AN ORDINANCE TO WAIVE FORMAL COMPETITIVE BIDDING AND APPROVE A COST
SHARE AGREEMENT WITH STEFFAN AND CATHERINE SARKIN FOR STREET AND
DRAINAGE IMPROVEMENTS ALONG STORER AVENUE WITH A REFUND IN AN AMOUNT NOT
TO EXCEED $36,696.63 TO BE PAID BY THE CITY OF FAYETTEVILLE FOR THE COST OF
IMPROVEMENTS THAT EXCEED THE ROUGH PROPORTIONALITY OF THE IMPACT OF THE
DEVELOPMENT
WHEREAS, Steffan and Catherine Sarkin are developing six new single-family residential homes along
the west side of Storer Avenue which, pursuant to § 171.13 of the Unified Development Code requires
the installation of sidewalks; and
WHEREAS, the City Engineering Division recommends several additional improvements including new
trench drainage, new piping to convey water underground, and new curb and gutters which would
exceed the rough proportionality of the development's impact; and
WHEREAS, the City proposes to enter into an agreement with the Sarkins to refund an amount of up
to $36,696.63, which represents the estimated cost of improvements that exceed the rough proportionality
of the development's impact; and
WHEREAS, allowing the Sarkins to utilize their own contractor who will be on -site installing the sidwalk
for the additional improvements will allow the City to achieve significant savings.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

Section 1: That the City Council of the City of Fayetteville, Arkansas hereby detennines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement
with Steffan and Catherine Sarkin for street and drainage improvements along Storer Avenue with a refund in
an amount not to exceed $36,696.63 to be paid by the City of Fayetteville for the cost of improvements that
exceed the rough proportionality of the impact of the development.

RECOMMENDATION:
Staff recommends approval of this cost share with Sarkin to pay $36,696.63 for street and
drainage improvements along Storer Avenue.
BACKGROUND:
In October 2019, the Development Services Office received a request for six new single-family
residential houses to be constructed along the west side of Storer Avenue, between Douglas
and Cleveland. These residential structures were permitted based on a lot split, that was
previously approved, and replaced two existing single-family structures that were demolished.
Along with development of the new houses, sidewalk is required to be installed per the Unified
Development Code. This section of Storer Avenue, north of Caraway Street is very steep,
narrow and unimproved with open ditches on each side. It is one of the only remaining sections
of Storer Avenue that is not improved, which makes construction of a sidewalk challenging, and
will ultimately increase maintenance burden for the city maintain a sidewalk next to an open
ditch with active erosion issues.
DISCUSSION:
During permitting review for the project, the engineering division met multiple times with the
developer to discuss options to improve the existing street in this location and were approached
about the possibility of a cost share to complete the improvements. The improvements will
consist of a new trench drain to capture water flowing down the hill, as well as new piping to
convey the water underground and facilitate removal of the open ditch. In addition, new curb
and gutter will be included new driveway aprons and sidewalks to complete the street scape on
this portion of the street.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF STREET IMPROVEMENT COSTS
This Agreement, made and entered into on this 5th day of May, 2020, by and
between the City of Fayetteville, Arkansas ("City') and Steffan and Catherine Sarkin ("Sarkin"),
witnesseth:
WHEREAS, Sarkin has proposed a new residential development, approved along the west
side of Storer Avenue. and
WHEREAS, the Sarkin development is required to construct sidewalk improvements
along its property frontage of Storer Avenue: and
WHEREAS, Sarkin has committed to completing these required sidewalk improvements
along their property frontage, and
WHEREAS, street and drainage improvements, which exceed the rough proportionality
of impact of the project are necessary along the property frontage to complete the street scape and
make installation of the sidewalk possible.
WHEREAS, the City of Fayetteville Engineering Division recommends the street
improvements, which exceed the rough proportionality of impact from the development be funded
by means of a cost share.
NOW, THEREFORE, the City of Fayetteville. Arkansas and Sarkin agree as follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse Sarkin for $36,696.63 which represents one half of the cost to install
approximately 224 linear feet of curb and sidewalk, 180 linear feet of concrete
sto►7n pipe, a junction box, curb inlet, and trench drain, as well as full cost to
extend the curb, storm drainage and sidewalk north to Cleveland Street as
shown in Exhibit "A", attached.
B. Payments due to Sarkin, shall be remitted within sixty (60) days after receipt of
valid invoices, and pending successful inspection and acceptance of the
completed work by the City of Fayetteville Engineering Division.
2. Sarkin a�0rees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary to complete the work shown on Exhibit "A", in accordance with
the City of Fayetteville Minimum Street Standards, and City Standard Details,

B. Provide a copy of the invoices from the Contractor upon completion and City
approval of the street, drainage and sidewalk improvements described in
Exhibit "A"
C. Pay for the street, sidewalk and drainage improvements (with reimbursement
of $36,696.63 of the cost by the City of Fayetteville).
3. It is further understood that the contract for construction is between Sat -kin and their
Contractor and that the City has no contractual obligation with either the Contractor
or any agent for Sarkin. The City's only obligation shall be to participate in a
contractual agreement with a not -to -exceed amount of $36,696.63 for the street,
sidewalk, and drainage improvements.

In close proximity to the University of Arkansas, this neighborhood sees a large amount of
pedestrian traffic. Without a sidewalk, the only option currently is to walk in the street. This cost
share if approved will improve vehicular and pedestrian safety for the neighborhood, as well as
reduce future maintenance associated with open ditches with active erosion.
BUDGET/STAFF IMPACT:
This project is funded by the Sales Tax Capital Improvements Fund
