TO AUTHORIZE THE MAYOR TO PROHIBIT NON -ELECTRIC VEHICLES FROM PARKING IN
DESIGNATED ELECTRIC VEHICLE CHARGING PARKING SPACES IN ALL CITY PARKING
FACILITIES
WHEREAS, the current language in § 72.58(N) of the City Code authorizes the Parking Manager to
prohibit all non -electric vehicles from parking in designated electric vehicle charging spaces, but only in
Parking Lot 1 across from City Hall on Mountain Street where the first charging stations were installed
in a City parking lot; and
WHEREAS, the Sustainability Division is working to expand the number of electric vehicle charging
stations to other City parking facilities and it is important to ensure those parking spaces are reserved
for electric vehicles that need to use the charging stations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 72.58(N) of
the Fayetteville City Code and enacts a new § 72.58(N) as follows:
"(N) Electric Vehicle Charging Stations. The Mayor is authorized to designate Electric Vehicle Charging
Station parking spaces in City parking facilities to prohibit all non -electric vehicles from parking in these
spaces. The owner or operator of an electric vehicle shall only park in this space while charging the
vehicle's battery and shall pay normal parking rates while parked in this space."

SUBJECT: Amendment to the City Code Chapter 72: Parking Regulations authorizing
the Parking Manager to designate "electric vehicle charging station parking
spaces" to prohibit the parking of non -electric vehicles in these spaces.
RECOMMENDATION:
Staff recommends the City Council adopt an ordinance amending section 72.58(n) — Off Street
Parking Facilities; Rules and Rates of the City Code. This city code designates specific electric
vehicle charging station parking spaces by prohibiting the parking of non -electric vehicles in
these spaces.
BACKGROUND:
The Sustainability Division is working to expand electric vehicle charging stations on city parking
lots for public use. This is one of the strategies listed in the Energy Action Plan to help reduce
greenhouse gas emissions in the transportation sector. The City is working on an agreement
with Francis Energy to install one Level 3 charging station and one Level 2 charging station and
to designate at least two electric vehicle only parking spaces adjacent to the EV charging station
in the Spring St. Parking Deck. These EV chargers will provide facilities for the growing number
of electric vehicles in our downtown area.
The current ordinance language that allows for electric vehicle charging stations specifies that
the city can prohibit all non -electric vehicles from parking in designated EV charging spaces but
limits this ability to specifically and only Parking Lot 1 across from City Hall on Mountain St.
There is a Level 2 EV charging station located at Parking Lot 1 and the below graph
demonstrates over the past two years use of this public charging station has increased tenfold
with a current average use of nine hours of use each day.

This EV charging station serves the Fayetteville Square but is not located within commonly
considered walking distance of the other major downtown destination center — Dickson St.
Entertainment District. Visitors to Dickson St. area and the future Cultural Arts Corridor come
for events and social occasions with shorter visitation lengths than the business community
utilizing the EV charger near the square. For this reason, an EV charging station near the
Dickson St. Entertainment District with a faster charge rate would better serve the community.
Level 3 EV charging stations charge 80% of a battery in 30 minutes rather than the four to six
hours required with a Level 2 EV charger. This higher performance charging station is well
suited for the event visitor to the entertainment district.
DISCUSSION:
In order to allow designation of EV parking spaces across city parking facilities, including at the
Spring St. Parking Deck, the City Attorney's Office has suggested amending section 72.58(n) —
Off Street Parking Facilities; Rules and Rates of the City Code as follows:
