Institutional.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby amends the official

SUBJECT: RZN-2020-000011: Rezone (NE OF DEANE ST. & PORTER
RD./FAYETTEVILLE PD, 364): Submitted by CITY STAFF for property located
NORTHEAST OF DEANE STREET & PORTER ROAD The property is zoned R-
A, RESIDENTIAL AGRICULTURAL and contains approximately 11.60 acres. The
request is to rezone the property to P-1, INSTITUTIONAL.
RECOMMENDATION:
The Planning Commission and staff recommend approval of an ordinance to rezone the subject
property as shown in the attached Exhibits `A' and 'B'.
BACKGROUND:
The subject property includes 11.60 acres of undeveloped land northeast of Deane Street's
intersection with Porter Road, approximately '/2 mile north of Wedington Drive. Although owned
by the University of Arkansas for decades, the property's use in association with the school and
its agricultural programs is limited. In April of 2019, Fayetteville voters approved a sales tax bond
package worth up to $226,065,000, including $36,965,000 for land acquisition and construction
of a new Police Department headquarters, and $15,840,000 for the land acquisition and
construction of new Fire Department stations. In November of 2019, the City of Fayetteville
acquired the subject property from the University of Arkansas for construction of the new police
headquarters and a fire station.
Request: The request is to rezone the property from R-A, Residential Agricultural, to P-1,
Institutional. The City of Fayetteville intends to develop the property with a police headquarters
and fire station.
Land Use Compatibility. The property in question is surrounded by varied land uses, from
institutional agricultural land to the north and east, to residential and neighborhood -scale
institutional property to the south and west. Staff finds that an institutional use would likely
compliment the surrounding neighborhood by locating services, whether the intended police and
fire department facilities or other allowed institutional or municipal uses, closer to this area.
Land Use Plan Analysis: As noted above, the property is designated on the Future Land Use
Map as a Civic Institutional Area. Staff contends that the proposal is compatible with the guiding

policy of this designation: Encourage the establishment of civic institutional areas in locations
that would serve large numbers of Fayetteville citizens. Although not in the geographical center
of Fayetteville, the subject property and its transportation connectivity make its use for
institutional facilities accessible to many residents. By increasing access and service, the
potential for meeting City Plan 2040's goals citywide is inherently increased.
CITY PLAN 2040 INFILL MATRIX: City Plan 2040's Infill Matrix indicates a varying score of 4-6
for this site. The following elements of the matrix contribute to the score:
• Near Razorback Transit Bus Stop (Route 33)
• Near Park (Lewis)
• Near Trail (Meadow Valley)
• Near Sewer Main (Porter Road and interior to the site)
• Near Water Main (Porter Road & Deane Street)
• Near Public School
DISCUSSION:
On September 16, 2020, the Planning Commission forwarded the rezoning request with a
recommendation of approval. Commissioner Brown made the motion and Commissioner Garlock
provided a second. The subsequent vote was 6-2-1. Commissioner Hoffman recused while
Commissioners Belden and Paxton dissented. Those opposed to the motion expressed their
desire to see municipal projects held to the same zoning standard as private development, where
urban form is considered preferred by many long-range planning documents. Commissioner
Belden specifically referenced a recent proposal to P-1 that was denied for a religious institution
on the grounds that it permitted parking between the street and the building, rather than to the
side or rear, and building orientation that does not address the street. The City Council ultimately
approved that rezoning on appeal, with a bill of assurance restricting parking to the side and rear
of the church.
Although no public comment was received in advance of the meeting, a representative of the
Fayetteville Housing Authority spoke during the hearing, expressing her preference that the City
request a mixed -use zoning district that promotes urban form, similar to what is expected of other
development. Additionally, she shared frustration with what she contends is inadequate or last-
minute public involvement on this City project and others.

BACKGROUND:
The subject property includes 11.60 acres of undeveloped land northeast of Deane Street's
intersection with Porter Road, approximately '/2 mile north of Wedington Drive. Although owned
by the University of Arkansas for decades, the property's use in association with the school and
its agricultural programs is limited. In April of 2019, Fayetteville voters approved a sales tax bond
package worth up to $226,065,000, including $36,965,000 for land acquisition and construction
of a new Police Department headquarters. In November of 2019, the City of Fayetteville acquired
the subject property from the University of Arkansas for construction of the new police
headquarters and a fire station. Surrounding land uses and zoning is depicted in Table 1.

