SPRING STREET COTTAGES, LLC:
AN ORDINANCE TO WAIVE THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING AND
APPROVE A COST SHARE AGREEMENT WITH SPRING STREET COTTAGES, LLC FOR THE
INSTALLATION OF A FIRE HYDRANT NEAR THE INTERSECTION OF EAST SPRING STREET
AND NORTH WASHINGTON AVENUE, WITH MATERIALS TO BE PROVIDED BY THE CITY OF
FAYETTEVILLE IN THE AMOUNT OF
$3,682.29
WHEREAS, Spring Street Cottages, LLC will be developing property located at 132 and 144 North
Washington Avenue and has requested that the City share in the cost of installing a fire hydrant near the
intersection of East Spring Street and North Washington Avenue; and
WHEREAS, installing the fire hydrant will improve fire service in the immediate area; and
WHEREAS, waiving formal competitive bidding and providing the materials for the fire hydrant
installation to the developer will save time and cost by utilizing the developer's contractor who will be
on-site installing the water main for the project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement
with Spring Street Cottages, LLC for the installation of a fire hydrant near the intersection of East

SUBJECT: Cost Share Agreement with Spring Street Cottages, LLC for a Fire Hydrant
Installation on North Washington Avenue
RECOMMENDATION:
Staff recommends the approval of a cost share agreement with Spring Street Cottages, LLC for
the installation of a fire hydrant near the intersection of East Spring Street and North
Washington Avenue, with materials valued at $3,682.29 to be provided by the Water and Sewer
Operations Division.
BACKGROUND:
Spring Street Cottages, LLC has requested that the City share in the cost of installing a fire
hydrant near the corner of East Spring Street and North Washington Avenue.
DISCUSSION:
Installing this fire hydrant will allow Spring Street Cottages, LLC to develop the properties
located at 132 and 144 North Washington Avenue. This fire hydrant will also improve fire
service in the immediate area. The City of Fayetteville Water and Sewer Operations Division will
provide the fire hydrant with associated piping and appurtenances, with a materials value of
$3,682.29. Spring Street Cottages, LLC will be responsible for installing the fire hydrant per City
standard specifications.
BUDGET/STAFF IMPACT:
Funds are available in the Construction Materials account within the Water and Sewer Fund.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF FIRE HYDRANT INSTALLATION COSTS

This Agreement, made and entered into on this day of September, 2019, by and
between the City of Fayetteville, Arkansas ("City") and Spring Street Cottages, LLC, witnesseth:
WHEREAS, Spring Street Cottages, LLC has requested that the City share in the cost of
installing fire hydrant and water main near the intersection of East Spring Street and North
Washington Avenue; and
WHEREAS, installing this fire hydrant will improve fire service in the area and allow
Spring Street Cottages, LLC to develop the properties located at 132 and 144 North Washington
Avenue.
NOW, THEREFORE, the City of Fayetteville, Arkansas and Spring Street Cottages, LLC
agree as follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Provide materials valued at $3,682.29 as shown in Exhibit "A", attached.
2. Spring Street Cottages, LLC agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable fire hydrant and water main
installation in the area shown on Exhibit `B", including submittal of plans and
specifications to the City's Engineering Department, per their standard
procedures.
B. Submit all required plans and specifications to the City and receive approval
from the City's Engineering and Utilities Departments prior to commencing
work on the project.
C. Pay for the fire hydrant and water main installation with the exception of the
materials provided by the City of Fayetteville, Arkansas.
