SUBJECT: RZN 20-6999: Rezone (3509 E. HUNSTVILLE RD./PALMER, 529): Submitted by
DIANNE PLAMER for property located at 3509 E. HUNSTVILLE RD. A portion of
the property is zoned, C-1, NEIGHBORHOOD COMMERCIAL and contains
approximately 0.67 acres. The request is to rezone the property to RSF-4,
RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE.
RECOMMENDATION:
The Planning Commission and staff recommend approval of an ordinance to rezone the subject
property to RSF-4, Residential Single-family, 4 Units per Acre, as shown in the attached Exhibits
`A' and 'B'.
BACKGROUND:
The subject property is located at 3509 East Huntsville Road. The property totals approximately
0.67 acres, is split -zoned as C-1, Neighborhood Commercial, and RSF-4 Residential Single -
Family, 4 Units per Acre. The property contains a single-family dwelling built in 1961.
Request: The request is to rezone the property from the current split zone of RSF-4 and C-1 to
entirely RSF-4. The applicant informed staff that they were in the process of selling the property
but the sale was put on hold due to the split zoning on the subject property.
Land Use Compatibility: Land uses immediate and general adjacency to the subject property are
primarily detached single-family dwellings, although there are a variety of zoning districts near the
subject property. Staff finds that the proposed rezoning is generally compatible with adjacent land
uses.
Land Use Plan Analysis: Staff believes that the proposal is consistent with the goals in City Plan
2040, adopted land use policies, and the future land use designation for this location. This
property, designated as a Residential Neighborhood Area, envisions primarily residential uses in
a variety of complimentary building types and configurations. RSF-4 on the entirety of this property
would limit development to low density, single-family residential, as is consistent with the
property's location on the urban transect.

BACKGROUND:
The subject property is located at 3509 E. Huntsville Road. The property totals approximately
0.67 acres, is split -zoned as C-1, Neighborhood Commercial and RSF-4 Residential Single -
Family, 4 units per acre. The property contains a single-family dwelling built in 1961. Surrounding
land uses and zoning is depicted in Table 1.

Request: The request is to rezone the property from the current split zone of RSF-4,
Residential Single-family, 4 units per acre and C-1, Neighborhood Commercial to entirely RSF-
4, Residential Single -Family, 4 units per acre. The applicant informed staff that they were in the
process of selling the property but the sale was put on hold due to the split zoning on the

Public Comment: Staff has received no public comment
INFRASTRUCTURE:
Streets: The subject area has frontage to East Huntsville Road. East Huntsville Road is a
partially improved Regional Link with asphalt paving and open ditches along the
property's frontage. Any street improvements required in these areas would be
determined at the time of development proposal.
Water: Public water is available on this property. An existing 8-inch watermain along the
north side of North Huntsville Road provides water access to this property.
Sewer: Sanitary Sewer is available to this property. An existing 12-inch sanitary sewer
main that crosses this property provides access.
Drainage: Any additional improvements or requirements for drainage will be determined at
time of development. Hydric soils appear to be present within the entire subject
area.
Fire: Fire apparatus access and fire protection water supplies will be reviewed for
compliance with the Arkansas Fire Prevention Code at the time of development.
The site will be protected by Station 3, located at 1050 S Happy Hollow. The
property is located approximately 1.5 miles from the fire station with an
anticipated drive time of approximately 3 minutes using existing streets. The
anticipated response time would be approximately 5.2 minutes. Fire Department
response time is calculated based on the drive time plus 1 minute for dispatch
and 1.2 minutes for turn -out time. Within the City Limits, the Fayetteville Fire
Department has a response time goal of 6 minutes for an engine and 8 minutes
for a ladder truck.
Police: The Police Department expressed no concerns with this request.
CITY PLAN 2040 FUTURE LAND USE PLAN: City Plan 2040 Future Land Use Plan designates
the property within the proposed rezone as Residential Neighborhood Area.
Residential Neighborhood Areas are primarily residential in nature and support a variety of
housing types of appropriate scale and context, including single family, multifamily and row -
houses. Residential Neighborhood encourages highly connected, compact blocks with gridded
street patterns and reduced setbacks. It also encourages traditional neighborhood development
that incorporates low -intensity non-residential uses intended to serve the surrounding neighbor-
hood, such as retail and offices, on corners and along connecting corridors. This designation
recognizes existing conventional subdivision developments which may have large blocks with
conventional setbacks and development patterns that respond to features in the natural envi-
ronment.
FINDINGS OF THE STAFF
A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: Land Use Compatibility: Land uses in immediate and general adjacency to
the subject property are primarily detached single-family dwellings.
Although there are a variety of zoning districts in close proximity to the
subject property. Staff finds that the proposed rezoning is generally
compatible with adjacent land uses.

Residential Neighborhood Area, envisions primarily residential uses in a
variety of complimentary building types and configurations. RSF-4 on the
entirety of this property would limit development to low single-family
residential. The future land use plan designates this area as Rural/Natural
Area.
A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: Based on the request letter and conversations staff has had with the
applicant, the requested rezoning is justified and needed at this time for the
to align the zoning of the property with the existing land use. The applicant
mentioned a sale was contingent on rezoning this property to a residential
district.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Rezoning the property to RSF-4 has limited potential to increase density or
the amount of traffic on Huntsville Road. While the property could be
developed with an accessory dwelling units, the current lot width along
Huntsville Road does not allow for subdivision, restricting the ability for
additional housing. Thus the possibility of increased traffic danger and
congestion will not be appreciable.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: Rezoning the property from the split zoning of RSF-4/C-1 to entirely RSF-4
will not increase the potential population density and will not undesirably
increase the load on facilities and services. The 0.90-acre property has
access to existing water, sewer, and other public services that eliminate the
need for costly extensions or stretched fire or police service.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the
proposed zoning is not desirable.
