as the ultimate destination to connect with
information, with the omnichannel of social media routing to that.
• Media outreach. Your Media will continue and expand public media relationships
including print such as the Free Weekly, network television such as Fox 24, and on
radio on stations such as KPSQ and New Rock 104.9 the X.
• Organizational outreach. Your Media will proactively reach out to city departments
and local organizations that can take advantage of the resources including:
Fayetteville-based High Schools; The U of A; and any Fayetteville City departments
or programs needing to create video to raise awareness.
• Event Sponsorship. Your Media will offer technical and media support services to
local and regional events to raise awareness of the resources available. Past
examples of these have included: The Fayetteville Film Fest; the Offshoot Film
Festival; Last Night Fayetteville; TedX Fayetteville; Spring Creek Arts Festival, and
more.
The FPTV Operational Manager will also work closely with the Director of Media Services to
discuss and pursue any new outreach strategies that may arise.

2. Create and provide training curriculum in free classes to emphasize technical
proficiency and production quality in public access programming.
Your Media has created a customized training curriculum to address the specific equipment
offered at the Television Center, and to prepare the users to produce quality programming. As
equipment and technology change, Your Media will continue to work closely with the city staff to
keep the equipment current and the educational materials current with the equipment.
The curriculum we have developed has had successful results and reviews from the
participants. The average scores we report on monthly are most often above 95%.
On the end of course test, students have the opportunity to take a survey.. This allows the
student to rate from one to five their experience of the class in which they just participated. The
the averages have consistently remained very high:

3. Offer a minimum of six (6) free classes a week in various disciplines of video
production and programming distribution.
In the last 5 years, Your Media has greatly increased the number of people who are taking
classes and the number of classes they are taking (see appx B). Part of this increase is due to
the increase and flexibility in class offerings and opportunities (see appx C). The schedule and
classes we propose to offer have been optimized to maximize accessibility and flexibility to
meet the needs of the community. This combined with other efforts have led to the consistent
sustainable increase in educational participants and participation in the last 5 years (see appx
A). Classes alternate between morning and evening times weekly. The customized educational
curricula catalogue Your Media has developed is the most comprehensive and current it has
ever been. These resources are available to the public on the website.
In the wake of the COVID pandemic. FPTV successfully converted all non-studio classes to
virtual offerings. Your Media would continue to offer these virtual options in the future to
increase accessibility.
4. Create and maintain student evaluation criteria and methods that allow students to
demonstrate proficiency in training both in writing and practical application.
Your Media continues to design new student evaluation tests in conjunction with the
educational materials. The written student evaluation forms and practical application tests are
given as part of the certification process. As new equipment is added and educational materials
need to be modified, the written student evaluation forms and practical application tests will be
presented to the DOMS for approval. This will assure that all the necessary evaluations are

being done in order for Fayetteville residents to properly use the city's equipment. If after taking
the test, the student does not evaluate successfully, instruction to overcome shortfalls will be
immediately given and/or scheduled with that individual student. Once instruction is complete,
the evaluation will be performed again. Individuals will not be allowed to check out or utilize the
city's equipment until he or she has satisfied the evaluation criteria.
Having demonstrated their proficiency in an aspect of the operation, producers can achieve
different types of Certification:
Equipment Certification: Students who have completed orientation, and either studio or
field classes may be certified in the areas in which they have been trained. Equipment
certification occurs at the end of the studio, field or editing classes, when the instructor
determines whether the student shows proficiency with the equipment, based on written and
practical evaluation methods.
Producer Certification: To become a certified producer, a student must create and submit
a show for telecasting on the City of Fayetteville's Public Access channel. To remain active and
be certified to use city equipment, the producer must create and submit at least one show per
year. Through our focused efforts, we doubled the number of Certified producers in 2019.
Proficiency Certification: Certification examinations will be offered to individuals who have
video production experience and desire to become certified access users without the need of
undergoing basic hands-on training. Anyone wishing to take a proficiency exam who is not
already a certified user must first attend an orientation session. If 12 months pass and an
individual has not utilized the resources they are certified for, they will be re-assessed for
proficiency.
5. Maintain records of student performance and evaluations.
Your Media has designed a comprehensive cloud-based digital record keeping system for the
student performance and evaluations in addition to the custom user portal we have in place.
These new systems provide more accurate information more efficiently by reducing the
chances of human error. It has been the goal of Your Media as the service provider to develop
and move to a paperless examination and record-keeping system. We have continued to make
great strides towards this in the last five years.
6. Recruit new people who are Fayetteville residents to complete a basic core curriculum
of three training classes.
Your Media has designed and maintained a consistent and sustainable outreach program as
defined in section Al. This will continue to be the foundation of our recruiting efforts. Your
Media has also successfully found ways to facilitate a more constant presence in Wards 3 and
4, as they historically have proven less active in connecting with the resources.

