* Public comment at a Fourth Judicial District Drug Task Force Control Board meeting
shall be allowed for all members of the audience who have signed up prior to the
beginning of the agenda item they wish to address. Speakers shall be limited to a
maximum offive (5) minutes. The Fourth Judicial District Drug Task Force Control
Board may allow a speaker additional time or may allow an unsigned -up person to
speak by unanimous consent or majority vote.

MEETING
October 21, 2020
MINUTES
A meeting of the Fourth Judicial District Drug Task Force Control Board was held
on October 21, 2020. This meeting was held using Zoom due to COVID-19 and
recommendations for social distancing.
Those present were:

Mike Peters, Chief -Springdale Police Department
Jay Cantrell, Chief Deputy- Washington County Sheriff's Office
Chris Workman, Chief- Prairie Grove Police Department
Tyler Moore, Sergeant- 4th Judicial Drug Task Force
Willie Newman, Financial Director-4th Judicial Drug Task Force

The meeting was called to order by Mike Reynolds. Upon roll call, the above listed
members were acknowledged present. Copies of the minutes from the September
16, 2020 meeting were distributed to all present. A motion was made by Chris
Workman, and seconded by Mike Peters, to approve the minutes. The motion was
approved unanimously.
A copy of the financial report for the Grant FY 2019-2020 was distributed to all
present for review, period ending April 30, 2020. Financial Director Willie Newman
stated the total expense to date was $110,418.00 which included Federal-J21-004-
18 $57,681.00, Local-J21-004-18 $ 15,100.00, and Non -Allowed- $37,637.00.
Sergeant Tyler Moore reported on the task force's activity September 1, 2020
through September 30, 2020 and distributed a copy of statistics to all present.
Moore stated that in September the task force opened 23 cases, closed 22 cases,
and made 12 arrests. Moore further noted that $1,950.00 was expended for the
purchase of evidence, $0.00 for the purchase of service, and $150.00 for the
purchase of information. Moore stated that drugs seized during the month

