NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portions of street right-of-way, access easement, and utility easements as described in Exhibit B attached to the Planning Department's memo. Section 2: A copy of this Ordinance duly certified by the City Clerk along with the map attached as Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County Circuit Clerk. Section 3: This vacation approval is subject to the condition that any relocation of or damage to existing utilities or existing facilities shall be at the owner/developer's expense. School Avenue to the east, and West Avenue hmthe west. Rezoned to DG. Downtown Genene|, and MSC, Main Street/Center in accordance with the Downtown Master Plan in 2006, the property is currently developed with the Fayetteville Public Libnary, and the recently -demolished City Hospital. Rock Street bisects the property east -west, but was approved for vacation in November of 2017. The street's vacation was approved in anticipation of the library's expansion and is conditioned on utility relocation work and the dedication of an alley -width section of right-of-way south ofthe expansion. The library expansion itself was voted on and approved by Fayetteville residents in August 2017. taking the form of a property tax rniUage increase. During development review for the Fayetteville Public Library expansion, it became apparent that a remnant portion of right-of-way and multiple easements conflicted with the proposed site and building layout. As such, the applicant proposes to vacate the areas as described below and as indicated in the attached vacation exhibit: 1. A 3 -foot wide public street and utility easement located at the existing southern entrance of the library; 2. A portion of a utility easement south of the parking deck entrance; 3. An existing access easement located south of Rock Street that is no longer in use; and 4. A utility easement that was created in association with the Rock Street vacation per Ordinance 6414. Utilities will be removed and relocated in to existing or future easements. DISCUSSION: At the April 22, 2019 Planning Commission meeting, this item was forwarded as part of the consent agenda to City Council with a recommendation for approval, with all conditions as recommended by staff.