7. Include as part of the producer certification process the production of at least one new
telecast quality program per trainee. Include as part of maintaining certification the
production of a minimum of one telecast quality program per producer per year.
Your Media will continue to provide classes to certify individuals to use the city's video
equipment and facilities and to help both new and existing video producers improve their skills
and the quality of their productions. The orientation process will inform students that at least
one telecast quality program, per year, will be required to both earn and maintain their status as
a certified producer.
With the goal of seeing their project complete and on the channel, it is, and will continue to
be, the goal of Your Media to find out what the student is interested in producing, shaping their
training to best meet that goal, encouraging them and offering technical support consultation
needed during their process.
8. Maintain a website for promotion and education of the public that includes at least
current information regarding program, production and class schedules, information
about the organization, production resources beyond the organization and a forum for
exchange of information.
Your Media has successfully implemented two website overhauls in the last five years as
the operation has modernized. The first was in 2019 to integrate our outward-facing user portal.
The second was in 2020 to re-launch the operation after the television center was closed during
the pandemic.
9. Stay abreast of emerging technologies through professional development that
includes technical training.
Your Media staff will remain abreast of emerging technologies through a variety of means.
Your Media production staff continue their education through trade publications and online
resources focused on production technologies. Your Media also has a Lynda.com account and
a Masterclass account specifically for the purpose of staff continuing education. Lynda.com
offers technical training in all aspects of media production in an online format. This allows the
staff to expand their knowledge base within the means of their schedules. The Operational
Manager reports on professional development topics and their application to the operation in
their monthly reports.
10. Utilize, and train citizens in the use of, all available methods of television
programming distribution.
The Your Media staff is well versed in many methods of television and Internet programming
distribution including but not limited to YouTube, Vimeo, and web streaming. Your Media staff
will serve as an in-house resource for all program producers in ways to distribute their
programming beyond the access channel. All Public Access programming will also be shown

via live web streaming on our YouTube Channel which allows a broader distribution of public
access content.
11. Create and publish a monthly schedule of classes, a minimum of 30 calendar days
prior to conducting the classes, on the public access television channel's on-air bulletin
board and its web site; and make it available for publication in other outlets that wish to
do so.
The scheduled classes offered by FPTV will be maintained in a google calendar published
on the FPTV website. The coming month's classes will be scheduled and posted on the
website, on the on-air bulletin board, and in the Television Center. The class offerings will also
be publicized on social media.
12. Provide free workshops for citizens on various topics related to production and
distribution led by subject matter experts from outside the organization (individuals who
are not staff or board members of the organization). These workshops are in addition to
and enhance the regular classes.
Your Media will schedule and publicize workshops led by staff and area industry
professionals. Thanks to the expanding network of regional industry professionals aware of
FPTV and its production community, Your Media will be able to provide FPTV users with
opportunities to connect with individuals who are working successfully in the area. We will also
record these workshops and run them on the channel, enriching the educational programming
offered.
13. Ensure that instructors maintain a minimum level of competence in the operation of
equipment. This can be demonstrated through industry certification or actual
demonstration of skills.
Your Media staff will be fully competent in the operation of the equipment at the television
center. Due to the increased educational participation and increased production activity, the
Your Media staff is and must be prepared to teach and utilize all of the resources available at
the television center. The Operational Manager will oversee the regular assessment of the staff
competency through evaluations.
14. Provide reports on training and education activity as required by the City.
Your Media will continue to provide comprehensive reports on training and educational
activity as defined by the service provider contract.
B.) Provide equitable channel availability and programming services to all Fayetteville
residents on a first-come, first-served, content-neutral, and non-discriminatory basis.
Your Media will continue to ensure equitable playback opportunity to all segments of the
community on a first-come, first-served, content-neutral and non-discriminatory basis. The

first-come, first-served principle is central to the mission of the service Your Media provides at
FPTV. There are occasionally times when scheduling conflicts arise, especially in channel
availability. Below you will find outlined the non-discriminatory practices in scheduling priorities
created to protect the rights of local producers to have adequate access to channel availability.
1. Provide a weekly open-studio opportunity, not to exceed five minutes per speaker,
available without charge to any resident of Fayetteville.
To fulfill this FPTV has offered and produced a program entitled Open Mic to facilitate this
service. Each week, the Your Media staff provides regular studio times in which residents can
have up to five minutes, free of charge, to share their information, opinion, or talents with a
television and Internet audience. It is extremely accessible for those using this service, as it
simply requires them to sign in upon arrival and then wait their turn to record their segment. We
have seen growth in Open Mic participation due to our outreach efforts. It has proven a valuable
resource for City Departments, including the Recycling Department, to quickly get awareness
videos made.
2. Define and establish the decision-making process and criteria for the scheduling of
programming that will ensure the protection of 1st Amendment rights of citizens while
ensuring programming does not violate Federal, State or local laws or ordinances.
As noted above, FPTV makes every attempt to schedule programming on a first-come,
first-served basis. Regardless of when a program was submitted, when there is a conflict for
certain times in the schedule, programs will be scheduled with the following preference
hierarchy:
• Regularly scheduled, locally produced series.
• Premiere showing of a new locally produced show.
• Subsequent showing of a new locally produced show.
• Premiere showing of a new imported show.
• FPTV promotion.
• Requested replay.
• Other programming.
When two or more program providers in the same category have requested the same time
slot, the program request that was submitted first gets scheduling preference. Either way, the
Operational Manager will do his / her best to provide a scheduled time with which the producer
is satisfied. (At times when programs are not scheduled, the message board will play.)
Currently, local residents may also submit programs that are produced outside the FPTV
facility. These programs can be produced by local residents themselves or be "outside"
programs from other production resources. Outside shows can be sponsored by a Fayetteville
resident. Additionally, residents may request a replay of a program previously shown on FPTV.

