RECOMMENDATION: City Planning staff and the Planning Commission recommend approval of a request to rezone the subject property as described and shown in the attached Exhibits 'A' and 'B'. BACKGROUND: The subject property is located in south Fayetteville along S. School Road across the street and just north of the Tyson Foods Mexican Original Plant. The subject property is a vacant, residentially zoned lot (RSF-4, Residential Single Family, 4 Units per Acre) in between commercially -zoned property (C-2, Thoroughfare Commercial). Public Comment: Staff has received no public comment on this item. Land Use Compatibility: The property in question is surrounded by commercial uses and commercial zoning, and is the last remaining residentially -zoned property along this portion of S. School Road. While the property to the east is currently zoned RSF-4, it is largely undeveloped. Staff finds that an institutional use would likely enhance the surrounding neighborhood by locating essential city services closer to this area, and would decrease service and response times for an area marked as a City Neighborhood Area. School Avenue, which is a fully improved Regional Link with asphalt paving, curb, gutter, and sidewalk. An existing 6-inch sanitary sewer main is present along the east side of S. School Avenue. Drainage: Any additional improvements or requirements for drainage will be determined at time of development. Hydric soils appear to be present along the west side of the property along S. School Avenue. No portion of the property is within the Hillside - Hilltop Overlay District, a FEMA floodplain, nor is there a protected stream present in the subject area. Fire: Fire apparatus access and fire protection water supplies will be reviewed for compliance with the Arkansas Fire Prevention Code at the time of development. Station 1 located at 303 W. Center Street currently protects this site. The property is located approximately 1.7 miles from the fire station with an anticipated drive time of approximately 4 minutes using existing streets. The anticipated response time would be approximately 6.2 minutes. Fire Department response time is calculated based on the drive time plus 1 minute for dispatch and 1.2 minutes for turn -out time. Within the City Limits, the Fayetteville Fire Department has a response time goal of 6 minutes for an engine and 8 minutes for a ladder truck. This property is allocated for a new fire station. Police: The Police Department expressed no concerns with this request. CITY PLAN 2040 FUTURE LAND USE PLAN: City Plan 2040 Future Land Use Plan designates the property within the proposed rezone as Civic Institutional. Civic Institutional Areas are dedicated for buildings generally operated by not -for -profit organizations dedicated to culture, government, education or transit and municipal parking. Civic Institutional Areas are to be established in locations that would serve large numbers of Fayetteville citizens. Finding: The property is slated for the development of a new fire station that is funded through the approval of the 2019 Bond Projects. The current zoning, RSF-4, does not permit institutional uses by -right. The rezoning is required to bring this property into compliance with its designation as a Civic Institutional Area as determined by the 2040 City Plan. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: Rezoning the property from RSF-4 to P-1 does have the potential to increase in and out traffic to the site, especially given the proposed use as a fire station. Any required infrastructure improvements that may be needed to mediate any of this traffic will be determined at the time of development submittal. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: Rezoning the property from RSF-4 to P-1 does not have the potential to increase population density. If there are reasons why the proposed zoning should not be approved in view of considerations under b (1) through (4) above, a determination as to whether the proposed zoning is justified and/or necessitated by peculiar circumstances such as: a. It would be impractical to use the land for any of the uses permitted under its existing zoning classifications; b. There are extenuating circumstances which justify the rezoning even though there are reasons under b (1) through (4) above why the proposed zoning is not desirable. The request is to change the zoning of this property to P-1, Institutional. This zoning will fit with the intended use of this site for a future fire station. This use is compatible with the existing zoning of the surrounding properties. This property is bordered by commercial zoning on three sites and residential on the other. The Institutional zoning will allow for additional public services to be built on the site. This will not only be compatible, it will be beneficial to the surrounding area.
