AN (&1DITIANCE TO BE E'1TTTLI AN ORDINANCE TO PROVIDE FOR AODITI XIAL REGU-
LATIONS FOR TTIE RETAIL $A7 +<S OF BEER AND LIGHT WINES, PROVIDING PENALiT S
FOR VIOLATION CF SAID REGULATIONS AND FOR OTHER PURPOS^S
WHEREAS, Ordinance No. 760 does not provide proper supervision for the retail
sale of beer and light wines and for the revocation of licenses for selling
the same in the City of Fayetteville and .
WHEREAS, it is necessary for additional. restrictions to be placed on the sale
of the sane and to provide for revocation of licenses,

SECTION 1. It shall be unlawful for any person, firm corr.:oration or associa-
tion to ma:false answers in any application to questions touching his
qualifications for a permit to sell beer and light wines in the City of
Fayetteville.
Section 2. It shall be unlawful to sell beer or light wines in any residence
In any or building used in part as a residence, or built onto, or is a
part of any residence, provided, however, that this section shall v t apply to
p&aoes of business where apartments are located over same.
Section 3. It shall be unlawful to sell or serve beer or light wines, or
aLlow he same to be consumed in any dance- hall or place where dancing is carr-
ied on; and it shall be unlawful for dancing to be allowed in any place where
beer or light wines are being sold, dispensed or served; and it sh3li be un-
lawful to sell beer or light wines in any place or building where there is a
direct entrance allowing ingress or egress to any dance hall or place where
dancing is allowed. Provided, however, that no part of this section shall
apply to private homes being used exclusively as such.
Section Li. It shall be unlawful to sell beer or light wines within 200 feet
of any church or any public or parochial school in the residential section
of the City of Fayetteville. The residentiatl secti on of the City of F�y-
etteville shall be any part of s aid City that is outside of the fire zcne"
as is now or may hereafter be fixed by the City Council, and the business'
section of the City of F� etteville is that part of said City within the
Fire Zone.
Section 5. It shall be unlawful to sell beer or light wines in the residen-
tial . section of the City of Fayetteville between the hours of 12:00 o'clock
midnight and 7:00 o'clock in the morning, or to serve either or allow either
to be consumed in a public place between those hours.
Section 6. It shall be unlawful to sell beer or light wines to any person
who is intoxicated at the tiis the sale is made.
Section 7. It shall be unlawful for any person, firm, corporation or associa-

of business.
Section S. If any person, fins, corporation, or association engaged in the
sale of beer or light wines ii the City of Faystteville shall allow arW

any person or persons of dissolute character to loiter in and around
his place of business or shall pnit profane language therein, or
loud or unnecessary noises, or conduct his place of business in any
other gray that is detrimental to the good. morals of the community
or in such manner as to constitute a nuisance or if the City Council
shall find that any retail deaIver in beer or light brines has made

Fayetteville.
Section 9. Nothing in this Ordinance shall be construed as repealing any

Section 10. Any person, firm, corporation or association violating Sections
1, 2P 3, 5, 6, or 7 of this Ordinance shall be deemed guilty of a mis—
demeanor, and upon conviction shall be fined any sum of not more than
Five Hundred Dollars (,4,•,5OO.00) and each days violation of said Ordinance
shall constitute a separate offense, and in addition to such fine, it shall
be the duty of the Court to revoke t:ie license of anyone so convicted.
Section 11. It being ascertained and found by the City Council of Fayette -
v fTTe that, the unregulated sale of beer and light wines in the City of
Fayetteville constitutes a menace to the public peace, health and sa._f,- y
of the citizens of Fayetteville and requires the iran-,diate passage of an
ordi nance to regulate and control sale of beer and light .nines, an emer-
gency is hereby declared to exist, and this Ordinance shall take and be
in force i m front and after its passage, approval and publication.