Your Media will use all forms of public outreach, media and networking skills to educate the
public that programs produced outside the facility (made by local residents and/or residents
having imported programming from other sources) are welcomed to be shown on FPTV.
Your Media utilizes the interstitial message board (slides played in between scheduled
programs) to keep residents informed of events in our community, to educate residents about
the opportunities at FPTV, and to promote FPTV original programming. Increasing the public's
knowledge of the multitude of production and scheduling opportunities available to them
through FPTV, is without question a top priority.
Another top priority is being good and responsible stewards of the First Amendment, one of
the cornerstone ideals upon which our country was founded. Public Access Television
maintains resident's rights to free speech by operating the public access channel without
control of content. All producers are encouraged to tell their own truths in public access. Your
Media staff is well aware of the difference between obscenity and indecency and the
differences in laws that govern broadcast television versus cable-cast access like the city's
public access provider.
3. Define and establish a citizen complaint and appeal process whereby citizens can
communicate their views on programming or operations to the management of the
channel and the City, or appeal any decisions made by the management of the channel
regarding programming.
As it stands now, Your Media has a solid policy for handling such complaints. This current
policy, as articulated in our policies and procedures manual and published on our website, is:
When a formal complaint is made the Fayetteville Public Access Television staff will:
• Document the complaint, recording the date, time, nature of the complaint, all
available details to facilitate the investigation of the complaint, and contact
information of the complainant, if available.
• Immediately communicate the complaint to the Director of Media Services.
• Immediately communicate to the complainant that their complaint is being
investigated, and they will receive a determination, in writing, regarding their
complaint within three business days.
• Provide a written response to the complainant detailing the investigation of their
complaint, any findings thereof, and any action taken by the Fayetteville Public
Access Television staff in response to the complaint.
• Provide a copy of all correspondence and other pertinent materials to the Director of
Media Services
There has not been a formal complaint about the operation or programming in over 8 years.
4. Encourage the public to produce programming outside the facility utilizing equipment
other than that of the Television Center.

As noted in Section B2, Your Media allows and even encourages the opportunity for
programming produced from outside the Fayetteville Television Center and not using FPTV
equipment to be telecast on the Public Access television. We have proactively reached out to
the local production community to make them aware of the resource, and will continue to find
local producers creating content to encourage them to contribute to the channel.
5. Define public access channel utilization goals with minimum standards for non-repeat
programming.
FPTV runs content 24 hours a day, with the interstitial Message Board playing in between
programs. The programming of these cablecast hours align with our scheduling priorities
outlined above. It should be stated that when it comes to new local programming, the minimum
standard for play is one time — which helps us fulfill the producer certification new-show
production aspect of the contract. However, most producers prefer to get the maximum plays.
With non-requested time slots, Your Media maintains a 60/40 ratio between inside and outside
programming. With the goal of creating a vibrant and entertaining channel, it is important to
note that the Your Media outreach plan for the coming years has a clear goal of continuing to
increase the number of new local programs produced for public access.
6. Design programming grids for the scheduling of public access programs and ensure
the telecast of programming on the public access channel.
Your Media will continue to use the scheduling software provided to aggregate the
programming for both FPTV and the Education Channel.
7. Publish and distribute to the public a current program schedule weekly.
There are three ways that FPTV currently distributes its weekly program schedule to the
public. The first is via the "programming schedule" link on our website and is accessible to
anyone who clicks it. The second is on our bulletin board in the Fayetteville Television Center
hallway, where we post the new schedule every week. The third is on the channel where we
have interstitial slides that list the upcoming programs. Weekly schedules are published via
these methods no later than the Saturday preceding the scheduled week's programming.
Additionally, a daily schedule is included in the Community Message Board that airs on the
public access channel.
8. Provide reports on programming as required by the City.
Your Media's Executive Director will meet with the Fayetteville Television Center manager to
draft clear parameters for providing meaningful reports regarding all aspects of the FPTV
operation. This will include reports on programming.
C.) Make television production equipment and facilities accessible to all Fayetteville
residents on a first-come, first-served, content-neutral, non-discriminatory basis.