Request: The request is to rezone the property from R-A, Residential Agricultural, to P-1,
Institutional. The City of Fayetteville intends to develop the property with a police headquarters
and fire station.
Public Comment: Although staff has received no public comment on this item, significant input
has been made at various City Council meetings regarding the proposed Police Department

headquarters. This has largely focused on funding of a police facility, programming and site
design of a new headquarters, and future street improvements to Deane and Porter.
INFRASTRUCTURE:
Streets: The subject property has direct access to West Deane Street and North Porter
Road. Both streets are unimproved Neighborhood Links with asphalt paving and
open ditches along the subject property's frontage. Any street improvements will
be determined at the time of development.
Water: Public water is available to the subject area. Existing 2-inch and 12-inch water
mains are present along Deane Street while a varying diameter main is present
along Porter Road.
Sewer: Sanitary Sewer is available to the subject area. An existing 6-inch sanitary sewer
main is present along the southwest side of the subject area on the west side of
Porter Road. Additionally, a 6-inch sanitary sewer main is present through the
northeast corner of the site.
Drainage: Although no portion of the property is within the Hilltop -Hillside Overlay District, a
FEMA-designated floodplain, or a streamside protection zone, hydric soils do
appear to be present on portions of the subject property. Any additional
improvements or requirements for drainage will be determined at time of
development.
Fire: Station 2 located at 708 North Garland Avenue currently protects this site. The
property is located approximately 2.6 miles from the fire station with an anticipated
drive time of approximately 5 minutes using existing streets. The anticipated
response time would be approximately 7.2 minutes. Fire Department response
time is calculated based on the drive time plus 1 minute for dispatch and 1.2
minutes for turn -out time. Within the City Limits, the Fayetteville Fire Department
has a response time goal of 6 minutes for an engine and 8 minutes for a ladder
truck. This property is allocated for a new fire station.
Ultimately, development of the property is intended to include a fire station, which
would have the effect of reducing fire response times for this site and the larger
area. Fire apparatus access and fire protection water supplies will be reviewed for
compliance with the Arkansas Fire Prevention Code at the time of development.
Police: The Police Department expressed no concerns with this request.
CITY PLAN 2040 FUTURE LAND USE PLAN: City Plan 2040 Future Land Use Plan designates
the property within the proposed rezone as Civic Institutional.
Civic Institutional Areas are dedicated for buildings generally operated by not -for -profit
organizations dedicated to culture, government, education or transit and municipal parking. Civic
Institutional Areas are to be established in locations that would serve large numbers of Fayetteville
residents.

Finding: Staff finds the request to be justified based upon the voter approval of sales
tax bonds for police and fire facilities, and the City Council's actions to
appropriate funding, approve the subject property's land purchase, and
contract with various construction and design services for a police
headquarters. The current zoning, R-A, does not permit institutional uses by -
right. The rezoning is necessary to ensure the property's consistency with
its designation as a Civic Institutional Area as determined by City Plan 2040.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Rezoning the property from R-A to P-1 and development of the site under the
institutional zoning allowances will increase traffic to and from the site.

Given the scale of the activity associated with a police headquarters and fire
station, this traffic is likely to be substantial. Accordingly, major
improvements are proposed to Deane and Porter within the 2019 sales tax
bond, including, but not limited to, curb and gutter, intersection
modification, pedestrian facilities, and the potential for on -street parking.
The Midtown Corridor, as the basket of improvements are named, will extend
from the northbound off -ramp of Interstate 49 to the intersection of Porter
and Deane, and eastward along Deane and Sycamore. In addition to future
improvements, the existing connectivity from the site to the wider City,
whether north along Porter to Mount Comfort and Interstate 49, or south
along Porter to Wedington and east along Deane to Garland, is extensive and
can diffuse potential traffic.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: Rezoning the property from R-A to P-1 does not have the potential to
increase population density or adversely affect public services. Rather, the
development of the property with core municipal emergency facilities will
improve both Fire Department response times and the Police Department's
capacity and services.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the
proposed zoning is not desirable.
Finding: N/A
RECOMMENDATION: Planning staff recommends forwarding RZN-2020-000011 to the City
Council with a recommendation for approval.

Re: Fayetteville Public Safety Campus Rezoning
Mr. Chairman,
Attached for your review and consideration is the rezoning package for the Fayetteville Police
Headquarters site. The request is to change the zoning of this property to P-1, Institutional. This
zoning will fit with the intended use of this site for the future Fayetteville Police Department
headquarters and Fayetteville Fire Department station.
The police headquarters and fire department are both funded by the 2019 sales tax bonds
approved by Fayetteville voters. The bond package included $36.9 million for the police
headquarters and $15.8 million for three new fire departments. The City council authorized the
purchase of the subject property for construction of the facilities in 2019, and the City bought the
property from the University of Arkansas in early 2020.
The proposed rezoning is compatible with Fayetteville's Future Land Use Map and surrounding
land uses. The P-1, Institutional zoning will allow public facilities to be built on the site that will
directly serve the surrounding mix of residential and institutional uses and the residents of the
City at -large.
