NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes Mayor Jordan to sign a cost share agreement with Double Springs Development, LLC for the upsizing of a sewer line with an amount not to exceed $72,976.00 to be paid by the City of Fayetteville, and further approves a project contingency in the amount of $14,595.20. BACKGROUND: Double Springs Development, LLC is developing the 126 -acre Goose Creek Village, Phase 1 subdivision on the west side of Double Springs Rd. in Farmington. They are required to install an 8 -inch sanitary sewer main for the development, but the City of Fayetteville's Wastewater Collection System Master Plan recommends a 15 -inch sanitary sewer main in that location. DISCUSSION: The developer received three bids for construction with Gene Nicholas, LLC being the lowest bidder. Staff recommends approval of a cost share agreement with Goose Creek Development, LLC in an amount not to exceed $72,976.00 to pay the difference in upsizing the sewer line from 8 -inch to 15 -inch diameter, and approval of a 20% project contingency in the amount of $14,595.20. BUDGET/STAFF IMPACT: Funds are available in the Water/Sewer Impact Fee Cost Sharing account within the Water and Sewer Fund. Mountain Street www.fayetteville-argov Fayetteville, AR 72701 CONTRACTUAL AGREEMENT FOR COST SHARE OF SEWER MAIN INSTALLATION COSTS This Agreement, made and entered into on this IJ of February, 2020, by and between the City of Fayetteville, Arkansas ("City") and Double Springs Development, LLC, witnesseth: WHEREAS, Double Springs Development, LLC is developing property known as Goose Creek Village, Phase 1 in the City of Farmington and is required to construct an offsite 8 -inch sewer line to facilitate the development which will be served by the City of Fayetteville's sewer system; and WHEREAS, the City's Wastewater Collection System Master Plan recommends a 15 -inch sewer line in this area to provide capacity for future development; and WHEREAS, constructing this segment of sewer main will allow Double Springs Development, LLC to obtain sewer service to develop the property known as Goose Creek Village, Phase 1, allow the City to upsize the sewer line from 8 -inch to 15 -inch to follow the recommendation of the City's Wastewater Collection System Master Plan, and also allow for ample future capacity which the City recognizes will be necessary for the area that is served by this sewer main. NOW, THEREFORE, the City of Fayetteville, Arkansas and Double Springs Development, LLC agree as follows: 1. The City of Fayetteville, Arkansas agrees to: A. Reimburse Double Springs Development, LLC for 100% of the cost to upsize the required 8 -inch sewer main to 15 -inch sewer main in the area identified in Exhibit "A" up to a maximum -not -to -exceed amount of $72,976.00, as was estimated by the builder's representatives and shown on Exhibit `B", attached. B. Payments due to Double Springs Development, LLC, shall be remitted within sixty (60) days after receipt of valid invoices upon completion of the project. 2. Double Springs Development, LLC agrees to: A. Provide the necessary and normal project management, inspection, and testing as necessary for a complete and acceptable sewer main installation, including submittal of plans and specifications to the City's Engineering Department, per their standard procedures. B. Submit all required plans and specifications to the City and receive approval from the City's Engineering and Utilities Departments prior to commencing work on the project. C. Provide a copy of the invoices from the Contractor upon City approval of the sewer main installation. D. Pay for the sewer main installation (with reimbursement from the City of Fayetteville not to exceed $72,976.00). This development, when fully built -out, will provide approximately 335 residential lots. To provide sewer service to this development, an offsite sewer approximately 1220' long will be constructed to the newer pump station on Double Springs Road. This development only requires an 8" sewer main to service this development at full build -out. However, this extension was analyzed in a future capacity study by the City of Fayetteville and shown to require a 15" sewer main to service future development in the area. We have created construction documents that have been reviewed by the City of Fayetteville and are in the final stages of the approval process. We received bids on the extension from three different contractors, who provided both the 8" extension bids and the alternate 15" extension bids. Those bids are included herewith. Gene Nicholas LLC was selected to be the contractor on this project. The difference between their 8" and 15" offsite sewer bids is $72,976.00. We are requesting the City of Fayetteville pay this difference to upsize the sewer extension to the requested 15" main. The City will not pay anything until the main is installed, tested and approved. The developer will pay the contractor and the City will reimburse their amount after completion of the line. The work on this line will not be started until the construction plans are approved by the City of Fayetteville and the Health Department.