In order to ensure that the Fayetteville Television Center facilities and equipment are
maintained and remain accessible to all Fayetteville residents, Your Media has a three-fold
strategy in place:
1. Review all existing policies and procedures by the first quarter of 2021 to ensure
that they are both achieving and following their stated purpose.
2. Create and implement any additional policies that may be necessary to guarantee
the well-being of facilities and equipment—this phase will be completed by the
end of January 2021.
3. Focus strategically on being inclusive in our efforts to recruit and maintain diverse
residents to become producers, with specific emphasis on minority populations,
people with disabilities, youth and elderly residents. Outreach to community
organizations is one of the areas of expertise our Executive Director brings with
him from his past work history.
In the next section is an overview of the current FPTV policies and procedures for
equipment and facilities.
1. Devise and monitor equipment check-in and check-out procedures that include full
functionality checks and record keeping of equipment prior to check-out and
immediately upon return.
Your Media has clear procedures in place for equipment check-in and check-out including
functionality checks. Our Portal-based checkout system ensures a staff member has done the
necessary procedures.
2. Develop and Implement a policy for the proper use, care and maintenance of
equipment.
Your Media staff will continue to inform producers if the equipment they have requested is
available per their request. Your Media staff is trained in both customer service and equipment
care and use. Staff members are well-prepared to provide coaching and assist users in
equipment care and operations during their certification process. Proper use, care and
maintenance of equipment are covered in all FPTV classes and workshops. We also offer free
refresher courses and advanced courses for any Producer who would like to strengthen their
already existing production knowledge.
Your Media staff will, as needed, meet with the Director of Media Services to draft clear
policies for providing proper use, care and maintenance of equipment. All newly-updated
policies, once developed, will be implemented immediately and the Operational Manager will
work closely with the Your Media staff to insure that all policies and procedures are being
followed by the community producers.

3. Perform minor repairs, maintenance and upkeep of equipment and facilities as
directed by City staff.
Your Media staff has a proven ability over the past years of being able to perform minor
repairs to FPTV equipment and assist the Fayetteville Television Center staff in procuring
repairs as needed. As part of the policy and procedure strategy outlined in Section C above,
Your Media staff will work closely with the Director of Media Services regarding standards and
requirements for all aspects of policies and procedures regarding equipment and facilities. This
will include repairs and maintenance.
4. Schedule and monitor the use of editing and studio facilities.
Reservations are required and the use of stationary equipment such as the studio and
editing suites will be allowed only when a Your Media staff member is present to monitor facility
and equipment use. Repair of studio or editing equipment is handled in the same way as that
for field equipment. Routine maintenance is scheduled based on use level and is performed by
the qualified staff member or at the direction of the Director of Media Services.
5. Provide reports regarding equipment usage as required by the City.
Your Media staff has worked closely with the Director of Media Services to create
meaningful reports as defined in the contract regarding all aspects of Your Media's fulfilling the
City's contract to provide public access television services. These include reports regarding
equipment usage. Currently, we provide monthly, quarterly, and annual reports on equipment
use to the city staff and PEG Advisory Board. Reports are also used by Your Media staff to
optimize equipment availability and to guide prioritizing of equipment maintenance, purchase
and replacement. Additionally, it is our continued desire to assess trends and data that will
inform operational decisions.
D.) Effectively administer the public access contract, resources, and funds. Any funds or
equipment secured through underwriting, grants, fees, or contributions to the public
access contractor while performing its activity under the contract, or utilizing City funds,
facilities or equipment, shall become the property of the City of Fayetteville. This does
not preclude the successful Proposer from engaging in activity outside the scope of the
contract.
Your Media would administer the public access contract resources and funds professionally
and transparently. For the last several years the budget has been successfully implemented
within 2%. Your Media would be receptive to any funds or equipment that may be available to
enhance the operation. Through FPTV contract service productions, Your Media has generated
FPTV revenue that has been able to be applied to promotions of the operations, equipment,
and improvements to the facility. The successful contract production relationships that Your
Media has developed have generated unprecedented revenue to enhance and support the
operation.

Your Media has an employee manual that clearly defines the expectations of decorum and
maintaining a professional atmosphere. Your Media has worked closely with the City to
dramatically change and improve the Television Center environment to be professional and
welcoming. If awarded the contract, Your Media would continue to maintain this standard.
2. Provide an annual budget for review by the PEG Advisory Board and City Staff.
If awarded the contract to provide Public Access Television to the City of Fayetteville, Your
Media will continue to provide an annual budget for review by the Director of Media Services
and the PEG Advisory Board. The Executive Director will work with the Director of Media
Services to develop the annual budget. During the year, accounting for FPTV revenues and
expenditures is accomplished by a Certified Public Accountant working under contract with the
Your Media Board of Directors. The Executive Director reports to the Your Media Board of
Directors regarding the operational financial status, and alerts them to significant deviations
from the budget.
Your Media's fiscal year begins on January 1st and at its second quarter board meeting the
included proposed budget was presented to the board of directors and granted approval. The
budget was compiled by the Executive Director and Treasurer, and reviewed by the CPA who
provides the financial reports.
3. Specify number of employees, proposed job descriptions, anticipated salaries, and
benefits.
When the RFP was awarded in 2015, we made the historic leap of bringing the staff salaries
to a level that was comparable to the Government Channel employee packages. The thing we
did not address was an option for retirement savings. This RFP gives us the opportunity to add
that benefit to our employees, and completes the goal of offering comparable packages.
In 2019, the Operational Manager used intern hours to create an "Assistant Director of
Education" position. This experiment clearly showed that opening the bandwidth of staff
members serving the community in this capacity resulted in an increase in engagement. It is our
conclusion that making this a permanent addition would be the next step in sustainable growth
for the operation.
Knowingthat we would need someone in that role, combined with the need for a staff
member to support the Educational Channel, we are proposing the addition of one full-time staff
member to meet both needs. This person would spend half their time serving as Assistant
Director of Education, and the other half as the Education Channel Manager. This is the most

