A meeting of the Fayetteville City Council was held on May 21, 2019 at 5:30 p.m. in Room
219 of the City Administration Building located at 113 West Mountain Street, Fayetteville,
Arkansas.
Mayor Jordan called the meeting to order.
PRESENT: Council Members Sonia Gutierrez, Sarah Marsh, Mark Kinion, Matthew Petty,
Sloan Scroggin, Sarah Bunch, Teresa Turk, Kyle Smith, Mayor Lioneld Jordan, City
Attorney Kit Williams, City Clerk Sondra Smith, Staff, Press, and Audience.

Council Member Marsh made a motion to add the item to the agenda. Council Member
Smith seconded the motion. Upon roll call the motion passed 7-0. Council Members
Gutierrez, Marsh, Kinion, Petty, Scroggin, Turk, and Smith voting yes. Council Member
Bunch was absent during the vote.
Chris Brown, City Engineer gave a brief description of the resolution. He stated there is no
additional cost to the city.
Council Member Smith: Will this have any impact on the completion dates for the projects going
on right now?
Chris Brown: I don't believe the change order asked for additional days. The intent is that it would
still be complete by the end of August or the start of the university semester.
Council Member Kinion moved to approve the resolution. Council Member Marsh seconded
the motion. Upon roll call the resolution passed 7-0. Council Members Gutierrez, Marsh,
Kinion, Petty, Scroggin, Turk, and Smith voting yes. Council Member Bunch was absent
during the vote.

Unfinished Business:
RZN 19-6553 (510 S. College Ave./Goody): An ordinance to rezone that property described in
rezoning petition RZN 19-6553 for approximately 0.22 acres located at 510 South College Avenue
from NC, Neighborhood Conservation to RI -U, Residential Intermediate -Urban. This ordinance
was left on the first reading at the April 16, 2019 City Council meeting. This ordinance was left on the
second reading at the May 7, 2019 City Council meeting.
Council Member Marsh moved to suspend the rules and go to the third and final reading.
Council Member Petty seconded the motion. Upon roll call the motion passed 7-0. Council
Members Gutierrez, Marsh, Kinion, Petty, Scroggin, Turk, and Smith voting yes. Council

Garner Stoll, Development Services Director stated he didn't have any additional information.
Zara Niederman, Applicant gave a brief PowerPoint presentation of the proposed rezoning.
Council Member Scroggin: Are the changes correct that he has presented?
Garner Stoll: It is my understanding that they are. Originally, Neighborhood Conservation district
was primarily slated for downtown application. Subsequent years the Council wanted to use it for
broader application and increase the lot width.

Council Member Petty thanked the applicant for his presentation. He stated there were things he
hadn't considered before and had read the Walker Park Master Plan a dozen times. He stated he
hopes they can return to the original condition.

Ordinance 6183 as Recorded in the office of the City Clerk
RZN 18-6573 (509 W. Prairie St./Prairie St. Live): An ordinance to rezone that property
described in rezoning petition RZN 19-6573 for approximately 0.93 acres located at 509 West
Prairie Street from DG, Downtown General to MSC, Main Street/Center. This ordinance was left on
the first reading at the April 16, 2019 City Council meeting. This ordinance was left on the second reading
at the May 7, 2019 City Council meeting.
Council Member Gutierrez moved to suspend the rules and go to the third and final reading.
Council Member Marsh seconded the motion. Upon roll call the motion passed 6-0. Council

City Attorney Kit Williams read the ordinance.
Garner Stoll, Development Services Director gave a brief description of the ordinance.
Jody Verser, Modus Studio gave a brief PowerPoint presentation of the proposed rezoning.
Council Member Turk: How many people do you envision having at your music venue?
Jason Bigby, Family Representative: We are laying out different maps of different uses from food
festivals to beer festivals. It's hard for us to say how many people are going to be allowed until the
Fire Marshal does an assessment with the occupancy certificate.
Council Member Turk: What number are you requesting that the Fire Marshal review?
Jason Bigby: It depends on what the fire code will do.
Fire Chief, David Dayringer: For indoors, there is a formula they go by. It's a certain number of
feet if there is fixed seating. If it is all movable seating, it's a different number. I can't recall what
those numbers are. I will have to ask the Fire Marshall what the formula is for outdoor. There has
to be two ways to exit and the means of egress that's protected.
Council Member Turk: Would you allow the bathrooms to be open and water accessible at all
times or only during your events?

