WHEREAS, pursuant to the §39.10(C)(4) of the City Code, the City Council must approve the payment
of sewer damage claims exceeding $8,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas, pursuant to § 39.10(C)(4) of the
Fayetteville City Code, authorizes the Mayor to pay $7,039.89 to Elisha R. Thompson and Allison P.
Thompson for a sewer damage claim at 1840 East Viewpoint Drive in addition to a payment made to
ServiceMaster in the amount of $5,232.74 for sewer damage mitigation services.

SUBJECT: Sewer Damage Claim at 1840 East Viewpoint Drive
RECOMMENDATION:
Staff recommends the approval of a payment to Rex Thompson in the amount of $7,039.89 for
a sewer damage claim arising at 1840 E. Viewpoint Dr., in addition to a previous payment made
to ServiceMaster in the amount of $5,232.74 for sewer damage mitigation services.
BACKGROUND:
On October 6, 2019, roots caused a blockage in the sewer main on Viewpoint Drive. The
residence at 1840 E. Viewpoint Dr. experienced flooding as a result of the blockage. The home
is owned by Rex Thompson.
DISCUSSION:
ServiceMaster was called immediately to provide mitigation services to prevent further damage
to the residence. ServiceMaster has already been paid by the City in the amount of $5,232.74.
Rex Thompson incurred expenses in the total amount of $7,039.89 that are valid for
reimbursement by the City. The reimbursement will cover the costs of a new heat and air unit,
ductwork, a hot water heater repair, storage unit rental costs, and odor and mold elimination.
The documentation is attached that details the costs of the total requested reimbursement. Staff
recommends reimbursement in the amount of $7,039.89 to Rex Thompson for costs associated
with the restoration of his home after the sewer overflow and flooding.
BUDGET/STAFF IMPACT:
Funds are available in the non -vehicular damage account within the Water and Sewer Fund.

I have attached an itemized list with receipts of the major
expensive that I have encountered due to the flooding of my house.
I have also enclosed a letter from my insurance company
(Nationwide) denying the claim.
All of these repairs and replacemen s are due to the damage done
to the house due to the city's sewage line flooding. There are
some nickel and dime items that I purchased that I will not charge
the city for.
The major cost is the replacement of e Heat and AC unit along
with the new insulation on the air ducts. All of these items I have
paid for myself, so there are not outstanding invoices.

Our review showed that the water damage discovered to your home at
1840 Viewpoint Dr, Fay tteville, Ar was the result of water back up from
the city main drain line bloc ka'�'"ge, After further review, the policy
specifically excluded any damage resulting for water back up from any
outside sewer system. herefore a payment would not be issued under
the policy at this time for the damages discovered.. We expressly reserve
all other rights, defense;,or contentions, which are available to us under
the policy of insurance, by law or otherwise, and do not waive any such
rights or defenses which we now have or which may .become known to us
in the future.