efficient staffing solution to provide the groundwork to continue growing FPTV, and begin
growing an Education Channel.
To allow for growth and improvement of the services we are proposing the following
positions and salaries. All full-time staff will serve at the Television Center as their jobs require
and as production staff for any FPTV contract productions. Resumes of current Your Media
staff are attached in the Appendix.
Full-time staff:
1. Operational Manager (currently held by Dan Robinson) — up to $52,00 salary + up to
$5,400 annually toward health insurance coverage. 8% 401 K Contribution
The FPTV Operational Manager comprehensively oversees and leads the operation. It is
their responsibility to ensure compliance with the current contract with the city, manage the staff
and all staff-related administration, actively lead the outreach and awareness campaign, and
serve as a production consultant to help generate new programming. The OM keeps in touch
with the educational offerings, the equipment and facilities, and the programming and promotion
of the channel. They would oversee the FPTV operation as well as the Education Channel
operation. They serve as the liaison to the Director of Media Services, the PEG Advisory Board,
and the community at large. The additional duties include: maintaining an active presence in
the community representing FPTV; creating a favorable public image for FPTV, harmonious
office procedures and employee relations within the Television Center, finding new ways to
connect the community with the resources to generate programming, and overall operational
growth and development.
2. Director of Education (currently held by Paula Blanco Perez) — up to $38,500 salary +
up to $5,400 annually toward health insurance coverage. 8% 401 K Contribution
The Director of Education is responsible for overseeing the development and execution of
all classes, workshops and training offered by FPTV and is under the supervision of the FPTV
Operational Manager. It is the primary focus of the Director of Education to connect with the
people who come to the Television Center, ensure that they have a successful educational
experience, and offer any guidance as they apply those skills to create quality content for the
channel. The Director of Education also assists in FPTV productions and provides technical
support to our users in all stages of their production. The DoE is required to constantly expand
their knowledge base to stay current with emerging technologies and better serve our
production community.
3. Technical Director (currently held by Flint Woods) — up to $38,500 salary + up to
$5,400 annually toward health insurance coverage. 8% 401 K Contribution
The Technical Director is responsible for overseeing and implementing all of the technical
aspects of the operation. Primary duties are scheduling and programming the telecast
schedule, creating and maintaining the FPTV website, providing video post production services,

providing technical support on all equipment associated with the operation, consult with the
DOE on technical aspects of the curricula, and offer specialized advanced classes as part of
educational programming. The TD must be well-versed in television studio production, field
production, graphic design, web design, video formatting, video editing, animation, and video
production industry standards. The TD also serves as a tech-support resource for our
producers. To serve this role the TD is tasked with staying current with all emerging industry
technologies.
4. Education Channel Manager/ Assistant Director of Education (Would be filled upon
awarding of contract) - up to $38,500 salary + up to $5,400 annually towards health
insurance. 8% 401K Contribution
The ECM would be responsible foraggregating, maintainin and promotingthe Education

Channel programming. They would be connecting and in constant contact with the local
educational institutions creating educational content, and then work with the Operational
Manager and Director of Media Services to develop a programming schedule that best
meets the needs of the community. This would represent 20 hrs/wk. As the Assistant
Director of Education, the other 20 hrs/wk would be dedicated to serving the FPTV
educational offerings as an additional teaching resource and mentor.
Part-time staff:
1. Receptionist/ Social Media coordinator - 10hrs /week, $12/ hour
The Social Media Coordinator serves the vital role of managing our social media outreach,
seeking and systematically contacting eligible organizations, and creating and sharing posts
about opportunities at FPTV and the programming on the channel. They manage and schedule
our outreach campaign on multiple platforms, covering the various ways that the community
can engage with the operation. To serve this role, they are tasked with staying up-to-date on
the latest social media trends and information. They then help FPTV optimize our digital
outreach.
2. FPTV Production Crew (two 15 hour/week positions) — $10 / hour.
At FPTV, we are constantly having community members contact us about community events
that they would like to see recorded and telecast on the channel. We alert our volunteer
student pool to these opportunities, and occasionally some get covered, but many do not. We
are also constantly being contacted by video production students from the area wondering if we
have part-time production positions to help develop their production portfolio. These positions
have addressed both of those clear community needs. The crew members can work
individually or together under the direction of the Operational Manager to cover requested
community events on a first-come, first-serve, non-discriminatory basis. This has guaranteed
the consistent production of quality Fayetteville-focused content with a timely turnaround for
the channel. These positions have proven to provide the documentation of important moments
in Fayetteville's history in the last five years.