Jody Verser: I can't speak to 24/7, but the goal is to have them accessible to the trail users. I don't
know if that means after hours, but certainly during the high traffic times.
Council Member Turk: I heard one complaint from a nearby property owner during your March
Prairie Street event. They claim they weren't notified of the event. Reaching out to the property
owners around there would be a good idea. When you have events where you don't have permanent
structures where the bathrooms are located is a complaint I heard.
Garner Stoll: Our ordinance anticipates live music impacts. Under the conditional use permit for
that use, it does require a 500 -foot notification of surrounding properties. It is not just the adjacent
properties, but a 500 -foot circle around that parcel.
Colt Galloway, 225 South Church Avenue spoke in favor of the ordinance.
Ed Levi, 301 South West Avenue spoke about noise concerns.
Steve Clark, Chamber of Commerce President spoke in favor of the ordinance.
Council Member Scroggin stated he doesn't like it when government lets one group do something
and then another group isn't allowed because the first group didn't do so well. He stated they need
to look at conditional use permits and live music so that more businesses can do this.
Council Member Kinion stated he knows they will be looking at noise complaints. He stated they
have to preserve the neighborhood the best that they can for the people who live there. He spoke
about parking concerns. He stated bicycles are not an option for some people. He stated he's
supporting the rezoning because that area of town is dynamic and is in the area of where they want
to have a destination for the arts. He stated when you look at the future and the opportunities it
will offer, it will lead to good things.
Council Member Turk: I like the idea of having a music venue and that it is close to the trails.
As part of the conditional use permit, is there a set number of parking places required?
Garner Stoll: The ordinance requires a site plan that shows where the buildings and parking are
located. We have suggested that we ask for a parking plan. We've suggested that the applicant is
free to seek agreements with surrounding parking that's already available within easy walking
distance. There are a lot of opportunities in the neighborhood.
Council Member Turk: If they were to provide a parking plan, would you ask to see leases or
agreements?
Garner Stoll: Yes. That could be part of their proposal, which would strengthen their proposal in
the parking issue. It isn't as if the Planning Commission would have to require that. It is a
discretionary process and the ordinance doesn't require it. It could be made a part of the
requirements of the conditional use permit to reduce the impact on the area.
Council Member Turk: Do we have a maximum decibel level for noise?

Garner Stoll: Yes, it is 75 decibels. The conditional use permit says the ordinance states that
violations of the decibel level of sound can be a reason for revoking the permit. The ordinance is
very well drafted.
Council Member Gutierrez thanked Ed Levi for speaking about his noise concerns. She
encouraged Mr. Levi to speak to his neighbors about what would be ideal for them. She requested
for Garner Stoll to speak about the process of public input on the potential conditional use permit
if the ordinance passes.
Garner Stoll: The Planning Commission public hearing, which the 500 -foot property owners will
receive notification.
Council Member Gutierrez stated she did not know if Mr. Levi was in the 500 -foot range, but
encouraged him to talk to his neighbors. She spoke about it being an exciting project. She
encouraged the applicant to find more collaboration partners for the parking that are closer. She
stated she wants to support the item for the Cultural Arts District because it's good for the creative
economy.
Council Member Bunch stated she is in support of the rezoning. She stated it could be a place for
a lot of people to come and listen to music. She stated any problems that are had with parking or
decibel levels can be tweaked later.

