OAKBROOKE SUBDIVISION PHASES 1 AND 2 UTILITY EASEMENTS:
AN ORDINANCE TO VACATE PORTIONS OF UTILITY EASEMENTS IN PHASES 1 AND 2 OF THE
OAKBROOKE SUBDIVISION
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, a prior replat of the Oakbrooke Subdivision was intended, in part, to vacate certain utility
easements but the specific procedure for vacating utility easements set forth in the §171.06 of the
Fayetteville Unified Development Code was not followed and the vacations were never approved by the
City Council; and
WHEREAS, pursuant to Section 171.06(E) of the Fayetteville Unified Development Code a request to
vacate a public easement need not be presented to the Planning Commission before being submitted to
the City Council as long as the City Council makes certain findings by a vote of at least two -third of its
membership and the Mayor.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby finds, pursuant to §
171.06(E)(1) of the Fayetteville Unified Development Code, that the public utility easements shown in
the surveys attached collectively as Exhibit A and described in Exhibit B do not contain any utilities
within the areas to be vacated.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby finds, pursuant to

§171.06(E)(2) of the Fayetteville Unified Development Code, that special circumstances exist which
require prompt consideration of the vacation request and justify bypassing the Planning Commission.
Section 3: That the City Council of the City of Fayetteville, Arkansas hereby vacates the portions of
utility easements as described and shown in Exhibits A and B attached to this Ordinance.
Section 4: A copy of this Ordinance duly certified by the City Clerk, along with the surveys and legal
description attached as Exhibits A and B, shall be filed in the office of the Washington County Circuit
Clerk.

Vacation of Utility Easements in Oakbrooke Subdivision
Based on the City Council's request at the December 4, 2018 meeting, our
office has prepared an ordinance vacating all three easements in Phases 1
and 2 of the Oakbrooke Subdivision that Mr. Hoskins has identified.
1 also included the easement on the property located at 3995 West Starry
Night View that was approved in the last meeting only because the legal
description prepared by Bates & Associates is more accurate and detailed
than the one included in the earlier approval. This does not invalidate your
earlier approval but it better defines the vacated easement for future title
searches and surveys.