included: Methamphetamine, Ecstasy, LSD, Marijuana and pharmaceuticals.
Moore stated that 0 warrants were served. Moore also noted that there were 7 drug
convictions for the month of September. The task force seized 0 vehicles and a total
of $0 in U.S. Currency during the month. The locations of DTF Enforcement Action
for the month were: Fayetteville 4 cases, Springdale 11 cases, Prairie Grove 4 cases,
Farmington 3 cases, and West Fork 1 case.
Other Business
• Mike Reynolds brought forth an amendment to the Confidential Informant
Agreement concerning counsel for a Confidential Informant (CI).
Proposed additions are:
7. I understand it is my right to consult with and/or obtain counsel before
gathering information or providing any services to the Fourth Judicial Drug
Task Force. The Fourth Judicial Drug Task Force encourages cooperating
individuals to consult with an attorney at any time.
I have read and understand the preceding dealing with my conduct as a
cooperating individual for the Fourth Judicial Drug Task Force. I am signing
this of my own free will. No threats or any form of coercion have been used
against me.
Mike Reynolds opened the floor for discussion. Hearing no discussion,
Reynolds entertained a motion for approval of this proposal. A motion by
Mike Peters, seconded by Jay Cantrell, for approval of this proposal. The
motion was approved unanimously.
■ Proposal for the Confidential Informant (CI) Agreement to be recorded and
included in the CI's file. General Order #8, under Establishing a CI, Section
1. Initiating the establishment process requires the officer to document the
following information. Proposal subsection D reads as follows:
D. Confidential Informant Agreement
a. The completion of the Confidential Informant Agreement shall be
recorded in audio and shall be kept in the Cl file.
Under Establishing a Cl, Section 2. Each CI file shall contain the following
documents. Proposal subsection D reads as follows:
D. Confidential Informant Agreement with Audio recording of agreement.
Mike Reynolds opened the floor for discussion.
Chris Workman: Had some concerns regarding officer safety. What
additional equipment will be needed?
Tyler Moore: Recording will not create any dangers or safety hazards. Will
look into ordering recording devices for detectives.
Hearing no further discussion, Reynolds entertained a motion for approval of
this proposal. A motion by Chris Workman, seconded by Mike Peters, for
approval of this proposal. The motion was approved unanimously.
■ Proposal for age restrictions for a Confidential Informant. General Order #8,
under Establishing a Cl, Section 5, A Cl will not be considered established
until such time as the establishment process has been completed and
approved by the Operations Coordinator or their designee. Proposal
subsection A and B reads as follows:
A. Persons under the age of 21: The use of a confidential informant
under the age of 21 is not authorized without the approval of the
Washington County Prosecuting Attorney or his/her designee.
B. Juveniles: The use of a juvenile as a CI is prohibited without the
authorization of the Control Board Chairman or his/her designee.
Mike Reynolds also made the recommendation to strike the language in
Subsection B #2, due to redundancy of what is stated in
subsection B. #2 reads as follows:
2. No juvenile shall be used as a CI without the express consent of the
Control Board Chairman or his/her designee.
Mike Reynolds opened the floor for discussion. Hearing no discussion,
Reynolds entertained a motion for approval of this proposal and
recommendation to strike language. A motion by Mike Peters, seconded by
Chris Workman, for approval of this proposal. The motion was approved
unanimously.
• Proposal for authorization regarding "No Knock" Warrants. General Order
# 16, section 1 Procedures, subsection D. Proposal D reads as follows:
C. The Operation Coordinator shall receive authorization from the Law
Enforcement CEO, or his/her designee of the Jurisdiction in which a
"No Knock" exception will be used in the execution of a search warrant.
Mike Reynolds opened the floor for discussion. Hearing no discussion,
Reynolds entertained a motion for approval of this proposal. A motion by
Chris Workman, seconded by Mike Peters, for approval of this proposal. The
motion was approved unanimously.
• Mike Reynolds made some clarification regarding confusing language. The
use of Confidential Informant and Cooperating Individual is used
interchangeably. Reynolds made a motion to change the language from
Cooperating Individual to Confidential Informant throughout all agreements
and General Orders regarding the Fourth Judicial District Drug Task Force.
Mike Reynolds opened the floor for discussion. Hearing no discussion,
Reynolds entertained a motion for approval of this recommendation. A
motion by Jay Cantrell, seconded by Mike Peters, for approval of this change.
The motion was approved unanimously.
• Captain Casey Brown updated the Control Board with regards to the task
force website. After speaking with the Communications Division at the city,
the website now has a link to Agenda/ Minutes folder, so that the public has
access to past and present task force minutes and recordings of those
meetings. All 2020 meeting packets are available on the website. The meeting
packet will also be included on the city's weekly calendar. Brown walked
through the steps to access this information. Meeting announcements and
packets will be sent to the City Clerk's Office by the Thursday prior to the
following Wednesday meeting.
Brown also talked with Doug Bankston, Director of Media Services, about
getting an archive of the audio recordings and/or Zoom recordings like other
city meetings. This can be accessed by going to City Government Meeting
Archives and selecting the Drug Task Forces Meeting folder. At this time,
Zoom meeting link will be available but audio recordings link is still under
construction. Once the audio link is ready, it will be posted.
No other business brought before the Control Group.
Public Comment
John Comstock: Do you keep demographics on Confidential Informants (CI)?
Concerning CI's, under 21 requires the authorization of the Prosecuting Attorney
and/or designee, but the very next section says that if it is a juvenile, that it only
requires the consent of the commanding officer. Seems confusing and would like
clarification.
Did notice that on occasion that CI's used are on probation or parole. Would like
the board to reconsider using those on probation or parole as CI's. Understands
somewhat to the reason why they would be used but on the contrary we want folks
to become, good community citizens.
Sarah Moore: Applaud the changes. Challenges the board to continually improve
upon that, several of these don't go far enough. Ask that the board look at the age
bracket for a Confidential Informant. Would like twenty-five to be our threshold
when considering a person as Cl.
Would like to see all activities between a CI and detective recorded so, that in an
event there is a question or concern, it could be looked at in the future.
Applauds the use of the website. Will be incredibly useful for the community to
access information.
Would like to discuss looking into grants that will provide restored services for
individuals. Also, would like to discuss human trafficking and drug interaction.
David Freeman: Comment regarding reform measurements. Wanted to echo
Sarah Moore comment on moving the age of a CI to 25.
Concerned that even though "No Knocks" have been reformed that they can be used
under certain circumstances.
Scott Mashburn: Would be willing to offer ideas and support on the website. Would
like to see the task force continue to reduce barriers and opening the transparency
of getting information to the people.
What scientific forensic science, evidence -based practices were used for the three
items that you voted on today? Did you compare with other drug task force across
the state and nation?
What does it mean, on the monthly activity report, when a Drug Trafficking Group
(DTO) is dismantled?
Sarah Gaston: Thank you for acknowledging the "No Knock" warrants. When a "No
Knock" is used, what methods of oversight are being implemented? Do they have
body cameras?
Chief Mike Reynolds requested a date and time for the next meeting. The next
meeting will be November 18, 2020 at 1:30 P.M. This meeting will take place
remotely through Zoom due to Covid-19 and the recommendation for social
distancing. The meeting was adjourned.

General Orders
4. Law enforcement action shall not be taken solely on information provided by a
CI prior to the establishment of the CI by the 4th JDDTF. With all information
provided by informants of any type, officers of this department shall take
investigative steps to corroborate the information to the extent practicable and
feasible.
S. A CI will not be considered established until such time as the establishment
process has been completed and approved by the Operations Coordinator or
their designee.
A. Persons under the age of 21: The use of a confidential informant under
the age of 21 is not authorized without the approval of the Washington
County Prosecuting Attorney or his/her designee.
B. Juveniles: In addition to the approval of the Washington County
Prosecuting Attorney or his/her designee, the use of a juvenile as a CI
is prohibited without the authorization of the Control Board Chairman
or his/her designee.
1. No juvenile shall be used as an informant unless a parent or
guardian has given express written authorization and has co-
signed the CI agreement and a waiver.
2. No juvenile shall be used as a CI in a manner which is contrary
to state law.
Maintaining Confidentiality: It is recognized that a Cl whose identity has been discovered
may be at risk for retribution. As such, this department shall take all steps which are
legal to maintain the confidentiality of any established Cl. 01 JDDTF personnel who
become aware of the identity of a 4th JDDTF Cl, shall not reveal any information
related to the Cl that may reveal their identity. The following exceptions apply to this
provision and disclosure is appropriate under the following circumstances:
1. Disclosure to other departments' personnel, who have a need to know, in order
to perform official duties of the 4th JDDTF. The control officer for the informant
shall notify his/her supervisor that such disclosure has been sought and get
authorization for this disclosure.
2. Disclosure to other law enforcement agencies or governmental entities that
have a need to know, in order to perform their governmental function. The control
officer shall, through the chain of command, get approval from the Operations
Coordinator or his/her designee before this type of disclosure.