Ordinance 6184 as Recorded in the office of the City Clerk
Polystyrene Foam Products: An ordinance to prohibit the purchase of expanded polystyrene
foam with City of Fayetteville monies, to end the use of expanded polystyrene foam products by
city concessionaires and food trucks in city parks and city off-street parking lots and to raise public
awareness of the ecological damages caused by this product. This ordinance was left on the second
reading at the May 7, 2019 City Council meeting.
Council Member Gutierrez moved to suspend the rules and go to the third and final reading.

Members Gutierrez, Kinion, Petty, Scroggin, Bunch, Turk, and Smith voting yes. Council

City Attorney Kit Williams: This was sponsored by Council Member Turk. She had a meeting
last night with the Environmental Action Committee.

Council Member Turk thanked the Environmental Action Committee for their insights and
recommendations. She spoke about the latest research of single use styrofoam. She wants
Fayetteville to lead by example and slowly phase the ordinance in to allow businesses to adjust.
Abel Tomlinson, 60 West Smith Street spoke in favor of the ordinance.
Andrew Miles, 1884 North Caton Drive, Environmental Action Committee Chair spoke in favor
of the ordinance.
Mike Wiederkehr, Environmental Action Committee spoke in favor of the ordinance.
Anne Littell, 517 East Johnson Street spoke in favor of the ordinance.
Andrew Ragland, 127 University Avenue spoke in favor of the ordinance.
Tahlia Robson, 110 University Avenue spoke in favor of the ordinance.
Nathan Hudson, 724 North Washington Avenue spoke in favor of the ordinance.
Bob Walker, 127 University Avenue spoke in favor of the ordinance.
Taylor Bebe stated she works at a local restaurant and the employees implemented a recycling
program. She stated they got rid of all styrofoam and now use compostable take-out boxes and
paper bags.
Council Member Smith: Do you have any feedback on what the cost impact was to the business?
Taylor Bebe stated she was not in charge of the finances and could not answer the question.
Council Member Smith: Have you noticed any change in customers coming in the door because
of this.
Taylor Bebe: Absolutely. It is nice to see customers response for us taking a step in the right
direction of minimizing our carbon footprint.
Council Member Scroggin thanked Council Member Turk and the citizens. He stated it is
something he wants to see more of. He stated he is looking forward to banning styrofoam across
the city in the future. He requested to know would it stop what they intend to do now if they did
more.
City Attorney Kit Williams: One reason we brought it forward when we did is that we were
waiting for the legislature to adjourn. I doubt that the Governor would call a special session to try
and stop us from helping our economy and ecology. Until the legislature goes back into session,
in almost two years, they will not have the opportunity to do anything. If we can establish a good
program that works with our businesses, we might be effecting reduction of styrofoam and plastic
bags, not only in Fayetteville, but in many other cities around the state. Instead of doing a fast

