WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described 1.21 acres of a general utility
easement are not required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the general utility
easement as described in Exhibit B attached to the Planning Department's memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as
Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County
Circuit Clerk.
Section 3: This vacation approval is subject to the condition that any relocation of or damage to existing
utilities or existing facilities shall be at the owner/developer's expense.

250): Submitted by CEI ENGINEERS, INC. for property located NW OF DRAKE
ST. & GREGG AVE. The property is zoned UT, URBAN THOROUGHFARE and
contains approximately 1.21 acres. The request is to vacate a portion of a general
utility easement.
RECOMMENDATION:
Staff and Planning Commission recommend approval of VAC 20-7002 as shown in the attached
Exhibits 'A' and 'B' and with the following conditions of approval:
1. Any relocation of or damage to existing utilities or existing facilities shall be at the
owner/developer's expense.
BACKGROUND:
The subject property includes approximately 1.21 acres of existing utility easement northwest of
Gregg Avenue and Drake Street. In January of 2019, the easement was dedicated in association
with a previous development plan. Since that time, a differing site plan has been submitted and
reviewed, with which the subject easement conflicts. The property is currently undeveloped and
is most notable for its black walnut orchard near the railway right-of-way to the east.
DISCUSSION:
At the March 9, 2020 Planning Commission meeting, this item was forwarded as part of the
consent agenda to City Council with a recommendation for approval, with the condition as
recommended by staff.

On behalf of 1155 Properties, CE[ is proposing to vacate the 20-foot-wide Utility Easement shown and dedicated on
a Tract Split Survey recorded on January 1, 2019 as Document 2019-00000935. The easement was created for a
different development proposed at that time. Since the easement to be vacated was only created in January of this
year, it appears no new utilities have yet made use of it.
We are proposing to vacate this easement in its entirety to allow us to create new easements more suited to the
planned future development.

We, the undersigned, being all the owners of the real estate abutting the easement hereinafter sought to be abandoned
and vacated, lying in 34-17-30 Fayetteville Ont10tS, City of Fayetteville, Arkansas, a municipal corporation, petition
to vacate an easement which is described as follows:
PLEASE SEE ATTACHED EXHIBIT "A" FOR LEGAL
DESCRIPTION
That the abutting real estate affected by said abandonment of the alley are, 27-17-30 Fayetteville Outlots and 34-17-
30 Fayetteville OUt10t5, City of Fayetteville used by the public for a period of many years, and that the public
interest and welfare would not be adversely affected by the abandonment of the portion of the above described
easement.
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above described real estate,
subject, however, to the existing utility easements and sewer easements as required, and that the above described real
estate be used for their respective benefit and purpose as now approved by law.
The petitioners further pray that the above described real estate be vested in the abutting property owners as
provided by law.
WHEREFORE, the undersigned petitioners respectful ly pray that the governing body of the City of Fayetteville,
Arkansas, abandon and vacate the above described real estate, subject to said utility and sewer easements, and that

AN ORDINANCE TO APPROVE
VAC 20-7002 FOR PROPERTY
LOCATED NORTHWEST OF DRAKE
STREET AND GREGG AVENUE TO
VACATE ABOUT 1.21 ACRES OF A
GENERAL UTILITY EASEMENT
WHEREAS, the City Council has the
authority under A.C.A. § 14-54-104 to
vacate public grounds or portions Ihereol
which are not required for corporate
purposes; and
WHEREAS, the City Council has
determined that the following described
1.21 acres of a general utility easement
are not required for corporate purposes.
NOW, THEREFORE, BE IT
ORDAINED BY THE CITY COUNCIL
OF THE CITY OF FAYETTEVILLE,
Section I: That the City Council of the
City of Fayetteville, Arkansas hereby
vacates the general utility easement as
described in Exhibit B attached to the
Planning Department's memo.
Section 2: A copy of this Ordinance
duly certified by the City Clerk along
with the map attached as Exhibit A to
the Planning Department's memo shall
be filed in the office of the Washington
County Circuit Clerk.
Section 3: This vacation approval is
subject to the condition that any
relocation of or damage to existing
utilities or existing facilities shall be at
the owner/developer's expense.