4. Define priorities for expenditures to be compatible with the provisions of the contract
for services and this RFP.
The proposed 2021 annual budget (see Appendix for basic FPTV draft budget) will elucidate
the focus that Your Media has on creating a competitive and sustainable work environment that
will attract and retain professionals who will be able to provide excellent service to the
community. The dedicated staff at FPTV create the structures that have met and exceed the
provisions of the previous contracts. With the equipment and facilities provided, the
expenditures by the service provider by priority are: administrative expenses, staffing expenses,
software subscriptions, outreach expenses, and basic office expenses.
5. Maintain a process for effective communication with, and coordination among, all
affected City programs, City staff, and the PEG Advisory Board.
During contract negotiations for 2021, the Executive Director will meet with the Director of
Media Services and the Director of Communications to draft clear parameters for
communication regarding all aspects of Your Media's fulfilling the City's contract to provide
public access television services.
Once clearly defined and approved by all invested parties, Your Media will maintain this
process for clear and effective communication. The monthly, quarterly, and annual reports will
include but are not limited to programming, production, educational participation, viewership,
and outreach efforts . Additionally, Your Media will maintain informal and effective
communication with the City of Fayetteville's Government Channel staff members. It is
imperative that this communication is successful given we operate in the same space and that
we share the resources in the Fayetteville Television Center facility.
6. Provide a public access channel that effectively promotes itself by using the channel
and other methods to solicit privately-produced local programs, class participants, and
active producers working at the facility.
The collective creativity and community connections offered by the Your Media staff will
continue to ensure that public access promotion will be successful and remain a top priority and
a main charge of the staff as a whole. The communication and outreach strategy outlined in
section G below will include a major publicity push to promote public access television and the
services that Your Media will provide on behalf of the City.
• Produce promotional pieces that inform and engage the community
• Highlight local productions and encourage and empower the production of new
locally focused productions.
• Highlight the 30 years of rich Fayetteville public access television history
through dynamic interviews with public access leaders over the years, vintage
programming, and a retrospective of FPTV promos through the years.

• Highlight the educational resources of FPTV, including class, workshop and
training schedules being posted on the Message Board and featured in video
promos.
7. Conduct community outreach for recruiting new programming and new producers.
Community outreach is a top priority as the service provider. All of the operational growth at
FPTV has been "grass roots" and has not been the result of capital investment. It is important to
strengthen the efforts to inform all Fayetteville Residents about the opportunities FPTV
provides. The community outreach efforts will be grounded in the core philosophies of Public
Access Television — providing a platform for the entire public to engage with and participate in
their local public access television station. In order to increase participation in Public Access
Television, Your Media will continue to seek new ways to educate the community on what
services and products are provided by the city via FPTV, while also creating the ethos that
public access is a reflection of individuals that come together to make a community.
To achieve the goal of recruiting new producers and new programming, outreach will
continue to focus on all sectors of the Fayetteville community. Neighborhood groups,
non-profits, faith based and community groups are examples of targeted outreach efforts. The
City of Fayetteville is a vibrant and diverse community with a multitude of community groups all
of which have the potential to bring their views and stories to the public arena.
As noted in Section I, these will be some of the components included in the communication and
outreach plan, under the skilled navigation of Your Media's current Executive Director and staff
including:
• Encourage and facilitate the production of locally-focused content that will draw a
viewing audience and raise awareness of the community and resources.
• Launch a driven direct appeal outreach plan to area non-profits and other
organizations serving Fayetteville, including a focus on underrepresented
communities that have historically shown less participation in the public access
television arena.
• Be prominently involved in at least two annual high-profile community events that
promote our services and mission.
E.) Provide technical support to individuals and community groups to assist them in
producing their own programming for telecast on the public access channel.
Through the educational and certification classes, workshops and training outlined
previously in this proposal, individuals will have extensive access to learning, and even
mastering the technical side of production. A qualified, knowledgeable member of the Your
Media staff will be available during all hours of operation, so that technical support is readily
available to anyone utilizing the resources at the Television Center.

F.) Define a detailed communication strategy for the exchange of public information
about the operation of the public access channel and its programming in coverage by
local newspapers, commercial television stations, and online local news sources to
expand public awareness about public access television opportunities and to help
accomplish the City's goal of encouraging greater public participation by Fayetteville
residents.
In order to achieve the goal of a vibrant, sustainable and growing public access television
service, Your Media will continue and expand its communication and outreach strategy to
increase knowledge about FPTV which will continue to increase public participation. Our
communication and outreach strategy is outlined above and we envision that this strategy will
evolve as the City of Fayetteville evolves.
Concerning the communication and outreach plan, as listed in Section Al, FPTV will actively
promote itself through both mainstream and alternative media. Your Media has a proven track
record of creating growth in social media outreach (see appx. F) Your Media has successfully
approached local newspapers, commercial television stations and online local news sources to
expand awareness about the opportunities available. Additionally, we will continue to use
commercial and public radio to educate the public and increase participation. Press releases
will be created and disseminated regularly announcing new programming, classes, workshops,
fundraisers, and other special events.
G.) Provide all users with easily accessible hours of operation:
Your Media has worked to provide operating hours that (shaped through decades of
trial-and-error) appropriately meet the needs of the residents of Fayetteville. We have made the
hours clear and succinct for communication purposes.
1. Minimum operating hours of forty (40) hours per week is mandatory.