thing, I would rather go slower to get good acceptance. Thank you to the Environmental Action
Committee, Peter Nierengarten, and Brian Pugh. I am happy that the City Council is united on this.
There have been some setbacks in courts on the plastic bag issue. We want to look at those so we
don't have a problem. I want to do this carefully so we have a great product to show citizens and
other cities.
Council Member Kinion: I wanted to get everything banned tonight. I trust Kit with his analysis
of why it's better to be deliberate than to be aggressive. I was wanting to amend this, but I know
better than to do that because there was so much thought and work behind what we have in front
of us. I am going to respect the Environmental Action Committee, Council Member Turk, and
Kit's opinion. We can still have a resolution with a plan.
Council Member Bunch: I am so pleased that the city, Environmental Action Committee, and
Council Member Turk worked so hard to bring this forward. I would love to add more to this, but
I am going to be on the side of caution. I'm going to vote in favor of this and I hope we can come
up with a solid plan to add more items to it that will be very effective.
Council Member Smith stated the people who showed up tonight gave them a good indication of
where the community is on this and he believes there is broad community support. He stated if the
city can't recycle something, then they should be working to limit it and not produce as much of
it. He stated he's in favor of doing something that's better than what they have right now with a
promise to come back and do better than this later.
Council Member Gutierrez thanked Council Member Turk, city staff, and citizens. She spoke
about the City of Fayetteville valuing the environment. She believes the city should lead by
example. She appreciates the advice that has been given for the city to do this in incremental steps.
Council Member Petty stated he's happy that the Council is unified on the issue in making
advancements. He requested to know how long they think they need to develop the program.
City Attorney Kit Williams: We can get it done in a couple of months. We will have something
to present to Council at Agenda Session about your commitment and asking the Mayor to use his
staff to help with this. We have talked with the Environmental Action Committee about what we
would like to see them do and that would be relatively quickly. I need to do some legal research
to make sure we don't step across the line. We don't want to have any reactions against us.
Council Member Turk: I am delighted and encouraged by all the support. This is a team effort
to implement something like this. One of my campaign promises was to reduce our plastic
significantly. This ordinance is the first step. We want to be successful and get as many people on
board as we can to make it the most successful program in the country.
Mayor Jordan thanked Council Member Turk, the Environmental Action Committee, citizens
who spoke, and City Council. He spoke about cleanups around town and is always amazed with
the amount of litter found in streams. He stated it is going to take everyone working together to
keep the planet clean. He stated the proposed ordinance is taking another step to begin to make it
better for our children.

Council Member Scroggin: I want to talk about traffic, not because of density because I think
this would lower traffic and put people closer to where they work. Regarding curb cuts on Joyce,
what can we do to limit curb cuts and how many can they have?
City Attorney Kit Williams: A property owner is entitled to have eight curb cuts where their land
is abutting a street. They are abutting Joyce. This is a development issue rather than a zoning issue.
I don't know if they would even request more than one. Our access management standards would
be looked at and we would not be legally required to allow them to do more than one. I'm not
saying that from an engineering point of view because they might have two.
Council Member Scroggin: I hope it stays at one.
Council Member Smith: Would the one have to go on Joyce since they have multiple street
frontages?
City Attorney Kit Williams: They are entitled to access a street they abut.
Council Member Smith: Not each street?
City Attorney Kit Williams: Each street they abut.

Arkansas Department of Transportation: A resolution to approve a utility
construction/relocation agreement with the Arkansas State Highway Commission for the
relocation of utilities required by the widening and improvement project on Highway 16 between
College Avenue and Huntsville Road at a total estimated cost of $2,349,078.66, with the City of
Fayetteville's portion estimated to be $871,978.00.
Tim Nyander, Utilities Director gave a brief description of the resolution. He stated the Water &
Sewer Committee voted 3-0 in favor to forward it to the City Council for approval.
Council Member Kinion: The Water & Sewer Committee has been discussing this for a long
time. It is nice to see it moving along.
Council Member Marsh moved to approve the resolution. Council Member Gutierrez
seconded the motion. Upon roll call the resolution passed unanimously.

Smith, University of Arkansas Communications Department, Fayetteville Public Schools, and
Fayetteville Public Library. He spoke about everyone having equal digital equity available.
Council Member Gutierrez thanked everyone for their work on the project. She stated she sees
this as a huge economic development piece.

Announcements:
Susan Norton, Communications Director thanked the Council for passing the Digital Inclusion
and Equity Plan resolution. She spoke about the 2020 census. She stated the Wilson Park Pool will
open on Memorial Day weekend. She stated city offices will be closed on Memorial Day, but trash
will run as scheduled. She spoke about the grand opening of the Walker Park Splash Pad. She
spoke about the Gulley Park Concert Series. She stated information can be viewed on the City of
Fayetteville website.
Mayor Jordan stated he will be traveling to Little Rock to meet with the Arkansas Department of
Transportation about College Avenue. He will also be meeting with the Municipal League.
