Salem Road. BACKGROUND The subject property contains 3.23-acres and is located at the northwest corner of Weir Road and N. Salem Road. There are two accessory structures ' and an existing single- family home, which recently suffered substantial fire damage, located on the property. The property owner has offered a Bill of Assurance that will require the removal of an existing damaged structure on the property within 30 days from the date of annexation and rezoning of the subject property by the Fayetteville City Council. DISCUSSION This item was heard at the regular Planning Commission meeting on July 14, 2008. The Planning Commission voted 7-0-0 to recommend forwarding this rezoning request to the City Council with a recommendation for approval. BUDGET IMPACT None. Weir Road currently intersects Salem Road north of Gypsum Drive, which creates an off -set intersection. As agreed to with the approval of Holcomb Heights Ph. I, Weir Road is required to be removed and reconstructed to the south of the current street location to create a 4-way intersection with left hand turn -lanes. Additional street improvements will be evaluated with future development. Water: Public water is adjacent to the site. There is an 8" water main along N. Salem Road that was installed as part of an adjacent development to the east. A water service extension through the subject property to provide domestic service and fire protection may be required, depending on improvements associated with Holcomb Heights Ph. I. Sewer: Sanitary sewer is available near the site. There is an 8" sewer main on Gypsum Drive on the east side of Salem that may be adequate to serve future development; however, the capacity of the existing main will need to be evaluated at the time of development. A sewer service extension through the subject property may be required, depending on improvements associated with Holcomb Heights Ph. 1. Drainage: Standard improvements and requirements for drainage will be required for the development. Police. It is the opinion of the Fayetteville Police Department that this annexation will not substantially alter the population density and thereby undesirably increase the load on police services or create and appreciable increase in traffic danger and congestion in the area. CITY PLAN 2025 FUTURE LAND USE PLAN: City Plan 2025 Future Land Use Plan designates this site as an Residential Neighborhood Area, which recognizes conventional subdivision development, but encourages traditional neighborhood development that incorporates low -intensity non-residential uses. Stafff nds that the RSF-4 zoning is appropriate at this location and would result in a residential development pattern that is consistent with the Future Land Use Plan. FINDINGS OF THE STAFF 1. A determination of the degree to which the proposed zoning is consistent with land use planning objectives, principles, and policies and with land use and zoning plans. Finding: The property is designated as an Residential Neighborhood Area in the. City Plan 2025 Future Land Use Plan, which recognizes conventional subdivision development, but encourages traditional neighborhood development that incorporates low -intensity non-residential uses. The proposed RSF-4 zoning is consistent with the City's land use planning objectives, principles and policies to residential development. 2. A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: Staff finds that the rezoning is necessary at this time to allow for development that is consistent with the Future Land Use Plan. A zoning classification of R-A, Residential Agricultural, which is automatically applied to lands annexed into the City, would not permit either a conventional, or traditional neighborhood design. 3. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: It is expected that a rezoning to RSF-4 would create an increase in traffic compared with that allowed under the R-A zoning district applied to lands annexed into the City. However, the property is located at the intersection of two collectors, with several community amenities ,within walking distance. Additionally, the Fayetteville Police Department finds that the proposed rezoning would not create or appreciably increase traffic danger and congestion. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: A zoning classification of RSF-4 will allow morehousing units to be permitted than the R-A zoning district. However, it is unlikely that the increase in population density would undesirably increase the load on public services given the proximity of the property to an elementary school and water and sewer lines. Increased loads on public services were taken into consideration and recommendations from Engineering, Fire, and Police Departments are included in this report. S. If there are reasons why the proposed zoning should not be approved in view of considerations under b (1) through (4) above, a determination as to whether the proposed zoning is justified and/or necessitated by peculiar circumstances such as: a. It is the opinion of the Fayetteville Police Department that this RZN will not substantially alter the population density, and create an appreciable or undesirable increase in the load on police services. Weir Road. It contains 3.23 acres, which is owned by Nock -Broyles Land Development, LLC, and has been approved for de -annexation from Washington County. The property is currently adjoining the city limits on three sides. Surrounding the property to the north and east is zoned RSF-4, to the south is zoned R-PZD (Holcomb Heights), and the property to the west is within Washington County. We are proposing to be annexed into the City of Fayetteville and zoned RSF-4. We feel like the subject property would be a great addition to the City of Fayetteville for numerous reasons. One, it would potentially provide close neighborhoods and amenities for the area just a quarter mile north of Holcomb Elementary School and a short distance down the future extension of Rupple Road to Holt Middle School. This project will be a nice continuation to the surrounding neighborhoods of the area. The developer is improving and realigning approximately 660 linear feet of Weir Road to provide a safer connection to Salem Road. Weir Road will eventually be connected to the major thofoughfare of the Rupple Road extension less than a quarter mile to the west of the property. It is anticipated that the traffic will not be adversely affected by this proposal. There is an existing 4" water line available along Salem Road. We are placing a new 12" water line down the south side realignment of Weir Road with the construction of the Holcomb Heights Neighborhood. At which time an 8" water line and an 8" sewer line will be extended to serve the subject site. With this proposal, attractive building facades will be designed to face on to the local streets to give the neighborhood and surrounding area a nice identity and character.