2. Create an operations, training and production schedule that maintains convenient
business hours as well as a class schedule that allows producers to become certified
through a combination of evening and weekend classes.
In order to ensure accessibility for all residents and ensure that all those new local
producers have every opportunity to become certified, Your Media has created a proposed
operations, classes and workshops schedule that provides a combination of alternating evening
and weekend time slots. Your Media would continue and modify as needed, the schedule of
production classes and workshops to meet the above stated goals.
H.) Incorporate an education channel component within the public access contract:
Your Media could effectively incorporate the operation of the Education Channel with the
current successful operational structure. By adding the necessary focused staff member to the
team, Your Media could implement the same successful networking and publicity strategies it is
using for FPTV to make the region aware of the new valuable resource. Your Media could
provide the same turn-key, comprehensive service for the Education Channel including staff
services, designing and maintaining a dedicated website, youtube channel, outreach, and
publicity. (See appx. I)
I.) Work with the City Administration and Director of Media Services to formulate and
implement procedures, policies, and protocols for an effective education channel.
In promoting and networking FPTV as an educational resource for the last 5 years, Your
Media has developed relationships and communication channels with the majority of
educational institutions in the region that are creating educational content. In anticipation of this
proposal, we reached out to several organizations who were eager at the prospect of being able
to contribute to a resource of this nature. These organizations include; The FPS Television and
Film Department; The Fayetteville Education Foundation; The University of Arkansas Global
Campus; Springdale Public Schools; and the Fayetteville Public Library (see Johnson Letter in
Vendor References).
Your Media would be eager to facilitate conversations with local educational institutions to
find out what content they could aggregate, and how the channel could best serve their
communities. We could then present this information and work with the DOMS to develop a
programming schedule, procedures, policies, and protocols that fit accordingly.
J.) Provide equitable education channel availability and programming services to
Fayetteville educational institutions and educational institutions of Washington and
Benton Counties
Utilizing the strategy above, we would design the availability and programming services to
the specifications of the Director of Media Services, ensuring that Fayetteville-based institutions
are given equitable priority to the additional content providers.

K.) Define and implement yearly growth goals of the education channel
Initially, we could look at the following basic aspects of the operation to define growth:
• Volume of content being aggregated.
• Quantifiable interaction with that content.
• Social Media engagement.
• Community feedback.
• Support for initiatives.
The first year would define the baseline for the initiative, and the subsequent years could be
shaped to facilitate growth and success.

community, and we'd like to offer a new adage for your consideration of this proposal: if it keeps

Overview of Cost to City
The proposed cost to the City to deliver the services outlined in this proposal will be
$248,186. This allows for:
• Industry-comparable staffing compensation that will attract and retain
high-quality candidates.
• The addition of a staff member to facilitate the Education Channel.
• The administration associated with providing those staffing services.
• A base-line outreach budget to guarantee that the service provider has
resources to help maintain and raise public awareness.
• Office supplies.
• The software subscriptions necessary to provide the service.
All revenue generated by FPTV contract productions, services, or fees would also be
applied to publicity tools and efforts. Ensuring the compensation packages to be equitable to
comparable City Positions helps that we can hire and retain qualified professionals.
Adding the Educational Channel Director meets the need of scalable growth for the
Education Channel, the need for additional support for FPTV Educational offerings, and the
ability to recruit and retain a qualified candidate.
There is exponential value in providing the resources for the public and the City to
produce locally-focused media. Any Fayetteville City department, or City-supported
organization can maximize their outreach potential by utilizing the free resources available.
FPTV has proven its ability to serve the community, but also serve the city as the need for
media support increases.
When weighing the expense of the Public Access operation as a priority against other
essential city services, it is important to remember that FPTV is a unique resource in that it
has the ability to serve the other programs and services that the city funds.
As the resource has developed and progressed, the City has been able to take great
pride in the advances we have made. Investing in the Public Access operation is investing
in the awareness and archives of Fayetteville as a leader in Arkansas and the Nation in
effective community building. Your Media has elevated the online audience to a national
platform, creating a program worth investment. As the community builds, having a resource
available to them that empowers them to use either provided resources or their own
resources to create original content enhances the arts and entertainment industries here in
Fayetteville. Your Media has developed FPTV to serve as a friendly, accessible resource
capable of doing great things for the community into the future.

Your Media Fayetteville Education Channel Vision Overview
Proposed Goal: To create a top-quality educational resource channel that provides an outlet for the
original content being produced by Fayetteville-based and regional educational institutions.
Proposed Contractual Structure: Your Media would provide comprehensive staff/ administrative
services for the City as part of the RFP for Public Access Television. The City would provide
equipment and technical support, and the channel would be run out of the Fayetteville Television
Center.
STAFF STRUCTURE:
Education Channel Director (.5, 20 hrs/wk)
Responsibilities would include:
Schedule programming on the channel for 24/7 broadcasting
Maintaining open communication with all Fayetteville Educational institutions and comprehensively
networking with them to create opportunities including:
• Collecting and scheduling content created by Fayetteville schools and regional content
creators to maximize viewership and awareness
• Creating / Maintaining FEC website and social media presence to inform the community
about the programming and opportunities
• Produce original content at the Television Center featuring local educators and community
leaders
• Recruit and coordinate student volunteers / interns for production crew
• Research potential funding sources to additionally support FEC operations and programming
• Generating reports on programming produced, programming televised, and online viewership
• Reports to FPTV Operational Manager

