WHEREAS, on March 6, 2018, the City Council passed Resolution 76-18 to approve a Contract with
Sweetser Construction, Inc. for construction of the Old Wire Road Protected Bike Lane and Sidewalk
Project; and
WHEREAS, the change order includes an increase in project cost of $269,018.95 for Schedule 1
which is the 2006 Transportation Bond Fund and a decrease in cost of $22,530.10 for Schedule 2
which is the Water and Sewer Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves Change Order
No. 1 to the contract with Sweetser Construction, Inc. for the construction of the Old Wire Road
Protected Bike Lane and Sidewalk Project in the amount of $246,488.85. A copy of Change Order No. 1 is
attached to this Resolution and made a part hereof.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget
adjustment, a copy of which is attached to this Resolution.

SUBJECT: Approval of Change Order #1 in the amount of $246,488.85 for the
construction of the Old Wire Road Protected Bike Lane & Sidewalk Project.
RECOMMENDATION:
Staff recommends City Council approval of Change Order #1 in the amount of $246,488.85 for
the construction of the Old Wire Road Protected Bike Lane & Sidewalk Project. The change
order includes an increase in project cost of $269,018.95 for Schedule 1 which is the 2006
Transportation Bond Fund and a decrease in cost of $22,530.10 for Schedule 2 which is the
Water and Sewer Fund.
BACKGROUND:
At the March 6, 2018 meeting the City of Fayetteville City Council approved a contract with
Sweetser Construction, Inc. for the construction of this project. This project included storm
sewer improvements, curb and gutter, a two-way cycle track and a 5' wide sidewalk along the
east side of Old Wire Road. The Walton Family Foundation provided a 50/50 matching grant
that paid $1,361,428.00 towards the construction of the cycle track along this project.
DISCUSSION:
City staff worked with the contractor to provide a quality project for the city as well as all of the
property owners along the project. During the construction of this project, there were many
adjustments and changes that were required given the complexity and nature of this type of
project. These changes, while necessary to create a quality end product, resulted in additional
construction costs. Major changes that resulted in additional costs include:
• An overlay of the entire width of Old Wire Road instead of just the east half as originally
designed
• Placing extra thickness of asphalt at Township to avoid total removal and reconstruction
of the roadway, thereby reducing the inconvenience to the traveling public
• Additional driveway removal and replacement to create more comfortable slopes into
and out of properties
• Additional retaining wall construction to protect adjacent properties

Secondly, the construction period exceeded the contract time by 200 days. Giving
consideration to the field changes made during construction as well as the number of weather
days experienced, the contractor was credited with 80 days of additional time. According to the
contract agreement the contractor is to pay $750 for each additional day required to complete
the project over the days allowed in the contract. This amounts to a $90,000 credit to the City.
BUDGET/STAFF IMPACT:
The roadway, cycle track, sidewalk and storm sewer portions of this project are funded by the
Transportation Bond Fund and the grant from the Walton Family Foundation. The water and
sewer relocations in this project are funded by the Water and Sewer Fund. The change order
includes an increase in project cost of $269,018.95 for Schedule 1 which is the 2006
Transportation Bond Fund and a decrease in cost of $22,530.10 for Schedule 2 which is the
Water and Sewer Fund. A budget adjustment will be required in the amount of $269,019 and
will come from recognizing unallocated bond interest and closing out prior bond retainage.
