AN ORDINANCE TO APPROVE VAC 19-6948 FOR PROPERTY LOCATED SOUTHWEST OF
MOUNT COMFORT ROAD AND RUPPLE ROAD TO VACATE A PORTION OF A DRAINAGE
EASEMENT
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of a drainage
easement is not required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates a portion of a
drainage easement as described in Exhibit B attached to the Planning Department's agenda memo.
Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as
Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County
Circuit Clerk.
Section 3: This vacation approval is subject to the condition that any relocation of or damage to existing
utilities or existing facilities shall be at the owner/developer's expense.

SUBJECT: VAC 19-6948: Vacation (SW OF MT. COMFORT & RUPPLE RD./HAZEN, 361):
Submitted by CITY STAFF for property located SW OF MT. COMFORT RD. &
RUPPLE RD. The property is zoned CS, COMMUNITY SERVICES and contains
approximately 7.68 acres. The request is to vacate a portion of a drainage
easement.
RECOMMENDATION:
Staff and Planning Commission recommend approval of VAC 19-6948 as shown in the attached
Exhibits 'A' and 'B' and with the following conditions of approval:
1. Any relocation of or damage to existing utilities or existing facilities shall be at the
owner/developer's expense.
BACKGROUND:
The subject property is located south of Mount Comfort and west of north Rupple Road. The
request is to vacate a 20 -foot drainage easement that runs through the middle of the property.
The Rupple Road project has redirected the stormwater from Mt. Comfort Road into the new
storm sewer system which discharges into Hamestring Creek. The old concrete pipe has been
abandoned. Therefore, the drainage easement is no longer needed by the City for maintenance.
The property is zoned CS, Community Services.
DISCUSSION:
At the January 13, 2020 Planning Commission, this item was forwarded as part of the consent
agenda to City Council with a recommendation for approval, with the condition as recommended
by staff.

BACKGROUND:
The subject property is located south of Mount Comfort and west of north Rupple Road. The
request is to vacate a 20 -foot drainage easement that runs through the middle of the property.

RE: Drainage Easement Vacation - Rupple Road
The Rupple Road Relocation (Starry Night View to Mt. Comfort Rd.) construction project is one
of the City's Transportation bond projects. This project has relocated a portion of the existing
roadway to a new alignment which connects with the existing signalized intersection on Mt.
Comfort Road. The existing roadway storm sewer system for Mt. Comfort Road had a 24"
concrete pipe discharging into Hamestring Creek via an easement through the Hazen property.
The Rupple Road project redirected the stormwater from Mt. Comfort Road into the new storm
sewer system which also discharges into Hamestring Creek. The old concrete pipe has been
abandoned in place and plugged. Therefore, the drainage easement is no longer needed by the
City for maintenance. James and Judith Hazen have requested that the City vacate the drainage
easement. The Engineering Division does not have any objection to this transfer of land rights.
This action will only affect one (1) property owner, the Hazens. An Exhibit showing the
drainage easement to be vacated has been included in the submittal package.

We, the undersigned, being all the owners of the real estate abutting the Drainage Easement hereinafter sought
to be abandoned and vacated, lying in Section 1, Township 16 North, Range 31 West, City of Fayetteville, Arkansas,
a municipal corporation, petition to vacate an easement which is described as follows:
20 -foot Drainage easement description previously recorded on Drainage Easement 99069723 and filed
for record August 2,1999:

subject to existing easements as required,'and that the above described real estate be used for their respective