Your Media Board Biographies
JOE COVEY- BOARD PRESIDENT
Joe Covey is currently the Director of the Center for World Languages at the University of Arkansas. He works
to service and promote his department in lots of ways, and works with students and faculty of many
nationalities and backgrounds.Joe's education is in several languages, and has traveled extensively across the
globe, all of which has fostered his sense of worldliness and admiration of diversity. He previously worked in
the Training & Development industry, helping to market and design training materials for large corporations
in Northwest Arkansas. In his role there, he acquired many technical skills in multimedia and web design, as
well as marketing savvy. Beyond his work,Joe has lots of hobbies! He's an avid gardener, home-brewer,
carpenter, and inventor. You can normally find him knee-deep in some sort of project, or spending quality
time with his wife and two boys.
CEDRIC FONVILLE - BOARD TREASURER
Cedric Fonville is the owner of NICE LLC, a Northwest Arkansas based business designed to assist
organizations with developing their businesses through marketing. He grew up in Star City, Arkansas, and
later started his professional work as an Avionics Electronics Technician in the Navy. After six years, Cedric
returned to Arkansas to obtain a finance and business management degree from the University of Arkansas in
Fayetteville. When he's not working on growing his business, Cedric is actively involved as a board member
with three local nonprofits, exercising, spending time with his family and friends, or overindulging in
professional football.
TENISHA GIST- BOARD MEMBER
A native of East Tennessee,Tenisha Gist relocated to Fayetteville, AR in January of 2005. She has a Bachelor's
degree from the University of Mississippi in Art and a Master's degree from the University of Arkansas in
Education. Prior to becoming the YRCC's Director five years ago,Tenisha's experience focused in developing
mental health wellness strategies and providing recreational therapy activities for youth with disabilities.
Following three interviews,Tenisha's pursuit of serving her community soon aligned with her life's purpose.
She continues to enjoy her role as one who seeks to build community through collaborations as well as
equipping others with the tools to impact people, programs, & policy.
MARILYN KNAPP- BOARD MEMBER
Marilyn Knapp works for the Arkansas Archeological Survey in Fayetteville and has been a Fayetteville
resident for 24 years. She serves as the Survey/Society Liaison and has held the position for 5 years.The
Survey is the organization of professional archeologists for the State of Arkansas.The Arkansas Archeological
Society is the volunteer organization whose members come from all walks of life and from all over the
county. They share an interest in learning about archeology and Arkansas's rich cultural heritage.
Besides handling the Society's membership, finances and daily activities, Marilyn also is responsible for
planning and coordinating the Society's and Survey's largest events throughout the year.These events
include Arkansas Archeology Month in March,the Training Program in Archeology in June and the Society's
Annual Meeting in the fall each year. In Marilyn's past life she was a Senior Underwriter at St. Paul Insurance

More recently, she worked at the Business Affairs office of the University of Arkansas as an Administration
Assistant for 10 years before joining the Survey. Marilyn is very excited about the opportunity to serve Your
Media as a board member.
RANDALL DIXON - BOARD MEMBER
Randy Dixon is the director of news media and archives at the Pryor Center for Arkansas Oral and Visual
History at the University of Arkansas in Fayetteville. Before coming to the Pryor Center, Dixon spent more
than three decades of his media career at KATV News in Little Rock. KATV is the ABC television affiliate owned
by Allbritton Communications. At KATV he oversaw all aspects of news, weather, and sports coverage, all
local broadcasts, and managed a staff of more than 60 employees. During Dixon's tenure at Channel 7, the
station dominated ratings in the Little Rock market for almost 20 years. Working his entire career at KATV,
spanning more than 31 years, Dixon began at the age of 19 as a news photographer while studying
communications at the University of Arkansas at Little Rock. He has tackled almost every newsroom position
including: film/video editor, producer, assignment editor, writer, assistant news director, special projects
director and executive producer. Dixon also spent one year as the promotions director while also fulfilling his
responsibilities in the newsroom. Dixon's work has been recognized and honored within the news industry,
having received ten regional Emmys, 22 regional and four national Edward R. Murrow awards, more than
four dozen Associated Press awards and three Gold World Medals from the New York Festivals. In addition,
under his leadership KATV was awarded numerous Telly and Associated Press Mark Twain news gathering
awards.
Dixon has used his skills to benefit numerous charitable organizations including the National Organization for
Victims Assistance, Winrock International, Heifer International and the Anne Pressly Scholarship Fund. After
the tragic death of KATV reporter Anne Pressly, Dixon co-authored and published Making Memories: A
Celebration of the Life of Anne Pressly. All proceeds from the book sales benefited the Anne Pressley
Scholarship Fund, raising more than $90,000 to date. Dixon attended Hendrix College in Conway, Arkansas
and the University of Arkansas at Little Rock where he studied biology and radio/television/film respectively.
Dixon has two daughters, Rebecca and Leslie, and lives in Fayetteville with his wife Shannon..
