NORTHWEST ARKANSAS AND $27,926.73 TO SERVICEMASTER BY QUALITY RESTORATION
FOR A SEWER DAMAGE CLAIM AT 699 NORTH SANG AVENUE
WHEREAS, on January 10, 2019, roots in a sewer line caused a backup at Temple Shalom of
Northwest Arkansas impacting about two-thirds of the building; and
WHEREAS, ServiceMaster by Quality Restoration was contacted to immediately complete the emergency
sewer mitigation work at a cost of $27,926.73 because the time required to obtain quotes or bids would have
caused even more damage to the property; and
WHEREAS, the City solicited quotes for restoration of the property and Servicemaster by Quality
Restoration submitted the lowest quote in the amount of $25,511.32; and
WHEREAS, Temple Shalom has also requested reimbursement for personal contents and plumbing
services in the total amount of $2,078.72; and
WHEREAS, Temple Shalom has insurance coverage that will pay $20,000.00 toward the damage claim,
leaving $7,590.04 to be paid to the claimant.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby finds the above circumstances
make competitive bidding not feasible or practical and therefore waives the requirements of formal
competitive bidding and authorizes a payment to Servicemaster by Quality Restoration in the amount of
$27,926.73 for mitigation work and a payment to Temple Shalom of Northwest Arkansas in the amount of
$7,590.04 for the costs related to property restoration, replacement of personal property and plumbing services
not covered by insurance for a sewer damage claim at 699 North Sang Avenue.

SUBJECT: Approval of payments to ServiceMaster by Quality Restoration and to
Temple Shalom of Northwest Arkansas for a sewer damage claim arising at
699 North Sang Avenue.
RECOMMENDATION:
Staff recommends the approval of a payment to ServiceMaster by Quality Restoration in the
amount of $27,926.73, and approval of a payment to Temple Shalom of Northwest Arkansas in
the amount of $7,590.04 for a sewer damage claim arising at 699 North Sang Avenue.
BACKGROUND:
On January 10, 2019, roots in a sewer line caused a backup at Temple Shalom of Northwest
Arkansas located at 699 North Sang Avenue. Approximately two thirds of the building was
flooded due to the backup. City crews cleared the roots from the sewer line, and immediately
called ServiceMaster for mitigation.
DISCUSSION:
ServiceMaster completed the sewer mitigation work in the amount of $27,926.73, which will be
paid by the City upon City Council approval. The mitigation work is considered an emergency,
so three bids are not obtained so that further damage to the building is prevented. This
emergency mitigation work included removing baseboards, sheet rock, insulation, drying out all
wetted areas and cleaning and disinfecting floors. ServiceMaster also provided an estimate for
restoration in the amount of $25,511.32, to be paid by the claimant. This restoration estimate
was the lowest of three bids. The restoration will include drywall installation, baseboard and
cabinet repairs, replacement of insulation, and painting the walls and other affected areas.
Temple Shalom of Northwest Arkansas had personal contents valued at $1,921.22 that were
destroyed in the incident. They have also requested reimbursement on an invoice from John
Reed Plumbing in the amount of $157.50. Temple Shalom of Northwest Arkansas' insurance
company has agreed to pay $20,000.00 towards the claim, leaving a balance of $7,590.04 to be
paid to the claimant upon City Council approval.

City Code §39.10(C)(4) states that "in no case shall the City pay more than $20,000.00 pursuant
to this claims procedure for a damage claim related to a water or wastewater utility infrastructure
occurrence unless in an extraordinary case the Mayor recommends and the City Council by
two-thirds ( 2/3 ) majority approves an exemption from the $20,000.00 damage cap and
approves a payment up to $40,000.00."
Staff recommends payment to ServiceMaster by Quality Restoration in the amount of
$27,926.73 for mitigation, and payment to Temple Shalom of Northwest Arkansas in the amount
of $7,590.04 to reimburse them for costs associated with damage to their building and contents
located at 699 North Sang Avenue resulting from a City sewer backup. The total amount
proposed to be paid out for this claim is $35,516.77.
BUDGET/STAFF IMPACT:
Funds are available in the Self Insurance Non -Vehicle account within the Water and Sewer
operations budget.

I have been in contact with the representative for the city of Fayetteville, Mark Rogers (who is
CC'd on this email). Mr. Rogers is making a formal request to the city to pay the remainder of

CLAIM:
AN ORDINANCE TO WAIVE THE
REQUIREMENT OF FORMAL
COMPETITIVE BIDDING AND TO
APPROVE- PAYMENT IN THE AMOUNT OF
$7,590.04 TO TEMPLE SHALOM OF
NORTHWEST ARKANSAS AND $27,926.73
TO SERVICEMASTER BY QUALITY
RESTORATION FOR A SEWER DAMAGE
CLAIM AT 699 NORTH SANG AVENUE
WHEREAS, on January 10, 2019, roots in a
sewer line caused a backup at Temple Shalom of
Northwest Arkansas impacting about two-thirds
of the building; and
WHEREAS, ServiceMaster by Quality
Resloralion was contacted to immediately
complete the emergency sewer mitigation work
at a cost of $27,926.73 because the time required
to obtain quotes or bids would have caused even
more damage to the properly; and
WHEREAS, the City solicited quotes for
restoration of the property and Scrvicemasicr by
Quality Restoration submitted the lowest quote
in the amount of $25,511.32; and
WHEREAS, Temple Shalom has also requested
reimbursement for personal contents and
plumbing services in the total amount of
$2,078.72; and
WHEREAS, Temple Shalom has insurance
coverage that will pay $20,000.00 toward the
damage claim, leaving $7,590.04 to be paid to
the claimant.
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1, That the City Council of the City of
Fayetteville, Arkansas hereby finds the above
circumstances make competitive bidding not
feasible or practical and therefore waives the
requirements of formal competitive bidding and
authorizes a payment to Servicemaster by
Quality Restoration in the amount of $27,926.73
for mitigation work and a payment to Temple
Shalom of Northwest Arkansas in the amount of
$7,590.04 for the costs related to property
restoration, replacement of personal property
and plumbing services not covered by insurance
for a sewer damage claim at 699 North Sang
Avenuc.
